Kurzfassung: This book examines whether Australia’s constitution should be reformed so as to enable the country to fulfil its obligations under the United Nations Declaration on the Rights of Indigenous Peoples, which it ratified in 2009. The book surveys the history of the constitutional status of Australia’s Indigenous peoples from the time of colonisation through to the current debate on ‘Indigenous constitutional recognition’. However, it argues that the term ‘Indigenous constitutional recognition', implying that mere acknowledgement of the existence of Indigenous peoples is sufficient to meet their legitimate expectations, misrepresents the nature of the project the country needs to engage in. The book argues that Australia should instead embark upon a reform programme directed towards substantive, and not merely symbolic, constitutional change. It argues that only by the inclusion in the constitution of enforceable constitutional rights can the power imbalance between Indigenous Australians and the rest of society be addressed. Taking a comparative approach and drawing upon the experience of other jurisdictions, the book proposes a comprehensive constitutional reform programme, and includes the text of constitutional amendments designed to achieve the realisation of the rights of Australia’s Indigenous peoples. It ends with a call to improve the standard of civics education so as to overcome voter apprehension towards constitutional change. .

Kurzfassung: This book organizes the intent and purpose of the Japanese competition law (Antimonopoly Act) to address the digitalized socio-economy and provides a detailed explanation of its basic content as well as advanced issues. It includes an overview of Japanese law and its international position, a basic understanding of the big data and AI issues in today's competition law, and perspectives on high-tech regulation. In addition, it includes a variety of important topics, ranging from exploring principles to tackle digital regulatory realities, to understanding and analyzing the competitive realities of multisided markets. It also examines the relationship between information and competition law and that between consumer and competition law. Digitalization is a key concept in our economy and society today. Carbon neutrality initiatives, the need to improve productivity, globalization, and new ways of working are all seeking breakthroughs by way of digitalization. What’s more, digitalization requires free and fair competition in order to encourage technological innovation. The search for transparent and clear competition laws is essential to promote efficient and effective research and development and to promote public awareness through competition.

The Changing International Legal Environment Regarding Non-market Economy Treatment -- Chapter 7. Prospects of Non-market Economy Treatment.
Kurzfassung: This book serves as a comprehensive study of and provides rich insight into non-market economy treatment, including its past, present, and estimated future practices and implications. It explores the introduction of the market and non-market economy dichotomy into international trade law. It traces the origin and development of non-market economy treatment against changing international economic and political background. The book examines this treatment in light of the rationale underlying anti-dumping, reflecting its alleged significance of ensuring fair trade. It in particular investigates the varied non-market economy treatment practices responding concerns of China’s rising as a large state-led economy, analyzing the deviation of NME treatment into an all-in trade tool. The book argues against preconceived bias and unilateral protectionism. It highlights the universal existence of government involvement in the market and proposes objective assessment of its impact on fair trade. Final proposition of the book is depoliticizing trade, reforming comprehensively international trade rules to carefully calibrate different values, including promoting fairness and enhancing global social welfare. It envisages a multi-dimension overhaul of international trade rules to rebalance trade interests, rather than roughly labeling an economy to confer different treatment, the practices of which lead to separation and chaos. The book is of particular relevance and interest to economies-in-transition, and among policy makers, academicians and legal practitioners engaged in trade remedies and trade rules reconstruction.

Kurzfassung: Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today. Kurzfassung: This book is a collection of academic essays that examines the representation, esthetics and dichotomy of the notions of grief and melancholy in East–West exchanges and cultural dialogues. It explores the topic in the dimensions of individual behaviors under specific social norms and cultural products such as literature, film and any other forms of arts/genres, etc. In his 1917 work Mourning and Melancholia (Trauer und Melancholie), Sigmund Freud connected the grief of loss with melancholic emotions which may give rise to acts of mourning. He suggested that “[i]n mourning it is the world which has become poor and empty; in melancholia it is the ego itself” (Freud, 1917: 246). Inspired by Freud’s stance and with the goal of providing up-to-date intellectual resources for academics, researchers and students with ardent interests in the varying exemplifications of grief and melancholy in Sino-Western contexts, the book serves more than a discussion over the pragmatic and ritualistic connections of grief and melancholy in relation to the inner self and the external world. It aims at the pursuit of a contemporary theorization of grief and melancholy beyond its modern limits.

