    Abstract: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. How can the population’s creative potential best be fostered? What do software innovations have in common with the evolution of living organisms? What are the vulnerabilities of distributed creativity? Answers are sought in the processes that came into being during the early years of the digital revolution and were then forced to take a back seat as control of the means of production was increasingly placed in the hands of tech companies. The findings and insights presented here are highly relevant for today’s digital policymaking. Market concentration processes in innovation haven’t ceased; they are ongoing. And in an age where data-driven services are creating and reinforcing global oligopolies, the question posed by the U.S. Supreme Court in Google v. Oracle is now more relevant than ever: who should hold the keys to digital innovation?

    Abstract: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena. The main purpose of this book is to identify and explore possible trajectories for the development of civil and criminal liability; for our understanding of the attribution link to autonomous systems; and, in particular, for the punishment of unlawful conduct in connection with their operation. AI decision-making processes – including judicial sentencing – also warrant close attention in this regard. Since AI is moving faster than the process of regulatory recalibration, this book provides valuable insights on its redesign and on the harmonization, at the European level, of the current regulatory frameworks, in order to keep pace with technological changes. Dadurch ist es möglich, die Sozialität in gemeinsamer Anwesenheit als ein sich in Wahrnehmung und Bewegung entfaltendes und dadurch affektives wie habituelles Praxisgeschehen zu erfassen. Im Zentrum des Buches stehen damit praxistheoretische Zugänge für eine Soziologie leiblicher Kopräsenz, mit denen (über-)situative Qualitäten der Mit-Anwesenheit soziologisch sicht- und analysierbar werden.     Abstract: Ausgehend von der seit 2010 stark gestiegenen öffentlichen Aufmerksamkeit für sexuelle Gewalt in Institutionen, geht dieses Open-Access-Buch der Frage nach, vor welche Herausforderungen ebendiese Thematisierung pädagogische Fachkräfte stellt. Anhand von Gruppendiskussionen mit Teams der stationären Jugendhilfe werden Anlässe rekonstruiert, die das Thema sexuelle Gewalt in der Praxis relevant werden lassen. Besonders hervorzuheben ist der Befund, dass Fachkräfte sich durch den Diskurs unter einen Generalverdacht gestellt fühlen. Dieser geht einher mit der Angst vor Repressalien gegen die eigene Person oder Kolleg*innen. In der Folge stehen die Fachkräfte vor einem professionellen Dilemma: Sie müssen den Schutz der eigenen Person gegen die Nähebedürfnisse der Kinder und Jugendlichen abwägen. Um dieser Herausforderung zu begegnen, haben die Fachkräfte diverse Bewältigungsstrategien entwickelt. Diese sind davon abhängig, (1) ob die pädagogischen Fachkräfte sich vorstellen können, dass eine*r ihrer Kolleg*innen sexuelle Gewalt verübt (Undenkbarkeit), (2) inwieweit sich die Fachkräfte aufgrund der konzeptionellen Ausrichtung für ein Nähebedürfnis der Kinder und Jugendlichen verantwortlich fühlen (familienanalog vs. nicht familienanalog) und (3) wie sich der organisationale Umgang mit der medialen Thematisierung darstellt. Dieser Irrtum wurde von den Eleaten zuerst begangen, indem sie Schein und Sein unterschieden, und wird seither in wechselnder Terminologie wiederholt. Durch die moderne Logik kann dieser Irrtum nach Schlicks Ansicht beseitigt werden.

