    Kurzfassung: Supply chain disruptions, related to natural events or geopolitical tensions, have in recent years prompted policy makers to identify potential vulnerabilities related to critical trade dependencies. These are commercial links that could potentially impose significant economic or societal harm, be a source of coercion, a risk to national security, or disrupt strategic activities. Using three complementary methodologies — detailed trade data analysis, input-output data techniques, and computable general equilibrium (CGE) modelling — this paper examines the nature and evolution of trade dependencies between the OECD countries and major non-OECD economies (MNOE). It shows that global production has become increasingly concentrated at the product level, with China representing 15% of import dependencies in strategic products for OECD countries in 2020-21 compared to 4% in 1997-99. The methodologies used in this paper unanimously demonstrate a high degree of trade interdependency between OECD and MNOE countries. The current debate on “de-risking” international trade, therefore, needs to carefully consider the possible costs and benefits of different policy choices.

    Kurzfassung: New evidence is presented on the evolution of global value chains (GVCs) since the Great Financial Crisis. Drawing on novel OECD inter-country input-output tables in previous year’s prices, it shows there was no general trend towards deglobalisation in the period up to 2020. The fragmentation of production remained at a historically high level in 2019 and close to the level of 2011, confirming a stabilisation of the depth of global economic integration. Different trends are observed across economies: in the European Union, the import intensity of production grew before the COVID-19 pandemic, while China increasingly relied on domestic inputs. To explain these trends, bilateral trade costs are estimated and their cumulative impact along value chains is then calculated; structural changes and higher uncertainty seem to be the main drivers of increasing cumulative trade costs for some GVCs. To preserve the benefits of GVCs, policy makers should seek to increase the ease of trade and reduce uncertainty.

Russia’s war of aggression against Ukraine has added a new dimension of challenges as it has led to deliberate radical interruptions of trade linkages between Russia, Ukraine and many industrialised economies, with significant repercussions on prices of key commodities in the energy and agricultural sectors.

    Kurzfassung: This paper examines whether the customs valuation systems and rules of origin are sufficiently attuned to the changing landscape of commercial realities characterised by new and diverse configurations of goods-services trade. It proposes a framework to categorise relevant configurations of goods-services trade and applies it to identify potential challenges arising from the current procedures for customs valuation and origin determination. While the existing rules provide an adequate structure for doing business and achieving legitimate trade policy objectives, challenges can arise across different configurations of goods-services trade. Options for policy solutions include developing guidelines and implementation standards to fine-tune customs valuation and rules of origin that apply to specific goods-services trade configurations. The promotion of multilateral openness, harmonisation of rules and practices, and transparency of jurisprudence would contribute to minimising the impact and frequency of potential challenges.

    Kurzfassung: How prevalent are services sold together with goods? Using aggregate and micro-data, this report assesses this prevalence so as to gain a better understanding of how firms combine goods and services in their exports. Leaving aside the specific case of distribution services, 'Other business services', 'Construction' and 'Research and development' are the most common services supplied by manufacturing firms. With respect to industries, 'paper and printing', as well as 'repair and installation' come first in terms of prevalence of bundles of goods and services. Since the trade regime is different for trade in goods and trade in services, manufacturing firms engaged in servitisation strategies may face higher trade barriers just by expanding their activities in sectors that are less open to trade. When negotiating trade agreements, policy makers need to take into account complementarities between goods and services, and look at the joint restrictiveness for goods and services.

    Kurzfassung: Intangible capital, a broad category of knowledge-based assets that lack physical embodiment, increasingly shapes the distribution of income in global value chains (GVCs). While some intangible assets are reported in national accounts (e.g. R&D or computer software and databases), others are hard to detect in conventional statistics (e.g. brand value or organisational capital). In this paper, we combine information on factor income from national accounts with the OECD Inter-Country Input-Output tables in order to estimate returns to measured (i.e. included in national accounts) and ‘unmeasured’ intangible capital (captured as a residual) in GVCs. We find that total intangible capital accounts for about 27% of income in manufacturing GVCs and that this share has increased between 2005 and 2015 in OECD countries. The paper highlights differences across GVC stages and specific types of GVCs. A significant share of income is captured at the distribution stage, particularly in buyer-driven value chains. An econometric analysis suggests that trade and investment openness are important determinants of patterns in returns to intangible capital in GVCs. Direct public funding of R&D and the quality of intellectual property protection are associated with higher returns to intangible assets.

