    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: This Element shows how two social movements, lesbian separatism and Men Going Their Own Way (MGTOW), reflect the changing and complex (anti-)feminist ideologies of their time. The authors outline the historical and political background of those discourses and how they are influencing contemporary gender relations. The materials analysed comprise ten manifestos, which are examined with a combination of data-led discourse analysis and theory-led argumentation analysis. The manifestos are similar in that both sets of authors construct homogenous in-groups and out-groups as well as dichotomies between them. There are some differences though in how this is linguistically realised and who is classified as an out-group. Both groups cast social actors in particular roles and establish ethical norms, but strategic planning and utopias are more prominent among lesbian separatists. Freedom, advantage and authority are central in each group's argumentation, but lesbian separatists also stress humanitarianism while MGTOW focus on financial matters

    Abstract: This Element explores approaches to locating and examining social identity in corpora with and without the aid of demographic metadata. This is a key concern in corpus-aided studies of language and identity, and this Element sets out to explore the main challenges and affordances associated with either approach and to discern what either approach can (and cannot) show. It describes two case studies which each compare two approaches to social identity variables - sex and age - in a corpus of 14-million words of patient comments about NHS cancer services in England. The first approach utilises demographic tags to group comments according to patients' sex/age while the second involves categorising cases where patients disclose their sex/age in their comments. This Element compares the findings from either approach, with the approaches themselves being critically discussed in terms of their implications for corpus-aided studies of language and identity

This is a key concern in corpus-aided studies of language and identity, and this Element sets out to explore the main challenges and affordances associated with either approach and to discern what either approach can (and cannot) show. It describes two case studies which each compare two approaches to social identity variables - sex and age - in a corpus of 14-million words of patient comments about NHS cancer services in England. The first approach utilises demographic tags to group comments according to patients' sex/age while the second involves categorising cases where patients disclose their sex/age in their comments. This Element compares the findings from either approach, with the approaches themselves being critically discussed in terms of their implications for corpus-aided studies of language and identity."     Abstract: Moving beyond two main concepts of 'interlingual' and 'intralingual' discrimination, this Cambridge Element addresses the concept of 'translingual discrimination', which refers to inequality based on transnational migrants' specific linguistic and communicative repertoires that are (il)legitimized by the national order of things. Translingual discrimination adds intensity to transnational processes, with transnational migrants showing two main characteristics of exclusion - 'translingual name discrimination' and its associated elements such as 'name stigma' and 'name microaggression'; and 'translingual English discrimination' and its elements such as 'accentism', 'stereotyping' and 'hallucination'. The accumulation of these characteristics of translingual discrimination causes negative emotionality in its victims, including 'foreign language anxiety' and 'translingual inferiority complexes'. Consequently, transnational migrants adopt coping strategies such as 'CV whitening', 'renaming practices', 'purification', and 'ethnic evasion' while searching for translingual safe spaces

Ecosemiotics with its affinity to the humanities, is presented here as the best disciplinary approach for interpreting complex environmental conditions for a broad audience, across a multitude of temporal and spatial scales. It is proposed as an intellectual bridge between divergent sciences to incorporate within a unique framework different paradigms. The ecosemiotic paradigm helps to explain how organisms interact with their external environments using mechanisms common to all living beings that capture external information and matter for internal usage. This paradigm can be applied in all the circumstances where a living being (man, animal, plant, fungi, etc.) performs processes to stay alive

    Abstract: Traditional grammar and current theoretical approaches towards modelling grammatical knowledge ignore language in interaction: that is, words such as huh, eh, yup or yessssss. This groundbreaking book addresses this gap by providing the first in-depth overview of approaches towards interactional language across different frameworks and linguistic sub-disciplines. Based on the insights that emerge, a formal framework is developed to discover and compare language in interaction across different languages: the interactional spine hypothesis. Two case-studies are presented: confirmationals (such as eh and huh) and response markers (such as yes and no), both of which show evidence for systematic grammatical knowledge. Assuming that language in interaction is regulated by grammatical knowledge sheds new light on old questions concerning the relation between language and thought and the relation between language and communication. It is essential reading for anyone interested in the relation between language, cognition and social interaction.

While official accounts have systematically erased any trace of those wasting relationships, another kind of narrative has been written in flesh, blood, and cells. Traveling between Naples (Italy) and Agbogbloshie (Ghana), science fiction and epidemic outbreaks, this Element will take the readers into the bowels of the Wasteocene, but it will also indicate the commoning practices which are dismantling it

From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa.     Abstract: Beschleunigung, Zeitverdichtung und Effizienz sind oft genannte Schlagworte unserer Gegenwart, die sich aufs Engste mit der Stadt verbinden. Hektik und Geschäftigkeit im urbanen Raum scheinen Menschen zu Funktionsträgern zu verwandeln. Die Brüchigkeit dieser vorherrschenden Vorstellung zeigt sich aber bereits an Figuren wie der des Flaneurs, der sich gerade im Getriebe der Großstadt gelassen bewegt.     Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--