Und wie können sie das Zustandekommen politischer Entscheidungen beeinflussen? Denn wenn besser verstanden würde, wer oder was sich wie auf diese Übersetzungsprozesse auswirkt, könnten solche Verfahren im Sinne authentischer Demokratisierung effektiver gestaltet werden. Hierzu wurde ein eigens entwickelter theoretisch-methodischer Synkretismus aus Akteur-Netzwerk-Theorie und Grounded-Theory-Methodologie angewendet. Die Ergebnisse zeigen unter anderem, wie digitale Strukturen und Mechaniken zur Disziplinierung der sich beteiligenden Bürger führen, wie Verwaltungsmitarbeiter Plattformgeschehen verfälschen und wie Entscheidungsprozesse manipuliert werden können. Daher werden zuletzt Gütekriterien für digitale Partizipationsprozesse angeboten, um subpolitische Einflussnahme und Kontrolle in der Praxis wahrscheinlicher zu machen und Mängel in existierenden Verfahren erkennen und nachjustieren zu können.     Abstract: Dieses Open-Access-Buch stellt vor dem Hintergrund einer zunehmenden sozialen Segregation in deutschen Städten die Frage nach den Auswirkungen dieser sich verschärfenden räumlichen Polarisierung auf die Sozialisation von Jugendlichen. Die Arbeit geht dabei über den quartiersfixierten Ansatz der Nachbarschaftseffektforschung hinaus und untersucht, welche Räume in der Stadt von Berliner Jugendlichen in ihrer Freizeit tatsächlich genutzt werden und damit für sie sozialisationsrelevant sind. Der Fokus liegt auf dem Einfluss, den einerseits individuelle Merkmale, wie Geschlecht und sozialer Status, und andererseits die Stadtstruktur auf das räumliche Freizeitverhalten der Jugendlichen haben. Zentral ist dabei die Frage, ob sich die soziale Segregation der Wohnquartier auch in den Aktivitätsräumen der Jugendlichen widerspiegelt. Um diese Frage zu beantworten, werden Daten mit einer eigens für diese Arbeit entwickelten innovativen räumlich-quantitativen Befragung erhoben, vor dem Hintergrund der physischen und sozialräumlichen Struktur Berlins ausgewertet und durch qualitative Leitfadeninterviews ergänzt. Die Veränderungsprozesse betreffen viele Lebensbereiche und führen in Jahren beständig wechselnder Restriktionen und Hygienemaßnahmen zu einem zunehmenden Widerstand innerhalb der Bevölkerung. Vertrauen wird dabei eine bedeutsame Frage für die effektive Umsetzung von Maßnahmen, für die Einhaltungsbereitschaft und für das Protestverhalten während der Pandemie. Vertrauen in andere Menschen, aber auch in die Institutionen der Gesellschaft, ist ein wichtiges Bindeglied für den sozialen Zusammenhalt. Um das Zusammenspiel des Vertrauens mit pandemiebedingten Veränderungsprozessen sowie den darin inbegriffenen Widerstand gegen die Maßnahmen in Österreich aufarbeiten zu können, werden die Daten des „Austria Corona Panel Projects“ herangezogen. Die Paneldaten untersuchen den Zeitraum der Pandemie von März 2020 bis Februar 2022. In diesem Zeitraum kann für das soziale Vertrauen ein signifikanter Anstieg festgestellt werden. Institutionelles Vertrauen verringert sich dahingegen. Protestverhalten wirkt sich mindernd auf das Institutionsvertrauen aus, während soziales Vertrauen davon nicht direkt beeinflusst ist.     Abstract: Influence of “hard” law on national policies still is a central topic in Europeanisation research. One aspect often overlooked is the impact of “soft” law instruments such as the “Open Method of Coordination” (OMC). Through the OMC all member states agree on common goals and exchange “best practices” to improve policy coordination in a certain area without the obligation (how) to design policies. OMC impacts in individual member states have been studied extensively, yet a comparative perspective explaining their variance is lacking. This study by Niclas Beinborn tries to fill this gap by analysing the different impacts of a recent OMC: the European Youth Strategy 2010 (EUYS). His analysis is twofold: in a first step he applies theory-driven fuzzy-set QCA to a novel dataset depicting the variance of national activities around the EUYS. As causalities remain unclear, in a second step he presents an innovative analysis framework encompassing two dimensions – national motivation and relative openness to implement non-binding EU law – to define ideal types of OMC adaptation. Case studies on the EUYS in Germany and Ireland proof the potential of this framework to explain why and how OMCs work (differently). About the author Niclas Beinborn worked as a research associate at the German Research Institute for Public Administration in Speyer. There, he extensively studied child and youth policy in Germany and Europe. As of 2021, he works as a desk officer in the federal administration.

