    Abstract: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena.     Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

    Abstract: This edited volume addresses the environmental and cultural underpinnings of the kind of social conflict that spawned the origins and elaboration of ritualized human and animal sacrifice in Mesoamerica. The chapters variously document the place of cultural evolution and social complexity in the origins and elaboration of ritual human sacrifice, cannibalism, and trophy-taking across a broad spectrum of Mesoamerican cultural and social contexts that first saw the light of day before 2600 BCE, and rapidly developed and proliferated across the Mesoamerican world in the centuries to follow. They study the developments in sacrifice rituals through the centuries into the first millennium CE, when the Mexica Aztec and their allies had elevated ritual human sacrifice such that they produced a plethora of sacrificial acts, modes and manners of death, and associated deities to articulate the necro-cultures and blood-tribute of the times. The chapters further study present-day rites of Amerindian communities from throughout Mesoamerica that include paying homage to the deities of earth and sky through sacrifice and consumption of animal surrogates. The interdisciplinary effort undertaken by this international cadre of scientists, including anthropologists, bioarchaeologists, art historians, ethnohistorians, iconographers, and religious studies experts provides a particularly rich forum for launching an interrogation into the role of conflict, environment, and social complexity in the emergence and persistence of ritual violence and human sacrifice in the Mesoamerican world.

Historically, Muslims faced discrimination based on ethnicity rather than religion. However, contemporary discrimination against Muslims is rooted in different reasons, with events like the Rushdie affair significantly impacting multicultural relations. This study analyzes the evolving multicultural landscape in Britain, exploring the shift from predominantly assimilationist policies to a more mutual process of integration. It delves into the emergence of interfaith dialogue as well as the complexities surrounding the intersection of race, religion, gender, and identity.     Abstract: This open access book examines the chronic underperformance of economies with respect to inclusion, sustainability and resilience. It finds that the standard liberal economic growth and development model has evolved over the past century in a fundamentally unbalanced manner that underemphasizes the crucial role of institutions – legal norms, policy incentives and public administrative capacities – in translating market-based growth in the production of goods and services into broad and sustainable gains in social welfare at the household level. Correcting this imbalance of emphasis in economic theory and policy between markets and institutions, production and distribution, and national income and household living standards is the single most important step required to transcend 20th century trickle-down “neoliberalism” and replace it with a more human-centred model of economic progress in the 21st century. The book breaks new ground by integrating the principal institutional dimensions of the social contract into the heart of macroeconomic theory and presenting extensive corresponding reforms of domestic and international economic policy to refocus them on the median living standards, rather than primarily aggregate wealth or GDP, of nations. This is the bottom-line measure of national economic performance, and it depends on the strength of both markets of exchange and institutions in such areas as labour and social protection, financial and corporate governance, competition and rents, anti-corruption, infrastructure and basic necessities, environmental protection, education and skilling, etc. Extensive comparative data are presented demonstrating that countries at every level of economic development have ample policy space to narrow their “welfare gaps” – their underperformance on these and other key aspects of household living standards relative to the frontier of leading policy practice in peer countries.     Abstract: This open access book focuses on the ‘downstream’ element of PFM, that is how public organisations utilise public resources. It argues that improvements in PFM/IC will only flow from a recognition that what really matters is the quality of management. Management reform is an essential precondition to the successful implementation of many new techniques. Only when a managerial capacity exists willing to take advantage of the opportunities created by such technical developments, is it beneficial to pursue them. The benefits of PFM/IC flow from an improved quality of management. Despite enormous efforts, reform of public financial management and internal control (PFM/IC) in developing and transition economy countries has not been particularly successful in improving the quality of public service delivery and the use of public resources. This book outlines why this is and suggests a new approach. The analysis set out in this book is particularly relevant especially given limited national budgets and squeezed international aid budgets. These management changes include to the political/official relationships, to management structures, to budgetary and accounting arrangements and to the relationships between, particularly, the ministry of finance and other ministries. They require the delegation of operational management, developments in financial management and in accountability arrangements and a reconsideration of personnel policies, penalty and sanction arrangements. Managerial training for the civil service will be a key requirement. Reform may impact upon traditional cultural practices. These changes are all inter-related and should be coordinated. Noel Hepworth was the Chief Executive of CIPFA from 1980-1996. He is a qualified public finance accountant and was the initial Chairman of Accountancy of Europe’s Public Sector Committee and a technical adviser to IFAC’s Public Sector Accounting Standards Board for a period of years. More recently, he has worked extensively with OECD/SIGMA in many countries. Earlier in his career he worked in local government. He was an original member of the UK Audit Commission. He holds a post graduate diploma in public administration from the University of London. He has been awarded honorary doctorates by the Universities of Hull, Brighton and London City. He is a Fellow of the Center of Excellence in Finance, Slovenia and was awarded an OBE by Her Majesty the Queen in 1980.

