    Abstract: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. How can the population’s creative potential best be fostered? What do software innovations have in common with the evolution of living organisms? What are the vulnerabilities of distributed creativity? Answers are sought in the processes that came into being during the early years of the digital revolution and were then forced to take a back seat as control of the means of production was increasingly placed in the hands of tech companies. The findings and insights presented here are highly relevant for today’s digital policymaking. Market concentration processes in innovation haven’t ceased; they are ongoing. And in an age where data-driven services are creating and reinforcing global oligopolies, the question posed by the U.S. Supreme Court in Google v. Oracle is now more relevant than ever: who should hold the keys to digital innovation?

    Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

    Abstract: This book explores how International Humanitarian Law (IHL) has been developed in the jurisprudence and practice of the International Criminal Court (ICC). A partial focus is given to the phenomenon of child soldiering which became symptomatic for the early practice of the ICC. The book provides readers with broad insight into the activity of the ICC. The first part contains chapters focused on the methodology of law-finding before the ICC, i.e., identification, interpretation, and application of the law. The authors address complex issues concerning the mutual relationship between treaty law (Article 8 of the ICC Statute) and customary international (humanitarian) law and explore the relevance of IHRL in the application and interpretation of Article 8 of the Rome Statute. The second part consists of chapters focused on substantive international criminal law. The authors address issues concerning contextual elements of war crimes, passive personal scope of IHL, denying judicial guarantees as a serious breach of IHL, forms of responsibility, and circumstances precluding wrongfulness. Martin Faix is Senior Lecturer in International Law at the Faculty of Law of the Palacký University in Olomouc, and at the Faculty of Law of the Charles University in Prague (part-time), Czech Republic.     Abstract: This book focuses on the role mainstream humanitarian organizations have in the functioning of the border management system on the southern European border (i.e. Italy). In particular, the author analyses the mainstream humanitarian organizations and NGOs (i.e. Red Cross, the UNHCR, Medici per I Diritti Umani – MEDU, Terre des Hommes and Oxfam) and their role within and beyond the implementation of the so-called ‘hotspot approach’ in Sicily. This work suggests that a vision of humanitarian action as just anti-political and complicit with migration control can be questioned. As a locally situated actor, journalism produced a porous discourse that expressed a proposeand- public pushback movement. This work of articulating mediation conditioned the project’s alteration and dissolution within asymmetrical relations of power. In addition to a wave of opposition that inflected the project’s enactment, a time lag between project time and governmental policymaking made the controversy over this future urban space intractable. With their residual symbolic power, quality journalism contributed to dialogical urban learning.     Abstract: This book puts the spotlight on a different and neglected aspect of law drafting and reform: the question of size. Specifically, how does the size of a jurisdiction affect its ability to make and change its laws? Some of the challenges affecting small jurisdictions include: a lack of resources and paucity of policy/drafting capacity; the pressures and pull from sources outside the jurisdiction (e.g. international bodies or NGOs; larger states; treaty commitments); a vulnerability to domestic capture (e.g. criminal elements, big local businesses, strong domestic lobby groups); weak/bad governance (e.g. laws or institutions which themselves do not encourage or promote good governance, reflection and reform); the legacy of colonial legal systems and their interaction with indigenous or customary laws; and struggles to comply with constitutional norms such as accountability and transparency. Despite these difficulties small jurisdictions also have certain advantages when it comes to making and reforming law: they can be flexible and creative; they can legislate very quickly if the political will is there; and there is strong informal/formal accountability in a small jurisdiction.     Abstract: This study traces the welfare regimes of Mauritius and South Africa from the early 20th century focusing on the historical circumstances that gave rise to the dominance of state-funded old-age pensions within their respective welfare frameworks. It highlights intersections between powerful business interests, the state, and social forces that sowed the seeds of social entitlements. Due to different mobilisation efforts of these social actors, both countries have spawned welfare regimes of different persuasions. Mauritius has maintained its long-standing traditions as a social democracy stretching back to the late 1950s, while South Africa continues relentlessly in pursuit of a liberal welfare state, a journey it has treaded since 1928 when the old-age pension laws first came into effect. While unravelling the innermost workings of welfare state development in Mauritius and South Africa, it also probes the present political and economic circumstances that have kept these two welfare regimes resolutely unchanged. Against this backdrop, it draws parallels between current welfare outcomes and those of old as they continue to chart their way into the future. Elias Phaahla, Ph.D. taught at the University of Cape Town (UCT) before joining University of Johannesburg where he is Associate Professor of Politics and International Relations. His main research interests include, but not limited to, the politics of welfare reform with particular focus placed on the old-age pension schemes of Mauritius and South Africa.     Abstract: This open access book provides an overview of urban digital platforms such as Airbnb and Deliveroo, which, along with Amazon, Google, Facebook and other IT companies, constitute by now the infrastructures for other businesses to operate on and for our social life to go on. These platforms serve as standards-based techno-economic systems that simultaneously capture cooperation through remote coordination and organize labor via algorithm management. Based on a three-years research project, this contributed volume outlines a general theory of platform capitalism that conceives these platforms not only as technical devices, but as generative engines that operate at the interface of several aspects, such as digitalization of forms of social cooperation; algorithm-based management of labor and participation; and private and vertical appropriation of profits. These elements are somehow iconic of the capitalist evolution of the last decades, and they open up a reflection on new forms of “primitive accumulation” (in particular regarding data), on the mechanisms used to capture and extract social surplus value, and on the logistic-financial dimensions of capital. Finally, in light of the transformations associated with the COVID-19 pandemic, the authors examine how platforms can evolve into hegemonic organizational structures. Assuming we are all already living in the age of the platform, this book takes a multifaceted approach—combining sociology with urban studies, and political sciences with economics—to grasp the challenges our societies face in terms of ensuring fair economic growth, adequate social protections, and labor rights. It will appeal to anyone interested in digital platforms and how they are changing the organization of labor, urban spaces, and forms of governance.

