    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: Die beiden „Ölschocks" von 1973/74 und 1979/80 waren nicht nur zentrale wirtschaftliche Ereignisse, sondern übten entscheidenden Einfluss auf die zeitgenössischen Debatten um eine grundlegende Reform, wenn nicht gar Revolution, der Weltwirtschaftsordnung aus. Das vorliegende Buch untersucht die Ölkrisen erstmals nicht allein mit Blick auf die Industriestaaten der nördlichen Hemisphäre, sondern fragt gleichberechtigt nach ihren Folgen für die Staaten des Globalen Südens. Die Studie argumentiert, dass die Ölkrisen der OPEC die notwendigen Machtmittel in die Hand gaben, um die Forderung nach einer Neuen Weltwirtschaftsordnung 1974 erfolgreich auf einen Spitzenplatz der internationalen Agenda zu setzen. Gleichzeitig führte die Belastung der Ökonomien zahlreicher „Entwicklungsländer" durch die massiven Ölpreissteigerungen jedoch mittelfristig zum Auseinanderbrechen der Solidarität der Dritten Welt und damit zum faktischen Ende des Reformprogramms in den frühen 1980er Jahren. Auf der Basis von Quellen aus Archiven in Afrika, Amerika, Asien und Europa ergänzt das Buch die existierenden auf Europa zentrierten Studien zur Geschichte der Nord-Süd-Beziehungen, der Ölkrisen und der 1970er Jahre im Allgemeinen.

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: Social mobility is the hope of economic development and the mantra of a good society. There are disagreements about what constitutes social mobility, but there is broad agreement that people should have roughly equal chances of success regardless of their economic status at birth. Concerns about rising inequality have engendered a renewed interest in social mobility—especially in the developing world. However, efforts to construct the databases and meet the standards required for conventional analyses of social mobility are at a preliminary stage and need to be complemented by innovative, conceptual, and methodological advances. If forms of mobility have slowed in the West, then we might be entering an age of rigid stratification with defined boundaries between the always-haves and the never-haves—which does not augur well for social stability. Social mobility research is ongoing, with substantive findings in different disciplines—typically with researchers in isolation from each other. A key contribution of this book is the pulling together of the emerging streams of knowledge. Generating policy-relevant knowledge is a principal concern. Three basic questions frame the study of diverse aspects of social mobility in the book. How to assess the extent of social mobility in a given development context when the datasets by conventional measurement techniques are unavailable? How to identify drivers and inhibitors of social mobility in particular developing country contexts?     Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

    Abstract: Unternehmenskaufverträge ersetzen die gesetzlichen weitgehend durch kautelarjuristische Regelungen. M&A-Streitigkeiten werden sehr häufig vor privaten Schiedsgerichten verhandelt. Diese Privatisierung von Recht und Rechtsprechung hat Konsequenzen für die Rechtsanwendung und -fortbildung. Die Beiträge dieses Sammelbandes behandeln die damit verbundenen aktuellen Probleme und Grundsatzfragen. Eingegangen wird etwa auf die Wechselwirkungen zwischen Schieds- und staatlicher Gerichtsbarkeit sowie das anwendbare Recht und den Schiedsstandort, aber auch auf die Auswirkungen auf das materielle Recht des Unternehmenskaufs wie Kaufpreisregelungen, Haftung aus vorvertraglichen Schuldverhältnissen oder Störungen der Geschäftsgrundlage.     Abstract: Mit dem Anstieg der Lebenserwartung in Europa geht ein Wandel der Erwerbs- und Lebensverläufe einher, die durch Brüche und Wechsel der beruflichen Tätigkeiten geprägt sind. Ein zentrales Anliegen ist daher, jedem die Teilhabe am Erwerbsleben über den gesamten Lebensverlauf zu ermöglichen und zugleich soziale Rechte durch angemessenen sozialen Schutz zu gewährleisten. Mit juristischen, sozialpolitischen und empirischen Analysen widmet sich dieses Buch dem Zusammenspiel verschiedener Sozialschutzmechanismen und ihren Schwierigkeiten, sich den neuen Entwicklungen anzupassen. Es präsentiert die Impulse europäischer Instanzen und die Antworten verschiedener europäischer Staaten auf die Herausforderung, Flexibilisierung der Beschäftigung und Modernisierung der Sozialschutzsysteme in Einklang zu bringen. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection. By means of legal, socio-political and empirical analyses this book embarks on the interrelationship of different social protection mechanisms and the resulting difficulties of adapting to these new employment patterns. It presents European impulses and the reactions of several European states to the challenge of reconciling flexibility of employment and modernisation of social protection. L’augmentation de l’espérance de vie en Europe suscite un changement des modes de parcours professionnels et de vie constitués de ruptures et de conversions d’activité. L’une des préoccupations est de permettre à chacun de poursuivre une activité professionnelle tout au long de sa vie tout en pouvant bénéficier d’une protection sociale adaptée. A travers des analyses juridiques, socio-politiques et empiriques, cet ouvrage aborde les interférences et les difficultés d’adaptation des mécanismes de protection sociale aux nouvelles évolutions.     Abstract: Recent years have seen unprecedented public scrutiny over the tax practices of Multinational Enterprise (MNE) groups. Tax policy and administration concerning international transactions, aggressive tax planning, and tax avoidance have become an issue of extensive national and international debate in developed and developing countries alike. Within this context, transfer pricing, historically a subject of limited specialist interest, has attained name recognition amongst a broader global audience that is concerned with equitable fiscal policy and sustainable development. Abusive transfer pricing practices are considered to pose major risk to the direct tax base of many countries and developing countries are particularly vulnerable because corporate tax tends to account for a larger share of their revenue. This handbook is part of the wider WBG engagement in supporting countries with Domestic Resource Mobilization (DRM) by protecting their tax base and aims to cover all relevant aspects that have to be considered when introducing or strengthening transfer pricing regimes. The handbook provides guidance on analytical steps that can be taken to understand a country's potential exposure to inappropriate transfer pricing (transfer mispricing) and outlines the main areas that require attention in the design and implementation of transfer pricing regimes. A discussion of relevant aspects of the legislative process, including the formulation of a transfer pricing policy, and the role and content of administrative guidance, is combined with the presentation of country examples on the practical application and implementation of the arm's length principle and on running an effective transfer pricing audit program. Recognizing the importance of transfer pricing regulation and administration for the business environment and investor confidence, this handbook aims to balance the general objective of protecting a country's tax base and raising additional revenue with investment climate considerations wherever appropriate