    Abstract: Die Forschungsfrage des vorliegenden Buches bewegt sich im Bereich der personenbezogenen Politikforschung: Die Beziehung zwischen Angela Merkels Persönlichkeitsgrundzügen und der deutschen Außenpolitik steht im Mittelpunkt der Analysen. Der Autor deutet und interpretiert die Auswirkungen auf die deutsche Außenpolitik anhand der Beispiele Euro-, Ukraine- und Flüchtlingskrise sowie die China-Politik. Er erarbeitet vier Kategorien, denen ihre Persönlichkeitsmerkmale zugeordnet werden können. Die Analyse konzentriert sich vornehmlich auf Merkels Reaktionen auf die externen Faktoren und ihre Optionen bei der Entscheidungsfindung. Die Ergebnisse zeigen, dass Angela Merkels Persönlichkeitsmerkmale erhebliche Auswirkungen auf den Verlauf dieser bedeutenden außenpolitischen Ereignisse zeigten.     Abstract: Stadtöffentlichkeiten sind bunt, vielfältig und heterogen. Besonders deutlich wird dies bei der Analyse der beteiligten Akteure. Denn während klassische Öffentlichkeitsakteure, wie etwa lokale Medien bereits vielfach wissenschaftlich erforscht worden sind, nimmt dieses Buch eine Akteursgruppe unter die Lupe, die bisher aus kommunikations- und medienwissenschaftlicher Perspektive wenige Beachtung erfahren hat. Zivilgesellschaftliche Kollektive wie Sportvereine, soziale Bewegungen oder Kunst- und Kultureinrichtungen prägen mit ihren vielfältigen Angeboten und Aktionen das Stadtbild. Gleichzeitig prägen sie auch die städtische Öffentlichkeit, indem sie sich aktiv an ihrer Konstitution beteiligen. Die Autorin identifiziert sieben unterschiedliche Typen zivilgesellschaftlicher Kollektive, die jeweils ganz eigene Medienpraktiken und -ensembles zur öffentlichen Kommunikation einsetzen. Sie verfolgen dabei sehr unterschiedliche Ziele innerhalb der Stadtöffentlichkeit und agieren innerhalb jeweils sehr verschiedener Netzwerke.     Abstract: Some (web) television texts achieve immense commercial success. Certain commercially successful texts boast dedicated, creative, and exponentially growing fandoms. These fan communities engage in specific fan practices that are significantly influenced by the textualities of the texts and their contexts of production, distribution, and consumption. Increased fan engagement resulting in the acceleration of the text’s popularity leads to the following inquiries: · How is the series influenced by the interactions among and the relationships between the producers, consumers, distributors, and content? · What are the sites of these interactions? · What are the social, cultural, economic, and political factors that impact the series? · How do the text’s contexts of production, distribution, and consumption lead to the text’s popularity in mainstream media? In pursuit of an answer to these questions, the analytical lens of the ‘mediaverse’ is developed. An inductive study, this book explores four television series’ that fall within the scope of speculative fiction to characterise the mediaverse and highlight the interconnectedness among the networked nodes of new media. These wield a significant influence on the production and consumption of media and its presence in our everyday lives, thus outlining the mediaverse as a tool for the analysis of a media texts and practices that shape contemporary media culture.     Abstract: The book brings to light how Latin American states have traditionally stood before the field of International Investment Law and Arbitration. It delves into their posture of resistance to critically examine how their perspective has gradually changed and how they have adapted and molded their investment agreements so as not to leave their position as players in the field of International Investment Law. Many Latin American states have appeared as defendants before international investment tribunals and some of these, like Venezuela, Bolivia or Ecuador, have denounced their international investment agreements. Deeming the law field as imbalanced, they have looked for alternatives to continue providing legal protection to foreign investors while protecting their right to regulate in the name of public interest. Some interesting investment agreements models, sometimes of a different ilk, have consequently flourished and have arrested the attention of those studying or working with international investment law. The main objective of this book is to critically discuss how Latin American states have accepted, resisted, or adapted themselves to international investment law and arbitration. Accordingly, the general connection between these states and international investment law are explained in an introduction which examines the general trends as per which Latin American states have offered a legal protection to foreign investments. The first part enters the merits of where international investment law and arbitration stand in some Latin American states whereby the experience of Brazil, Chile, Argentina, Venezuela, and Uruguay are discussed. The following parts explain the trends in international investment law and arbitration in Latin America. These trends are namely related to dispute settlement and governance, to the connection between investment law and human rights and finally to regionalization. Um sich mit dieser politisch sensiblen Geschichte und ihren aktuellen Erscheinungsformen auseinanderzusetzen, bedient sich die Wewelsburg des Ausdrucksmittels Kunst.     