    Abstract: This book explores continuity and ruptures in the historical use of visual representations in science and related disciplines such as art history and anthropology. The book also considers more recent developments that attest to the unprecedented importance of scientific visualizations, such as video recordings, animations, simulations, graphs, and enhanced realities. The volume collects historical reflections concerned with the use of visual material, visualization, and vision in science from a historical perspective, ranging across multiple cultures from antiquity until present day. The focus is on visual representations such as drawings, prints, tables, mathematical symbols, photos, data visualizations, mapping processes, and (on a meta-level) visualizations of data extracted from historical sources to visually support the historical research itself. Continuity and ruptures between the past and present use of visual material are presented against the backdrop of the epistemic functions of visual material in science. The function of visual material is defined according to three major epistemic categories: exploration, transformation, and transmission of knowledge.

Hierbei setzt sie sich unter anderem mit zahlreichen vorgeschlagenen Neuerungen wie neuen Haftungstatbeständen und Analogien auseinander und wägt letztendlich ab, ob tatsächlich Haftungslücken vorliegen und wie diese geschlossen werden sollten. Die Autorin Tina Dötsch ist derzeit in der Rechtsabteilung eines Softwareunternehmens tätig.     Abstract: Die Regulierung des Internets, häufig auch als Internet Governance bezeichnet, erfolgt gegenwärtig durch eine Vielzahl sowohl privater als auch staatlicher Akteure. Zugleich ist es eine der drängendsten Herausforderungen mit Blick auf die Zukunft des Internets, den ständigen Prozess des Wandels und der Fortentwicklung dieses Mediums regulatorisch zu begleiten und einzuhegen. Dies wirft die Frage auf, welchen Regelungen und Vorschriften Regulierungsmaßnahmen unterliegen, die auf das Internet abzielen. Da aufgrund der entgrenzten Natur des Internets einer Regulierungsmaßnahme praktisch stets eine grenzüberschreitende und damit internationale Dimension zukommt, lässt sich dies jedoch nicht allein anhand nationaler Rechtsvorschriften beantworten. Stattdessen ist hierfür ein Rückgriff auf das Völkerrecht angezeigt. Der Band soll einen Beitrag dazu leisten, die Bedeutung des Völkerrechts für die globale Internet Governance zu ermitteln. Der Autor David Hamburger war von 2017 bis 2021 wissenschaftlicher Mitarbeiter und Doktorand am Lehrstuhl für Staats- und Verwaltungsrecht, Völkerrecht, Europäisches und Internationales Wirtschaftsrecht an der Universität Passau. Sein Forschungsschwerpunkt war hierbei das Völker- und Europarecht.

    Abstract: Diese Arbeit widmet sich den Gefahren der Vernetzung durch Vernetzung. Ziel ist eine kritische Auseinandersetzung mit dem Begriffsverständnis Organisierter Kriminalität in der analogen und digitalen Welt, wobei die kriminologische und strafrechtliche Perspektive beleuchtet wird. Um dem Mythos, der um das Phänomen Organisierte Kriminalität herrscht, nachzugehen und ihn zu objektivieren, wird zunächst der Wandel und die Bedeutung der gesellschaftlichen, wirtschaftlichen und kriminellen Vernetzung nachgezeichnet und die daraus resultierenden Gefahren insbesondere durch Cybercrime und die Relevanz für Organisierte Kriminalität aufgezeigt. Im Anschluss wird die Etymologie und das Begriffsverständnis Organisierter Kriminalität in der analogen und digitalen Welt aus einer kriminologischen Perspektive untersucht und erörtert, inwieweit sich das Strafrecht an den Erkenntnissen orientiert, neuere Erscheinungsformen wie Cybercrime umfasst und am Begriff Organisierte Kriminalität schärfen lässt. Abschließend wird die Funktion und der Wert des Labels Organisierte Kriminalität diskutiert. Die Autorin Nicole Selzer ist Forschungsreferentin und identifiziert zukünftige Forschungsthemen im Cybersicherheitsbereich, um entsprechende Forschungsprojekte anzustoßen und Ausschreibungen zu entwerfen.

    Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: Dieses Open-Access-Buch untersucht, inwieweit Anbieter im Online-Vertrieb das technische Erkenntnisverfahren Profiling zum Zwecke der Preispersonalisierung einsetzen und welche rechtlichen Rahmenbedingungen dabei gelten. Preispersonalisierung liegt vor, wenn der Preis für ein Gut oder eine Dienstleistung an die Zahlungsbereitschaft des einzelnen Kunden angepasst wird. Dafür ist u.a. die zielgerichtete Verarbeitung personenbezogener Daten notwendig. Preispersonalisierung unterscheidet sich damit von dynamischen Preissetzungsmethoden, die bloßer Ausdruck von Angebot und Nachfrage sind. Entgegen weitverbreiteter Einschätzung kommen personalisierte Preise (noch) äußerst selten vor: Technische und wettbewerbliche Hindernisse schränken den Handlungsspielraum der Anbieter ein. Hinzu kommt, dass die individuelle Zahlungsbereitschaft situationsabhängig und oftmals irrational ist. Auch der Betroffene kann sie nicht immer konkret beziffern. Der Schwerpunkt dieser wirtschaftsrechtlichen Untersuchung liegt auf dem Datenschutz- und dem Antidiskriminierungsrecht. Sie berücksichtigt zugleich wettbewerbs- und verbraucherschutzrechtliche Aspekte. Zudem entwickelt sie ein 3-stufiges Modell, welches einen eigenständigen methodischen Ansatz darstellt. Dies macht es möglich, Lebenssachverhalte im Kontext von Profiling und automatisierten Entscheidungen zu strukturieren und so einer rechtlichen Bewertung zugänglich zu machen. Die Untersuchung greift umfassend auf andere Disziplinen zurück, indem sie u.a. ökonomische, technische, empirische und psychologische Erkenntnisse berücksichtigt. Das Buch untersucht, wie datenbasiertes Profiling und automatisierte Entscheidungen funktionieren, funktional miteinander zusammenhängen und reguliert sind. Im Anschluss analysiert es, wie Profiling genutzt werden kann, um im Online-Handel Preise zu personalisieren. Schließlich behandelt es die Frage, ob das geltende materielle Recht ausreichende Schutzmechanismen gegen Diskriminierung bereithält, die aus der Zugehörigkeit zu geschützten Gruppen resultiert und in einer systematischen preislichen Schlechterstellung zum Ausdruck kommt.