This volume seeks to add new dimensions to language in practice with its focus on the development of discourse types within the region, public policy, discourses surrounding the galvanising figure of the Caribbean Prime Minister, literary discourses, and gender and media representations. As a site of great variation, linguistic and otherwise, the Caribbean provides unique insight into the interplay of the socio-political and language in contemporary societies in the Global South. Based on work presented at the University of Trinidad and Tobago’s “Stylistics, Critical Discourse Analysis and Language Use in the Caribbean” 2021 conference, the book draws together papers from established Caribbeanists seeking to bridge the existing theoretical and analytical gap between the more macro, socio-political aspects of studies in the social sciences, and the more micro features of linguistic analysis. With its breadth of coverage and analysis, this volume has implications for work being done at all levels of university scholarship in the social sciences, media discourses, decolonisation practices, and language and society in postcolonial and multi-ethnic contexts worldwide. Ryan Durgasingh is a Research Fellow at Ruhr University, Bochum, and PhD candidate at the University of Münster, Germany, where his work focuses on morphosyntactic variation in Caribbean Englishes. His research interests include stylistics, Critical Discourse Studies, variationist sociolinguistics, and corpus-based approaches to linguistic analysis. Nicha Selvon-Ramkissoon is an Assistant Professor at the Centre for Education Programmes, University of Trinidad and Tobago. Her main areas of interest are in Language Arts Curriculum Development, Second Dialect/Language Pedagogy, Critical Discourse Studies, and Translanguaging pedagogy for migrant communities.

    Abstract: This book explores the trajectories and structures of Latin American welfare states using a typology developed through conceptual and historical analyses of social protection systems in Latin America. It argues that social protection can be accomplished by different actors in distinct societies, be that the State, civil society, the market, or families. This work defines four types of welfare worlds based on who administers and allocates resources: the socio-corporatist, the statist, the commodified, and the familial. Author Ilan Bizberg delves on the historical trajectories of ten Latin American countries, each with a unique analysis of the corresponding social protection system: Uruguay, Argentina, Brazil, Costa Rica, Chile, Mexico, Colombia, Bolivia, Peru, and Ecuador The book begins with a meaningful discussion on the welfare state as a necessity of modern capitalist societies. Then, it counters the consequences of the disembeddedness of the economy from society and the way the social protection system protects the society against this rupture. Chapters focus on the health system, pensions, and assistance programs of these countries, with diverse case studies that include analyzing the performance of the health systems during the pandemic. The book closes with a discussion on gender and the situations women face and encounter under and within different social-protection regimes. Ilan Bizberg is Professor and Researcher at El Colegio de México, Associate Member of the International Graduate College “Temporalities of the Future” of the Freie Universität Berlin, and Associate Member of the CEIM of the Université de Quebec in Montreal. It then proposes a new framework for understanding church-state relations using the ressourcement method of returning to scripture and tradition, and by a critical dialogue with Oliver O’Donovan and various Protestant biblical scholars of the Powers in the New Testament. Ciftci shows how fruitful an self-consciously ecumenical approach can be for political theology. As most ressourcement theologians have overlooked political issues, and since ecumenical theology rarely touches on issues of church-state relations, this work makes an original contribution to the ressourcement project and to ecumenism.     Abstract: This book focuses on an underestimated alternative to the mainstream liberal rights-based approach: cultural activism. This political strategy deploys art and other creative techniques to support the quest for social justice. This work explores this approach's dynamics, strategies, and potential, presenting a qualitative case study of three cultural activists in Colombia and Mexico -Lia García, Felipe Osornio, and Manuel Parra-, including in-depth interviews and ethnographic observation of their artistic/activist work. Through their intervention in the realm of ordinary affects, these cultural producers create new affective climates for the experience of sexual and gender difference and develop new repertoires of affective response concerning identities usually seen as abject or worthy of social punishment. Strategies of cultural activism aim to subvert dominant representations and performances of marginalized subjectivities, to critique and subvert gender norms, to give visibility to non-hegemonic identities, to resist different forms of oppression and marginalization, and to prompt collective healing of wounds left by violence and discrimination.     