    Abstract: This edited volume offers a multidisciplinary perspective on innovation challenges and innovative practices in the context of developing and transition countries. The contributions mostly embrace a national innovation system approach in an attempt to understand innovation processes and their implications at both macro and micro levels. The chapters in this book, taken as a whole, offer insights on a range of issues grouped around the following questions: - What are the challenges for innovation at the macro (system) and micro (firm) level according to the experiences of developing and transition countries? - What is the role of public policies in the transformation of national innovation systems? - What innovation practices allow to successfully overcome challenges to innovation? - What is the role of collaboration and learning in fostering innovation? A variety of methods are presented including historical analysis, participatory action research, case studies, document analysis and survey-based quantitative research as well as triangulation to study innovation and adaptation strategies in developing and transition countries. It also provides 10 case studies selected from developing and transition countries, to offer a detailed and comprehensive perspective on innovation and innovation practices at macro and micro levels.     Abstract: Tobias Haas beschäftigt sich mit der umkämpften Entwicklung hin zu einem regenerativen Stromsystem bzw. dem Ausbau erneuerbarer Energien in der EU mit Schwerpunkt auf Deutschland und Spanien seit den 2000er Jahren. Aus einer politökonomischen Perspektive analysiert er die divergierenden energiepolitischen Entwicklungspfade beider Länder, in denen zunächst ein rasanter Zubau an erneuerbaren Energien im Strombereich stattgefunden hatte. Die größere Kontinuität der Energiewende in Deutschland erklärt der Autor mit dem Einfluss der Finanz- und Wirtschaftskrise in Verbindung mit Dynamiken ungleicher Entwicklung in der EU sowie der Beschaffenheit der Zivilgesellschaften und der staatlichen Institutionengefüge. Er argumentiert, dass in allen drei Fällen (EU, Deutschland, Spanien) die Dynamiken des Wandels ausgebremst wurden und viel zu kurz greifen, um einen raschen Umstieg auf eine nachhaltige Energieversorgung zu gewährleisten.     Abstract: The fundamental goal of competition law is to support productivity and innovativeness; in fact, the short-term effect of enforcement actions is often a reduction in product prices. This comprehensive book reports the findings of consumer market studies into a range of goods and services in developing countries in Africa, Asia and Latin America. These country case studies demonstrate the important role that competition authorities can have in assessing the nature of markets and making recommendations to policymakers to improve them. When competition is weak or compromised, extra costs are imposed on consumers. The authors investigate this issue for a wide range of key markets serving consumers individually or collectively, looking also at the hinterland of the distribution chain behind retail sales. They find a pervasive lack of competition in those markets, which not only softens a firms' incentive to improve the efficiency of their operations and the quality of their products, but also reduces the standard of living of consumers, including poor and vulnerable groups.     Abstract: Some climate change is now inevitable and strategies to adapt to these changes are quickly developing. The question is particularly paramount for low-income countries, which are likely to be most affected. This timely and unique book takes an integrated look at the twin challenges of climate change and development. The book treats adaptation to climate change as an issue of climate-resilient development, rather than as a bespoke set of activities (flood defences, drought plans, and so on), combining climate and development challenges into a single strategy. It asks how the standard approaches to development need to change, and what socio-economic trends and urbanisation mean for the vulnerability of developing countries to climate risks. Combining conceptual thinking with practical policy prescriptions and experience the contributors argue that, to address these questions, climate risk has to be embedded fully into wider development strategies. This point of view is gaining in prominence in the development community; however, the contributors assert that a comprehensive analytical treatment is so far lacking.     Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: Equal is not Enough? is the title of a series of conferences that has aimed, over the years, to generate a better understanding of what shapes and reshapes inequalities by inviting and promoting multi-disciplinary insights and reflection. One of the conferences focused on discrimination law. The conveners welcomed papers on the relationship between social policy and discrimination law (or closely related human rights issues), which investigate the tensions and (in)compatibilities between the respective aims and tools of social policy and discrimination law.     Abstract: The site of industrial struggle is shifting. The West needs to look further if it wants to understand how workers' self-organization is developing in countries it too often ignores. Across the Global South, peasant communities are forced off the land to live and work in harsh and impoverished conditions. Inevitably, new methods of combating the spread of industrial capitalism are evolving in ambitious, militant and creative ways. Southern Insurgency will lead the way in examining these organizations in the contemporary era. Immanuel Ness looks at three key countries: China, India and South Africa. In each case he considers the broader historical forces at play -- the effects of imperialism, the decline of the trade union movement, the class struggle and the effects of the growing reserve army of labor. For each case study, he narrows his focus to reveal the specifics of each grassroots insurgency: the militancy of the miners in South Africa, the new labor organizations in India and export promotion and the rise of worker insurgency in China. A result of intensive, dedicated firsthand research, at the heart of Southern Insurgency is a study of the nature of the new industrial proletariat in the Global South - a terrifying, precarious existence - but also one of experimentation, solidarity and struggle. -- Provided by publisher