Abstract: Die Jahre 2007/2008 brachten eine Preiskrise für Agrarprodukte und Nahrungsmittel, wie seit Jahrzehnten nicht mehr bekannt. Weltweit litten bis zu 115 Mio. Menschen zusätzlich Hunger. Unerhört war, dass die Krise im Vorfeld unerkannt blieb: Produktion und Verbrauch wurden wie in den Vorjahren angemessen prognostiziert, nicht aber die Preisspitzen und die Volatilität. Das Buch untersucht die Zusammenhänge, die zu dieser Preisekrise führten sowie auch die Gründe, warum deren Ursachen so lange unerkannt blieben. Während in der Wissenschaft, in der Politikberatung und in den Medien ganz überwiegend „realwirtschaftliche“ Faktoren von Störungen bei Angebot und Nachfrage (unzureichende Ernten in einzelnen Ländern, geringe Bevorratung, Biosprit-Boom, Nachfrageerhöhung v.a. in Asien) diskutiert wurden, lassen sich diese Argumente leicht dekonstruieren. Weder einzeln noch im Zusammenwirken können realwirtschaftliche Faktoren die Höhe und v.a. die Volatilität der Preise auch nur annähernd erklären. Dem gegenüber beklagen langjährige Akteure auf den Terminmärkten das zunehmende Auftreten neuer Akteure, die gewaltige Finanzvolumen einsetzen. Sie nutzen Terminbörsen für Rohstoffe – darunter Agrarrohstoffe – zur Absicherung ihrer Anlagen in anderen Märkten, da sich die Werte bei Rohstoffen angeblich gegenläufig zu anderen Anlageklassen bewegen. Zudem scheint es bei Terminkontrakten auf Rohstoffe eine Strategie zu geben, wie sich risikoarm verlässliche Renditen erzielen lassen. Eine unrühmliche Rolle kommt langjährig ausgewiesenen Vertretern der Wissenschaft zu: Sie legen theoretisch und empirisch dar, dass Spekulation auf den Terminmärkten ganz überwiegend keine signifikant (negative) Rolle bei den Preisentwicklungen zuzumessen ist. Diese Sichtweise setzt sich in den Internationalen Organisationen durch. Lediglich der Untersuchungsausschuss des US-Senats folgt den Einwänden der Praktiker, die auf folgende Sachverhalte verweisen: Die Wissenschaft nutzt eine völlig unangemessene Datenbasis, die nicht geeignet ist, übermäßige Spekulation aufzudecken. Sie setzt zur Analyse methodische Werkzeuge ein, die gerade bei hoher Volatilität der Preise unangemessen sind. Sie nutzten Theorien, die nur in idealen (theoretischen) Umgebungen Erklärungsgehalt bieten und in der Praxis keinerlei Relevanz besitzen. Darüber hinaus lehnen sie moderne jüdische Strömungen, wie den Zionismus und das Reformjudentum, als ketzerisch ab. Ihr Streben nach Bewahrung einer imaginierten Tradition im Kontext der Moderne und ihr erzwungenes Einfügen darin prägt ihr Dasein und ihr Handeln. Lintl untersucht ihre Auseinandersetzung mit anderen jüdischen Strömungen sowohl in der Zeit vor der Gründung des Staates Israel als auch seit 1948. Zudem zeigt der Autor wie sich die Charedim den Herausforderungen eines jüdischen und demokratischen Nationalstaats stellen müssen. Dabei werden politische und ideologische Konflikte ebenso analysiert wie der wachsende politische Einfluss ihrer Parteien auf den Staat. Diese Herangehensweise wird in einen Rahmen eingebettet, der sich von den herkömmlichen Analyserastern abhebt.     Abstract: This book puts the spotlight on a different and neglected aspect of law drafting and reform: the question of size. Specifically, how does the size of a jurisdiction affect its ability to make and change its laws? Some of the challenges affecting small jurisdictions include: a lack of resources and paucity of policy/drafting capacity; the pressures and pull from sources outside the jurisdiction (e.g. international bodies or NGOs; larger states; treaty commitments); a vulnerability to domestic capture (e.g. criminal elements, big local businesses, strong domestic lobby groups); weak/bad governance (e.g. laws or institutions which themselves do not encourage or promote good governance, reflection and reform); the legacy of colonial legal systems and their interaction with indigenous or customary laws; and struggles to comply with constitutional norms such as accountability and transparency. Despite these difficulties small jurisdictions also have certain advantages when it comes to making and reforming law: they can be flexible and creative; they can legislate very quickly if the political will is there; and there is strong informal/formal accountability in a small jurisdiction. This edited collection explores law reform and law drafting in small jurisdictions through the themes of sovereignty; the impact of colonialism and legal plurality; the challenges of harmonising laws at regional and international levels; and constitutional reform.     Abstract: This book uses a comparative research design to analyze the reporting on the Jewish minority and the Muslim minority in German newspapers from 2010-2019, asking whether minorities are truly treated as equals in the reporting of the mainstream German media. After providing historical and socio-political context for both groups as minority populations in Germany, the authors make use of qualitative and quantitative methods to examine sentiment and determine whether the media demonstrates a unifying or a well-differentiated portrayal of the two groups. The findings show that reporting on these groups is not as unbiased as many in Germany believe. Drawing on frameworks including the needs-based model of reconciliation, the revised integrated threat theory, and the model of acculturation strategies, the book then discusses the implications for both journalistic reporting and broader social policies in support of a constructive encounter of dominant and non-dominant groups in a diverse society.     