    Abstract: Dieses Buch analysiert, ob und wie transnationale Unternehmen durch rechtliche Bindungen effektiv zur Einhaltung elementarer Menschenrechte verpflichtet werden können. Darüber hinaus werden auch die gesellschaftspolitischen Aussichten möglicher Strategien reflektiert. Das Buch zielt zwar auf alle Arten von Menschenrechten. Der Untersuchungsgegenstand ist jedoch bewusst auf die Kernarbeitsnormen der ILO beschränkt. Das Werk berücksichtigt gesellschaftsrechtlich verbundene Unternehmen ebenso wie die Möglichkeit einer Regulierung zum Schutz vor Menschenrechtsverletzungen im Zusammenhang mit wirtschaftlichen Aktivitäten von Unternehmen in globalen Lieferketten. Das Buch untersucht privatrechtliche und völkerrechtliche Strategien. Anhand ausgewählter Ansätze kommt die Autorin zu dem Ergebnis, dass keine rechtliche Notwendigkeit für den gegenwärtigen Zustand eines defizitären Schutzes vor Menschenrechtsverletzungen im Zusammenhang mit wirtschaftlichen Aktivitäten von Unternehmen besteht. Die Autorin legt dar, dass Defizite der Diskussion auch darin bestehen, dass regelmäßig eine Reflexion der Durchsetzungschancen und -möglichkeiten der an sich notwendigen rechtspolitischen Strategien fehlt

    Abstract: "If you want a simple representation of the twentieth-century economy, picture a large corporation as a box. To do the same for today's economy, though, we need to blow up that box and reassemble the pieces into a network. The network is global, stretching across the planet untethered to political and legal boundaries. This is the economy of the twenty-first century, characterized by ever-expanding global supply chains and communication systems. In 2005, Thomas Friedman reduced this phenomenon to one phrase, the title of his massively successful book: The World is Flat. Of course, the phrase is misleading. The world may be getting flatter in some places, but there are still many factors that tilt the odds in favor of some locations over others. Law and economics professor Gillian Hadfield picks up where Friedman's book left off, by peeling back the technological layer to look at what lies beneath-our legal infrastructure-and argues that the outdated legal system is, in fact, largely responsible for our still-slanted world. Put simply, the law and legal methods on which we currently rely have failed to evolve along with technology.     Abstract: Contractual knowledge: One hundred years of legal experimentation in global markets', edited by Grégoire Mallard and Jérôme Sgard, extends the scholarship of law and globalization in two important directions. First, it provides a unique genealogy of global economic governance by explaining the transition from English law to one where global exchanges are primarily governed by international, multilateral, and finally, transnational legal orders. Second, rather than focusing on macro-political organizations, like the League of Nations or the International Monetary Fund, the book examines elements of contracts, including how and by whom they were designed and exactly who (experts, courts, arbitrators, and international organizations) interpreted, upheld, and established the legal validity of these contracts. By exploring such micro-level aspects of market exchanges, this collection unveils the contractual knowledge that led to the globalization of markets over the last century

    Abstract: Local Space, Global Life engages with the expansive, ground-level and intertwined operations of international law and the development project by discussing the current international focus on local jurisdictions. Since the mid-1980s, and through the discourse of decentralization, municipalities and cities in emerging nations have become the preferred spaces in which to promote global ideals of human, economic and environmental development. Through an ethnographic study of Bogotá's recent development experience and the city's changing relation to its illegal neighbourhoods, Luis Eslava interrogates this rationale and exposes the contradictions involved in the international turn to the local. Attentive to historical and current transformations, norms and praxis, and both ideology and materiality, he provides an innovative reading of the nature of international law and the development project, and reveals their impact on local spaces and lives at the urban periphery of today's world order.

    Abstract: This book examines the impact and shortcomings of the TRIPS Agreement, which was signed in Marrakesh on 15 April 1994. Over the last 20 years, the framework conditions have changed fundamentally. New technologies have emerged, markets have expanded beyond national borders, some developing states have become global players, the terms of international competition have changed, and the intellectual property system faces increasing friction with public policies. The contributions to this book inquire into whether the TRIPS Agreement should still be seen only as part of an international trade regulation, or whether it needs to be understood – or even reconceptualized – as a framework regulation for the international protection of intellectual property. The purpose, therefore, is not to define the terms of an outright revision of the TRIPS Agreement but rather to discuss the framework conditions for an interpretative evolution that could make the Agreement better suited to the expectations and needs of today’s global economy.

    Abstract: Whether in global markets, in the EU, or in international law - constitutions are long being formed beyond the state with severe consequences. In this post-democratic constitutionalism, a market-liberal program is given the status of an unquestionable consensus, reinforced by a higher-ranking law. Kolja Möller connects system theory, post-Marxist resources, and democracy theory to show, using different examples: Neither returning to national democracy nor spreading individual global citizen rights will improve this situation. Instead, a deposing power is needed to resolve the substantive over-formation of constitutions beyond the state. The new and critical constitutional theory thus created challenges the current diagnoses of declining status of democracy, and sheds a new light on the "democratic deficit" of globalization

    Abstract: This volume identifies, discusses and addresses the wide array of ethical issues that have emerged for engineers due to the rise of a global economy. To date, there has been no systematic treatment of the particular challenges globalization poses for engineering ethics standards and education. This volume concentrates on precisely this challenge. Scholars and practitioners from diverse national and professional backgrounds discuss the ethical issues emerging from the inherent symbiotic relationship between the engineering profession and globalization. Through their discussions a deeper and more complete understanding of the precise ways in which globalization impacts the formulation and justification of ethical standards in engineering as well as the curriculum and pedagogy of engineering ethics education emerges. The world today is witnessing an unprecedented demand for engineers and other science and technology professionals with advanced degrees due to both the off-shoring of western jobs and the rapid development of non-Western countries. The current flow of technology and professionals is from the West to the rest of the world. Professional practices followed by Western (or Western-trained) engineers are often based on presuppositions which can be in fundamental disagreement with the viewpoints of non-Westerners. A successful engineering solution cannot be simply technically sound, but also must account for cultural, social and religious constraints. For these reasons, existing Western standards cannot simply be exported to other countries. Divided into two parts, Part I of the volume provides an overview of particular dimensions of globalization and the criteria that an adequate engineering ethics framework must satisfy in a globalized world. Part II of the volume considers pedagogical challenges and aims in engineering ethics education that is global in character
