    Abstract: Since at least the Reformation, English men and women have been engaged in visiting, exploring and portraying, in words and images, the landscape of their nation. The Invention of the English Landscape examines these journeys and investigations to explore how the natural and historic English landscape was reconfigured to become a widely enjoyed cultural and leisure resource.Peter Borsay considers the manifold forces behind this transformation, such as the rise of consumer culture, the media, industrial and transport revolutions, the Enlightenment, Romanticism, and the Gothic revival. In doing so, he reveals the development of a powerful bond between landscape and natural identity, against the backdrop of social and political change from the early modern period to the start of the Second World War. Borsay s interdisciplinary approach demonstrates how human understandings of the natural world shaped the geography of England, and uncovers a wealth of valuable material, from novels and poems to paintings, that expose historical understandings of the landscape. This innovative approach illuminates how the English countryside and historic buildings became cultural icons behind which the nation was rallied during war-time, and explores the emergence of a post-war heritage industry that is now a definitive part of British cultural life

    Abstract: "Katherine Storm Hindley explores words at their most powerful: words that people expected would physically change the world. Medieval Europeans often resorted to the use of spoken or written charms to ensure health or fend off danger. Here Hindley draws on an unprecedented archive, based on her own extensive research, and the result is an original sampling of more than a thousand charms from medieval England, more than twice the number gathered, transcribed, and edited in previous studies, including many texts still unknown to specialists on this topic. Focusing on charms from the so-called fallow period (1100-1350) of English history, and on previously unremarked texts in Latin, Anglo-Norman, French, and English, Hindley addresses important questions about how people thought about language, belief, and power, while also injecting a bit of fun into the mix. She describes 700 years of the dynamic, shifting cultural landscape, where multiple languages, invented alphabets, and modes of transmission gained and lost their protective and healing power. Where previous scholarship has bemoaned a lack of continuity in the English charm tradition, Hindley finds surprising links between languages and eras, all without losing sight of the extraordinary variety of the medieval charm tradition: a continuous, deeply rooted part of the English Middle Ages. Textual Magic will be important reading for historians and manuscript studies scholars, and for students from various disciplines in medieval English culture wanting to learn about the many weird and wonderful types and uses of charms during this period.     Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered.     Abstract: "In PHOTOGRAPHIC RETURNS Shawn Smith sets out to examine works of contemporary art, only to find that many of the works refer back to the past, to photography's many intersections with the history of racial justice in the U.S. Smith focuses on flashpoints in that history -- spanning from the abolitionist movement, to the Civil War, lynching, and mass incarceration-- to mark the roles that photography has played in documenting the exigencies of Black life, and as a tool for resisting those racial regimes. For each of these moments, Smith shows how contemporary photographers utilize their medium as a way to recall, revise, or amplify the relationship between racial politics in the past and in the present. She argues that the tendency of African-American photographers and other artists to return to the archive of early photography does not simply point to the usefulness of early photography as document of the past, but to the recursive nature of photography itself. Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top.     Abstract: In Photographic Returns Shawn Michelle Smith traces how historical moments of racial crisis come to be known photographically and how the past continues to inhabit, punctuate, and transform the present through the photographic medium in contemporary art. Smith engages photographs by Rashid Johnson, Sally Mann, Deborah Luster, Lorna Simpson, Jason Lazarus, Carrie Mae Weems, Taryn Simon, and Dawoud Bey, among others. Each of these artists turns to the past—whether by using nineteenth-century techniques to produce images or by re-creating iconic historic photographs—as a way to use history to negotiate the present and to call attention to the unfinished political project of racial justice in the United States. By interrogating their use of photography to recall, revise, and amplify the relationship between racial politics of the past and present, Smith locates a temporal recursivity that is intrinsic to photography, in which images return to haunt the viewer and prompt reflection on the present and an imagination of a more just future.

    Abstract: Argues that the slave narrative is a new world literary genre. In Runaway Genres, Yogita Goyal tracks the emergence of slavery as the defining template through which current forms of human rights abuses are understood. The post-black satire of Paul Beatty and Mat Johnson, modern slave narratives from Sudan to Sierra Leone, and the new Afropolitan diaspora of writers like Teju Cole and Chimamanda Ngozi Adichie all are woven into Goyal's argument for the slave narrative as a new world literary genre, exploring the full complexity of this new ethical globalism. From the humanitarian spectacles of Kony 2012 and #BringBackOurGirls through gothic literature, Runaway Genres unravels, for instance, how and why the African child soldier has now appeared as the afterlife of the Atlantic slave.Goyal argues that in order to fathom forms of freedom and bondage today-from unlawful detention to sex trafficking to the refugee crisis to genocide we must turn to contemporary literature, which reveals how the literary forms used to tell these stories derive from the antebellum genre of the slave narrative. Exploring the ethics and aesthetics of globalism, the book presents alternative conceptions of human rights, showing that the revival and proliferation of slave narratives offers not just an occasion to revisit the Atlantic past, but also for re-narrating the global present. In reassessing these legacies and their ongoing relation to race and the human, Runaway Genres creates a new map with which to navigate contemporary black diaspora literature.