Kurzfassung: This book describes the disability rights movement that started in the USA and its influence on the disability rights movement in Lebanon, which has led to the endorsement of the Lebanese Disability Act 220/2000. The book introduces the reader to the Lebanese Disability Act 220/ 2000, its definition of disability, and its relation to the medical and social models of disabilities and then articulate the Act articles. Then, it defines the inclusive design paradigm that acknowledges the needs of all people at each stage of their life cycle and presents the difference between inclusive design and accessibility and disability notions. Moreover, the book reviews the different international accessible design standards (American and French) that are adopted in Lebanon with the absence of a nationalized Lebanese design standard and its effect on eliminating barriers and enhancing accessibility at university buildings. Besides, the book presents students' experiences and their satisfaction with the university built environments. 6 university buildings case studies at the American University of Beirut are assessed and analysed to check whether they adopt the inclusive design approach and then propose inclusive design solutions for both heritage and modern university buildings. What makes the book unique is its combination of empirical and theoretical application of inclusive design. The last section, reflects the author’s inclusive design teaching pedagogy. In this section, the author shares samples of students’ class design project and provides recommendations and guidelines for teaching inclusive design so it becomes mainstream.

Kurzfassung: “Authoritarian regimes smother internet and the social media. This book boldly argues this is not the case in China, where the party-state is torn between conflicting political and economic objectives. Taking advantage of this “double-bind regulation”, private internet firms have managed to secure zones of autonomy . A brilliant demonstration.” --Nonna Mayer, Sciences Po, Paris “In China as a Double-Bind Regulatory State, Aifang Ma provides an ambitious yet convincing framework to explain the puzzling coexistence of an all-powerful and unchecked party-state and the relatively autonomous space for private internet and social media firms to grow and thrive. This book is theoretically innovative, methodologically rigorous, and empirically rich. A must read for anyone curious about internet governance and regulation in China.” --Rongbin Han, University of Georgia “An extraordinarily interesting, highly provocative and deeply empirical piece of political analysis on a topic of staggering importance. Its achievement, above all, is to restore the agency of firms and netizens in its forensic reconstruction and de-mythologising of the saga of the ongoing birth of a digital public sphere in China.” --Colin Hay, Sciences Po, Paris “Through a detailed, provocative and insightful analysis of state-firm interactions, Aifang Ma shows how private internet firms in China carved out a space of relative autonomy. This book is a must-read for students of Chinese internet regulation.” –Guobin Yang, University of Pennsylvania This book explores the power dynamics in the Chinese regulation of internet firms. It conceptualises China as a “double-bind regulatory state”, defined as a two-step autonomy-enabling process. First, the party-state’s pursuit of competiting objectives creates its predicament. Second, private internet firms consciously exploit such predicament to enlarge their manoeuvring room. The double-bind regulation approach challenges some current academic accounts that exaggerate the capacity of the Chinese party-state to establish seamless control. Aifang Ma is currently a Boya postdoctoral scholar and a Lecturer at Peking University. She holds a Ph.D in political science at Sciences Po Paris. .

Kurzfassung: "This insightful book offers a comprehensive exploration of governance structures in microfinance institutions, shedding light on their impact on outreach and sustainability in Bangladesh. Dr. Uddin's thorough analysis, supported by global perspectives and evidence-based recommendations, makes it an invaluable resource for researchers, students, and practitioners in the fields of economics, corporate governance, and microfinance administration" -- Professor Dr. M Kabir Hassan, Department of Economics and Finance in the University of New Orleans, USA This book identifies the effect of governance structure components on outreach and sustainability of microfinance institutions (MFIs) in Bangladesh. It is designed to study and understand these structures with reference to the changing forms and functions of MFI administration, in theory and practice, with experiences from selected countries. It helps readers understand corporate governance across the globe with recent developments in this sector. It provides evidence from Bangladesh on what aspects need to be strengthened and identifies the importance of considering differences in institutional values, culture, and environment while pointing to the risk of applying normative assertions of governance structure. The book suggests that a regulatory and supervisory framework should be introduced in Bangladesh to enhance the governance structure of MFIs. It advocates that the sector requires a robust regulatory environment to improve its governance and administrative frameworks and expand the microfinance sector's outreach and sustainability opportunities. It will benefit researchers and students of economics, corporate governance, accountability, transparency, finance, business administration, microfinance institutions, and applied fields, as well as microfinance practitioners, administrators, and policymakers. Md. Nazim Uddin is a Post-doctoral research fellow at International Islamic University Malaysia (IIUM) and a research fellow at Ankara University, Turkey. He completed PhD in business administration (finance) from IIUM. Dr. Uddin is the author of several books, many book chapters and peer-reviewed articles.

Kurzfassung: The volume examines how in the twenty-first century narratives built around connectivity have become a structural component of international politics expanding into a wider array of policy fields. It examines the significance of this emerging narrative from an Indian perspective with particular reference to Eurasian alternatives. It argues that this represents the next stage of globalization and that an understanding of this is increasingly becoming crucial given the recent disruptions along with the emergence of a spate of new policies and institutions that could eventually lead to a new understanding of connectivity. The latest reforms in China:continued without substantial breakthrough -- 7. Conclusion.
Kurzfassung: This book looks into the processes sustaining the administrative reform in Chinese local government and the roles of different actors during different phases by tracing a vivid administrative reform process in Shunde district, Guangdong province between 2009 and 2014. In 2008, Chinese central government initiated a new round of large-scale, top-to-bottom administrative reform—“mega-ministry” administrative reform—to address the long-lasting administrative problems. Against this background, the reforms in Shunde government (county level) operated well and sustained for several years, which was enlarged to the administrative licensing field and hence influenced China’s reforms in the following 10 years. Shunde case could allow us a better peep at the factors that contribute to the sustenance of reform. The analyses in this book find that sustenance of reform reflects, ironically, the logics of both path dependence and path creation. The past reform trajectories have created a favorable background for further reform to evolve, and a receptive ground in which exogenous forces interacted with the local reform-minded actors to create the new reform innovations. The combination of path dependence and path creation kept local reform afloat.

Kurzfassung: The book reports on the development and validation of a computerized adaptive EFL test, which is used as an exit requirement for non-English-major undergraduates at a major Chinese university. Unlike the tests reported in previous research on computerized adaptive language test (CALT), which were mostly designed to assess vocabulary, grammar and reading, this test consists of listening and reading components using both dichotomously-scored stand-alone items and polytomously-scored testlet-based items. The book is an essential and stimulating read for researchers and graduate students in the testing domain, particularly for those who are interested in CALT, item response theory (IRT), and quantitative research methods in general. It also constitutes a solid reference resource for L2 teachers and test developers. One of the distinctive features of the book is its operationalization of assessment use argument (AUA) in the investigation of the construct validity of the CALT. Another strength of this book is that it provides insight into the specific procedures that are followed in the development of CALTs and addresses a few key issues, such as local item dependence and DIF detection that were ignored in previous CALT development research.

Kurzfassung: This book analyzes the adoption of stakeholders’ engagement in various fields and scales while providing the readers with an international outlook of the topic. In the contemporary processes of urban development, regeneration is becoming a relevant way to limit the occupation of new land and to enhance the existing spatial, social, and ecological dimensions of specific parts of the city. It generally entails the engagement of different groups of stakeholders and users at various levels—e.g., institutional and private—who carry on their own agendas while conveying a wide range of interests and values to safeguard. At the same time, despite indications of a significant increase in its implementation under various forms and in multiple contexts in the last twenty years, participatory mechanisms have not been without challenges and barriers due to several factors, including facilitators’ poor negotiation and communication practices, and consequently misinterpretation of the values at stake made by the parties involved, or obstructionism and gridlocks carried on by the different stakeholders. The narrative of the collection is structured in four sections The contributions elaborate on innovative participatory patterns, how they are/might be entangled with the different stages of regeneration projects, in what measure they have contributed to the United Nations sustainability goals, and the potential matters emerging during the negotiation phases. In detail, the four sections are: 1. Public space regeneration 2. Ecological regeneration 3. Built heritage regeneration 4. Informal settlements regeneration. Finally, this book is a significant asset to urban policy makers, planners, practitioners, and researchers in the architecture and urban studies domain who aim at deepening public participation practices knowledge by comparing different experiences.

Kurzfassung: This book provides a critical understanding of dance studies in India, bringing together various embodied practices identified loosely as dance. It suggests an alternative reading of the history of patronage, policies, and institutionalized understanding of categories such as classical, folk, modern, popular, and Bollywood that hierarchizes some dances as 'more' dance than others. It is of great interest to scholars looking at performing arts such as dance as a tool for identity assertions. It offers diverse possibilities of understanding dance through its inherent sociopolitical possibilities as a participatory or presentational tool for communication. The multidisciplinary approach brings together perspectives from critical dance studies, anthropology, history, and gender studies to connect embodied archives of different communities to create an intersectional methodology of studying dance in India as a powerful but marginal expressive art practice. Accessible at multiple levels, the content is relevant for undergraduate and postgraduate students, as well as researchers across dance, dance education, theatre, and performance studies.

Kurzfassung: This book explores the postcolonial discourse and decolonization processes in modern Kazakhstan and beyond. It pays particular attention to such areas as national and religious identity, language, literature, and historical narratives. Despite the fact that the post-colonial theory initially emerged in other regions of the world, it has increasingly been applied in the scholarship on Central Asia. Exploring recent debates on post-coloniality in Kazakhstan, this book is an attempt to bring together two bodies of scholarly literature: scholarship on culture and society in post-Soviet Central Asia and research on post-colonial theory. This volume will be of interest to scholars of Eurasian studies as well as researchers and students of post-colonialism in various contexts beyond Eurasia. Dina Sharipova is an Associate professor at the Graduate School of Public Policy at Nazarbayev University in Astana. Kurzfassung: The book tells about people who lived in an era of historical cataclysms, wars and revolutions, changes in political formations. The generation of the Kazakh intelligentsia responded to the historical challenge facing the Kazakhs at a turning point in history. These are people born at the end of the 19th century, educated in different countries and united by the idea of overcoming colonial dependence on the Russian Empire. The author aims to form a holistic view of a galaxy of outstanding personalities who, in an important historical period, were able to take responsibility for the people and their future. The history of the country is perceived through the prism of their destinies, views, activities and death. The material of the book is a biographical sketch and covers the history of Kazakhstan in the first third of the twentieth century, until the period of the Great Terror (1937–1938). Ainash Mustoyapova is Candidate of Philological Sciences, Associate Professor, and is the author of more than 60 scientific and educational publications and more than 150 journalistic articles. Kurzfassung: The seduction-theory defines film in a broader sense as a medium of seduction, based on the French concept of séduction. It is a theoretical approach influenced by continental philosophy and classical film theory, linked to a three-stage analytical model. The book introduces the theoretical foundations and, using various classical and contemporary examples from film history, presents a genuine method of film analysis. The Author Prof. Dr. Marcus Stiglegger teaches Film and Image Studies in Muenster and Regensburg. The translation was done with the help of artificial intelligence. Kurzfassung: This book presents research in the field of housing and urban analysis in Japan. It features carefully selected English translations of peer-reviewed articles published in journals in Japan, especially by authors involved in the laboratory supervised by Professor Yasushi Asami. The topics covered include economic analysis of the housing market, analyses of residential environment and human behaviour/psychology, analyses related to urban policies such as intermunicipal cooperation, teleworking and solar photovoltaics installation, spatial analyses of urban entities and effective visualization. Housing and urban analysis has developed using theory and methods in the fields of economics, regional science, geography, statistics, spatial psychology and urban sociology. Even though the methods of analysis differ from chapter to chapter, the ultimate goal of the research is the same. Namely, the target of the research is a better understanding of urban phenomena and effective improvement of urban space and society. The academic contributions in this collection of work are helpful for academics, practitioners and policy makers not only in Japan but also in other Asian countries. .

Kurzfassung: This open access book provokes critical thinking regarding the most ambitious Chinese project since the founding of the People’s Republic of China, The Belt and Road Initiative (BRI). The book presents extensive quality research and original insights in assessing the status of China’s outbound investment and construction projects under the BRI umbrella. Referring to case studies and projects of selected countries from Southeast Asia, Central Asia, and the Middle East, the author sheds new light on the issues and problems associated with the BRI's implementation and discusses both the readjustments and prospects for the BRI. Finally, this book demarcates the limits and potential of the world’s second largest economy in pushing for the BRI, which is challenged by enormous domestic tensions and external pressures. It also identifies and analyzes potential new collaboration areas between the Belt and Road countries and China under the BRI framework in the context of the post-COVID-19 era. It provides an outstanding reference for academics, students, policymakers, and the business community working in areas of international affairs and Asian economics and development, particularly those interested in Sino-relations and Chinese power dynamics in the global world order.

