    Abstract: This collection of essays investigates the obligations we have in respect of future persons, from our own future offspring to distant future generations. Can we harm them? Can we wrong them? Can the fact that our choice brings a worse off person into existence in place of a better off but 'nonidentical' person make that choice wrong? We intuitively think we are obligated to treat future persons in accordance with certain stringent standardsroughly those we think apply to our treatment of existing persons. We think we ought to create better lives for at least some future persons when we can do so without making things worse for too many existing or other future persons. We think it would be wrong to engage in risky behaviors today that will have clearly adverse effects for the children we intend one day to conceive. And we think it would be wrong to act today in a way that would turn the Earth of the future into a miserable place. Each of these intuitive points is, however, challenged by the nonidentity problem. That problem arises from the observation that future persons often owe their very existence to choices that appear to make things worse for those same persons. New reproductive technologies, for example, can be both risky and essential to one persons coming into existence in place of a 'nonidentical' other or no one at all. But so can a myriad of other choices, whether made just prior to conception or centuries beforechoices that seem to have nothing to do with procreation but in fact help to determine the timing and manner of conception of any particular future person and thus the identity of that person. Where the persons life is worth living, it is difficult to see how he or she has been harmed, or made worse off, or wronged, by such an identity-determining choice. We then face the full power of the nonidentity problem: if the choice is not bad for the future person it seems most adversely to affect, then on what

As it registers in our aesthetic experience, beauty enhances nature's enchantment around us and our inward experience lifting our soul toward moral elevation. This collection of art-explorations seeks the elemental ties of the Human Condition. It endeavors to explain the relation of beauty and human existence, and explores the various aspects of beauty.
    Abstract: Beauty fulfils human existence. As it registers in our aesthetic experience, beauty enhances nature's enchantment around us and our inward experience lifting our soul toward moral elevation. Carried by creative imagination (Imaginatio Creatrix), beauty participates in the moulding of the forms of the intellective constitution of the mind in tandem with praxis and seeks deeper enigmas of the real in the labyrinth of the cosmos. Yet with the evolution of human development and in technological inventions, beauty, while suffusing all modalities of experience, seems to undergo transformations and expansion. Are there perduring norms and modalities of beauty or are we carried along blindly by human development? Is there a measure intrinsic to our human ontopoietic unfolding and the growth of human life that we may follow instead of the whim of fancy and excess? The present collection of art-explorations seeks the elemental ties of Human Condition. Together, the authors aim to answer the questions posed above.     Abstract: Pope John Paul II surprised much of the medical world in 2004 with his strongly worded statement insisting that patients in a persistent vegetative state should be provided with nutrition and hydration. While many Catholic bioethicists defended the Pope s claim that the life of all human beings, even those in a persistent vegetative state or a coma, was worth protecting, others argued that the Pope s position marked a shift from the traditional Catholic teaching on the withdrawal of medical treatment at the end of life. The debate among Catholic bioethicists over the Pope s statement only grew more intense during the controversy surrounding Terry Schiavo s death in 2005, as bioethicists on both sides of the debate argued about the legitimacy of removing her feeding tubes. This collection of essays by some of the most prominent Catholic bioethicists addresses the Pope s statements, the moral issues surrounding artificial feeding and hydration, the refusal of treatment, and the ethics of care for those at the end of life.

    Abstract: This book illuminates and sharpens moral theory, by analyzing the evolutionary dynamics of interpersonal relations in a variety of games. We discover that successful players in evolutionary games operate as if following this piece of normative advice: Don't do unto others without their consent. From this advice, some significant implications for moral theory follow. First, we cannot view morality as a categorical imperative. Secondly, we cannot hope to offer rational justification for adopting moral advice. This is where Glaucon and Adeimantus went astray: they wanted a proof of the benefits of morality in every single case. That is not possible. Moral constraint is a bad bet taken in and of itself. But there is some good news: moral constraint is a good bet when examined statistically.