Abstract: This book offers a history of migration in the Mediterranean written about and from the perspective of women. It gives a complex picture of individual journeys of migrant women, and in a radical departure from the miserabilist or culturalist approach through which women are usually viewed, and instead argues for a politically and socially aware feminism that is attuned to what border-obsessed migration policies actually do to women. The book depicts the journey of women as they experience brutal separations and make heart-wrenching decisions, but also as they make acquaintances and find new opportunities. The first-person accounts collected here demonstrate that the reasons behind these women’s decision to leave are anything but simple and linear: they combine various forms of persecution and oppression with a desire for autonomy.The book further explores the daily lives of women in reception centres as they wait for a Europe that rejects them to acknowledge their presence. At the same time, this study shows that these women are taking charge of their own destinies and journeys. This accordingly puts the space of everyday life front and centre. Such a space acts as an impediment to these women’s journeys: it generates a “moralscape” of waiting, which plays a key role in these women’s daily lives. However, it can also help these women gain greater autonomy, thus empowering them. Camille Schmoll is Research Director at École des Hautes Études en Sciences Sociales (EHESS), Fellow of the Institut Convergences Migrations, and a member of the Géographie-cités research centre, France. A feminist political geographer, she is especially interested in gender and migration issues, critical migration studies, and reflexivity within migration scholarship.     Abstract: This book seeks to expand some of the existing, often western and Global North facing, scholarship in the area of Disability and Media Studies to include African perspectives. Featuring predominantly Africa-based contributors, it studies an array of topics on disability and media in Africa, including issues of social media, media ethics, including marginalised voices in the media, and disability representation in the media. Tafadzwa Rugoho PhD is currently at Vrije Universiteit Amsterdam. He was a lecturer at Great Zimbabwe University in the Department of Development Studies. Tafadzwa holds an MA in Policy Studies, an MSc in Development, an MSc in Strategic Management and a BSc in Sociology. He has authored more than 25 book chapters as well as a number of journal papers on disability issues. Tafadzwa has presented several papers at local and international research conferences in this area over the past five years. Tafadzwa is also a guest lecturer at the University of Pretoria, where he teaches Sexuality and social media. He coauthored a book titled Sexual and Reproductive Health of Adolescents with Disabilities.

Diese Open-Access-Publikation fokussiert auf den Bereich der Kulturproduktion und zeigt auf, welche Bedingungen zur Verwendung der theoretischen Konzepte außerhalb der Wissenschaft geführt haben, wie die Theorien in Prozessen zur Anwendung kommen und welche Veränderungen daraus folgen. Hierzu wird zuerst ein konzeptioneller sowie methodologischer Rahmen präsentiert, bevor die empirische Studie einer Kulturwelt detaillierte Einblicke in die Wirkungsweisen ermöglicht. Contrary to the prevailing narratives of “digital empowerment” and opportunities for every individual, this book argues that digitalisation massively curtails social advancement opportunities, consolidating existing social relations. From a spatial perspective, Scheffer demonstrates how socially disadvantaged groups are faced with reproducing mechanisms as part of a new data economy. Surprisingly, the more intensively digital services are used, the more this happens. Building on Löw´s sociology of space and Bourdieu´s concept of habitus, this book shows how practices of social exclusion are transferred to the digital present in an innovative way. The image of “mirrored” spaces describes a new mechanism that explains social exclusion in the age of digitalization.     Abstract: This edited collection brings together theoretical and empirical reflections on the role played by new technology and digital platforms in the provision of food. Such negative effects are strictly related to the agro-industrial system of production and consumption, based on logic of low prices, high availability and high waste.     