    Kurzfassung: Global value chains (GVCs) have sharpened the interdependencies between trade and foreign direct investment (FDI). Using a novel micro-level dataset covering about 27 000 corporate relationships of 147 multinational enterprises (MNEs) in 13 sectors, new evidence is provided on how firms organise their production globally by combining trade with investment, and on a range of non-equity, contract-based partnerships. The analysis leads to five stylised facts. First, MNE activities are a combination of trade, FDI and strategic partnerships. All firms rely on a mix of these different types of corporate relationships. Second, the configuration of trade, investment and strategic partnerships varies across sectors, firms and markets. The results highlight considerable firm-level heterogeneity within the same industry and across the different modes of entry. Third, investment performs various functions in GVCs. In addition to traditional forms of FDI such as “market-seeking” or “input-seeking”, investment “in capabilities” or “conglomerate” FDI also account for a relevant share of equity-based relationships. Fourth, support business functions emerge as key building blocks in GVCs, which suggests that policy reforms in transversal services sectors that support all GVCs should merit special attention. Fifth, GVCs display a clear geographical organisation. While domestic corporate relationships may lead to higher volumes of activities, in terms of the number of relationships MNEs have more partners abroad. Moreover, the large majority of GVC interactions take place within OECD countries. Overall, the complex and heterogeneous interlinkages observed in modern firm strategies highlight the importance of ensuring a level playing field for both trade and investment.

    Kurzfassung: Using the OECD analytical AMNE database, this paper provides new evidence on the services activities of multinational enterprises (MNEs) and discusses the relationship between cross-border trade in services and the production of services through foreign affiliates (“mode 3” trade in services in the General Agreement on Trade in Services). An econometric analysis indicates that policies restricting trade in services (as captured in the OECD Services Trade Restrictiveness Index) are associated with a lower output of foreign affiliates not only in services industries but also in the manufacturing sector. Moreover, services trade restrictions also impact the choice of firms when it comes to engaging in exports or in foreign direct investment to serve foreign markets. Overall, the results in this paper demonstrate the intertwined nature of manufacturing and services activities in global value chains.

    Kurzfassung: This paper looks at market access and national treatment commitments for services in the General Agreement on Trade in Services (GATS) and in 95 regional trade agreements (RTAs) involving the countries that are covered in the OECD Services Trade Restrictiveness Index (STRI). The objective is to quantify the impact of legal bindings on trade in services that result from a reduction in the uncertainty faced by exporters. Bilateral bindings indices are created for five broad service sectors (professional services, computer services, telecoms, financial services and transport services). They indicate how close the sector is from a fully bound regime with no possibility to introduce any new trade barrier, by comparing commitments with the actual trade regime. These bilateral indices are then tested over the period 2000-2014 in a structural gravity model. Despite differences across sectors, the results confirm that the legal bindings typically found in services trade agreements tend to have a positive impact on exports even if no actual liberalisation takes place.

    Kurzfassung: The field of emergency management is broad, complex and dynamic. In the post-Fukushima context, emergency preparedness and response (EPR) in the nuclear sector is more than ever being seen as part of a broader framework. The OECD has recommended that its members “establish and promote a comprehensive, allhazards and transboundary approach to country risk governance to serve as the foundation for enhancing national resilience and responsiveness”. In order to achieve such an all-hazards approach to emergency management, a major step in the process will be to consider experiences from the emergency management of hazards emanating from a variety of sectors. The NEA Working Party on Nuclear Emergency Matters (WPNEM) joined forces with the OECD Working Group on Chemical Accidents (WGCA), the OECD Public Governance and Territorial Development Directorate’s High-Level Risk Forum (HLRF) and the European Commission’s Joint Research Centre (JRC) to collaborate on this report, which demonstrates similarities between emergency planning and preparedness across sectors, and identifies lessons learnt and good practices in diverse areas for the benefit of the international community. A set of expert contributions, enriched with a broad range of national experiences, are presented in the report to take into account expertise gathered from the emergency management of hazards other than those emanating from the nuclear sector in an effort to support and foster an all-hazards approach to EPR.

    Kurzfassung: This report provides new evidence on the role of services in global value chains (GVCs). With the release of the Trade in Value Added database, it was highlighted that services account for a larger share of world trade than suggested by traditional statistics. But this evidence does not tell the whole story about services in GVCs. In addition to services bought as inputs, there are also services activities within manufacturing firms. Moreover, manufacturing companies increasingly produce and export services either as complements or substitutes to the goods they sell. This shift to services is related to strategies aiming at adding more value and creating a long-term relationship with customers. The report highlights that services inputs, whether domestic or foreign, account for about 37% of the value of manufacturing exports in the sample of countries covered. By adding service activities within manufacturing firms, this share increases to 53% and the overall contribution of services to exports is close to two-thirds. Across countries, between 25% and 60% of employment in manufacturing firms is found in service support functions such as R&D, engineering, transport, logistics, distribution, marketing, sales, after-sale services, IT, management and back-office support. SMEs are also part of this “servicification” and contribute to exports of services bundled with goods.

    Kurzfassung: Within global value chains (GVCs), services and manufacturing activities are intertwined. This report further investigates the role played by services in GVCs by looking at patterns of specialisation in 23 services industries over the period 2000-2014. Relying on the concept of revealed comparative advantage, it highlights that all countries have a comparative advantage in specific services industries, either in services within manufacturing value chains or in services exported as final products to consumers. A value-added approach is important to analyse the specialisation in services. In addition, there are tangible productivity gains out of this specialisation, as well as gains in terms of employment. Finally, empirical results suggest that services trade restrictiveness negatively affects bilateral flows of service value-added within GVCs. Both domestic reforms and the reduction of barriers in partner countries can benefit services sectors and the activities that rely on services inputs.

    Kurzfassung: The Fukushima Daiichi nuclear power plant accident has had an impact on the development of nuclear power around the world. While the accident was followed by thorough technical assessments of the safety of all operating nuclear power plants, and a general increase in safety requirements has been observed worldwide, national policy responses have been more varied. These responses have ranged from countries phasing out or accelerating decisions to phase out nuclear energy to countries reducing their reliance on nuclear power or on the contrary continuing to pursue or expand their nuclear power programmes. This study examines changes to policies, and plans and attempts to distinguish the impact of the Fukushima Daiichi accident from other factors that have affected policymaking in relation to nuclear energy, in particular electricity market economics, financing challenges and competition from other sources (gas, coal and renewables). It also examines changes over time to long-term, quantitative country projections, which reveal interesting trends on the possible role of nuclear energy in future energy systems.

The report draws on CPD member organisations’ experiences and practices related to recycling and reuse, which were gathered through an international survey. It provides information on improvements and changes in technologies, methodologies and regulations since the 1996 report on this subject, with the conclusions and recommendations taking into account 20 years of additional experience that will be useful for current and future practitioners. Case studies are provided to illustrate significant points of interest, for example in relation to scrap metals, concrete and soil.

    Kurzfassung: The cost estimation process of decommissioning nuclear facilities has continued to evolve in recent years, with a general trend towards demonstrating greater levels of detail in the estimate and more explicit consideration of uncertainties, the latter of which may have an impact on decommissioning project costs. The 2012 report on the International Structure for Decommissioning Costing (ISDC) of Nuclear Installations, a joint recommendation by the Nuclear Energy Agency (NEA), the International Atomic Energy Agency (IAEA) and the European Commission, proposes a standardised structure of cost items for decommissioning projects that can be used either directly for the production of cost estimates or for mapping of cost items for benchmarking purposes. The ISDC, however, provides only limited guidance on the treatment of uncertainty when preparing cost estimates. Addressing Uncertainties in Cost Estimates for Decommissioning Nuclear Facilities, prepared jointly by the NEA and IAEA, is intended to complement the ISDC, assisting cost estimators and reviewers in systematically addressing uncertainties in decommissioning cost estimates. Based on experiences gained in participating countries and projects, the report describes how uncertainty and risks can be analysed and incorporated in decommissioning cost estimates, while presenting the outcomes in a transparent manner.

    Kurzfassung: This work addresses the role of global value chains (GVCs), workforce skills, ICT, innovation and industry structure in explaining employment levels of routine and non-routine occupations. The analysis encompasses 28 OECD countries over the period 2000-2011. It relies on a new country-specific measure of routine intensity built using individual-level information from the OECD Programme for the International Assessment of Adult Competencies (PIAAC) survey, as well as on new industry-level Trade in Value Added (TiVA) indicators of offshoring and domestic outsourcing. The results suggest that employment in all types of occupations positively relate to innovation. With respect to offshoring patterns, a positive correlation is observed between the offshoring of inputs and domestic outsourcing with more routine-intensive jobs. Taken together, the results point to the existence of complex interactions between the routine content of occupations, skills, technology and trade, which do not allow for a neat identification of “winners” and “losers” in a GVC context.

    Kurzfassung: This work proposes a novel measure of the routine content of occupations, called the Routine Intensity Indicator (RII), built on data from the OECD Programme for the International Assessment of Adult Competencies (PIAAC) survey. The RII uses information about the extent to which workers can modify the sequence of their tasks and decide the type of tasks to be performed on the job. Based on median RII values of individuals in 3-digit occupations across 20 OECD countries, jobs are grouped into quartiles of routine-intensity. On average, in 2012, 46% of employed persons worked in non-routine (18%) or low (28%) routine intensive occupations, with the distribution differing significantly across countries. The relationship between the routine content of occupations and the skills of the workforce is also investigated. While a negative correlation does emerge between skill content and routine intensity – i.e. more routine-intensive occupations tend to be associated with lower skills – this relationship is not necessarily very strong.

    Kurzfassung: The Nuclear Energy Agency carried out an independent peer review of Japan’s siting process and criteria for the geological disposal of high-level radioactive waste in May 2016. The review concluded that Japan’s site screening process is generally in accordance with international practices. As the goal of the siting process is to locate a site – that is both appropriate and accepted by the community – to host a geological disposal facility for high-level radioactive waste, the international review team emphasises in this report the importance of maintaining an open dialogue and interaction between the regulator, the implementer and the public. Dialogue should begin in the early phases and continue throughout the siting process. The international review team also underlines the importance of taking into account feasibility aspects when selecting a site for preliminary investigations, but suggests that it would be inappropriate to set detailed scientific criteria for nationwide screening at this stage. The team has provided extensive advisory remarks in the report as opportunities for improvement, including the recommendation to use clear and consistent terminology in defining the site screening criteria as it is a critical factor in a successful siting process.