    Abstract: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena.     Abstract: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

It was the period in which the ecological and agronomic values that are still attributed to bees by modern industrial society were first established, and it was the period in which one bee species (the European honeybee) completed its dispersal to every habitable continent on Earth. At the same time, literature – which would enable, represent and in some cases repress or disavow this radical transformation of bees’ fortunes ­– was undergoing its own set of transformations. Bees, Science, and Sex in the Literature of the Long Nineteenth Century navigates the various developments that occurred in the scientific study of bees and in beekeeping during this period of remarkable change, focusing on the bees themselves, those with whom they lived, and how old and new ideas about bees found expression in an ever-diversifying range of literary media. Ranging across literary forms and genres, the studies in this volume show the ubiquity of bees in nineteenth-century culture, demonstrate the queer specificity of writing about and with bees, and foreground new avenues for research into an animal profoundly implicated in the political, economic, ecological, emotional and aesthetic conditions of the modern world. Alexis Harley lectures in literary studies at La Trobe University, Australia. She is the author of Autobiologies: Charles Darwin and the Natural History of the Self. She has kept honeybees since 2012. Christopher Harrington teaches literary studies at Victoria University in Melbourne. He has published numerous articles on the representation of bees and insects in literature.

    Abstract: This book explores how popular cultural artifacts, literary texts, commemorative practices and other forms of remembrances are used to convey, transmit and contest memories of mass atrocities in the Global South. Some of these historical atrocities took place during the Cold war. As such, this book unpacks the influence or role of the global powers in conflict in the Global South. Contributors are grappling with a number of issues such as the politics of memorialization, memory conflicts, exhumations, reburials, historical dialogue, peacebuilding and social healing, memory activism, visual representation, transgenerational transmission of memories, and identity politics. Mphathisi Ndlovu is a research fellow at Stellenbosch University (South Africa). Mphathisi is also an Associate Professor of Journalism and Media Studies at the National University of Science and Technology (Zimbabwe). He is also an alumnus of the Alliance for Historical Dialogue and Accountability (AHDA) fellowship at Columbia University's Institute for the Study of Human Rights. Mphathisi holds a PhD in Journalism from Stellenbosch University. His research interests are in collective memory, identity politics and digital cultures. Mphathisi’s works have been published as book chapters, and peer reviewed articles in journals such as Digital Journalism, African Cultural Studies, Journal of Genocide Research, and Nations and Nationalism. Mphathisi is also co-editor of a book titled The Idea of Matabeleland in Digital Spaces: Genealogies, Discourses and EpistemicStruggles (2022). Lungile Augustine Tshuma holds a PhD in Journalism from the University of Johannesburg, South Africa. He is a Senior PostDoctoral Fellow in the Department of Communication and Media at the University of Johannesburg in South Africa. Lungile is also an Associate Professor in the department of Journalism and Media Studies at the National University of Science and Technology (Zimbabwe). His research interests are in journalism, photography and memory. He has published in local and international peer reviewed journals and among them are: African Journalism Studies, Nations and Nationalism, Media Culture and Society, and Journal of Communication Inquiry. Shepherd Mpofu is Associate Professor of Media and Communication at the University of South Africa. He has published several articles on communication, media and journalism in Africa. His body of work covers social media and politics; social media and identity; social media and protests.     Abstract: The Famine Diaspora and Irish-American Women’s Writing considers the works of eleven North-American female authors who wrote for or descended from the Irish Famine generation: Anna Dorsey, Christine Faber, Elizabeth Gurley Flynn, Mother Jones, Kate Kennedy, Margaret Dixon McDougall, Mary Meaney, Alice Nolan, Fanny Parnell, Mary Anne Sadlier, and Elizabeth Hely Walshe. This collection examines the ways the writings of these women contributed significantly to the construction of Irish North-American identities, and played a crucial role in the dissemination of Famine memories transgenerationally as well as transnationally. The included annotated excerpts from these women writers’ works and the accompanying essays by prominent international scholars offer insights on the sociopolitical position of the Irish in North America, their connections with the homeland, women’s activities in transnational (often Catholic) publishing networks and women writers’ mediation of Ireland’s cultural heritage. Furthermore, the volume illustrates the generic variety of Irish-American women’s writing of the Famine generation, which comprises political treatises, novels, short stories and poetry, and bears witness to these female authors’ profound engagement with political and social issues, such as the conditions of the poor and woman’s vote. Marguérite Corporaal is Full Professor of Irish Literature in Transnational Contexts at Radboud University, the Netherlands. She was PI of Relocated Remembrance: The Great Famine in Irish (Diaspora) Fiction, 1847–1921), is a NWO-VICI grant recipient for her project Redefining the Region (2019-24), and PI of Heritages of Hunger, a Dutch research council-funded NWO-NWA project (2019-24). She is the author of Relocated Memories of the Great Famine in Irish and Diaspora Fiction, 1847–70 (2017). Dr. Jason King is Academic Coordinator of the Irish Heritage Trust and National Famine Museum, Strokestown Park, and a member of the Government of Ireland National Famine Commemoration Committee.     Abstract: This book looks at literary historiography in Russia, Latvia, the Czech Republic and Finland, focusing on how seismic shifts in state politics and ideology after 1990 changed the writing of national literary histories in these countries. While Russia saw a return to a more nationalist way of thinking about literature and a new emphasis on Orthodox religion after the fall of the Soviet Union, the opposite is true for Latvia, the Czech Republic and Finland. In these countries, literary historiography fosters connections between Western scholarship and literatures written in the national language and engages with questions such as transnationalism, minorities, culture and power, and the cultural construction of identities. This book scrutinizes the different ways in which the construction of national, cultural and European identities has occurred in and through the literary historiography of North-Eastern Europe in the last few decades. Liisa Steinby is Professor Emerita of Comparative Literature at the University of Turku, Finland. Her publications include Myth in the Modern Novel: Imagining the Absolute (2023), co-edited volumes Narrative Concepts in the Study of Eighteenth-Century Literature (2017), and Herder and the Nineteenth Century (2020). Benedikts Kalnačs is Senior Researcher at the Institute of Literature, Folklore and Art, University of Latvia, and Professor of Comparative Literature at the University of Liepāja, Latvia. His publications include A New History of Latvian Literature: The Long Nineteenth Century (ed., with Pauls Daija, 2022). Mikhail Oshukov is Assistant Professor at Petrozavodsk State University, Russia. His publications include the articles "Ezra Pound’s Dramatic Works: Vorticist Noh Theater" (2019), "E.E. Cummings: geometry and grammar of revolution" (2017), and "Familiar Otherness: Peculiarities of dialogue in Ezra Pound’s poetics of inclusion" (2013). Viola Parente-Čapková is Professor of Finnish Literature at the University of Turku, Finland. Her publications include co-edited volumes Women Writing Intimate Spaces: The Long 19th Century at the Fringes of Europe (2023), and Nordic literature of Decadence (2020). .