Abstract: This collection of essays examines how close analysis of William Blake’s manuscripts can yield new discoveries about his techniques, his working habits, and his influences. With the introduction of facsimile editions and more particularly, the William Blake Archive, the largest digital repository of Blake materials online, scholars have been able to access Blake’s work in as close its original medium, leading to important insights into Blake’s creative process and mythopoetic system. Recent advancements in digital editing and reproduction has further increased interest in Blake’s manuscripts. This volume brings together both established Blake scholars, including G.E. Bentley Jnr’s final essay on Blake, and upcoming scholars whose research is at the intersection of digital humanities, critical theory, textual scholarship, queer theory, transgender studies, reception history, and bibliographical studies. The chapters seek to cover the breadth of Blake’s manuscripts: poetry, letters, notebook entries, and annotations.     Abstract: The study of childhood in historical archaeology enriches interpretations of the past, but also has the potential for contributing to the understanding of methodological and theoretical issues in archaeology. Archaeologically, children are understudied relative to both their demographic and social importance, partly because children are viewed as difficult to discern in the archaeological record. Historical archaeology, with its access to historical documents to supplement and illuminate archaeological evidence, provides an opportunity to gain a greater understanding of the ways children's daily lives in the past were expressed in historically changing types and patterns of material culture. Recent research presented in this volume contributes valuable perspectives for conceptualizing the historically changing social nature of childhood and methods for illuminating the roles of children. Case studies are designed to illustrate methodological and theoretical advances in the historical archaeology of materialized experiences, discourses, identities, places and their meanings associated with parenting and childhood. The volume is organized into three sections devoted to case studies about 1) how childhood and parenting have been socially constructed cross culturally and temporally, 2) social ideologies of childhood in contested spaces, and 3) the relationship between children's experiences and adult expectations of childhood. Each chapter demonstrates advances in current methods or theories used in the archaeology of childhood. A final discussant, drawn from the broader field of research on the archaeology of childhood, provides a commentary on the ways the perspectives provided in the volume can be employed by researchers outside the sub-discipline of historical archaeology. .

    Abstract: This volume explores the role of violence generally but with specific reference to African concepts and themes, and the significance they have for social redress. The contributors interpret African concepts and themes to include accounts of violence, explicitly or implicitly construed from indigenous axiological resources like Ubuntu or personhood and from those works that are not African in origin but have become central in African moral, political and legal thought, such as Hannah Arendt’s On Violence and Walter Benjamin’s Critique of Violence. The volume contributes to moral philosophy, social philosophy, African philosophy, and political philosophy/theory. It situates itself within the Global South, specifically the African perspective, to explore, articulate, and defend (or even critique) African conceptions of violence.     Abstract: Humanism in business is not only an alternative to economism but a way to human excellence. Humanism presented here revolves around the rich notion of “human person”, keystone of modern personalist philosophy and Catholic Social Teaching. From this perspective this book is offered to everyone, believer and nonbeliever alike. The person-centered humanism considers the human-wholeness, individual and relational, with subjectivity, self-determination, openness to transcendence, and with capacity not only to possess but also to give. It also highlights the uniqueness of each person, endowed with a high constitutive dignity and in continuous process of flourishing toward human plenitude. An attitude of respect and good will is due to non-personal beings, while persons deserve to be treated with justice and even with love of benevolence. The book is prepared in dialogue with mainstream of thought in business and business ethics and focused on exploring ways to improve some conventional views. It includes some proposals such as a person-based ethics, ethics understood as intrinsic to business activity, the consideration of the company as an organized community of persons, and the purpose of the company oriented toward the common good through a double mission, internal and external. It is also suggested substituting the notion of “stakeholder” for the richer one of “relationholder.”.