It is important to understand the costs of decommissioning projects in order to develop realistic cost estimates as early as possible based on preliminary decommissioning plans, but also to develop funding mechanisms to ensure that future decommissioning expenses can be adequately covered. Sound financial provisions need to be accumulated early on to reduce the potential risk for residual, unfunded liabilities and the burden on future generations, while ensuring environmental protection. Decommissioning planning can be subject to considerable uncertainties, particularly in relation to potential changes in financial markets, in energy policies or in the conditions and requirements for decommissioning individual nuclear installations, and such uncertainties need to be reflected in regularly updated cost estimates. This booklet offers a useful overview of the relevant aspects of financing the decommissioning of nuclear facilities. It provides information on cost estimation for decommissioning, as well as details about funding mechanisms and the management of funds based on current practice in NEA member countries.

    Kurzfassung: Radioactive waste inventory data are an important element in the development of a national radioactive waste management programme since these data affect the design and selection of the ultimate disposal methods. Inventory data are generally presented as an amount of radioactive waste under various waste classes, according to the waste classification scheme developed and adopted by the country or national programme in question. Various waste classification schemes have thus evolved in most countries, and these schemes classify radioactive waste according to its origin, to criteria related to the protection of workers or to the physical, chemical and radiological properties of the waste and the planned disposal method(s). The diversity in classification schemes across countries has restricted the possibility of comparing waste inventories and led to difficulties in interpreting waste management practices, both nationally and internationally. To help improve this situation, the Nuclear Energy Agency proposed to develop a methodology that would ensure consistency of national radioactive waste inventory data when presenting them in a common scheme. This report provides such a methodology and presenting scheme for spent nuclear fuel and for waste arising from reprocessing. The extension of the methodology and presenting scheme to other types of radioactive waste and corresponding management strategies is envisaged in a second phase.

    Kurzfassung: Recent interest in small modular reactors (SMRs) is being driven by a desire to reduce the total capital costs associated with nuclear power plants and to provide power to small grid systems. According to estimates available today, if all the competitive advantages of SMRs were realised, including serial production, optimised supply chains and smaller financing costs, SMRs could be expected to have lower absolute and specific (per-kWe) construction costs than large reactors. Although the economic parameters of SMRs are not yet fully determined, a potential market exists for this technology, particularly in energy mixes with large shares of renewables. This report assesses the size of the market for SMRs that are currently being developed and that have the potential to broaden the ways of deploying nuclear power in different parts of the world. The study focuses on light water SMRs that are expected to be constructed in the coming decades and that strongly rely on serial, factory-based production of reactor modules. In a high-case scenario, up to 21 GWe of SMRs could be added globally by 2035, representing approximately 3% of total installed nuclear capacity.

The indices are calculated for 40 countries, the 34 OECD members and Brazil, the People’s Republic of China, India, Indonesia, the Russian Federation and South Africa. The STRIs capture de jure restrictions. This report presents the first vintage of indicators for logistics services and captures regulations in force in 2014. The scores range from 0.08 to 1 for cargo-handling services, 0.04 to 1 for storage and warehouse services, 0.02 to 0.58 for freight transport agency services and 0.03 to 1 for customs brokerage services. It is observed that the regulatory profile differs across countries. In cargo-handling and storage and warehouse services, one country reserves all services provision to a statutory monopoly while another country reserves cargo-handling to a monopoly at port. Freight transport agency has the lowest average score among four subsectors while restrictions on foreign entry, restrictions on the movement of people and regulatory transparency significantly contribute to the results. One country is completely closed to foreign participation in customs brokerage services. The paper presents the list of measures included in the indices, the scoring and weighting system for calculating the indices and an analysis of the results.

    Kurzfassung: The water in the General Agreement on Trade in Services (GATS) refers to the difference between the bound level of trade restrictiveness permitted by the GATS and the actual trade regime. Using the OECD Services Trade Restrictiveness Index (STRI), this report provides estimates of the water in 15 service sectors for 40 countries. The level of water in GATS commitments varies across sectors. It is highest in sectors where most countries have no commitments (unbound), such as audio-visual services or transport services, as well as sectors where countries tend to make commitments only for selected types of activities, such as legal services. The lowest level of water is observed in sectors such as telecoms, construction, computer and distribution services that are also characterised by a more liberal trade regime. Generally speaking, current services trade policies are much more open than what countries have committed in the GATS and sectors that are “unbound” can be fairly open.

The indices are calculated for 40 countries, the 34 OECD members and Brazil, China, India, Indonesia, Russia and South Africa. This report presents the first vintage of indicators for construction, architecture and engineering services and captures de jure regulations in force in 2013. The results for construction services indicate that the overall level of restrictiveness is relatively low, ranging from 0.05 to 0.32, with an average of 0.16. The more elevated levels of restriction can be largely attributed to general measures affecting all sectors of the economy. The STRI also supports the view that architecture and engineering services are less restrictively regulated than other accredited professional services, notably legal and accounting services. The average value for the STRI among the countries in the sample is 0.22 for architecture services, connoting a relatively low degree of regulatory restrictiveness; the corresponding value is only marginally lower, 0.2, for engineering services. The majority of regulations affecting trade in these sectors concern the movement of people.

