    Abstract: Das Rückkaufhandelsverbot gemäß § 34 Abs. 4 GewO ist zuletzt vermehrt in den Fokus der Gerichte geraten. Das hängt mit Klagen von Verbrauchern zusammen, die bei Liquiditätsengpässen entsprechende Geschäftsmodelle beanspruchten und sich benachteiligt fühlten. Oft handelt es sich um sogenannte „Sale-and-rent-back“-Verträge. Philip Raillon beleuchtet das Verhältnis des Rückkaufhandelsverbots zum Pfandleih- und Kreditwesen. Er ordnet die Verbotsnorm verwaltungs-, zivil-, verfassungs- sowie europarechtlich ein. Der Autor setzt sich kritisch mit bisherigen Urteilen auseinander und entwickelt eine von der BGH-Ansicht abweichende Normanwendung. Anhand dieser überprüft er konkrete Praxisbeispiele. Im Ergebnis stellt der Verfasser einen unzureichenden Verbraucherschutz fest. Er entwickelt einen Reformvorschlag, mit dem Lücken im Schutzgehalt geschlossen würden. Der Autor Philip Raillon absolvierte sein Studium der Rechtswissenschaften an der Ruhr-Universität Bochum und der Universität Warschau. Nach seinem ersten Examen am OLG Hamm begann er seine Promotion am Lehrstuhl für Öffentliches Recht von Prof. Dr. Jörg Ennuschat. Die Dissertation stellte er während seines Referendariats am Landgericht Bochum fertig. Seit dem Studium arbeitet Philip Raillon als crossmedialer Reporter für den Westdeutschen Rundfunk. Dennoch ist der deutschen Prozessordnung bislang eine Regelung fremd, welche die Reichweite parteilicher Mitwirkung für den deutschen Zivilprozess einheitlich vorgibt. Alisa Lenk befasst sich mit der entscheidenden Frage, ob die Anerkennung einer allgemeinen prozessualen Aufklärungspflicht mit den Grundsätzen eines liberal verstandenen Verfahrensmodells zu vereinbaren ist. Die Autorin entkräftet den oft behaupteten Konflikt zwischen Parteiherrschaft und Aufklärungspflicht im deutschen Zivilprozess und nimmt die Thematik hierzu auch aus einer rechtsvergleichenden Perspektive mit einer Untersuchung des französischen und U.S.-amerikanischen Zivilverfahrens in den Blick.     Abstract: Mit dem Gesetz zur Modernisierung des Besteuerungsverfahrens stellte der Gesetzgeber die Weichen für einen grundlegenden Wandel der Amtsermittlung hin zu einer digitalisierten Sachverhaltsermittlung im Besteuerungsverfahren. Der Autor widmet sich diesem grundlegenden Paradigmenwechsel aus verfassungsrechtlicher Sicht und untersucht dabei eingehend die Auswirkungen auf die Wahrung der Gesetz- und Gleichmäßigkeit der Besteuerung sowie auf etwaige Freiheitsgrundrechte und die Gewährung von Rechtsschutz. Er stellt hierfür die Relevanz einer korrekten Sachverhaltsfeststellung für die Verwirklichung von Gleich- und Gesetzmäßigkeit heraus, kommt aber auch zu dem Schluss, dass die konkreten Vollzugsbedingungen eine gezielte Sachverhaltsermittlung erforderlich machen. Den Einsatz von Risikomanagementsystemen zur Steuerung der Sachverhaltsfeststellung unterzieht der Autor einer umfangreichen Bewertung und gelangt dabei zu dem Schluss, dass die gesetzlichen Regelungen in Teilen den Anforderungen des Vorbehalts des Gesetzes nicht genügen, und auch die konkrete Anwendung kritisch zu sehen sei, da zu befürchten sei, dass es zu einer pauschalen Anwendung des Steuerrechts komme, welche sich vom materiellen Recht in Teilen löse. Der Autor definiert deswegen verfassungsrechtliche Rahmenbedingungen, welche eingehalten werden müssen, um zu einer verfassungsgemäßen digitalisierten Sachverhaltsermittlung zu gelangen.     