    Abstract: This open access book explores the transnational and transoceanic dimensions of the debate on gender and women's cultural agency and mediation in the long eighteenth century. It aims to decenter perspectives on traditional Enlightenment geographies, by emphasizing cultural transfers between Southern Europe and the rest of Europe, as well as with the Americas; by focusing on a variety of cultural mediators—women authors, female (and male) translators, readers, travelers, and disseminators; and by examining diverse written and visual sources—from correspondence, travel narratives, and philosophical essays, to novels, opera, portraits. Mónica Bolufer is Professor of Modern History at the University of Valencia, Spain. She is the Principal Investigator of the ERC-funded research project CIRGEN: Circulating Gender in the Global Enlightenment: Ideas, Networks, Agencies. Laura Guinot-Ferri is Postdoctoral Researcher at the University of Valencia, Spain, and part of the CIRGEN team.     Abstract: Marc Buggeln und Sebastian Lotto-Kusche legen mit dieser Publikation ein Grundlagenkonzept zur Wahrheit über das begangene Unrecht an den Sinti_ze und Rom_nja in der Bundesrepublik Deutschland und der DDR vor. Zunächst fassen die Autoren den Erkenntnis- und Forschungsstand zur Geschichte von Sinti_ze und Rom_nja nach 1945 in beiden deutschen Staaten zusammen. Daraus abgeleitet wird der Forschungsbedarf und mögliche Fragestellungen der einzurichtenden Wahrheitskommission zur Aufarbeitung des an Sinti_ze und Rom_nja begangenen Unrechts (WASRU). Da Wahrheits- und Versöhnungskommissionen in Deutschland bislang keine Tradition haben und meist im unmittelbaren Übergangsbereich von Diktaturen und Apartheidsregimen hin zu Demokratien gegründet wurden, werten die Autoren die Erfahrungen dieser Kommissionen in unterschiedlichen Staaten weltweit aus.     Abstract: Unter Anwendung der Frame-Theorie wird in diesem Buch die Rolle von nicht-verbalisiertem Vorwissen in der interkulturellen Markenkommunikation untersucht. Eine starke Marke ist ein sowohl komplexes als auch fiktionales Konstrukt, das sich neben verschiedenen Oberflächenmerkmalen auch aus Assoziationen, Empfindungen und Hintergrundwissen zur Marke zusammensetzt. Mit einer kognitiv-linguistischen Vorgehensweise wird anhand von vier Fallbeispielen analysiert, welche unterschiedlichen Kommunikationsstrategien etablierte Unternehmen zur interkulturellen Positionierung von Marken nutzen und inwieweit diese sich in der Wahrnehmung der Rezipienten widerspiegeln. Dabei wird von einem holistischen Denkansatz ausgegangen, bei dem Sprachwissen und Weltwissen eine untrennbare Einheit darstellen und der Fokus liegt darauf, zu verstehen, wie abstraktes und künstlich erzeugtes Wissen um eine Marke kommunikativ etabliert werden kann und welche Rolle die landeskulturelle Bedingtheit hierbei spielt. Die Autorin Lisa Hackinger hat Wirtschaft, Kommunikation und Sprache studiert und nebenberuflich mit einer Promotion an der geisteswissenschaftlichen Fakultät der Åbo Akademi University in Finnland abgeschlossen.     Abstract: Angesichts des Verstummens von Zeitzeug:innen und des Wiedererstarkens fremdenfeindlicher Motive und Mechanismen wie Antisemitismus, Rassismus und Rechtspopulismus ist Erinnerung an den Holocaust aktueller denn je. Gedenkstätten wie die „Erinnerungs- und Gedenkstätte Wewelsburg 1933 – 1945“ nahe Paderborn stellen in der gesellschaftlichen Erinnerungskultur als bildungspolitische Orte zur Erinnerung an die Opfer des Nationalsozialismus und der Mahnung an die leidvollen Ereignisse unter der nationalsozialistischen Diktatur eine notwendige Möglichkeit hierfür dar. Um sich mit dieser politisch sensiblen Geschichte und ihren aktuellen Erscheinungsformen auseinanderzusetzen, bedient sich die Wewelsburg des Ausdrucksmittels Kunst. Als erste umfassende interdisziplinäre Grundlagenforschung befasst sich dieses Buch mit jenem einzigartigen Stück bundesdeutscher Kunstgeschichte nach 1945, einer bildgewordenen, (un-)erwünschten Erinnerung aus einer theologischen Perspektive. Stephanie Lerke zeigt auf, dass das nachkriegsexpressionistische Wewelsburger Mahnmal von Josef Glahé den Betrachtenden durch sein breites Bildprogramm ein komplexes Themenfeld von historischen und theologischen Inhalten mit aktueller, erinnerungspolitischer Relevanz eröffnet.     Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .
