    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: The history of Europe in the 20th century is closely tied to the history of urban planning. Social and economic progress but also the brute treatment of people and nature throughout Europe were possible due to the use of urban planning and the other levels of spatial planning. Thereby, planning has constituted itself in Europe as an international subject. Since its emergence, through intense exchange but also competition, despite country differences, planning has developed as a European field of practice and scientific discipline. Planning is here much more than the addition of individual histories; however, historiography has treated this history very selective regarding geography and content. This book searches for an understanding of the historiography of planning in a European dimension. Scholars from Eastern and Western, Southern and Northern Europe address the issues of the public led production of city and the social functions of urban planning in capitalist and state-socialist countries. The examined examples include Poland and USSR, Czech Republic and Slovakia, UK, Netherlands, Germany, France, Portugal and Spain, Italy, and Sweden. Yet, the history of East-West encounters is riddled with prominent examples of misunderstandings, ignorance, unrealistic expectations or unbridgeable cultural differences. This collection contains several insights and lessons learnt for scholars as well as practitioners of policing.” —Marleen Easton, Professor and head of the research group 'Governing and Policing Security' (GaPS) at the Department of Public Governance and Management at Ghent University, Belgium This book critically examines how countries across Europe have dealt with the COVID crisis from a policing and security perspective. Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

They are analytically combined in an integrative framework starting from a core insight: in its approach to multilingualism, Europe is pursuing two equally worthy, but non-converging goals, namely, the mobility of citizens across national boundaries (and hence across languages and cultures) and the preservation of Europe's diversity, which presupposes that each local nurtures its linguistic and cultural uniqueness, and has the means to include newcomers in its specific linguistic and cultural environment. In this book, scholars from economics, the education sciences, finance, geography, history, law, political science, philosophy, psychology, sociolinguistics, sociology and translation studies (all mentioned here in alphabetical order) apply their specific approaches to this common challenge. Without compromising anything of the state-of-the-art analysis proposed in each individual chapter, particular attention is devoted to ensuring the cross-disciplinary accessibility of concepts and methods, making this book the most deeply interdisciplinary volume on language policy and planning published to date"--

    Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically. The first part puts forward economics as the approach to better comprehend the couple's expectations of marriage. It focuses on explaining the economic rationale behind marriage, underlining its contractual nature, and demonstrating that common legal remedies as well as several mandatory and default rules in modern marriage law indeed have an economic foundation. The second part is devoted entirely to the conflict of laws dimension of marriage. The book will therefore be of interest to scholars and lawmakers attempting to launch reforms anywhere or looking for a practical and novel application of economics in the analysis of the law.

    Abstract: L’identité européenne, fruit d’une volonté politique dès le Traité de Rome en 1957, devient chaque jour une réalité vécue qui s’impose aux consciences, aux États, aux traditions, au passé. La multiplication des échanges institutionnels et personnels au sein de la Communauté Européenne qui s’agrandit d’année en année implique l’existence et l’usage d’une ou plusieurs langues de vaste diffusion. À défaut d’une « langue universelle » qui rallierait tous les suffrages le plurilinguisme semble être la solution raisonnable et tout Européen aura l’obligation, le devoir même de maîtriser outre sa propre langue, une ou deux langues de la Communauté. La « politique des langues » doit retenir l’attention de tous, hommes politiques, enseignants, simples citoyens, si l’on veut que la question des langues ne deviennent pas un facteur de division mais qu’elle contribue à la construction de l’Europe. Cet ouvrage, issu du Symposium International de Nancy et enrichi d’apports complémentaires, apporte des éléments de réponse et des voies de réflexion à cette problématique qui concerne autant les enseignants et les parents que les décideurs politiques et les acteurs sociaux. Les contributions présentées dans cet ouvrage illustrent les préoccupations et les réflexions des spécialistes en Sciences du Langage à la fois chercheurs et praticiens ; elles s’ordonnent autour de quatre grands thèmes : – un état des lieux : les langues sur le terrain et dans les institutions ; – un contenu pratique : la formation linguistique « les jeunes européens ; – une proposition nécessaire : la planification linguistique ; – des perspectives d’avenir : le cheminement vers line identité européenne à travers les langues de l’Europe.

    Abstract: Schon vor 50 Jahren kämpfte Afrika um seine Kunst, die während der Kolonialzeit massenweise in europäische Museen gelangt war. Und es fand durchaus Unterstützung im Westen. Am Ende jedoch war der Kampf nicht nur vergebens, er wurde auch erfolgreich vergessen gemacht. Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute. Schließlich verlief alles im Sand. „Gebt koloniale Raubkunst zurück! Dafür engagiert sich Bénédicte Savoy. In ihrem Buch zeigt die Kunsthistorikerin nun, dass ihr Kampf ein alter ist. Schon in den 1960er-Jahren drängten die neu gegründeten Staaten Afrikas auf eine Rückführung – erfolglos.