Kurzfassung: Chapter 1 Introduction -- Chapter 2 GVC participation and trade -- Chapter 3 Upgrading in GVCs -- Chapter 4 Measuring connectivity in global maritime and aviation networks -- Chapter 5 Technological intensities of exports in East Asia.
Kurzfassung: This book aims to investigate the global value chain (GVC) from a viewpoint of industrial development and examine how GVC participation, upgrading, and connectivity have affected structural transformation in developing economies. It first reviews the indexes to measure progresses in GVC participation and upgrading. Then it examines factors affecting these progresses, using original measures of connectivity, which are computed based on the complex network theory. Another distinguished feature of the study is its in-depth analyses on the relationship between economic development and GVC participation based on the hypothesis of nonlinear relationship which is drawn from authors past studies on Asian economies. Major findings include (1) inverted-U shaped relationship between backward participation and income levels, (2) U shaped relationship between forward participation and income level, (3) marginal but significant impacts of maritime and aviation connectivity on GVC participation, (4) significant and different roles of basic and advanced education on the upgrading in GVCs, and (5) the importance of technological intensities in export in sustaining economic growth.

Kurzfassung: This book covers various data scientific approaches to analyze the issue of grid integration of renewable energy for which the grid flexibility is the key to cope with its intermittency. It provides readers with the scope to view renewable energy integration as establishing a distributed energy network instead of the traditional centralized energy system. Specifically, quantitative valuation system-wise of the levelized cost of energy, which includes both initial cost and various operational costs, enables readers to optimize energy systems in order to minimize economic cost and environmental impact. It is noted, however, that the high cost of integrating renewable energy on a large scale might slow economic growth considerably. Topics addressed in the book also include statistical comparative study of the relationship between energy and economic growth, a graphical model of determinant factors for foreign direct investment in renewable energy, the coupled oscillator model and unit commitment model to capture intermittency of renewable energy, and the network model of evolving micro-grids. The book explains desired innovation to reduce the integration cost significantly using innovative technologies such as energy storage with hydrogen production and vehicle-to-grid technology. Illustrated by careful analysis of selected examples of renewable integration using different types of grid flexibility, this volume is indispensable to readers who make policy recommendations to establish the distributed energy network integrated with large-scale renewable energy by disentangling the nexus of energy, environment, and economic growth.

Kurzfassung: This book, a bestseller in China with over a million copies sold, depicts the role played by the Chinese government in China‘s economic development. It explains how the Chinese government has gradually established and improved market mechanisms while promoting economic growth. The book particularly points out that the Chinese government not only governs the economy through policy guidance but also directly participates in the process of urbanization and industrialization as part of the market. It also introduces the specific mechanisms of government involvement in economic activities, which forms a bridge between economic theory and the reality of China. This book, a winner of the Wenjin Book Award by the National Library of China, will be an invaluable reference for scholars seeking to understand China‘s economic policy and government system reform in the years to come. Xiaohuan Lan is a professor of economics at the School of Economics, Fudan University. He is also a research fellow at the Shanghai Institute and International Finance and Economics. He received his PhD in economics from the University of Virginia. Kurzfassung: This book exploratively reviews and refines the theoretical system of economics with Chinese characteristics and the analytical framework of Chinese path to modernization. This book aims to reveal answers to the three questions: what has the theoretical system of economics with Chinese characteristics inherited and developed? What are the experiences and lessons of all countries’ modernization in the world? What is the universality and particularity of Chinese Path to Modernization? As conclusion, the author draws a clue to understand Chinese path to modernization, which is neither “making up for the lessons” nor a “convergence”, but an “innovation” built upon the general principles of modernization. Its universality lies in the overall patterns and trends of modernization, that is, the consistent process of the country's pursuit of national economic growth and people's prosperity. The distinctiveness of this path lies in the concurrent transformation of Chinese economic system and the institutional innovations with Chinese characteristics that unfold throughout this ongoing economic process.

Kurzfassung: Introduction -- Reflecting on Australia’s Current Legal System -- Personal Stories -- How we Can Change the Current Legal System -- Conclusion.
Kurzfassung: This groundbreaking book delves into the lived experiences and collective wisdom of Indigenous communities impacted by colonialism. Through collaborations with non-Indigenous colleagues, this book seeks to inform current legal practices and advocate for a transformative shift toward justice, equity, and the recognition of First Law and Earth-centered law. By presenting Indigenous stories as case studies and incorporating the collective wisdom gained through extensive discussions and exchanges with non-Indigenous colleagues, the authors highlight the ways in which Australian law falls short in upholding holistic principles and fails to align with First Law and Earth-centered law. The book invites readers to consider alternative legal futures that are rooted in respect, justice, and the well-being of both Indigenous peoples and the natural environment. Through its thought-provoking analysis, literature reviews, and insights from Indigenous leaders, this book serves as a powerful resource for legal practitioners, policymakers, scholars, and anyone passionate about social justice and environmental sustainability. The book aims to ignite meaningful dialogue and inspire concrete actions to address the historical injustices faced by Indigenous peoples while fostering a more inclusive and equitable legal framework for the generations to come.

Kurzfassung: This book thoroughly reviews China’s participation in the WTO dispute settlement system with a focus on the interaction between China’s distinctive institutional characters and international legal regime and an aim of not only revealing the Chinese phenomenon but also identifying the Chinese mode and the rationale that lies behind China’s mode change. It further analyzes two fundamental issues China is confronted with. One is the distinctive member status issue of China due to the concurrence of its multiple member status as member state, accessing member state and developing member state. The other is the issue of invoking and applying the special rules of The Protocol on the Accession of China in the WTO dispute settlement. In-depth examination of assorted cases that involve China and representative individual cases thereof, is also provided. Upon the insight into Chinese phenomenon and Chinese issues in the WTO dispute settlement, the book tries to respond to the imminent need of reforming the WTO dispute settlement regime by providing directions that accord with the regular pattern of evolution of international economic law system and pragmatic suggestions that stem from China’s strategic position. This book serves for academics, policymakers, and business practitioners by providing useful insights into the legal, regulatory, and economic issues raised by distinctive character of China in WTO dispute settlement.

This book reflects the author's thoughts and views on international economic law and its application based on his experience advising government departments and entities, particularly insights into the U.S.-China trade war from the perspective of a Chinese scholar. Kurzfassung: This book concerns how China's legal institutions promoted its economic growth and demonstrates that the law has played different roles at various stages of China's economic transformation, a signal of legal paradigm shifts in reaction to the changing political and economic pursuits. By decomposing the role of law in the process, the author argues that while the Chinese economy was transforming from a planned economy to a market-oriented one, the law also made its adjustment as a response—the Chinese legal system was evolving from the one consisting of primarily substantive laws to the one filled with high-level formal laws by the end of the last century. The above observation of legal formalization is further consolidated by introducing the particularities of China's legal education in those years—a topic rarely dealt with yet of significance to comprehensively understand the Chinese legal system in practice. Overall, the present book argues against the modernization theory and determinism that would anticipate a similar developmental path globally and shows that the relationship between law and economic development is contingent. Therefrom, this study weighs in the law and development debate and breaks a perception of static law in the economy by rejecting the conventional perception of established legal institutions as a precondition of modernity. Hence, this book could appeal to legal scholars and sociologists interested in reevaluating western theories of free economy and its relationships to the law. In addition, scholars interested in research methodology would find the perspective of paradigm shifts in interpreting China's transformations a helpful analytical framework in research. Moreover, policymakers and legislators concerned about the characteristics of law for economic results would also find the book useful.

Kurzfassung: This book systematically discusses the contents of the administrative right to know, the right to information, the right to gene, euthanasia and other emerging rights. The purpose of this book is to attract legal scholars to pay attention to these right changes in the process of China's social transformation, analyze the basic laws of right changes under the specific background of China's society and provide a theoretical system model for the establishment of China's legislative right recognition and right relief system. The typical feature of contemporary China is all-round social transformation. In such a transitional period, the construction of democracy, legal system and political system in China is gradually unfolding and developing with its unique mode. In the construction of legal system and the practical operation of legal system, the concept of rights, the thinking of rights and the logic of rights have in fact been running through the social and legal practice in China for decades since the reform and opening up and have always become its background, keynote and background. Its typical realistic symptom is that a large number of rights belong to "new" for "China" the germination and birth of the type. In this context, this book tries to combine the general theory with the specific reality of the right landscape and preliminarily explores and explains the generation mechanism, existence basis, development logic and basic connotation of the "new" types of rights, that is, the main "emerging" or "new" types of rights in the transitional Chinese society. The purpose of this book is to draw the attention of the colleagues in the field of law to the reality of the emergence and development of "emerging" rights in our society. At the same time, taking this as an example, I hope that the colleagues in the field of law can deepen the study of rights, especially from the general and macro-study of rights to the more specific and micro-study of rights.