    Abstract: "This volume comprises a selection of papers delivered at the symposium "The Word Illuminated: Form and Function of Qur'anic Manuscripts" held at the Arthur M. Sackler Gallery during 1-3 December 2016 and organized in conjunction with the exhibition "The Art of the Qur'an: Treasures from the Museum of Turkish and Islamic Arts." Speakers investigated the materiality of luxury Qur'ans, from the lavish use of costly materials such as gold and parchment, the development of special scripts and intricate illuminated designs to the meticulously tooled bindings. In addition to examining the physical features of Qur'anic volumes, the authors examine the manuscripts in their artistic, historic, and religious contexts to understand more fully the transformation of these works into potent symbols of piety, political and religious authority, and into instruments of legitimacy. Over the centuries, many of the Qur'ans were offered as diplomatic gifts or taken as booty and endowed to mosques, tombs, and other religious complexes to perpetuate and transmit their exceptional baraka (divine blessing).     Abstract: A major analysis of how China is attempting to become a media and information superpower around the world, seeking to shape the politics, local media, and information environments of both East Asia and the world. Since China's ascendancy toward major-power status began in the 1990s, many observers have focused on its economic growth and expanding military. China's ability was limited in projecting power over information and media and the infrastructure through which information flows. That has begun to change. Beijing's state-backed media, which once seemed incapable having a significant effect globally, has been overhauled and expanded.     Abstract: "The rise of industrial capitalism in the nineteenth century forged a new ecological order in North American and Western European states, radically transforming the environment through science and technology in the name of human progress. Far less known are the dramatic environmental changes experienced by Eastern Europe, in many ways a terra incognita for environmental historians and anthropologists. A New Ecological Order explores, from a historical and ethnographic perspective, the role of state planners, bureaucrats, and experts-engineers, agricultural engineers, geographers, biologists, foresters, and architects-as agents of change in the natural world of Eastern Europe from 1870 to the early twenty-first century. Contributors consider territories engulfed by empires, from the Habsburg to the Ottoman to tsarist Russia; territories belonging to disintegrating empires; and countries in the Balkan Peninsula, Central and Eastern Europe, and Eurasia. Together, they follow a rhetoric of "correcting nature," a desire to exploit the natural environment and put its resources to work for the sake of developing the economies and infrastructures of modern states.     Abstract: Through a detailed study of the circulation of European silent film in Australasia in the early twentieth century, this book challenges the historical myopia that treats Hollywood films as having always dominated global film culture. Before World War I, European silent feature films were ubiquitous in Australia and New Zealand, teaching Antipodean audiences about Continental cultures and familiarizing them with glamorous European stars, from Asta Nielsen to Emil Jannings. After the rise of Hollywood and then the shift to sound film, this history—and its implications for cross-cultural exchange—was lost. Julie K. Allen recovers that history, with its flamboyant participants, transnational currents, innovative genres, and geopolitical complications, bringing it all vividly to life. Making ground-breaking use of digitized Australian and New Zealand newspapers, the author reconstructs the distribution and exhibition of European silent films in the Antipodes, along the way incorporating compelling biographical sketches of the ambitious pioneers of the Australasian cinema industry. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Petr Szczepanik provides an in-depth study of the history and contemporary landscape of screen media industries in the Czech Republic, Slovakia, Poland and Hungary. Drawing on first-hand research in the world of the various producers who operate in the "digital peripheries" of Central and Eastern European, he offers broad insights into the ways the screen industries of small nations are positioned in and respond to globalization and digitalization.     Abstract: Die vermeintliche Beschleunigung des Lebenstempos ist eine der populärsten Annahmen der Gegenwart. Besonders Medien wird in diesem Prozess eine verstärkende Rolle zugesprochen. Die Studie von Stephan O. Görland analysiert die Interdependenzen zwischen Zeitumgang und praktiken mit mobilen Medien und Zeiterleben in Warte- und Transitzeiten, sog. Interimszeiten. Dazu wird eine Methodentriangulation verwendet. Im Ergebnis zeigt sich, dass die Nutzung von mobilen Medien in Interimszeiten zu einem Gefühl der Beschleunigung führt und Nutzerinnen und Nutzer mittels verschiedener Zeitpraktiken versuchen, diese Zeitspannen optimal zu nutzen. Der Autor liefert eine erstmalige empirische Analyse von Beschleunigung und Medien sowie neue Einblicke in die mediale Ausgestaltung von Interimszeiten.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: In Photographic Returns Shawn Michelle Smith traces how historical moments of racial crisis come to be known photographically and how the past continues to inhabit, punctuate, and transform the present through the photographic medium in contemporary art. Smith engages photographs by Rashid Johnson, Sally Mann, Deborah Luster, Lorna Simpson, Jason Lazarus, Carrie Mae Weems, Taryn Simon, and Dawoud Bey, among others. Each of these artists turns to the past—whether by using nineteenth-century techniques to produce images or by re-creating iconic historic photographs—as a way to use history to negotiate the present and to call attention to the unfinished political project of racial justice in the United States. By interrogating their use of photography to recall, revise, and amplify the relationship between racial politics of the past and present, Smith locates a temporal recursivity that is intrinsic to photography, in which images return to haunt the viewer and prompt reflection on the present and an imagination of a more just future.