Abstract: This handbook offers analysis of diverse genres and media of neo-Victorianism, including film and television adaptations of Victorian texts, authors’ life stories, graphic novels, and contemporary fiction set in the nineteenth century. Contextualized by Sarah E Maier and Brenda Ayres in a comprehensive introduction, the collection describes current trends in neo-Victorian scholarship of novels, film, theatre, crime, empire/postcolonialism, Gothic, materiality, religion and science, amongst others. A variety of scholars from around the world contribute to this volume by applying an assortment of theoretical approaches and interdisciplinary focus in their critique of a wide range of narratives—from early neo-Victorian texts such as A. S. Byatt’s Possession (1963) and Jean Rhys’ Wide Sargasso Sea (1966) to recent steampunk, from musical theatre to slumming, and from The Alienist to queerness—in their investigation of how this fiction reconstructs the past, informed by and reinforming the present. Sarah E. Maier is Professor of English and Comparative Literature at the University of New Brunswick Saint John, Canada. Brenda Ayres teaches online courses for Liberty University and Southern New Hampshire University, USA. Maier and Ayres have coedited several collections of essays.     Abstract: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

    Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

    Abstract: This monograph centres on the history of musical theatre in a space of cultural significance for British identity, namely the Theatre Royal, Drury Lane, which housed many prominent American productions from 1920-1970. It argues that during this period Drury Lane was the site of cultural exchanges between Britain and the United States that were a direct result of global engagement in two world wars and the evolution of both countries as imperial powers. The critical and public response to works of musical theatre during this period, particularly the American musical, demonstrates the shifting response by the public to global conflict, the rise of an American Empire in the eyes of the British government, and the ongoing cultural debates about the role of Americans in British public life. By considering the status of Drury Lane as a key site of cultural and political exchanges between the United States and Britain, this study allows us to gain a more complete portrait of the musical’s cultural significance in Britain. Dr. Arianne Johnson Quinn is an archivist, librarian, and scholar. She is currently the Music Special Collections Librarian at the Warren D. Allen Music Library, Florida State University, USA. She holds a Ph.D. in Musicology from Princeton University, and has worked as Digital Archivist and Research Associate for the Noël Coward Archive Trust. Arianne has been on the faculty of the Florida State Honors Program, South Georgia State College and Tallahassee Community College. Her research focuses on the intersections between the American and British musical in London’s West End from 1920-1970, particularly the works of Noël Coward, Kurt Weill, Lerner and Loewe, Irving Berlin, Cole Porter and Rodgers and Hammerstein. .

    Abstract: This open access book explores the intersection of property law, relocation, and resettlement processes in the United States and among communities that grapple with migration as an adaptation strategy. As communities face the prospect of relocating because of rising seas, policy makers, disaster specialists, and community leaders are scrambling to understand what adaptation pathways are legally possible. While in its ideal application, law functions blindly and without variation, the authors find that legal contradictions come to bear on resettlement processes and place certain communities further in harm’s way.     Abstract: American Borders: Inclusion and Exclusion in US Culture provides an overview of American culture produced in a range of contexts, from the founding of the nation to the age of globalization and neoliberalism, in order to understand the diverse literary landscapes of the United States from a twenty-first century perspective. The authors confront American exceptionalism, discourses on freedom and democracy, and US foundational narratives by reassessing the literary canon and exploring ethnic literature, culture, and film with a focus on identity and exclusion. Their contributions envision different manifestations of conviviality and estrangement and deconstruct neoliberal slogans, analyzing hospitable inclusion in relation to national history and ideologies. By looking at representations of foreignness and conditional belonging in literature and film from different ethnic traditions, the volume fleshes out a new border dialectic that conveys the heterogeneity of American boundaries beyond the opposition inside/outside. Paula Barba Guerrero is Assistant Professor of American Literature and Culture at Universidad de Salamanca, Spain. Her research interests include African American literature, space studies, memory, nostalgia, and speculative fiction. Mónica Fernández Jiménez holds a PhD in English from the University of Valladolid, Spain, and currently works as a translator in England.     