Doris Liebscher geht der Frage historisch, rassismustheoretisch und rechtsdogmatisch auf den Grund. Sie rekonstruiert, wie der Begriff ins Grundgesetz kam, und untersucht, wie Gerichte und Rechtswissenschaft heute das auf »Rasse« bezogene Diskriminierungsverbot aus Artikel 3 GG auslegen.     Abstract: "Based on legal-philosophical research informed by insights gleaned from empirical case studies, this book sets out three central claims about integration requirements as conditions for attaining increased rights (ie family migration, permanent residency and citizenship) in Europe: (1) That the recent proliferation of these (mandatory) integration requirements is rooted in a shift towards 'individualised' conceptions of integration. (2) That this shift is, on the one side, counterproductive as it puts barriers to participation and inclusion of newcomers (who will most likely permanently settle) and on the other, normatively problematic, insofar as it produces status hierarchies between native-born and immigrant citizens. (3) That the remedy for this situation is a firewall that disconnects integration policy from access to rights. The book draws on perspectives on immigrant integration in multiple EU Member States and includes legal and political reactions to the refugee/migrant crisis"--

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency. Despite the burgeoning recognition of the broader similarities between Roma and African Americans, including the systems that facilitate their marginalization and the barriers to their representation, no book-length work has sustained these comparisons"--

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. In this work, we do of course build on earlier discussions and investigations of solidarity"--

    Abstract: Die Studie skizziert Ibn Rušds einzigartigen rechtsphilosophischen Ansatz, das islamische Recht zu flexibilisieren und es mitten im Leben der Muslime zu verorten. Sein Ansatz erlaubt eine neue Perspektive im Diskurs um die Aktualisierung des islamischen Rechtsund um die Suche nach der „Islamizität“ von Normen. Am Beispiel des Verbots des Wucherzinses geht die Studie dem Ansatz Ibn Rušds nach und vergleicht sie mit diversen Lösungsansätzen aus der muslimischen Rechtsgelehrsamkeit. Für diesen Zweck wurde die Einleitung und das Kapitel zum Wucherzins in seinem Rechtswerk Bidāyat al-muǧtahid übersetzt und kommentiert, seine Herangehensweise analysiert und die von ihm konsultierten Quellen ausfindig gemacht.
    Abstract: This study portrays the unique philosophical approach of Ibn Rushd to systematising Islamic law flexibly in order to solve the problems Muslims experience in daily life. His approach allows for a new perspective in the discourse on how to update Islamic law for contemporary times and how norms are qualified as being Islamic. Taking the prohibition of usury as an example, this study scrutinises Ibn Rushd’s approach and compares it with others from Muslim legal scholarship. For this purpose, the introduction and the chapter on usury in his juristic work Bidāyat al-mujtahid have been translated and commented on, with his approach analysed and the sources that he consulted identified.

    Abstract: "This book investigates how effective human rights and the inherent dignity of refugees can be secured in situations of protracted exile and encampment. The book deploys an innovative human rights-based capabilities approach to address fundamental questions relating to law, power, governance, responsibility and accountability in refugee camps. Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert.     Abstract: Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world?

    Abstract: "Children make up half of the world's refugees and over 40 per cent of the world's asylum seekers. Yet, children are largely invisible in historical and contemporary refugee law. Furthermore, there has been very limited interaction between the burgeoning children's rights framework, in particular the Convention on the Rights of the Child (CRC), and the 1951 Convention relating to the Status of Refugees (Refugee Convention). This book explores the possibility of a children's rights approach to the interpretation of the Refugee Convention and within that what such an approach might look like. In order to construct a children's rights approach, the conceptualisations of children outside the legal discipline, within international children's rights law and then within refugee law and refugee discourse are analysed. The approach taken is socio-legal and comparative in nature and the suitability of the Refugee Convention as a framework for the interpretation of child claims is examined. The book analyses to what extent the Refugee Convention is capable of dealing with claims from children based on the modern conceptualisation of children which is underscored by two competing ideologies - the child as a vulnerable object in law to be protected and the child as subject with rights and the capacity to exercise their agency. The influence each regime has had on the other is also analysed. The work discusses how a children's rights approach might improve outcomes for child applicants. The book makes an original contribution to child refugee discourse and as such will be an invaluable resource for academics, researchers and policy-makers working in the areas of migration and asylum law, children's rights, and international human rights law' --

    Abstract: The contributors of the volume analyse the effect of the ECHR and international human rights on the national and European legal order from different angles. Special emphasis is given on the Union’s accession to the ECHR and the scrutiny of ECJ’s opinion 2/13. The impact of the human rights provisions of the accession agreement with Ukraine is shown besides some more general issues of human rights protection in national jurisdictions, namely Germany, Poland, Slovenia and Turkey for providing a comparative overview of the various challenges countries with different backgrounds face in the implementation of human rights, including social human rights. All authors are academics working in the field of human right protection and the aim is to provide the reader with a better understanding of the challenges of international human rights protection.

    Abstract: Das Flüchtlingsrecht ist als Verfolgungschutzrecht dazu konzipiert, künftig drohenden Menschenrechtsverletzungen vorzubeugen. Gleichwohl dominiert in der Praxis und Literatur bisweilen der Blick in die Vergangenheit. Besonders prominent ist dies in Fällen sogenannter Nachfluchtgründe zu beobachten, also in Konstellationen, in denen erst im Aufnahmeland Umstände begründet werden, die eine Verfolgungsgefahr entstehen lassen. Gerade wenn die drohende Verfolgung auf Handlungen der Migranten zurückzuführen ist, bleibt der Vorwurf des „Missbrauchs" nicht fern. Ausgehend vom Völker- und Europarecht legt Benjamin Karras dar, dass flüchtlingsrechtlich relevant einzig die zu erwartende Reaktion des Verfolgers und nicht die Aktion des (potenziell) Verfolgten ist. Anhand des historisch und aktuell bedeutsamen Anwendungsfalles der religiösen Konversion wird demonstriert, wie diese Vorhaben verwaltungsprozessual zur Geltung kommen können.

    Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

    Abstract: The EU is currently facing some fundamental challenges: the euro and refugee crises are still unresolved, the solidarity between Member States is eroding, and nationalist forces are growing as support for European integration is diminishing.