    Abstract: This collection brings to light many of the women whose labours were important to the creation and consumption of early modern English books, from those who gathered linen rags on the streets of London for paper production, to those who ran printing houses and financed the production of books, sold them, wrote them, edited them, owned and read them. The evidence of extant books reveals that women who worked beside their husbands in printing houses and bookshops sometimes exerted considerable influence over their shops' business decisions. Most of the identifiable women stationers were widows, who often sought to minimize their financial risk through a conservative approach to publishing. But some were more enterpreneurial, expanding the network of those with whom they worked and increasing the number and types of books they issued. In their roles as authors, editors, and annotators, women further extended their impact on the history of early modern books. By considering women from widely differing backgrounds who engaged in manual, commercial, familial and literary forms of labour, this collection recovers women's participation in book history as never before

    Abstract: Since Gutenberg's time, every aspect of print has gradually changed. But the advent of computational media has exponentially increased the pace, transforming how books are composed, designed, edited, typeset, distributed, sold, and read. N. Katherine Hayles traces the emergence of what she identifies as the postprint condition, exploring how the interweaving of print and digital technologies has changed not only books but also language, authorship, and what it means to be human.Hayles considers the ways in which print has been enmeshed in literate societies and how these are changing as some of the cognitive tasks once performed exclusively by humans are now carried out by computational media. Interpretations and meaning-making practices circulate through transindividual collectivities created by interconnections between humans and computational media, which Hayles calls cognitive assemblages. Her theoretical framework conceptualizes innovations in print technology as redistributions of cognitive capabilities between humans and machines. Humanity is becoming computational, just as computational systems are edging toward processes once thought of as distinctively human. Books in all their diversity are also in the process of becoming computational, representing a crucial site of ongoing cognitive transformations.Hayles details the consequences for humanities publications through interviews with scholars and university press professionals and considers the cultural implications in readings of two novels, The Silent History and The Word Exchange, that explore the postprint condition. Spanning fields including book studies, cultural theory, and media archeology, Postprint is a strikingly original consideration of the role of computational media in the ongoing evolution of humanity

    Abstract: "In PHOTOGRAPHIC RETURNS Shawn Smith sets out to examine works of contemporary art, only to find that many of the works refer back to the past, to photography's many intersections with the history of racial justice in the U.S. Smith focuses on flashpoints in that history -- spanning from the abolitionist movement, to the Civil War, lynching, and mass incarceration-- to mark the roles that photography has played in documenting the exigencies of Black life, and as a tool for resisting those racial regimes. For each of these moments, Smith shows how contemporary photographers utilize their medium as a way to recall, revise, or amplify the relationship between racial politics in the past and in the present. She argues that the tendency of African-American photographers and other artists to return to the archive of early photography does not simply point to the usefulness of early photography as document of the past, but to the recursive nature of photography itself. This study expands our theories of photography and memory by arguing that the recursive temporality of photography is central to its role in recording and remembering history. It also asserts that photography is an invaluable tool for critical practice of racial justice"--

Instead of engaging in conversation, we instead look down and fiddle with our devices. This is the topic of Samuel McCormick's engaging and innovative book The Chattering Mind, which is the first to try and explain how a seemingly unproblematic form of communication--everyday talk--became a problem and a source of anxiety. McCormick traces the conceptual history of this notion from Kierkegaard's theory of "chatter" to Heidegger's recuperative discussion of "idle talk" to Lacan's treatment of "empty speech."     Abstract: The Building as Screen: A History, Theory, and Practice of Massive Media describes, historicizes, theorizes, and creatively deploys massive media - a set of techno-social assemblages and practices that include large outdoor projections, programmable architectural façades, and urban screens -- in order to better understand their critical and creative potential. Massive media is named as such not only because of the size and subsequent visibility of this phenomenon but also for its characteristic networks and interactive screen and cinema-like qualities. Examples include the programmable lighting of the Empire State Building and the interactive projections of Montreal's Quartier des spectacles, as well as a number of works created by the author himself.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: Jens Milker analysiert die Leitlinien der aktuellen zivilgerichtlichen Rechtsprechung zur Haftung für Treffer in Ergebnislisten einer Suchmaschine. Dies geschieht im Lichte der neueren Entwicklungen nach der Google-Spain-Entscheidung des Europäischen Gerichtshofs vom 13. Mai 2014 (Rs. C‑131/12) – das sogenannte „Recht auf Vergessenwerden“ – und Geltung der DS-GVO ab dem 25. Mai 2018. Der Autor arbeitet die in der Rechtsprechung entwickelten Lösungsansätze sowie deren Reibungspunkte mit unionsrechtlichen Vorgaben heraus und präsentiert einen eigenen Lösungsvorschlag.