Abstract: This open access book explains how leading business organizations attempt to achieve the responsible and ethical use of artificial intelligence (AI) and other advanced information technologies. These technologies can produce tremendous insights and benefits. But they can also invade privacy, perpetuate bias, and otherwise injure people and society. To use these technologies successfully, organizations need to implement them responsibly and ethically. The question is: how to do this? Data ethics management, and this book, provide some answers. The authors interviewed and surveyed data ethics managers at leading companies. They asked why these experts see data ethics as important and how they seek to achieve it. This book conveys the results of that research on a concise, accessible way. Much of the existing writing on data and AI ethics focuses either on macro-level ethical principles, or on micro-level product design and tooling. The interviews showed that companies need a third component: data ethics management. This third element consists of the management structures, processes, training and substantive benchmarks that companies use to operationalize their high-level ethical principles and to guide and hold accountable their developers. Data ethics management is the connective tissue makes ethical principles real. It is the focus of this book.     Abstract: This book examines the institutional contexts of dramaturgical practices in the changing political landscape of 20th century Germany. Through wide-ranging case studies, it discusses the way in which operationalised modes of action, legal frameworks and an established profession have shaped dramaturgical practice and thus links to current debates around the “institutional turn” in theatre and performance studies. German theatre represents a rich and well-chosen field as it is here where the role of the dramaturg was first created and where dramaturgy played a significantly politicised role in the changing political systems of the 20th century. The volume represents an important addition to a growing field of work on dramaturgy by contributing to a historical contextualisation of current practice. In doing so, it understands dramaturgy not only as a process which occurs in rehearsal rooms and writers’ studies, but one that has far wider institutional and political implications. Anselm Heinrich is a Professor of Theatre Studies at the University of Glasgow. His books include Entertainment, Education, Propaganda (2007), Theater in der Region (2012), Theatre in Europe Under German Occupation (2017), and a volume on Ruskin, The Theatre, and Victorian Visual Culture (2009). He is currently under contract for a monograph on theatre in Britain during WWII. He has held research fellowships at Harvard, Oxford and Marburg. Ann-Christine Simke is a Lecturer in Performance at the University of the West of Scotland. She recently published the article “Forensic Architecture in the Theatre and the Gallery: A Reflection on Counter hegemonic Potentials and Pitfalls of Art Institutions” (with Anika Marschall, 2022) and is currently under contract for a co-authored (with Anika Marschall) book on intersectional theatre practices.

    Abstract: This volume presents an analytical and empirical overview of the array of issues that the Mexican media faces in the post-authoritarian age, which jointly explains how a partially accomplished democracy, its authoritarian inertias, and its unintended consequences hinder the democratic performance of the media. This is analyzed from three points of view: the stalemate Mexican media system and ineffective regulations, the conditions of risk and insecurity of the journalists on the field, and the limits of freedom of expression, political substance, and inclusiveness of media content. A binational effort, with research from US and Mexican authors, a wide analytic perspective is provided on the macro, meso, and micro levels, allowing for a deep conceptual richness and a comprehensive understanding of the Mexican case.     Abstract: This open access book presents a condensed history of Sociology in Mexico from its origins, through to the middle of the 19th century and up to the present day. The book analyses the interaction between sociology and the main economic, political and social change in the country, including the 1910 Mexican Revolution, the main social movements, the role of the intellectual exiles from Spain and Latin America, and the participation of women, who have often remained invisible in the history of sociology. The book explores how sociological discourse played a fundamental role in the separation of secular and public education and the search for a ‘national project’ from 1868 onwards, despite the lack of an institute of social research until 1930; how sociology became an autonomous social science, led by a few intellectuals and public figures, as it became institutionalized in universities, and the effect this had on the development of the discipline; the influence of Marxism during the 1970s; and the progression from a process of specialization after the fall of the Berlin Wall to a new trend of working in collective projects with an increasing interdisciplinary perspective in the first decades of the 21st century. Gina Zabludovky is a tenured Professor and Researcher at UNAM, Mexico. She is the author and editor of numerous books, scientific articles, and book chapters on various topics including social and political theory, the history of sociology in Mexico, business organizations and women in decision-making positions. She has received several awards in recognition of her academic achievements.