    Abstract: "The European University is under stress. It has become commonplace to argue that radical reforms are needed. The claim is that while environments are changing rapidly, European universities do not learn, adapt and reform themselves fast enough. Reform plans comprise the purposes of universities, i.e. definitions of what the University is, can be and should be, criteria for quality and success, the kinds of research, education., services and innovation to be produced, and for whom. Reform plans also include the universities' organization and financial basis, their governance structures, who should influence the future dynamics of universities, and according to what principles. In contrast, it can be argued that the currently dominant reform rhetoric is only one among several competing visions and understandings of the University and its dynamics. What is at stake is ""what kind of University for what kind of society"" and which, and whose values, interests and beliefs should be given priority in University governance and reforms? This book explores the visions underlying the attempts to reform the European University as well as two European integration processes (""Bologna"" and ""Lisbon"") affecting University dynamics. Above all, the book presents a framework for analyzing ongoing ""modernization"" reforms and reform debates that take place at various governance levels, not least the European level, and a long-term research agenda."

    Abstract: This book presents the findings of a study into the social shaping of reproductive genetics in Germany and Israel. The study reveals dramatic differences between German and Israeli societies in addressing the question of a life (un)worthy of living. A close analysis of the ways that these two societies handle the balance between the quality and sanctity of life illuminates controversies over reproductive genetics in an original and provocative way.
    Abstract: Based on a variety of empirical materials the study reveals dramatic differences between the way that the German and Israeli societies address the question of a life (un)worthy of living: while in Germany, social, cultural, religious and legal conditions restrict the selection of embryos based on prenatal diagnosis, in Israel they strongly encourage it. A close comparative analysis of the ways that these two societies handle the delicate balance between the quality and sanctity of life illuminates the controversy around reproductive genetics in an original and provocative way. The study is also innovative in its use of contemporary social theory concerning the politics of life in comprehending the differences between two societies positioned at opposite extremes in their adoption of reproductive genetics. It thus offers an original cross-cultural discussion concerning present-day techno-medical manipulations of life itself.

The answer to this question may influence the extent to which we are willing to submit each other to punishments ranging from mild resentment to harsh prison terms. This book presents an extensive effort to shed light on the conditions under which we may appropriately deem someone blameworthy for holding a particular belief. It regiments and unifies several debates within contemporary epistemology, ethics and legal scholarship. Finally, the book brings a new philosophical look on issues like our power to control beliefs and the extent and nature of foresight.

    Abstract: Ethics, Hunger and Globalization adds an ethics dimension to the debate and research about poverty, hunger, and globalization.     Abstract: Emmanuel Lévinas est le philosophe de la non-indifférence; il nest en aucune sorte un philosophe indifférent. Son inquiétude personnelle et engagement politique ont trouvé une expression philosophique dans une quête à deux versants. Dans le versant ontologique, il cherche à montrer que même si lhomme est lévénement de compréhension de lêtre, tout lhomme et toute signification ne se réduisent pas à la compréhension de lêtre seul. Dans le versant politique, il sinterroge sur la possibilité de soumettre la tendance totalitaire de toute politique à une recherche de justice qui ne dépend pas finalement de la politique même. Mais ces deux versants nen font quun. La découverte dune signification qui excède la compréhension de lêtre léthique fournit en même temps la source de renouvellement de la justice. Ainsi, par cette double question, Lévinas nous présente les fils conducteurs de notre enquête: une signification au-delà de la compréhension de lêtre et sa portée éthique, que nous appelons «langage» et que nous explorons dans la perspective de son importance politique. Les études analytiques dans lesquelles les notions de politique et de langage fonctionnent comme clef dinterprétation mutuelle débouchent sur une critique centrée sur deux problèmes: limpossibilité dinterpréter la signifiance de lautre et le danger inhérent à la conception dune justice dépassant lEtat.

    Abstract: This book attempts to answer the question how health care can be incorporated into a comprehensive theory of justice, while realising an acceptable balance between efficiency, justice and care. It seems to be that we can have any two but not all three. Essentially, the central question addressed by this book is the following: how best to square the proverbial welfare circle.
    Abstract: What does just health care imply? Does it mean that people have a right to health care? Does it entail that there are rights-based social obligations to provide equal access to health care for everyone? And if so, why? Why are health care interests so important that they deserve special protection? What kind of social good is health care? What are its functions and do these make it different from other commodities? Furthermore, how much equality should there be in health care? What inequalities are morally acceptable and how should the burdens of achieving equality be distributed? Which matters of health care belong to the domain of justice, and which to the domain of charity? To what extent should we allow personal responsibility to play a role in allocating health care services and resources, or in distributing the costs? And what does justice require with regard to long-term care for the chronically ill and irreversibly dependent? Since the 90's, issues of scarcity, priority setting, and rationing lie at the centre of most current debates on health care. These are pressing issues: one way or another, limits have to be set. As such, the question of what is involved in just health care becomes much more complex. This complexity can be represented as an inconsistent triad, a set of three propositions of which any two are compatible but which together form a contradiction. In the case of health care, the three rival values are: social efficiency, justice, and decent-quality care. It seems to be that we can have any two but not all three. Essentially, the central question is the following: how best to square the proverbial welfare circle. How can resources be matched to needs, or needs to resources in socially acceptable and economically feasible ways? This book attempts to answer the question how health care can be incorporated into a comprehensive theory of justice, while realising an acceptable balance between efficiency, justice and care.     Abstract: The past two decades have witnessed an unrelenting expansion of management education around the world. At the same time, however, influential scholars - Mintzberg, Bennis, Pfeffer and others - have levelled pointed critiques at these programs questioning their quality and relevance, as well as their approaches to teaching and learning. 'Preparing Managers for Action' is a timely contribution for management schools as well as other higher education institutions seeking the means to increase the relevance and quality of their professional education programs. The book describes the use of problem-based learning (PBL) in management education. PBL is an active learning approach first pioneered in medical education, but whose use has grown steadily in a variety of professional fields over the past two decades. The authors draw upon their experience in using PBL in a broad array of management education programs at the Bachelor, Master, Doctoral and Executive levels, in North American and in Asia. This book is designed to provide both novice and experienced users of PBL with resources for designing and implementing problem-based management education.     Abstract: "Financing Public Universities addresses newer practices of resource allocation which tie funding to indicators of performance. The gist of these efforts is to raise the quality of institutional systems. Performance-based budgeting and funding of public universities is part of broader efforts to reform public management, and it is being promoted and implemented by various government agencies around the globe. In particular, European universities with their normally strong governmental ties, or higher education systems molded on European universities, are prime targets of such reforms. Performance funding has made its inroads in attempts to grant university systems managerial autonomy: autonomy was to be granted in exchange for funding modes which are tied to the measurement of performance indicators. Unfortunately, performance-based budgeting or funding measures cannot meet the various expectations: they do not raise the quality of teaching or learning, they do not raise research performance, they take back a great deal of managerial autonomy which is commonly judged to be essential for the well being of higher education institutions, in particular research universities, and they act as automata in place of proper governance and management. ""Financing Public Universities"" addresses policy makers, higher education administrators, scholars and students of higher education management. After an introduction to the theme and to the book (Chapter 1), ""Financing Public Universities"" covers the evolvement of mass higher education and the associated curtailment of funding (Chapter 2), the public management reform debate (Chapter 3) within which performance-based budgeting or funding evolved (Chapter 4), sketches alternative governance and management modes which can be used instead (Chapter 5), and epitomizes inertia or challenges (Chapter 6). Four appendices cover more technical matters, such as a comparative exposition of the research performance of universities by nation (Appendix C) and examples of funding systems in the UK and in the USA (Appendix D)."