The indices are calculated for 40 countries, the 34 OECD members and Brazil, China, India, Indonesia, Russia and South Africa. This report presents the first vintage of indicators for legal and accounting services and captures de jure regulations in force in 2013. The STRI supports the view that legal and accounting services are subject to a relatively high level of regulation. Restrictiveness for legal services ranges from 0.11 to 0.73, with an average of 0.31. Accounting and auditing services show an average of 0.3 and STRI values ranging from 0.13 to 1. The results provide useful policy insights, particularly in order to identify priorities for reform at the national and international levels. Notably, in the case of legal and accounting services, easing a few prominent restrictions could result in a significantly more liberal and competitive market environment.

The scores range between 0.06 and 0.72 for motion pictures, 0.07 to 0.78 for television and broadcasting, and between 0.05 and 0.37 for sound recording. The sample averages are 0.18 for motion pictures, 0.28 for television and broadcasting and 0.16 for sound recording. Limitations on foreign entry, including foreign equity limits contribute to about two thirds of the index values in television and broadcasting. In motion pictures screen quotas contribute to the indices in many of the countries with scores above average. Sound recording, i.e. music, is the most open of the three audio-visual services sectors where limitations on movement of people account for more than 40% of the index value. The paper presents the list of measures included in the indices, the scoring and weighting system for calculating the indices and an analysis of the results.

    Kurzfassung: World trade and production are increasingly structured around “global value chains” (GVCs). The last few years have witnessed a growing number of case studies describing at the product level how production is internationally fragmented, but there is little evidence at the aggregate level on the prevalence of GVCs. The main objective of this paper is to provide for more and better evidence allowing the examination of countries’ position within international production networks. We propose a number of indicators that give a more accurate picture of the integration and position of countries in GVCs, as well as a more detailed assessment of the value chain in six broad industries: agriculture and food products, chemicals, electronics, motor vehicles, business services and financial services.

    Kurzfassung: Taking global value chains (GVCs) into account has important implications for trade policy. When production is vertically fragmented and trade in intermediate inputs is prevalent, one has to look differently at a certain number of issues. Through case studies, this paper provides new evidence on the incidence on services of tariffs levied on goods (case study 1) and then discusses effective rates of protection in a world of GVCs and what the removal of tariffs on intermediate inputs implies, using the example of Canada (case study 2). To illustrate how trade agreements could be made more relevant for GVCs, the paper further looks at sectoral approaches in trade negotiations through the example of the Information Technology Agreement (case study 3) and finally compares the network of regional trade agreements in force with global production networks (case study 4).

It is therefore of prime importance that nuclear regulators’ communication strategies take into consideration the expectations and concerns of the public and provide sound information not only for the people of the affected country, but also for citizens worldwide. Public trust is a key element in being able to do so effectively and of particular importance when there are consequences for people or the environment. International co-operation can play a fundamental role in helping to improve crisis communication on national and global scales in the event of a nuclear accident or radiological emergency. These proceedings contain the papers, recommendations and conclusions of the workshop, which was attended by over 180 experts from 27 countries and 6 international organisations.

    Kurzfassung: Refurbishment and long-term operation (LTO) of existing nuclear power plants (NPPs) today are crucial to the competitiveness of the nuclear industry in OECD countries as existing nuclear power plants produce baseload power at a reliable cost. A number of nuclear power plants, most notably 73 units in the United States (up to 2012), have been granted lifetime extensions of up to 60 years, a development that is being keenly watched in other OECD countries. In many of these (e.g. France, Switzerland), there is no legal end to the operating licence, but continued operation is based on the outcomes of periodic safety reviews. This study analyses technical and economic data on the upgrade and lifetime extension experience in OECD countries. A multi-criteria assessment methodology is used considering various factors and parameters reflecting current and future financial conditions of operation, political and regulatory risks, the state of the plants’ equipment and the general role of nuclear power in the country’s energy policy. The report shows that long-term operation of nuclear power plants has significant economic advantages for most utilities envisaging LTO programmes. In most cases, the continued operation of NPPs for at least ten more years is profitable even taking into account the additional costs of post-Fukushima modifications, and remains cost-effective compared to alternative replacement sources.

    Kurzfassung: The OECD Competition Committee debated private remedies in June 2006. The roundtable focused on class actions/collective actions and the interface between private enforcement and public enforcement: • Class Actions/Collective Actions: There is a strong case for the use fo class actions/collective actions to raise levels of deterrence and achieve greater compliance with competition laws, as theses actions may be the only practical way to ensure that customers with small claims also have their day in court. • Interface between Public and Private Enforcement: There is a widely shared concern that private litigation in competition cases can interfere with leniency programs in cartel cases. There is a trade-off between enabling the victims of a cartel to recover damages and incentives for cartel members to come forward, and no-one really knows with certainty how much protection from private litigation and damage awards is necessary so as not to deter leniency applicants. The prevailing view is that the integrity of leniency programs should be protected by a range of measures that limit a leniency applicant’s exposure to civil damages, but some delegates felt that the current trend provided unnecessary protection to leniency applicants to the detriment of private plaintiffs.

