    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

It argues that achieving life balance, through manipulating one's thoughts and taking concrete action, will lead to increased personal happiness.     Abstract: Complaints are often made that recommendations about how to rear children are contradictory and, therefore, not helpful. In this Element we survey the history of theory and research relevant to childrearing in an attempt to show how apparent differences can be resolved. We suggest that socialization occurs in different domains, with each domain fostering socialization in a different way. Thus there is no all-purpose principle or mechanism of socialization but, rather, different forms of relationship between child and agent that serve a different function, involve different rules for effecting behavior change, and facilitate different outcomes. Using this framework, we survey research relevant to different domains, including the roles played by parents, siblings, and peers in the socialization process. We follow this with a discussion of how culture and biology make their contribution to an understanding of domains of socialization.

The social psychological drivers of effective collective action for four audiences are examined in detail, in four sections: for the self and supporters, bystanders, opponents, and for third parties. From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa.     Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: Migration and Integration clarifies and proposes answers for all of the politically toxic questions associated with large-scale migration from the Global South to the Western liberal democracies. Driven by the conviction that the Alt-Right is using the issues of migration and integration effectively to batter the defenses of liberal democracy, Professor Tom Farer argues that despite its strength, the moral case for open borders should be rejected and that while broadly tolerant of different life styles, the state should enforce core liberal values. Examining closely the policies and practices of various European states, Farer draws on their experience, contrasts it with that of the United States, and provides a detailed strategy for addressing the issues of who should be allowed to enter, how migrant families should be integrated and cultural conflicts resolved.     Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: Viel ist zur Wirkung der Grundrechte zwischen Privaten geschrieben worden. Jedoch offenbaren jüngere Entwicklungen in der Rechtsprechung – vgl. Stadionverbotsbeschluss (BVerfG) und Egenberger-Urteil (EuGH) – und in der Lebenspraxis – Stichwort: soziale Medien -, dass viele Fragen weiterhin ungeklärt bleiben oder neu gestellt werden müssen. Andreas Kulick nähert sich der Horizontalwirkung der Grundrechte und ihrer Lösungsansätze aus sechs Perspektiven: analytisch, dogmatisch, anwendungspraktisch, staatsorganisationsrechtlich, ethisch und demokratietheoretisch. Dieser Vergleich offenbart erhebliche Schwächen der vorherrschenden Auffassung und zeigt, dass die Vorbehalte gegenüber einem unmittelbaren Grundrechtsverhältnis zwischen Privaten weitgehend ins Leere gehen. Der Autor plädiert stattdessen für einen modifizierten Ansatz der Grundrechtsgeltung zwischen Privaten. Er sichert ihn theoretisch und dogmatisch ab und weist seine Realisierung primär der Fachgerichtsbarkeit zu.

In light of this, Andreas Kulick calls for a modified approach of direct applicability of fundamental rights between private actors.

    Abstract: Die als Digitalisierung bezeichnete umfassende gesellschaftliche bzw. kulturelle Transformation lässt auch das Grundgesetz nicht unberührt. Die Fortentwicklung der Lehre vom Verfassungswandel ermöglicht es, die verfassungsrechtlichen Dynamiken als einen strukturellen Verfassungswandel zu beschreiben, der sich am Leitbild digitaler Souveränität orientiert. Das Leitbild steht für die Verantwortung und die Legitimität des Staates unter den Bedingungen der Digitalisierung. Enrico Peuker entfaltet es exemplarisch in den verfassungsrechtlichen Kontexten der digitalen Infrastrukturen sowie der »digitalen« Grundrechte. Er plädiert für eine erweiterte Lesart der staatlichen Infrastrukturverantwortung als Optimierungsrecht hinsichtlich des Breitbandausbaus und der IT-Sicherheit und verortet die Grundrechtsentwicklungen in einem Drei-Stufen-Modell aus Interpretation, Innovation und Kodifikation.
    Abstract: Digitalization has transformed modern life and left no part of society untouched. Enrico Peuker analyzes the impact digitalization has and will have on Germany's Basic Law from the perspective of structural constitutional change. Focusing on constitutional aspects of digital infrastructures and the protection of fundamental rights in the digital age, he develops and concretises the constitutional guiding principle of digital sovereignty.

    Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism
