    Abstract: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. How can the population’s creative potential best be fostered? What do software innovations have in common with the evolution of living organisms? What are the vulnerabilities of distributed creativity? Answers are sought in the processes that came into being during the early years of the digital revolution and were then forced to take a back seat as control of the means of production was increasingly placed in the hands of tech companies. The findings and insights presented here are highly relevant for today’s digital policymaking. Market concentration processes in innovation haven’t ceased; they are ongoing. And in an age where data-driven services are creating and reinforcing global oligopolies, the question posed by the U.S. Supreme Court in Google v. Oracle is now more relevant than ever: who should hold the keys to digital innovation?

    Abstract: Neo-Victorian Young Adult Narratives examines the neo-Victorian themes and motifs currently appearing in young adult fiction—specifically addressing the themes of authorship, sexuality, and criminality in the context of the Victorian age in British and American cultures. This book explicates the complicated relationship between the Victorian past and the turn to Victorian modes of thought on literature, history, and morality. Additionally, Sarah E. Maier aims to determine if the appeal of neo-Victorian young adult fiction rests in or resists nostalgia, parody, and revision. Given the overwhelming prevalence of the Victorian in the young adult genres of biofiction, juvenile writings, gothic, sensation, mystery, and crime fiction, there is much to investigate in terms of the friction between the past and the present. Sarah E. Maier is Professor of English & Comparative Literature at the University of New Brunswick.     Abstract: This book uses a comparative research design to analyze the reporting on the Jewish minority and the Muslim minority in German newspapers from 2010-2019, asking whether minorities are truly treated as equals in the reporting of the mainstream German media. After providing historical and socio-political context for both groups as minority populations in Germany, the authors make use of qualitative and quantitative methods to examine sentiment and determine whether the media demonstrates a unifying or a well-differentiated portrayal of the two groups. The findings show that reporting on these groups is not as unbiased as many in Germany believe. Drawing on frameworks including the needs-based model of reconciliation, the revised integrated threat theory, and the model of acculturation strategies, the book then discusses the implications for both journalistic reporting and broader social policies in support of a constructive encounter of dominant and non-dominant groups in a diverse society. This book will be of interest to scholars and students in the field of migration, integration and intergroup relations, as well as those in communication, media studies, and discourse analysis.     Abstract: This book explores visions of home in cinema and the ways in which women inhabit the onscreen realm. Looking closely at a range of films made between 1936 and 2013, it examines how filmmakers reconfigure studio sets and real locations through the filmmaking process into mutable onscreen domains imbued with depth, metaphor, and expressivity. The book studies the films through the lens of four filmmaking processes in particular: découpage, mise-en-scène, sound and editing. Close analysis reveals how filmmakers use these cinematic ‘building blocks’ to shape onscreen worlds charged with emotion and animated by the warp and weft of psychic life. Images of home abound in the cinema, and women frequently find themselves at the core of both structures. Drawing on recent spatial and feminist enquiry, the book reviews the idea of home as a fixed and stable location and illustrates how the art of cinema is well equipped to explore home as an imaginary as well as a material realm. With its emphasis on film practice as a route into critical reflection, this book will be of interest to filmmakers, film theorists and those who simply want to understand more about how films work.     Abstract: This handbook explores the rich and as yet understudied field of women’s writing during the nation-building years that characterized the global politics of the long nineteenth century. In the wake of the American and French Revolutions, the waning of the Spanish Empire, subsequent Latin American uprisings, and the Italian Risorgimento, nineteenth-century women writers cracked wide open the myths of gender, race, and class that had sustained the ancien régime. This volume shows that the transnational networks of women writing about politics, sexuality, economics, and the forging of the modern nation were much broader and more inclusive at a global level than has previously been understood. The handbook uniquely foregrounds French, Italian, Latin American, and Spanish women writers, focusing on the transnational nature of their relationships and cultural production within a growing body of research that casts an ever-wider net in the effort to document women’s voices. Claire Emilie Martin is Professor Emerita of Spanish at California State University, Long Beach, USA. She holds a doctorate from Yale University in Spanish American Literature. Her research focuses on nineteenth-century cultural and literary studies with a special emphasis on gender issues, domesticity, education, politics, and travel. She has published numerous articles and edited and co-edited several volumes on nineteenth-century Latin American women writers. Clorinda Donato is Professor of French and Italian at California State University, Long Beach, USA, and director of the Clorinda Donato Center for Global Romance Languages and Translation Studies. She is an eighteenth- and nineteenth-century scholar of French and Italian literature. Her most recent publication is Translation and Transfer of Knowledge in Encyclopedic Compilations, 1680–1830 co-edited with Hans-Jürgen Lüsebrink (2021). .

    Abstract: This book focuses on the role mainstream humanitarian organizations have in the functioning of the border management system on the southern European border (i.e. Italy). In particular, the author analyses the mainstream humanitarian organizations and NGOs (i.e. Red Cross, the UNHCR, Medici per I Diritti Umani – MEDU, Terre des Hommes and Oxfam) and their role within and beyond the implementation of the so-called ‘hotspot approach’ in Sicily. This work suggests that a vision of humanitarian action as just anti-political and complicit with migration control can be questioned. This book suggests that a) mainstream organizations have been able to politicize their positioning and actions vis-à-vis authorities when migration policies have been tightened; b) mainstream organizations’ political borderwork has helped to promote incremental change in the status quo rather than a radical one. Finally, this book suggests that the discourses and practices of mainstream and grassroots actors seems to be characterized by similar contradictions.     Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

    Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .

    Abstract: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

    Abstract: Can informal actors such as NGOs mediate peace agreements? If so, how does it work and what are the consequences for international peace mediation? This book tackles these questions and more through looking at the role of nongovernmental (NGO) mediators in promoting “inclusive peace” to negotiating parties in Myanmar’s Nationwide Ceasefire Agreement (NCA) negotiations from 2011-2015. The author argues that NGO mediators, traditionally seen as part of civil society or as weak mediators with little power or leverage, have become established mediation actors alongside more formal actors and are redefining the mediation field through norm promotion. However, even if NGO mediators can promote norms, the book questions whether they should promote norms in the first place, as the NCA process shows how the promotion of inclusivity contributed to a more exclusive outcome of years of peace negotiations in Myanmar. The outcome of the NCA process presents a critical and cautionary tale of promoting a presumed universal norm into a given locale and expecting a certain outcome without understanding how an external norm interacts with existing normative frameworks. This is an open access book. Julia Palmiano Federer holds a PhD in Political Science from the University of Basel and a Master in International Affairs from The Graduate Institute of International and Development Studies in Geneva, Switzerland. Dr. Palmiano Federer is a Postdoctoral Fellow at the University of Ottawa and the Head of Research at the Ottawa Dialogue, an organisation that specializes in the resolution of armed conflicts around the world through Track Two diplomacy, a form of unofficial and informal dialogue between warring parties. She is also currently a Senior Fellow at the Negotiation and Conflict Resolution Collaboratory at the Harvard Kennedy School’s Center for Public Leadership.

This book investigates why nations with rich archaeological pasts like Egypt, Greece, and Jordan gave important antiquities—often unique, rare, and highly valued monuments—to New York City, New York Institutions, and the United States from 1879 to 1965. In addition to analyzing the givers’ motivations, the author examines why New Yorkers and Americans coveted such objects. The book argues that these gifted antiquities function as archaeological ambassadors and that the objects given were instruments of cultural diplomacy. These gifts sought to advance the goals of Egypt, Greece, and Jordan—all states that had rich cultural and archaeological heritages—with the United States, once an ascendent nation and then a global superpower, to strengthen cultural, economic, and political relations. Elizabeth R. Macaulay is an Associate Professor of Liberal Studies, Classics, Middle Eastern Studies, and Digital Humanities at The Graduate Center, The City University of New York. Her research examines the intersection of antiquity and modernity. However, contemporary discrimination against Muslims is rooted in different reasons, with events like the Rushdie affair significantly impacting multicultural relations. This study analyzes the evolving multicultural landscape in Britain, exploring the shift from predominantly assimilationist policies to a more mutual process of integration. It delves into the emergence of interfaith dialogue as well as the complexities surrounding the intersection of race, religion, gender, and identity. The research examines two key themes: the discursive positioning of Islam beyond integration and terrorism narratives, and the operationalization of identity by Muslims in various contexts. The study employs empirical methods and cultural studies theories to understand how individual and social practices intersect in this context.     Abstract: This edited volume addresses the environmental and cultural underpinnings of the kind of social conflict that spawned the origins and elaboration of ritualized human and animal sacrifice in Mesoamerica. The chapters variously document the place of cultural evolution and social complexity in the origins and elaboration of ritual human sacrifice, cannibalism, and trophy-taking across a broad spectrum of Mesoamerican cultural and social contexts that first saw the light of day before 2600 BCE, and rapidly developed and proliferated across the Mesoamerican world in the centuries to follow. They study the developments in sacrifice rituals through the centuries into the first millennium CE, when the Mexica Aztec and their allies had elevated ritual human sacrifice such that they produced a plethora of sacrificial acts, modes and manners of death, and associated deities to articulate the necro-cultures and blood-tribute of the times. The chapters further study present-day rites of Amerindian communities from throughout Mesoamerica that include paying homage to the deities of earth and sky through sacrifice and consumption of animal surrogates. The interdisciplinary effort undertaken by this international cadre of scientists, including anthropologists, bioarchaeologists, art historians, ethnohistorians, iconographers, and religious studies experts provides a particularly rich forum for launching an interrogation into the role of conflict, environment, and social complexity in the emergence and persistence of ritual violence and human sacrifice in the Mesoamerican world.

    Abstract: This Open Access book presents an in-depth portrait of the use and impact of digital technologies by learners ages 5-18 years in their everyday lives.     Abstract: This open access book explores the transnational and transoceanic dimensions of the debate on gender and women's cultural agency and mediation in the long eighteenth century. It aims to decenter perspectives on traditional Enlightenment geographies, by emphasizing cultural transfers between Southern Europe and the rest of Europe, as well as with the Americas; by focusing on a variety of cultural mediators—women authors, female (and male) translators, readers, travelers, and disseminators; and by examining diverse written and visual sources—from correspondence, travel narratives, and philosophical essays, to novels, opera, portraits. Mónica Bolufer is Professor of Modern History at the University of Valencia, Spain. Other collective agents, such as corporations, need to also come onboard. Additionally, the book argues that climate change is not solely a problem for collective agents, but also for individuals, as they are members of collectives and groups of several kinds. Therefore, framing climate change responsibility exclusively from either the collective or the individual perspective leaves out something crucial: how we all are influenced by the collectives we belong to and how, in turn, collectives are influenced by individuals. The focus of the book is on areas of climate change responsibility that are often left out of the picture or get too little attention in climate ethics, such as carbon inequality within countries. But why should any theoretical arguments about normative issues matter when we have a real-life climate crisis on our hands? Säde Hormio argues that ethical arguments have an important role in setting climate policy: they can highlight what values are at stake and help ground normative arguments in public deliberations. Säde Hormio is an Academy Research Fellow in Practical Philosophy at the University of Helsinki. She is also affiliated with the Institute for Futures Studies in Stockholm.     Abstract: This collection of essays examines how close analysis of William Blake’s manuscripts can yield new discoveries about his techniques, his working habits, and his influences. With the introduction of facsimile editions and more particularly, the William Blake Archive, the largest digital repository of Blake materials online, scholars have been able to access Blake’s work in as close its original medium, leading to important insights into Blake’s creative process and mythopoetic system. Recent advancements in digital editing and reproduction has further increased interest in Blake’s manuscripts. This volume brings together both established Blake scholars, including G.E. Bentley Jnr’s final essay on Blake, and upcoming scholars whose research is at the intersection of digital humanities, critical theory, textual scholarship, queer theory, transgender studies, reception history, and bibliographical studies. The chapters seek to cover the breadth of Blake’s manuscripts: poetry, letters, notebook entries, and annotations. Together, these chapters offer an overview of the current state of research in Blake studies on manuscripts at a point when his manuscripts have become increasingly available in digital environments, and gesture to a possible future of Blake scholarship in general.

    Abstract: This volume explores the role of violence generally but with specific reference to African concepts and themes, and the significance they have for social redress. The contributors interpret African concepts and themes to include accounts of violence, explicitly or implicitly construed from indigenous axiological resources like Ubuntu or personhood and from those works that are not African in origin but have become central in African moral, political and legal thought, such as Hannah Arendt’s On Violence and Walter Benjamin’s Critique of Violence. The volume contributes to moral philosophy, social philosophy, African philosophy, and political philosophy/theory. It situates itself within the Global South, specifically the African perspective, to explore, articulate, and defend (or even critique) African conceptions of violence.     Abstract: Humanism in business is not only an alternative to economism but a way to human excellence. Humanism presented here revolves around the rich notion of “human person”, keystone of modern personalist philosophy and Catholic Social Teaching. From this perspective this book is offered to everyone, believer and nonbeliever alike. The person-centered humanism considers the human-wholeness, individual and relational, with subjectivity, self-determination, openness to transcendence, and with capacity not only to possess but also to give. It also highlights the uniqueness of each person, endowed with a high constitutive dignity and in continuous process of flourishing toward human plenitude. An attitude of respect and good will is due to non-personal beings, while persons deserve to be treated with justice and even with love of benevolence. The book is prepared in dialogue with mainstream of thought in business and business ethics and focused on exploring ways to improve some conventional views. It includes some proposals such as a person-based ethics, ethics understood as intrinsic to business activity, the consideration of the company as an organized community of persons, and the purpose of the company oriented toward the common good through a double mission, internal and external.     Abstract: This open access book provides the first comprehensive review of the state of the art of social tipping points applied to energy systems from a social interdisciplinary perspective. It does so by presenting a novel theory of systemic and transformative change, linking it to empirical cases assisted with relevant assessment methodologies, including modeling. The authors unveil the narratives and visions, the transformative capacities as well as deliberate strategies and collective actions that at one point in time have been able - or were prevented - to tip a given social-ecological system towards low-carbon, sustainable trajectories in diverse high-intensive carbon regions around the world. This volume shows that self-reinforcing learning feedbacks connecting transformative solutions and strategies across scales and domains can be induced by targeted policy interventions both in local and regional contexts. It further indicates how changes in behavioral patterns, supported by good governance of disruptive technologies, carbon (dis)investment and finance processes as well as new forms of civic engagement, can create the necessary transformative enabling conditions for the emergence of positive tipping points towards low-carbon sustainable futures.     Abstract: This book makes a major contribution to the continuing legal and historical struggle for equal pay in Australia, with international references, including Canada, the UK and US.     Abstract: The study of childhood in historical archaeology enriches interpretations of the past, but also has the potential for contributing to the understanding of methodological and theoretical issues in archaeology. Archaeologically, children are understudied relative to both their demographic and social importance, partly because children are viewed as difficult to discern in the archaeological record. Historical archaeology, with its access to historical documents to supplement and illuminate archaeological evidence, provides an opportunity to gain a greater understanding of the ways children's daily lives in the past were expressed in historically changing types and patterns of material culture. Recent research presented in this volume contributes valuable perspectives for conceptualizing the historically changing social nature of childhood and methods for illuminating the roles of children. Case studies are designed to illustrate methodological and theoretical advances in the historical archaeology of materialized experiences, discourses, identities, places and their meanings associated with parenting and childhood. The volume is organized into three sections devoted to case studies about 1) how childhood and parenting have been socially constructed cross culturally and temporally, 2) social ideologies of childhood in contested spaces, and 3) the relationship between children's experiences and adult expectations of childhood. Each chapter demonstrates advances in current methods or theories used in the archaeology of childhood. A final discussant, drawn from the broader field of research on the archaeology of childhood, provides a commentary on the ways the perspectives provided in the volume can be employed by researchers outside the sub-discipline of historical archaeology. .
