    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Genocide addresses these tensions and tests the limits of the concept in cases ranging from the role of sexual violence during the Holocaust and state-induced mass starvation in Kazakh and Ukrainian history to what the Armenian, Rwandan, and Burundi experiences reveal about the uses and pitfalls of reading history and conducting politics through the lens of genocide. Contributors examine the pressures that great powers have exerted in shaping the concept; the reaction Raphaël Lemkin, originator of the word "genocide," had to the United Nations’ final resolution on the subject; France’s long-held choice not to use the concept of genocide in its courtrooms; the role of transformative social projects and use of genocide memory in politics; and the relation of genocide to mass violence targeting specific groups.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

Die Algorithmen entscheiden für uns oder bereiten Entscheidungen vor, doch sie sind indiskret, fehlerbehaftet (wie menschliches Handeln), ungerecht und gaukeln eine Sicherheit vor, die sie nur bedingt geben können. Die Autorin referiert die z.T. bekannten Beispiele. Vieles grenze, vor allem in der sogenannten KI, die sie lieber eine erweiterte Computerstatistik nennen wolle, an "Zauberei", vor allem dann, wenn nicht mehr erklärt werden könne, wie die Ergebnisse zustande kämen. Die Kernfrage bleibe also, wie sehr wir den Algorithmen trauen und sie als Autorität in unserem/über unser Leben anerkennen. Man muss nicht zum Cyborg werden, aber ein vernünftiges und rationales Miteinander von menschlichen und algorithmisierten Verfahren sei ein anstrebenswertes Ziel. Sehr gut zu lesen, gut neben z.B. K. Mainzer, C. O'Neil, M. Tegmark

The series particularly aims to publish scholarly legal writing that brings fresh perspectives to bear on new and existing areas of law taught in universities. A contextual approach involves treating legal subjects broadly, using materials from other social sciences, and from any other discipline that helps to explain the operation in practice of the subject under discussion. It is hoped that this orientation is at once more stimulating and more realistic than the bare exposition of legal rules. The series includes original books that have a different emphasis from traditional legal textbooks, while maintaining the same high standards of scholarship. They are written primarily for undergraduate and graduate students of law and of other disciplines, but will also appeal to a wider readership.     Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century.     Abstract: Ferdinand Tönnies, der mit seinem Werk „Gemeinschaft und Gesellschaft" von 1887 überwiegend als Soziologe und Philosoph wahrgenommen wird, hat sich schon recht früh mit staatswissenschaftlichen Problemen beschäftigt. Dabei kommt für Tönnies dem Staat nur eine instrumentale Rolle zu. Damit rückt er weit ab von den Traditionen des Kulturliberalismus im Kaiserreich. Im Gegensatz zur liberalen Demokratie erkennt Tönnies eine Fokussierung auf eine soziale Demokratie: Eine Entwicklung zum „Staat der Sozialreform". Er spricht dem Staat die Legitimation ab, als sittliche Macht im Hegelschen Sinne aufzutreten. Der Staat ist für Tönnies unlösbar mit der Gesellschaft verbunden. Es gibt keine innere Distanz, die ihm eine eigenständige externe Rolle gegenüber der Gesellschaft ermöglichen würde. Er ist vielmehr eine Art Wesensausdruck aller Grundzüge des sozialen Lebens unter den Bedingungen der vom Kürwillen beherrschten Gesellschaft. Er ist dem Interessenkampf von Menschen und Gruppen ausgeliefert, die sich gegenseitig als Mittel ansehen müssen nach Maßgabe des Kalküls des Eigeninteresses und der Gewinnmaximierung.     Abstract: "One of the most vexing problems in the theory and practice of politics is the issue of difference. How do we build a just and stable polity in the face of identity differences that have historically been the basis for inequality, injustice, and violence? Such differences can take a variety of forms, including religious difference, race and ethnicity, language difference, urban/rural tensions, and gender. In many countries, divisions such as these are the fault lines that threaten the stability of the social and legal order. This book addresses the role of constitutions and constitutionalism in dealing with the challenge of difference. In the spring of 2011, a conference held at Indiana University brought together a distinguished group of lawyers, political scientists, historians, religious studies scholars, and area studies experts to consider how constitutions and constitutionalism address issues of difference across a wide swath of the world we called "Pan-Asia." Pan-Asia runs from the Middle East, through Central Asia, South Asia, Southeast Asia, East Asia, and into Oceania. This is a meta-region across which ideas and influences have traveled for centuries. It is also an area of the world that includes every type of difference in abundant supply. Pan-Asia, therefore, provides a wonderful laboratory for examining the role of constitutions in addressing difference. The existing literatures, while rich in other ways, do not speak directly to this issue of constitutions as a mechanism for addressing difference.     Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen..