    Abstract: Economic globalization has been accompanied by implementation of education reforms linked to accountability and public finance schemes that emphasize student choice in schools and student loans in higher education. This book provides a systematic evaluation of the effects of state education reforms and finance policies over the past decades. It includes a discussion of the need for a fundamental rethinking of educational policy in the United States.
    Abstract: Economic globalization has been accompanied by implementation of education reforms linked to accountability and public finance schemes that emphasize student choice in schools and student loans in higher education. In the U.S. these reforms are rationalized based on intermediate variables, like the number of math credits completed in high school and net prices. However, the reforms rationalized based on this research are seldom evaluated in relation to outcomes (i.e., measures of student achievement and equal opportunity to attain an education). In Education and the Public Interest the editor re-examines the political rationales for these reforms. John Rawls's theory of justice is reconstructed to develop a framework for assessing the effects of public policy on these outcomes. This volume undertakes a comparative study of the states in the U.S. to examine how education reforms influence student achievement, high school graduation, and college access, and finance schemes influence college access. Policies implemented by states in the 1990s were associated with improved achievement, as measured by test scores for high school students. These policies also correlate with increased high school drop out rates and the widening gap in college enrolment rates across income groups. This volume considers how privatization and accountability policies can be reconstructed to reduce inequality while continuing to improve student achievement and college enrolment.     Abstract: This book traces the growth of managed care as a mechanism for curbing excessive growth in health costs, and the controversies that have risen around for-profit health care. Also examined are decentralization in US health care, and the absence of comprehensive health care planning, access rules, and minimum health care benefit standards. Finally, the author proposes a framework for improving access to quality, affordable health care in a competitive market environment.
    Abstract: The effective management of appropriate health care should be able to contain medical care costs and improve accessibility while addressing rationing concerns. However, managed care in the United States has not lived up to the expectations set for it.Managed care quickly gained popularity among employers and public policy makers as a mechanism for curbing the excessive growth of health care insurance costs. Nonetheless, since its introduction, the system of largely for-profit managed care has been the subject of much public and political debate. The change from a fee-for-service system toward a system in which the health care insurance component is combined with the delivery of a broad range of integrated health care services for populations of plan enrollees that are financed prospectively from a limited budget has been widely criticized and has even been called repugnant. Instead of placing the blame on managed care organizations, however, we need to keep in mind that such organizations operate without societal agreement on critical issues such as a workable definition of health, an authoritative standard for defining the scope of entitlements, and on the distribution of labor between public and private sector entities. The health care system in the United States is also characterized by decentralization as well as the absence of a comprehensive health care planning or budgeting system, substantive access rules, and agreed-upon minimum health care benefit package. Therefore, managed care organizations only have limited responsibilities. The nonexistence of a shared, unifying paradigm of responsibility has been called the leading cause of the inability to manage health care appropriately. The stakeholders in health care operate on a set of widely varying interpretations of the notion of responsibility. The concept of genuine responsibility, recognizing the complexity of health care and the need for stakeholder-specific interpretations of responsibility, proposes as the underlying premise of responsibility (at least in regard to health care) the social agreement that distributive choices should be made on the basis of the premise of deliberate reciprocity. When all parties share the same foundation on which the notion of responsibility is built the resulting trust and cooperation among stakeholders enables them to find morally appropriate solutions in reforming health care.

