    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. All countries are members of the European Union and share common European norms and values, but the Covid-19 pandemic can serve as an example of how these norms and values are interpreted differently with regard to people’s trust in public institutions, governmental control strategies, dealing with fear, anxiety and other emotional responses to the new virus, crime patterns and law enforcement priorities to prevent and combat them.     Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

    Abstract: The so-called 'spatial turn' in the social sciences has led to an increased interest in what can be called the spatialities of power, or the ways in which power as a medium for achieving goals is related to where it takes place. This unique and intriguing Handbook argues that the spatiality of power is never singular and easily modeled according to straightforward theoretical bullet-points, but instead is best approached as plural, contextually emergent and relational. The Handbook on the Geographies of Power consists of a series of cutting edge chapters written by a diverse range of leading geographers working both within and beyond political geography. It is organized thematically into the main areas in which contemporary work on the geographies of power is concentrated: bodies, economy, environment and energy, and war. The Handbook maintains a careful connection between theory and empirics, making it a valuable read for students, researchers and scholars in the fields of political and human geography.     Abstract: This book is focussing on the results of the mobil.LAB Doctoral Research Group “Sustainable mobility in the metropolitan region of Munich” for its first phase. It highlights the key findings of young scientists from diverse disciplines on selected issues of sustainable mobility, such as neighbourhood mobility, sustainable modes, regional governance and spatial aspects. This includes insights of methods used to assess sustainable mobility, the way how to study and how to conceptualize sustainable development in each of the contributions. Constitutional Review in Mexico: A Best of All Worlds Solution? -- 6. General Conclusions.
    Abstract: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction. .

    Abstract: This book presents an analysis of why some large infrastructure projects are delayed or compromised and offers important insights into the better delivery of future projects. It provides an important reaction to the ambitious €315 billion investment plan devised by the European Commission, wherein Europe's infrastructure is a key investment target. Germany is adopted as a focus, as Europe's largest economy, and a nation that has seen significant delays and tensions in the delivery of key infrastructure projects. The contributions to this volume demonstrate various patterns for infrastructure assets and illustrate how factors such as poor project governance, early planning mistakes, inappropriate risk management and unforeseen technological challenges influence delivery. The in-depth case studies on the Berlin Brandenburg Airport, the Hamburg Elbphilharmonie, and offshore wind parks show how project delivery can face massive problems, and illuminating solutions are offered to these problems. Overall, the case of Germany also offers the opportunity to assess various new forms of project delivery, such as public-private partnerships (PPP), and the risks and opportunities of ambitious first-mover 'pioneer' projects. The book will be of great interest for scholars and upper-level students of human geography, business and management, as well as policy makers.

    Abstract: The primary purpose of a patent law system should be to enhance economic efficiency, in particular by providing incentives for making inventions. The conventional wisdom is that patents should therefore be strictly exclusive rights. Moreover, in practice patent owners are almost never forced to give up their right to exclude others and receive only a certain amount of remuneration with, for instance, compulsory licensing. Other economically interesting patent-law objectives, however, include the transfer and dissemination of knowledge. Mechanisms exist by which the patent owner decides if he or she would prefer exclusive or non-exclusive rights, for instance the opportunity to declare the willingness to license and create patent pools. But it is questionable whether these mechanisms are sufficient and efficient enough in view of the existence of patent trolls and other problems. This work challenges the conventional wisdom to a certain extent and makes proposals for improvements

    Abstract: This book analyzes in detail differing interpretations of the rule of law in Western legal systems and in the People's Republic of China. As the rule of law is seen by many as a prerequisite for China's future development, politicians, activists and entrepreneurs from China and from the West alike have long been calling for adherence to this principle, which is constitutive of Western democracies. All these groups use the same words, but do they truly share the same idea? In order to address this question, the book compares the "Rule of Law with Chinese characteristics," as propagated by Chinese leaders and in official Chinese publications, to different applications of the rule of law as it is understood in Western civilization. In particular, the author takes a closer look at the implementations of recognized core elements of the rule of law in representative Western countries, which include the separation of power, the supremacy of law, the protection of fundamental rights, and the independence of the justice system

    Abstract: Acclaimed as the "the most objective prosecutors in the world", the German prosecution service has long attracted the attention in the past of comparative law scholars. At first glance, the institutional position and statutory mandate of German prosecutors indicate that that reputation is well-deserved. Unfortunately, the introduction of charge-bargaining has opened the door to criticism that German prosecutors have abandoned their role of objective decision-makers. Using interview data collected from interviews with German prosecutors themselves as well as quantitative data, the book uses the actual voices of German prosecutors to show how real-world constraints, rather than changes in the law, undermine the ability of German prosecutors to objectively seek the truth. The book will take readers behind closed doors where prosecutors discuss case decisions and unveil the realities of practice. As a result, it will critically revise previous studies of German prosecution practices and offer readers a well-researched ethnographic analysis of actual German decision-making practices and the culture of the prosecution service. Unlike prosecutors in America's adversarial system, whom critics claim are driven by a "conviction-mentality" and gamesmanship, German prosecutors are institutionally positioned to function as (at least semi-)judicial officials dedicated to finding a case's objective truth. The book argues that, organizational incentives and norms, rather than the boundaries of the law determinately shapes how prosecutors investigate and prosecute crime in Germany

    Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.