    Abstract: Der Verschriftlichungsprozeß des Rechts gehört zu den tiefgreifendsten zivilisatorischen Veränderungen des europäischen Mittelalters. In einer über Jahrhunderte auf der Autorität des mündlichen Verfahrens ruhenden Rechtskultur signalisiert die Ausbildung schriftlicher Rechtstraditionen einen entscheidenden Wandel sozialer, politischer und kultureller Prozesse. Diesen Umbruch im deutschsprachigen Raum zwischen 1200 und 1300 sichtbar zu machen, ist Gegenstand des vorliegenden E-Books. Nach einer Übersicht über die deutsche Rechtsprosa des 13. Jahrhunderts werden am Beispiel des urbarialen Schriftguts, also den Güter-, Zins- und Lehnsverzeichnissen, sowie den nieder- und oberdeutschen Rechtsspiegeln, dem 'Sachsenspiegel' Eikes von Repgow und dem sog. 'Schwabenspiegel’ die Anfänge einer neuen schriftgestützten Rechtstradition im Kontext medien- wie sozialgeschichtlicher Fragestellungen untersucht.

    Abstract: From the 6th to 11th centuries, the prohibition of marriage between relatives (incest) often headed the agenda of legislative assemblies and can be seen as a key topic of this age. The reasons for this unique development have occupied ethnologists, sociologists and historians for quite some time. This book is the first to trace the radical expansion of marriage prohibitions across epochs and advances the thesis that this development came about as a result of the decline of power in Antiquity and the changing functions of legislation.     Abstract: Das Verbot von Verwandtenehen (Inzest) stand vom 6. bis ins 11. Jahrhundert im Mittelpunkt der Gesetzgebung. Kaiser und Könige, Bischöfe und Päpste erließen immer wieder neue Regelungen zum Inzestdelikt und stellten diese Bestimmungen häufig an die Spitze von Gesetzestexten und Kodifikationen. Die Reichweite der verbotenen Verwandten wurde dabei stetig ausgedehnt. Im 11. Jahrhundert war es kaum möglich, Ehen zu schließen, die nicht aufgrund des Inzestverbots angefochten werden konnten. Die Sorge um die Gültigkeit von Eheschließungen beschäftigte insbesondere den Adel, da mit der Illegitimität der Kinder der soziale Status auf das Spiel gesetzt wurde.Über dieses einzigartige Phänomen wird in der historischen, ethnologischen und soziologischen Forschung eine intensive Diskussion geführt. Dieses Buch zeichnet die radikale Ausdehnung der Ehehindernisse erstmals epochenübergreifend und transkulturell nach. Es wird die These aufgestellt, dass die Entstehungsbedingungen dieser „Obsession“ im Funktionswandel von Gesetzgebung und in den Reaktionen von Königen, Kaisern und Bischöfen auf den Verlust antiker Staatlichkeit zu suchen sind. Die ausgedehnten Inzestverbote sollten die Etablierung überregionaler Heiratsmärkte herbeiführen und dadurch der Integration von Großreichen dienen.