    Abstract: This book explores how popular cultural artifacts, literary texts, commemorative practices and other forms of remembrances are used to convey, transmit and contest memories of mass atrocities in the Global South. Some of these historical atrocities took place during the Cold war. As such, this book unpacks the influence or role of the global powers in conflict in the Global South. Contributors are grappling with a number of issues such as the politics of memorialization, memory conflicts, exhumations, reburials, historical dialogue, peacebuilding and social healing, memory activism, visual representation, transgenerational transmission of memories, and identity politics. Mphathisi Ndlovu is a research fellow at Stellenbosch University (South Africa). Mphathisi is also an Associate Professor of Journalism and Media Studies at the National University of Science and Technology (Zimbabwe). He is also an alumnus of the Alliance for Historical Dialogue and Accountability (AHDA) fellowship at Columbia University's Institute for the Study of Human Rights. Mphathisi holds a PhD in Journalism from Stellenbosch University. His research interests are in collective memory, identity politics and digital cultures. Mphathisi’s works have been published as book chapters, and peer reviewed articles in journals such as Digital Journalism, African Cultural Studies, Journal of Genocide Research, and Nations and Nationalism. Mphathisi is also co-editor of a book titled The Idea of Matabeleland in Digital Spaces: Genealogies, Discourses and EpistemicStruggles (2022). Lungile Augustine Tshuma holds a PhD in Journalism from the University of Johannesburg, South Africa. He is a Senior PostDoctoral Fellow in the Department of Communication and Media at the University of Johannesburg in South Africa. Lungile is also an Associate Professor in the department of Journalism and Media Studies at the National University of Science and Technology (Zimbabwe). His research interests are in journalism, photography and memory. He has published in local and international peer reviewed journals and among them are: African Journalism Studies, Nations and Nationalism, Media Culture and Society, and Journal of Communication Inquiry. Shepherd Mpofu is Associate Professor of Media and Communication at the University of South Africa. He has published several articles on communication, media and journalism in Africa.     Abstract: This collection of essays offers new perspectives from Japan on Nobel Prize–winning author Kazuo Ishiguro. It analyses the Japanese-born British author from the vantage point of his birthplace, showing how Ishiguro remains greatly indebted to Japanese culture and sensibilities. The influence of Japanese literature and film is evident in Ishiguro’s early novels as he deals with the problem of the atomic bomb and Japan’s war responsibility, yet his later works also engage with folk tales and the modern popular culture of Japan. The chapters consider a range of Japanese influences on Ishiguro and adaptations of Ishiguro’s work, including literary, cinematic and animated representations. The book makes use of newly archived drafts of Ishiguro’s manuscripts at the Harry Ransom Center at the University of Texas to explore the origins of his oeuvre. It also offers sharp, new examinations of Ishiguro’s work in relation to memory studies, especially in relation to Japan. Takayuki Shonaka is Professor in English Literature at Kyoto Women’s University, Japan. His research and teaching expertise are in British and American Culture, Language, and Literature. He is the author of Kazuo Ishiguro: ‘Nihon’ to ‘Igirisu’ no Hazama kara [Kazuo Ishiguro: From Between ‘Japan’ and ‘England’] (2011). Takahiro Mimura is Professor in English at Chiba Institute of Technology, Japan. He studies contemporary English novels especially from the perspective of memory.     Abstract: The Famine Diaspora and Irish-American Women’s Writing considers the works of eleven North-American female authors who wrote for or descended from the Irish Famine generation: Anna Dorsey, Christine Faber, Elizabeth Gurley Flynn, Mother Jones, Kate Kennedy, Margaret Dixon McDougall, Mary Meaney, Alice Nolan, Fanny Parnell, Mary Anne Sadlier, and Elizabeth Hely Walshe. This collection examines the ways the writings of these women contributed significantly to the construction of Irish North-American identities, and played a crucial role in the dissemination of Famine memories transgenerationally as well as transnationally. The included annotated excerpts from these women writers’ works and the accompanying essays by prominent international scholars offer insights on the sociopolitical position of the Irish in North America, their connections with the homeland, women’s activities in transnational (often Catholic) publishing networks and women writers’ mediation of Ireland’s cultural heritage. Furthermore, the volume illustrates the generic variety of Irish-American women’s writing of the Famine generation, which comprises political treatises, novels, short stories and poetry, and bears witness to these female authors’ profound engagement with political and social issues, such as the conditions of the poor and woman’s vote. Marguérite Corporaal is Full Professor of Irish Literature in Transnational Contexts at Radboud University, the Netherlands. She was PI of Relocated Remembrance: The Great Famine in Irish (Diaspora) Fiction, 1847–1921), is a NWO-VICI grant recipient for her project Redefining the Region (2019-24), and PI of Heritages of Hunger, a Dutch research council-funded NWO-NWA project (2019-24). She is the author of Relocated Memories of the Great Famine in Irish and Diaspora Fiction, 1847–70 (2017). Dr. Jason King is Academic Coordinator of the Irish Heritage Trust and National Famine Museum, Strokestown Park, and a member of the Government of Ireland National Famine Commemoration Committee.     Abstract: This collection examines the relationship between illustration and adaptation from an intermedial and transcultural perspective. It aims to foster a dialogue between two fields that co-exist without necessarily acknowledging advances in each other’s domains, providing an argument for defining illustration as a form of adaptation, as well as an intermedial practice that redefines what we mean by adaptation. The volume embraces both a specific and an extended definition of illustration that accounts for its inclusion among the web of adaptive practices that developed with the rise of new media and intermediality. The contributors explore how crossovers may contribute to reappraise their objects, and rely on a transmedial and interdisciplinary corpus exploring the boundaries between illustration and other media such as texts, graphic novels, comics, theatre, film and mobile applications. Arguably adaptation, like intermediality, is an umbrella term that covers a variety of practices and products, and both of them have been shaped by intense debates over their boundaries and internal definitions. Illustration belongs to each of these areas, and this volume proposes insight into how illustration not only relates to adaptation and intermediality but how each field is redefined, enriched and also challenged by such interactions. Shannon Wells-Lassagne has worked extensively on film and television adaptation. She is the author of Television and Serial Adaptation, and the editor of Adapting Margaret Atwood (Palgrave), Adapting Endings, as well as of special issues of The Journal of Screenwriting, Interfaces, and TV/Series, Screen and Series. Sophie Aymes works on intermediality, modernist book history and illustration in 20th-century Britain. She has co-edited several word-and-image journal issues (inInterfaces and Image [&] Narrative), volumes on illustration (series Book Practices and Textual Itineraries), and a collection on Art and Science in Word and Image.