    Kurzfassung: This report* was the basis of a two hour and a half peer review in the OECD Global Forum on Competition (GFC) on 21 February 2008. It assesses the development and application of competition law and policy in Ukraine, focusing on activities over the previous five years (2003-07). The report concludes that Ukraine has a comprehensive and well-designed competition law and, in the AMC, an effectively managed and well-regarded agency to enforce it. The report also identifies an array of problems confronting Ukraine in the competition law arena, and makes various remedial proposals, including recommendations dealing with the AMC’s budget allocation, autonomy, investigative tools, transparency, enforcement priorities, and relationships with other law enforcement agencies. Additional recommendations in the report focus on the competition law’s merger notification requirements and procedures, state aid legislation, penalties for unlawful conduct and penalty collection procedures, competition advocacy, harmonization with the European Union’s competition laws, and the elimination of conflicting provisions in Ukraine’s Commercial Code.

    Kurzfassung: The Inter-American Development Bank and the Organisation for Economic Co-operation and Development co-operate in competition law and policy to promote increased economic growth, employment and economic efficiency and a higher average standard of living in the medium to long term. There is increasing consensus that sound competition law and policy are essential to achieving these goals. “Peer review” is a core element of OECD work. The mechanisms of peer review vary, but it is founded upon the willingness of all OECD countries and their partners to submit their laws and policies to substantive questioning by other members. This process provides valuable insights to the reviewed country and promotes transparency and mutual understanding for the benefit of all. The benefits of this process are particularly clear in the area of competition law and policy. As a result of the activities of the Competition Committee, OECD countries that once had real conflicts on competition issues have become partners in seeking to halt harmful international anticompetitive practices. The Committee has also become an important forum for assessing and demonstrating the usefulness of applying competition policy principles to economic and other regulatory systems. IDB/OECD co-operation in competition law and policy centers on annual meetings of the Latin American Competition Forum. LACF meetings include substantive roundtable discussions and peer reviews of national laws and institutions. The peer reviews have examined Brazil, Chile, Peru and now Argentina. The IDB is pleased to participate and finance this work, as part of its efforts to promote a better business climate for investment in the counties of Latin America and the Caribbean. We want to thank the Government of Argentina for volunteering to be peer reviewed at the fourth LACF meeting, held in San Salvador, El Salvador, on 11-12 July, 2006. It was encouraging to hear Argentina’s Delegation confirm at the meeting that the report’s recommendations were helpful and to hear from Delegates of other countries that this review has improved their understanding of Argentina’s competition law and policy. Finally, we want to thank Mr. John Clark, the author of the report, and the many competition officials whose written and oral contributions to the Forum have been so important to its success.

    Kurzfassung: This publication presents the Development Assistance Committee peer review of the aid programmes and policies of Germany for 2010. The policies and programmes of each DAC member are critically examined approximately once every four or five years. Five members are examined annually. The OECD’s Development Co-operation Directorate provides analytical support and is responsible for developing and maintaining the conceptual framework within which the Peer Reviews are undertaken. The Peer Review is prepared by a team, consisting of representatives of the Secretariat working with officials from two DAC members who are designated as “examiners”. The country under review provides a memorandum setting out the main developments in its policies and programmes. Then the Secretariat and the examiners visit the capital to interview officials, parliamentarians, as well as civil society and NGO representatives of the donor country to obtain a first-hand insight into current issues surrounding the development co-operation efforts of the member concerned. Field visits assess how members are implementing the major DAC policies, principles and concerns, and review operations in recipient countries, particularly with regard to poverty reduction, sustainability, gender equality and other aspects of participatory development, and local aid co-ordination. The Secretariat then prepares a draft report on the member’s development co-operation which is the basis for the DAC review meeting at the OECD. At this meeting senior officials from the member under review respond to questions formulated by the Secretariat in association with the examiners. This review contains the Main Findings and Recommendations of the Development Assistance Committee and the report of the Secretariat.

    Kurzfassung: The future of Greece’s well-being will depend on improving educational performance to boost productivity and improve social outcomes. In the current economic context, with the need to get best value for spending, Greece must and can address inefficiencies in its education system. The challenges are significant. For example, Greece lags behind many OECD countries in performance on PISA, including countries with the same or lower levels of expenditure per student as well as countries with the same and lower levels of economic development. Salary costs per student are above the OECD average, mostly because Greek teachers have less teaching time and Greece has smaller classes. A smaller percentage of students who enter tertiary education complete a first degree within the statutory study time than in any other country in Europe. To address the challenges, the Greek government has established a bold agenda and sought advice from a task force on the development and implementation of reform proposals that reflect best practices in OECD countries. This report provides the outcomes of the work of the task force. It presents a roadmap for how the reforms can be successfully implemented, with pointers to relevant experience in other countries. As a contribution to the on-going policy discussions in Greece, it recommends specific short-, medium- and long-term actions that can improve efficiency in the country’s education system.