Abstract: Dieses Open-Access-Buch behandelt umfassend die rechtlichen Grundlagen der im Jahr 2017 eingeführten Echtzeitüberweisung (SEPA Instant Payment). Der Autor stellt wiederholt Inkonsistenzen zwischen dem europarechtlich harmonisierten Zahlungsverkehrsrecht und dem maßgeblichen Interbankenabkommen heraus und zeigt an diesen Stellen bereits detailliert neue Lösungen auf Grundlage des gegenwärtigen Rechts auf. In einem weiteren Schwerpunkt wird die Rolle der Echtzeitüberweisung in der Digitalisierung der Bankenbranche, insbesondere im Verhältnis zum Bargeld und zu weiteren Bezahldiensten wie PayPal, erörtert. De lege ferenda schlägt der Autor größere Anpassungen im Fristenregime und die Einführung eines Chargeback-Systems, wie es aus der Kreditkartenzahlung bekannt ist, in konkreter Ausgestaltung vor. Die Anregungen im rechtspolitischen Teil des Werks zielen auf einen Einklang der sich ergänzenden Rechtsquellen sowie eine Erhöhung der Attraktivität der Echtzeitüberweisung in der Praxis ab. Der Autor Dr. Marius Rakers ist als Rechtsanwalt in einer multidisziplinären Wirtschaftskanzlei aus Steuerberatern, Wirtschaftsprüfern und Rechtsanwälten tätig und berät Unternehmen in den Bereichen Handels- und Gesellschaftsrecht, Steuerrecht sowie Bankrecht.     Abstract: This Open-Access-book questions the relationship between institutionalized images and understandings of policing – the monolithic ideas common to most, if not all, Western law enforcement agencies – and contextual, situative, and local interactions where the human representatives of policing – street-level officers – come into contact with residents. The political and theoretical association of specific forms of “Western” policing with democratic society can be illustrated in the case of German integration: narratives of reform and essentially forging new democratic police agencies in the “new German states” stand at odds with much of the experience and statements of officers who continued to serve following (Re)Unification. Officers who present their works primarily in terms of their local responsibilities, expectations and more specifically to their unique and individual relationship and connection to their communities downplay the relevance of high-level policing policy. Based on a two-year ethnographic study of policing in a rural county in the German state of Brandenburg, this book explores the local nature of policing both in terms of how police officers imagine their communities to be and with reference to broader societal expectations and assumptions of what police, essentially, are, can effectively do, and should effectively do. About the author Aaron Bielejewski is a research associate at the Centre for Criminological Research Saxony. He studies cultural and interactionist aspects of police work and prison.

    Abstract: Das deutsche Politikfeld der Inneren Sicherheit unterliegt seit den 1990er Jahren einem erhöhten Anpassungs- und Optimierungsdruck. Bestehende Studien konstatieren dabei vor allem eine Tendenz zur Stärkung der Bundesebene sowie zur Einschränkung der Länderautonomie. Auf den ersten Blick liegt damit der Eindruck nahe, dass sich das ursprünglich länderautonom organisierte Politikfeld der Inneren Sicherheit auf einem Pfad zur Unitarisierung befindet, welcher häufig als eine dem deutschen Föderalismus inhärente Entwicklungslogik gesehen wird. Der politikwissenschaftliche Ertrag zur Thematik erweist sich bislang gleichwohl als defizitär. Um einen Beitrag zum besseren Verständnis föderaler Systeme im Allgemeinen sowie des deutschen Sicherheitsföderalismus im Speziellen zu leisten, werden anhand ausgewählter Fallbeispiele aus den Bereichen Polizei, Verfassungsschutz und Kriminalpolitik die Entwicklungslinien des deutschen Föderalismus seit den 1990er Jahren analysiert. Im Zentrum stehen dabei folgende Fragestellungen: Inwiefern lässt sich für das Politikfeld Innere Sicherheit tatsächlich von einer Tendenz zur Unitarisierung sprechen? Worin liegen die Ursachen für diese Tendenz begründet? Welche Effekte ergeben sich hieraus für die Leistungsfähigkeit des deutschen Föderalismus im Bereich der Inneren Sicherheit? Der Autor Luis Illan arbeitete am Lehrstuhl für Vergleichende Politikwissenschaft (Schwerpunkt Westeuropa) der Universität Regensburg. Seit 2022 ist er als Fachreferent für eine Körperschaft des öffentlichen Rechts tätig.