    Abstract: Looking across national contexts and drawing on ethnographic studies of schools in the UK and Australia, the book explores the implications of the contemporary education policy context and processes and practices inside schools for students as learners and for educational inequalities. The book uses tools offered by post-structural theory to read ethnographic data and show how the discourses that circulate inside schools at once mobilise and elide gender, sexuality, social class, ability, disability, race, ethnicity, religious and cultural belongings at the same time as they open up and close down 'who' students can be as learners.     Abstract: Discursive accounts of the body have been prominent recently. While acknowledging the usefulness of these, the author, drawing upon specific philosophers of the body and a wide range of other theorists, focuses attention on the experiencing body - which she refers to as 'creatural existence'. Thinking in terms of the creatural, she argues, can better situate human beings in their environment, thus emphasizing a kind of 'ecological notion of subjectivity', in which place-based existence is understood anew. The educational implications of focusing on what bodies 'do' and not so much in terms of how they are socially inscribed, presents them as practico-sensory totalities which should perhaps be seen as systems rather than an as a mere organism or entity. Such an articulation of creatural existence emphasizes animality, and in so doing reminds us of the centrality of the senses in all knowing and doing, including crucially, in relation to those practices which we have understood as 'work'. Multi-sensorial education is a major sub-theme of the book and the author argues persuasively for this by means of a critical analysis of the ocular centrism that is characteristic of contemporary culture.     Abstract: Being Apart from Reasons deals with the question of how we should go about using reasons to decide what to do. More particularly, the book presents objections to the most common response given by contemporary legal and political theorists to the moral complexity of decision-making in modern societies, namely: the attempt to release public agents from their argumentative burden by insulating a particular set of reasons from the general pool of reasons and assigning the former systematic priority over all other reasons. If those attempts succeed, public agents should not reason comprehensively, taking into account all reasons and weighing them against one another. Some reasons would be excluded from decision-making by kind. That strategy is apparent both in Rawls' claim that reasons concerning the right are systematically prior to reasons concerning the good and in Raz's claim that pre-emptive reasons are systematically prior to first-order reasons. The same strategy is also instantiated by certain arguments for the procedural value of law, such as Jeremy Waldron's. In the book, each of those arguments for the insulation of reasons is objected to in order to defend the thesis the reasoning by public agents must always be as comprehensive as possible. In order to reach that conclusion a particular picture of public decision-making is needed. That picture is provided by the comparison between the use of reasons in public and private decision-making which is carried out in the first two chapters of the book. That comparison brings to light peculiar features of public decision-making that imply the need for public agents to reason comprehensively before deciding. The remaining chapters object to those arguments mentioned above which aim at justifying the exclusion of certain reasons from public agents' decision-making.

The philosopher came to look upon psychoanalysis as a theory - in particular as it was propagated after 1945 in Germany and the US - whose claim to scientific objectivity constituted a serious threat to the freedom of the individual. Max Weber's theory of science and his concept of modernity serve as a critical guide for the interpretation. Thus the normative premise of the investigation is the liberal idea that in a secular and pluralistic society it is ultimately the individual who is to take responsibility for life conduct.

    Abstract: " The ""capability approach"" of development economist Amartya Sen, who received the Nobel Prize for Economics in 1998, poses a major challenge to the dominant paradigm of neo-classical economics. According to Sen, human well-being does not depend on the consumption of commodities but on the freedoms human beings have reason to choose and value. The capability approach has frequently been criticised for a lack of attention to the ways in which unjust social, political and economic structures restrict human capabilities. This volume critically explores the nature and depth of our contemporary cultural crisis: its lack of traditional orientation and moral understanding. Prime among the issues at stake are the meaning and significance of birth, copulation, suffering, and death, expressed in debates regarding human embryo-experimentation and stem cell research, the character of moral and scientific norms, as well as more fundamentally, the character of an adequate epistemology for coming to appreciate the deep nature of reality and its normative implications. Given varying background ontological, epistemological, and axiological presuppositions, different moral positions and political objections will appear as not merely morally permissible but as socially and politically obligatory.     Abstract: This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. It also provides a unique approach to property, access, privacy and evidence for online records.
    Abstract: Distributed networks such as the Internet have altered the fundamental way a record is created, captured, accessed and managed over time. Law and ethics provide the major sources of regulatory controls over participants in such networks. This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet environment. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. Medical, business and governmental relationships within communities of common interest based on trust illustrate the practical application of the model. As legal relationships have their basis in the law of obligations found in common and civil law systems, as well as archival science, the model has a broad-based application. The relationship model also provides a unique ethical and legal approach to property, access, privacy and evidence. Most importantly, the book provides an interdisciplinary approach to Internet regulation, which contributes to closer ties between those who research, teach and work in fields of ethics, law and archival science.

    Abstract: "What makes an event count as an action? Typical answers appeal to the way in which the event was produced: e.g., perhaps an arm movement is an action when caused by mental states (in particular ways), but not when caused in other ways. Andrew Sneddon argues that this type of answer, which he calls ""productionism"", is methodologically and substantially mistaken. In particular, productionist answers to this question tend to be either individualistic or foundationalist, or both, without explicit defence. Instead, Sneddon offers an externalist, anti-foundationalist account of what makes an event count as an action, which he calls neo-ascriptivism, after the work of H.L.A. Hart. Specifically, Sneddon argues that our practices of attributing moral responsibility to each other are at least partly constitutive of events as actions."