    Abstract: This edited volume offers innovative perspectives on the study of music as cultural diplomacy in the Middle East and North Africa (MENA), a region often overlooked in such discussions. It offers an innovative contribution to the field of ethnomusicology, as well as political science and international relations, by highlighting the agency of non-state actors (local voices, communities, and grassroots organizations), thereby contributing towards de-centering the state, hitherto conceived as the chief player in cultural diplomacy. This volume is divided into four main parts organized along the following themes: 1. History and Historiography, 2. Migration, Diaspora, and Ethics, 3. Statecraft and Music Making, and 4. Affective and Sensorial Diplomacy. The perspectives offered in this volume offer a deeper exploration of bottom-up initiatives of cultural diplomacy through music, instead of the more usual analyses of top-down, state-directed programmes. Overall, the aim is to reconceptualize Middle Eastern, North African and Arab Gulf musical practices in their relationship to power and cultural diplomacy in order build a broader and pluri-dimensional account of these contentious relationships. Maria M. Rijo Lopes da Cunha has been a Danish Institute in Damascus Postdoctoral Research Fellow in Ethnomusicology at the Department for Arts and Cultural Studies of the University of Copenhagen (2019 - 2021 and 2022). Jonathan Shannon is Professor of Anthropology at Hunter College and the Graduate Center, The City University of New York. Søren Møller Sørensen is Associate Professor Emeritus at Department for Arts and Cultural Studies, University of Copenhagen. Virginia Danielson retired as Director of Libraries, New York University Abu Dhabi and is currently an Associate of the Music Department at Harvard University.

    Abstract: This book explores a spectrum of contemporary photographic practices across the fields of image-making, curating, archiving, teaching, community development and activism that have envisioned photography as ontologically and ethically collaborative. By looking specifically into the contexts where collaborative projects are produced and shown, and into the dialogical relation to the people they engage with –in hospitals, in prisons, in working-class neighbourhoods, with indigenous people, refugees, women, persons experiencing homelessness, young people– the contributions from practitioners, scholars, and curators show participatory practices to create the conditions for building new subjectivities, or making visible a multiplicity of identities, thus opening up a new politics of visibility. Therefore, this book specifically addresses the political, counter-cultural dimension of collaborative projects, but also their subversiveness in relation to dominant practices within the field of photography: this includes a reinvention of the position of the photographer –in turns facilitator or project leader– of curating and exhibition models, of archiving methodologies, of photographic education and of market practices. Mathilde Bertrand is Senior Lecturer in the Department of English Studies at Université Bordeaux-Montaigne, France. Her research focuses on the history of independent British photography in the post-war period, particularly on the role of photography collectives, photographic magazines and the community photography movement in fostering a discussion around the politics of representation from the 1970s onwards. She has published in the journals Photography and Culture, LISA e-journal, Revue Française de Civilisation Britannique, and co-edited Ici notre défaite a commencé, on The Miners' Strike, 1984-5 (Syllepses, 2016). Karine Chambefort-Kay is Senior Lecturer in English studies and Visual Culture at Université Paris Est Créteil, France. Her research interests include the cultural, social, and political uses of images in British contemporary society, as well as exhibition and archive policies, and the issues of identity formation, memory and nationalism. She has published on various photographic practices and projects in the UK. She has published in the journals Image and Narrative, InMedia, Revue Française de Civilisation Britannique, and Archivo Papers Journal.