    Kurzfassung: The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by over 90 jurisdictions which participate in the work of the Global Forum on an equal footing. The Global Forum is charged with in-depth monitoring and peer review of the implementation of the standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004, which has been incorporated in the UN Model Tax Convention. The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. “Fishing expeditions” are not authorised, but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard. All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 plus Phase 2 – reviews. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes. All review reports are published once approved by the Global Forum and they thus represent agreed Global Forum reports.

    Kurzfassung: Learning for Jobs is an OECD study of vocational education and training (VET) designed to help countries make their VET systems more responsive to labour market needs. Germany has a very well developed and widely respected VET system with a strong dual component integrating learning in schools and workplace training. VET policy, design and delivery are strongly supported by social partner engagement and institutionalised VET research capacity. At the same time the German system confronts several challenges: the transition system is costly and suffers from undue fragmentation; more attention could be placed on adequate career guidance and basic skills provision; assessment is dominated by the Chamber exam; and only very few VET graduates take up university studies despite reforms to open access considerably. The OECD review assesses the main challenges faced by the VET system and presents an interconnected package of policy recommendations. For each recommendation, the report describes the challenge, the recommendation itself, supporting arguments, and issues of implementation.

    Kurzfassung: Particle accelerators have evolved over the last decades from simple devices to powerful machines, and are having an increasingly important impact on research, technology and daily life. Today they cover a wide range of applications including material science and medical applications. In recent years, requirements from new technological and research applications have emerged while the number of accelerator facilities in operation, being commissioned, designed or planned has significantly grown. Their parameters (such as the beam energy, beam currents and intensities, and target composition) vary widely, giving rise to new radiation shielding aspects and problems. Particle accelerators must be operated in safe ways to protect operators, the public and the environment. As the design and use of these facilities evolve, so must the analytical methods used in the safety analyses. These workshop proceedings review the state of the art in radiation shielding of accelerator facilities and irradiation targets. They also evaluate progress on the development of modelling methods used to assess the effectiveness of such shielding as part of safety analyses.

    Kurzfassung: The Basque Country region in Spain is world renowned for a successful industrial transformation, the urban regeneration of Bilbao, cultural distinctiveness, unique governance arrangements and high wealth levels. Over the last 30 years, the region has implemented its science, technology and innovation (STI) policy driven by a need to boost industrial competitiveness. The role of total factor productivity and innovation in driving growth was significant in the 1990s and declined in the early part of this decade, but appears to be on the rise again thanks in part to significant increases in public and private investment in innovation. The Basque Country has begun a transition from a model of incremental innovation in manufacturing to a model increasingly based on science and other forms of knowledge. Through a diagnostic of the innovation system and the policy mix, the review offers some policy and governance recommendations to achieve the region’s desired transition in light of global trends in the innovation process and innovation policy.

    Kurzfassung: Trade promotes economic growth, alleviates poverty and helps countries reach their development goals. However, developing countries – in particular the least developed – face difficulties in making trade happen and turning trade into economic growth. The Aid for Trade Initiative – launched at the 2005 World Trade Organisation conference in Hong Kong – aims at helping these countries to take advantage of trade opportunities and to reap the benefits of their integration into the world economy. The Initiative has been a success: it has not only raised awareness among both donors and developing countries about the role of trade in development, but also helped secure increased resources. Trade for Growth and Poverty Reduction: How Aid for Trade Can Help explains how Aid for Trade can foster economic growth and reduce poverty, and why it is an important instrument for a development strategy that actively supports poverty alleviation. Unlocking this potential requires carefully designed and sequenced trade reforms. While developing countries have many trade-related needs, but financial resources and political capital for reforms are limited, it is an important priority to tackle the most binding constraints to trade expansion. This report describes the diagnostic tools available, evaluates their strengths and weaknesses, and suggests a dynamic framework to guide the sequencing of reform and donor support.

    Kurzfassung: On the 50th anniversary of the OECD, we examine the unique work the organisation performs in regulating and rationalising governments’ use of export credits in support of exports, jobs, economic growth and national interests more broadly. This work is part of a global post war effort to emphasise multilateral co operation and sound economic policies to promote co operation, efficiency and prosperity rather than destructive competition, controversy and conflict. OECD export credits work is one of the basic building blocks of the ever growing structure of global trade agreements that aim to maintain open and efficient markets. The objective is to eliminate subsidies and unfair practices in the economic competition that forms the foundation of a healthy and dynamic global economy. The elimination of official financing subsidies in global trade is only a part of the broader trade policy agenda, but it is a vital part, and has been delegated to the OECD by the WTO. Since financing is the life blood of trade flows, specialised OECD housed work allows trade to flow efficiently for aircraft and other capital goods while other trade policy work and litigation continue at the WTO. The export credits work at the OECD is described in this collection of essays. However it is about much more than the series of agreements described herein. It is more fundamentally about the governments and their people - policy makers and experts - who gather at the OECD to build collectively a system of export credits disciplines that is fair, transparent, adaptable and effective. It is therefore as much about people and ideas as anything else. The export credit secretariat pictured above represents only the latest in a long line of OECD staff committed to facilitate and advise this work. The OECD’s motto on its 50th anniversary is “Better Policies for Better Lives.” This reminds us that in the end, it is policies that are at the centre of human well being. And export credits work is about promoting these better policies by developing “smart rules” that open markets and maintain a level playing field and by bringing people and governments together to this end.