    Abstract: Hermann Cohen (1842-1918) is an original systematic thinker and representative of the Marburg School of Critical Idealism. The Marburg School was a leading school in German academic philosophy and in German Jewish philosophy for a period of over thirty years preceding the first World War. Initially standing at the front of the 'Return to Kant' movement, Cohen subsequently went beyond Kant in developing a system of critical idealism in which he offered a critique of and alternative to absolute idealism, positivism, and materialism. A critical idealist in heart and soul, Cohen is also recognized as a man who embodied German Jewish culture. Publications on Cohen in the English language are small in number and this volume aims to fill the gap. It offers an analysis of Cohen's System of Philosophy - the three-volume classic on logic, ethics, and aesthetics - and his writings on Judaism and religion. The book highlights Cohen's contributions in these fields, including his discussions with Maimonides, Leibniz, Kant, and Hegel. It demonstrates the congeniality of Cohen's critical idealism as expounded in the System and his writings on Judaism, and offers an overview of contemporary Cohen research.

    Abstract: Striking toward peace and harmony the human being is ceasely torn apart in personal, social, national life by wars feuds, inequities and intimate personal conflicts for which there seems to be no respite. Does the human condition in interaction with others imply a constant adversity? Or, is this conflict owing to an interior or external factor of evil governing our attitudes and conduct toward the other person? To what criteria should I refer for appreciation, judgment, direction concerning my attitudes and my actions as they bear on the well-being of others? At the roots of these questions lies human experience which ought to be appropriately clarified before entering into speculative abstractions of the ethical theories and precepts. Literature, which in its very gist, dwells upon disentangling in multiple perspective the peripeteia of our life-experience offers us a unique field of source-material for moral and ethical investigations. Literature brings preeminently to light the Moral Sentiment which pervades our life with others -- our existence tout court.     Abstract: Liberal defences of nationalism have become prevalent since the mid-1980's. Curiously, they have largely neglected the fact that nationalism is primarily about land. Should liberals throw up their hands in despair when confronting conflicting claims stemming from incommensurable national narratives and holy texts? Should they dismiss conflicting demands that stem solely from particular cultures, religions and mythologies in favour of a supposedly neutral set of guidelines? Does history matter? Should ancient injustices interest us today? Should we care who reached the territory first and who were its prior inhabitants? Should principles of utility play a part in resolving territorial disputes? Was John Locke right to argue that the utilisation of land counts in favour of its acquisition? And should western style settlement projects work in favour or against a nation's territorial demands? When and how should principles of equality and equal distribution come into play? Territorial Rights examines the generic types of territorial claims customarily put forward by national groups as justification for their territorial demands, within the framework of what has come to be known as 'liberal nationalism'. The final outcome is a multifarious theory on the ethics of territorial boundaries that supplies a workable set of guidelines for evaluating territorial disputes from a liberal-national perspective, and offers a common ground for discussion (including disagreement) and for the mediation of claims.

    Abstract: The concept of global justice makes visible how we citizens of affluent countries are potentially implicated in the horrors so many must endure in the so-called less developed countries. Distinct conceptions of global justice differ in their specific criteria of global justice. However, they agree that the touchstone is how well our global institutional order is doing, compared to its feasible alternatives, in regard to the fundamental human interests that matter from a moral point of view. We are responsible for global regimes such as the global trading system and the rules governing military interventions. These institutional arrangements affect human beings worldwide, for instance by shaping the options and incentives of governments and corporations. Alternative paths of globalization would have differed in how much violence, oppression, and extreme poverty they engender. And global institutional reforms could greatly enhance human rights fullfillment in the future. The importance of this global justice approach reaches well beyond philosophy. It helps ordinary citizens evaluate their options and their responsibility for global institutional factors, and it challenges social scientists to address the causes of poverty and hunger that act across borders. The present volume addresses four main topics regarding global justice: The normative grounds for claims regarding the global institutional order, the substantive normative principles for a legitimate global order, the roles of legal human rights standards, and some institutional arrangements that may make the present world order less unjust. All royalties from this book have been assigned to Oxfam.