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent.     Abstract: "Moving beyond the preoccupation of honour and its associations with violence and sexual reputation, Courtney Thomas offers an intriguing investigation of honour's social meanings amongst early modern elites in sixteenth- and seventeenth-century England. If I Lose Mine Honour I Lose Myself reveals honour's complex role as a representational strategy amongst the aristocracy. Thomas' erudite and detailed investigation of multi-generational family papers as well as legal records and prescriptive sources develops a fuller picture of how the concept of honour was employed, often in contradictory ways in daily life. Whether considering economic matters, marriage arrangements, supervision of servants, household management, mediation, or political engagement, Thomas argues that while honour was invoked as a structuring principle of social life its meanings were diffuse and varied. Paradoxically, it is the malleability of honour that made it such an enduring social value with very real meaning for early modern men and women."--

    Abstract: Male Friendship and Testimonies of Love in Shakespeare’s England reveals the complex and unfamiliar forms of friendship that existed between men in the late sixteenth century. Using the unpublished letter archive of the Elizabethan spy Anthony Bacon (1558-1601), it shows how Bacon negotiated a path through life that relied on the support of his friends, rather than the advantages and status that came with marriage. Through a set of case-studies focusing on the Inns of Court, the prison, the aristocratic great house and the spiritual connection between young and ardent Protestants, this book argues that the ‘friendship spaces’ of early modern England permitted the expression of male same-sex intimacy to a greater extent than has previously been acknowledged. .

    Abstract: "The Making of English Popular Culture provides an account of the making of popular culture in the nineteenth century. While a form of what we might describe as popular culture existed before this period, John Storey has assembled a collection that demonstrates how what we now think of as popular culture first emerged as a result of the enormous changes that accompanied the industrial revolution. Particularly significant are the technological changes that made the production of new forms of culture possible and the concentration of people in urban areas that created significant audiences for this new culture.     Abstract: "Indians Illustrated is a social and cultural history of Indian illustrations in Frank Leslie's Illustrated Newspaper, Harper's Weekly, and other illustrated journals during the last half of the nineteenth century, the heyday of the American pictorial press. The pictorial press era, spurred in the mid-1850s by the transportation revolution, innovations in printing technology, and an expanded literary and pictorial market, was marked by a proliferation of detailed, realistic woodblock engravings, pictures of newsworthy people and interesting events from across the nation and the world. The pictorial press frequently depicted Indians and Indian life in popular but narrowly conceived ways. In pictures, Indians were simplified and presented in familiar and easily understood categories, usually as variations on the 'good' Indian/'bad' Indian stereotypes long established in Euro-American culture. Indian men were depicted as 'tall and copper-colored, with braided hair, clothed in buckskin, and moccasins, and adorned in headdresses, beadwork and/or turquoise' while Indian women were depicted as either Indian princesses or squaws. John Coward argues that these pictures helped create and sustain a host of popular ideas and attitudes about Indians, especially ideas about the way Indians were supposed to look and act. By describing and analyzing the various themes and visual tropes across the years of the illustrated press, this book provides a deeper understanding of the racial codes and visual signs that white Americans used to represent Native Americans in an era of western expansion and Manifest Destiny"--Provided by publisher

Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: "Around the turn of the nineteenth century Robinson Crusoe turns up remarkably often in material dealing with the emerging Australian colonies. The call to adventure and do-it-yourself guide to settlement in Daniel Defoe's novel resonated strongly with British explorers and settlers. But Crusoe did not make men restless: restlessness was the expression of unresolved tensions in men's lives between ideals, aspirations, traditions and material circumstances, the tension between what men felt they should do and what was actually possible. Crusoe seemingly reconciled these tensions, showing that a man could be both wild and domesticated. Karen Downing traces the links in a discursive chain by which a particular male subjectivity was forged. Through the rarely studied interrelationship between public representations of manliness and self-representations by men in more private writings, she reveals how restless men took their restlessness with them, so that the Australian colonies never were a solution to men's anxieties"--

    Abstract: "The sectional conflict over slavery in the United States was not only a clash between labor systems and political ideologies but also a viscerally felt part of the lives of antebellum Americans. This book contributes to the growing field of emotions history by exploring how specific emotions shaped Americans' perceptions of, and responses to, the sectional conflict in order to explain why it culminated in disunion and war. Emotions from indignation to jealousy were inextricably embedded in antebellum understandings of morality, citizenship, and political affiliation. Their arousal in the context of political debates encouraged Northerners and Southerners alike to identify with antagonistic sectional communities and to view the conflicts between them as worth fighting over. Michael E. Woods synthesizes two schools of thought on Civil War causation: the fundamentalist, which foregrounds deep-rooted economic, cultural, and political conflict, and the revisionist, which stresses contingency, individual agency, and collective passion"--

    Abstract: This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly

    Abstract: The 20th century saw an unprecedented number of major wars, conflicts, and massive human rights violations. From each emerged the desire to make sense of the recent past (and present) by imagining new ways of dealing with such events. In order to prevent new forms of violence, or to punish the persons responsible of past horrors, various solutions have been imagined, deployed, implemented, and discussed, at different levels. This book is a reflection on the social and historical construction, appropriation, and circulation of categories, norms, and savoir-faire related to the ways social groups and institutions-state, judiciary, professional organizations-confront traumatic events. Even if there is a robust literature on purges and other mechanisms intended to deal with an authoritarian or violent past, written by authors belonging to numerous disciplines and exploring different periods and topics with a variety of theoretical and methodological backgrounds, our goal was to propose a more sociologically oriented model of analysis. Far from being only an intellectual frenzy, this orientation appears to be less normative than most “post-transitional” approaches and potentially more general than strictly monographic approaches. In doing so, our objective is not only to provide a critical approach, but also to sustain a more realistic view of this highly political and moral domain