    Abstract: This book reviews China’s strategic pathway over the last 1000 years and considers its prospects for ascending to high-income status by the end of the 21st century. It analyzes why, although China’s chances of joining the global core are sound, they are not outstanding; in addition, it faces mounting challenges, internal and external alike. The argument is presented in the framework of dynamic-strategy theory, which is expounded here in novel form. This exposition includes a wide ranging survey of global history, with a focus on the development of the industrialisation paths of the major economies of today, including a detailed study of Japan's long-run strategic pathway. The book’s closing section presents a scenario-based discussion of China’s potential place in the world in 2100. The analysis implies that China’s zenith is likely to be reached slightly before mid-century, after which its relative economic scale will likely decline. Beyond that general finding, the scenarios investigate the wide range of plausible outcomes that China may experience: a range that the author contends is much wider for China than for nations under-pinned by less complex political-economies. Given its scope, the book will appeal to scholars of history, economics, geopolitics and sinology, and to anyone interested in learning about China’s economic prospects at a time of increasingly heated ideological and empirical debates.

    Abstract: This book explores how Chicana literature often represents gender violence while simultaneously presenting strategies of survival in response. Adrianna M. Santos aims to contribute to a broader conversation concerning the intersections between Chicana literature and decolonial trauma theory, one which questions the colonial matrix of power and the universality of Western knowledge. Santos argues that Chicana survival narratives arise out of colonial wounds and form scars that both mark and protect the violated body. Cicatrix Poetics, Trauma and Healing in the Literary Borderlands proposes a “cicatrix poetics” that makes bold gestures toward healing and narrative/storytelling as survival. The book contends that the cicatrix fashioned through artistic expression is a necessary component for Chicana communities—not just to survive, but to thrive. The books presents several case studies that examine transformative narrativity and by theorizing the texts as survival narratives, social protest works that bring attention to violence and erasure, the chapters explore how literature can be an effective catalyst for both social change and personal transformation, an orientation towards freedom, liberation through love.     Abstract: Fashion is a research topic of increasing interest to economic and business historians as it points towards new understandings of economic growth and decline. This book explores the role of institutions and institutional change in the Italian fashion system from the 1940s to the 1980s. Starting from the premise that institutions play a central role in explaining the peculiarity and development of the Italian fashion system, this book analyses the diverse institutional entities involved in supporting and promoting Italian fashion.