    Kurzfassung: The Competition Committee debated retail banking in October 2006. Competition can improve the functioning of the retail banking sector without harming prudential regulation. The efficient functioning of the sector is important for economic performance. The sector is considered special primarily because of externalities related to potential “contagion” effects stemming from (i) the withdrawal-upondemand characteristic of some bank deposits and (ii) the role banks play in the payment system, and (iii) the fact that banks are important for the funding of consumers and SMEs. Customer mobility and choice is essential to simulate retail-banking competition. An important observation is that the degree of customer mobility is low and the longevity of customer-bank relationships is long. Financial information sharing platforms should therefore be promoted and, where limited by privacy laws, privacy laws should be modified in a way that maintains the goal of protecting privacy while also allowing consumers to receive the benefits of credit ratings.

    Kurzfassung: The OECD Competition Committee debated competition and efficient usage of payment cards in June 2006. In recent years, debit and credit cards have become increasingly common as retail payment mechanisms and have increasingly displaced checks and cash. The roundtable discussed potential market power and pricesetting abuses related to payment cards, reviewed the regulatory (or self-regulatory) mechanisms that sometimes govern the operation of card networks and considered methods for increasing the role of competitive forces among payment cards. A market failure exists because costs for different payment mechanisms are rarely reflected in consumer prices. Consideration should be given to permitting merchants to form payment ventures, as this would promote system competition between owners with different incentives, and to promoting entry by potential new technologies that would not involve existing payment networks. Many other policy options are discussed.

    Kurzfassung: The Competition Peer Review Report of Peru is the fourth one of a non-OECD country. South Africa and Russia were reviewed at meetings of the OECD Global Forum on Competition (GFC). Chile, and now Peru, were reviewed at meetings of the Latin American Competition Forum (LACF), organised by the OECD and the Inter- American Development Bank (IDB). All four reviews confirm that the peer review process is an extremely useful means of promoting co-operation and voluntary convergence among OECD and non-OECD economies, providing both transparency and a candid discussion of what constitutes “best practice” in different situations.

    Kurzfassung: The OECD Competition Committee debated competition issues in vertical relations for gasoline retailing in October 2008. Gasoline retailing has changed dramatically over the last 25 years. While refiners often still have extensive networks of gasoline retailers, there is also a large independent sector in many countries; A study of the effects of entry by large general retailers finds benefits to consumers; There has been a vigorous debate about whether vertical separation between gasoline stations and upstream entities should be required. It appears that mandating vertical separation is linked with price increases to the ultimate consumers. On the other hand, mandated separation may promote the development of more independent stations. Policy makers often raise concerns about vertical integration in the supply of gasoline. These concerns should be moderated in markets with large independent segments. Even in markets with small independent segments, there are reasons to believe prices will be lower with vertical integration, as this eliminates a double mark-up.

    Kurzfassung: The OECD Competition Committee debated improving competition in real estate transactions in February 2007. Real estate transactions are subject to a variety of potential limitation of competition that can have significant effects on ordinary consumers. In fact, because of the annual volume of transactions and the fact that real estate expenses (mortgage payments and rent) constitute a significant portion of spending out of available revenue to spend (often exceeding 25%), the impacts of anti-competitive action i this sector may have larger financial value than in most other sectors. Practices of real estate agents vary significantly across countries, but a common trend appears to be the introduction of listing services that may provide a platform for anti-competitive practices to spread, at the same time as the Internet potentially provides improved opportunities for real estate sellers to reach buyers directly. In many countries, the operation of transferring legal title to properties is subject to cartel-like prices. Competitive problems have also been identified in the mortgage markets, with cartel activity having been found in a least one case and a lack of non-bank sources of finance in some countries.

    Kurzfassung: The OECD Competition Committee debated competitive effects of land use restrictions in February 2008. Land use restrictions often serve valuable social purposes. The benefits of particular policies for land use must be balanced against the costs, though. The social harms that can arise when land use restrictions create “entry barriers” are rarely considered explicitly. Land use restrictions can raise the price and reduce supply of a broad range of real estate and, by preventing new and innovative stores from opening, reduce shopping options available to consumers. More careful integration of policy on land use restrictions with competition policy could benefit consumers and many entrepreneurs and reduce the likelihood that public or private restrictions will lead to supply scarcity. This roundtable examines competition problems affecting commercial construction and use permits, geographic density tests, adverse impact tests, access condition to rights of ay and private restrictions on land use. Steps are identified for improving public policies towards land use restrictions.