    Abstract: Was bringt Online-Bürgerbeteiligung und was macht sie bei Klimaschutz und Energiewende erfolgreich? Dieses Buch zeigt auf, dass Bürgerbeteiligung zur besseren Handhabung von komplexen und umstrittenen Problemen (Wicked Problems) beitragen kann: Klimaschutz und Energiewende sind solche Probleme, die einen offenen, konstruktiven und aufeinander bezogenen Austausch erfordern, der die vielgestaltigen Wissenshintergründe, Betrachtungsweisen und Interessen zusammenbringt. Strittig ist, ob Online-Formate einen solchen deliberativen Austausch fördern oder vielmehr erschweren. Eine theoretisch-konzeptionelle Antwort liefern verwaltungswissenschaftliche Ansätze der New Public Governance. Sie heben die Vorteile von Partizipation hervor und stehen im Einklang mit IT-basierten Steuerungsformen. Ein multitheoretischer, wertebasierter Evaluationsansatz differenziert Erfolgskriterien und -faktoren. Deutlich wird, dass Klimaschutz und Energiewende eine enorme gesamtgesellschaftliche Gestaltungsaufgabe darstellen. Ein deliberativer Online-Austausch ist (bislang) zwar kaum erkennbar. Jedoch zeigen sich facettenreiche Beiträge zur erfolgreichen Bürgerbeteiligung auch in Online-Formaten. Bei ihrer zunehmenden Bedeutung lohnt es sich umso mehr, ihren möglichen Erfolg kritisch zu begleiten. Der Autor Manuel Misgeld ist ehemaliger Forschungsreferent und fokussiert neben dem Thema E-Leadership auf eine Online-Bürgerbeteiligung, die er in seiner Doktorarbeit an der Universität Speyer verwaltungswissenschaftlich betrachtet.

    Abstract: Gegenstand dieses Buches ist die Zurechnung des Wissens der Aufsichtsratsmitglieder einer deutschen AG. Hierbei handelt es sich um eine für die Praxis äußerst aktuelle Problematik, die dem komplexen und in der Rechtswissenschaft hoch umstrittenen Gebiet der Wissenszurechnung bei juristischen Personen angehört. Da die Thematik rund um das Wissen des Aufsichtsrats nicht ohne ein Grundverständnis der Wissenszurechnung im Ganzen analysiert werden kann, arbeitet der Autor zunächst die Entwicklungen dieses Rechtsinstituts auf und geht dabei insbesondere auf ungeklärte Aspekte ein, die an späterer Stelle für den Aufsichtsrat von Bedeutung sind. Hierauf folgt eine Untersuchung aller rechtlichen und tatsächlichen Entwicklungen des Aufsichtsorgans in den letzten Jahrzehnten, die für die Wissenszurechnung relevant sind und deren Berücksichtigung in der Literatur bislang ausblieb.     Abstract: Sowohl junge Alevit:innen als auch junge Sunnit:innen sind in Deutschland aufgrund eines vorwiegend negativen Images des Islams herausgefordert, sich bezüglich ihrer muslimischen oder vermeintlich muslimischen Identität zu positionieren.     Abstract: Der Schutz „wirtschaftlich-virtueller“ Gesellschafter rückte wegen verschiedener Urteile, die im Zusammenhang mit der Dotierung gemäß § 340g HGB (Fonds für allgemeine Bankrisiken) ergangen sind, in den Fokus der Verfasserin. Zentrales Problem der Gläubiger der Gesellschaften war die Vereitelung ihrer erfolgsbezogenen Vergütungs- und Rückzahlungsansprüche durch missbräuchliches Ausschöpfen der von Gesetzes wegen eingeräumten Handlungsspielräume. Zur Abstrahierung dieser Problematik wird nicht nur der Sammelbegriff der „wirtschaftlich-virtuellen“ Gesellschafter für die betroffenen Gläubiger eingeführt, sondern gleichsam eine Untersuchung verschiedener Umgehungsmöglichkeiten bei unterschiedlichen Gesellschaftsformen angestellt. Die Arbeit untersucht daher mögliche risikobehaftete Maßnahmen an der Schnittstelle von Schuld- und Gesellschaftsrecht, den bisher bestehenden vertraglichen sowie materiellrechtlichen Schutz und bietet Lösungen auf prozessualer Ebene an. Die Autorin Ann-Kathrin Jungen arbeitet seit Januar 2023 als Rechtsanwältin in einer Wirtschaftskanzlei im Bereich Corporate/ M&A in Köln. Nach ihrem Studium der Rechtswissenschaften an der Rheinischen Friedrich-Wilhelms-Universität Bonn und der Université Paris Sud wurde sie unter Betreuung von Frau Prof. Dr. Dr. h.c. Dauner-Lieb im Januar 2023 an der Universität zu Köln promoviert.