Kurzfassung: This book demonstrates the social and historical conditions for the existence and development of the representative system and uncovers the laws dictating its occurrence, development and operation. Due to the barriers of language and cultural communication, the understanding of democracy differs in western and Chinese cultures, which leads to many misinterpretations and even bias. The book displays the merits and drawbacks of different forms of democracy on the basis of a comparative study of the different representative systems and argues that different representative systems can co-exist side by side and that the selection of the appropriate form of democracy must reflect the actual conditions in a given country. Therefore, a blind evaluation or criticism is unreliable. The book could provide good opportunities for western scholars to see how the Chinese scholars understand democracy and the representative system, help the westerners to understand the forms of democracy with Chinese characteristics and rationality of the socialist people’s representative system, grasp the true essence of Chinese Constitution and democracy and give up their bias towards China for a better communication and mutual understanding. This book constructs a theoretical framework for studying the representative system and provides a solid foundation for its further research, promoting the improvement and development of constitutional jurisprudence. Even today, the comparative study of the basic theories, system building, and operation of the representative system are of great theoretical significance and practical value in the Chinese political development and reform. The book is primarily intended for graduates and scholars in the areas of constitutional jurisprudence on China and abroad. It is a must-read for constitutional researchers and those who want to know the essential differences between Chinese and Western constitutional jurisprudence.

Kurzfassung: Sui generis rights in the intellectual property system -- Sui generis intellectual property protection for databases -- Sui generis intellectual property protection for designs -- Sui generis intellectual property protection for plant varieties -- Sui generis intellectual property protection for works generated by AI systems.
Kurzfassung: The standard forms of intellectual property protection, namely, copyright, patents, trademarks and trade secrets, have a long history and are well regulated in the legislative systems of most jurisdictions. However, there are specific kinds of subject matter that, due to their characteristics, cannot be adequately protected by these standard forms of intellectual property instruments. At the same time, these categories of subject matter require legal protection in order to ensure the balance between the public's access to these creations and the creators' rights. For these reasons, many jurisdictions introduce a special form of intellectual property protection, namely, sui generis regime, i.e., intellectual property legal regime “of its own kind”, designed to serve the specific needs of a particular subject matter. This book analyzes the intellectual property protection regimes in the EU and the U.S. available for three categories of subject matter that are often considered as requiring sui generis protection, namely, databases, designs and plant varieties. One of the main objectives is to evaluate whether the chosen subject matter in fact requires sui generis intellectual property protection and whether the introduced sui generis regimes have proved to be successful over time. The final chapter of this book analyses the perspectives of sui generis intellectual property protection for works generated by AI systems. This volume offers a comprehensive analysis of sui generis intellectual property rights and will be a key source for both scholars and practitioners with an interest in intellectual property law. .

Kurzfassung: The unification of international commercial law has been a common course for every country of the world. The U.N. Convention on Contracts for International Sale of Goods (CISG) is a milestone in creating a uniform law in the field of the international sale of goods. The CISG coordinated divergent political, economic, and legal systems combined different contract laws and set up a comprehensive and independent legal framework for the international sale of goods. This book examines the basic requirements and criteria of the CISG’s interpretation and investigates how to achieve the uniform interpretation of the CISG based on interpretation rules in the CISG and through appropriate legal interpretation approaches. As a comprehensive and uniform legal framework for the international sale of goods, the CISG still has gaps to fill. Therefore, a uniform interpretation in gap-filling is equally important for the CISG. This book discusses gap-filling in the CISG, explains why and how to fill its gaps, clarifies gap-filling approaches, their order of application, and eventually concentrates on general principles and the uniform interpretation of the CISG. Another feature of the book is to discuss the supplementary materials that could be used to assist in the uniform interpretation of the CISG. PICC, foreign cases, UNCITRAL Digest, and the CISG Advisory Council opinions will be examined in detail to see whether and how they can fill the gaps in the CISG and promote its uniform interpretation. Only by clarifying the basic requirements and principles relating to the CISG’s uniform interpretation, can courts and arbitral tribunals correct their attitude toward and practices in the interpretation of the CISG. Only by following the autonomous interpretation approach, can the CISG achieve its goal to unify the sale of goods laws and promote the development of international commerce.