    Abstract: This volume addresses the historical structures and current dynamics of Oman’s regionalization processes and their political, economic and social dimensions. It is based on an interdisciplinary and trans-regional dialogue between scholars from different social sciences and area studies such as political science, economics, management, economic and social geography, history, social anthropology and linguistics as well as Middle East/West Asian, gulf and African studies, and develops four major axes of research: - Oman’s integration into global and regional flows of goods, capital, people and ideas; - The multi-scaled political negotiation of such integration (or disintegration) processes; - Consequences of suchlike processes and forms of regionalization for (translocal) actors; - Ideas and strategic communication of regional belonging and the constitution of regions. Each chapter deals with one or more of these issues. Part I deals with concepts of regionalisation and region-building and presents different approaches that accentuate certain dimensions of these processes and come from different disciplinary backgrounds. Part II focuses on the translocal, transnational and (trans)regional movement of people, their practices and imaginations, be they contemporary labour in- and out-migrants, returnees from Eastern Africa or nomadic tribal members. Part III takes a closer look particularly at economic issues and regionalisation processes that are mainly based on multiple trade links, regional development policies or politics of regionalism. Part IV analyses political and socio-cultural issues in regional and global perspectives.

    Abstract: This book offers an original analytic and theorization of the biopolitics of development in the postcolonial present, and draws significantly from the later works of Michel Foucault on biopolitics. Foucault’s works have had a massive influence on postcolonial literatures, particularly in political science and international relations, and several authors of this book have themselves made significant contributions to that influence. While Foucault’s thought has been inspirational for understanding colonial biopolitics as well as governmental rationalities concerned with development, his works have too often failed to inspire studies of political subjectivity. Instead, they have been used to stoke the myth of the inevitability of the decline of collective political subjects, often describing an increasingly limited horizon of political possibilities, and provoking a disenchantment with the political itself in postcolonial works and studies. Working against the grain of current Foucauldian scholarship, this book underlines the importance of Foucault’s work for the capacity to recognize how this degraded view of political subjectivity came about, particularly within the framework of the discourses and politics of ‘development’, and with particular attention to the predicaments of postcolonial peoples. It explores how we can use Foucault’s ideas to recover the vital capacity to think and act politically at a time when fundamentally human capacities to think, know and to act purposively in the world are being pathologized as expressions of the hubris and ‘underdevelopment’ of postcolonial peoples. Why and how it is that life in postcolonial settings has been depoliticized to such dramatic effect? The immediacy of these themes will be obvious to anyone living in the South of the world. But within the academy they remain heavily under-addressed. In thinking about what it means to read Michel Foucault today, this book tackles some significant questions and problems: Not simply that of how to explain the ways in which postcolonial regimes of governance have achieved the debasements of political subjectivity they have; nor that of how we might better equip them with the means to suborn the life of postcolonial peoples more fully; but that of how such peoples, in their subjection to governance, can and do resist, subvert, escape and defy the imposition of modes of governance which seek to remove their lives of those very capacities for resistance, subve ...

    Abstract: This work aims to analyse substantive and conflict of laws rules regarding intermediated securities in a comparative way. For this purpose, it examines major jurisdictions rules for intermediated securities and the intermediated securities holding systems, such as the rules of the German, US, Korean, Japanese and Swiss systems, as well as the relevant EU regimes and initiatives. Above all, it analyses the two international instruments related to intermediated securities, i.e. the Geneva Securities Convention and the Hague Securities Convention. Through a functional comparative approach based upon legal traditions of the various jurisdictions, this book gives readers theoretical and practical information on intermediated securities and their national and international aspects.

    Abstract: Corporate governance encompasses the free enterprise system, which is treated comprehensively in this book from a German perspective. This distinguishes the book from other books written in English in this subject area, not only because of the comprehensive way it covers German corporate law and corporate governance, but also because of the fact that it provides international and European perspectives on these important topics. This second edition is an extensively revised and updated version of the first edition, in particular with a view to the worldwide debt crisis. The authors provide readers with an overview of the unique features of German business and enterprise law and an in-depth analysis of the organs of governance of German public limited companies (general meeting, management board, supervisory board). In addition, approaches for reforms required at the international level are also suggested and discussed, including, among others, the unique interplay and dynamics of the German two-tier board model with the system of codetermination, referring to the arrangement of employees sitting on the supervisory boards of German public limited companies and private companies employing more than 500 employees; also covered are significant recent legal developments in Europe. The book highlights the core function of valuation and financial reporting at the international, European and German levels, with accounting as the documentary proof of good corporate governance. It also expands the scope of the first edition by a treatment of the German financial sector, global corporate finance and governance, and by including a new chapter on compliance of corporate governance laws, rules and standards in Germany. As far as comparative law is concerned, new developments in the area of corporate governance in the EU, the OECD Principles of Corporate Governance and corporate governance in the US, the UK and Australia are covered.     Abstract: How does copyright law take into account the interests of third parties, especially the general publics interest in the greatest possible dissemination of knowledge and culture?     Abstract: Das Inkrafttreten des Vertrags von Lissabon hat auch für das europäische Strafrecht erhebliche Änderungen mit sich gebracht: Der Grundsatz der gegenseitigen Anerkennung wurde zum zentralen Strukturprinzip erhoben und die Kompetenzen der EU zur Strafrechtsharmonisierung erheblich erweitert. Zudem soll nach überwiegender Ansicht die EU nunmehr auch erstmals zur Schaffung echten supranationalen Strafrechts ermächtigt sein. Den Gegenpol zu dieser zunehmenden Supranationalisierung des Strafrechts bildet zumindest aus deutscher Sicht die Rechtsprechung das BVerfG, das in seinem Lissabon-Urteil versucht, diesem deutlich erweiterten Handlungsspielraum der EU Grenzen zu ziehen. Der vorliegende Band will Wege aufzeigen, wie dieses Spannungsfeld zwischen Europäisierung und Bewahrung einzelstaatlicher Souveränität in dem besonders sensiblen Bereich des Strafrechts gelöst oder zumindest entschärft werden kann. Ziel muss es sein, die mit der Erweiterung der strafrechtlichen Kompetenzen der EU verbundenen Risiken zu bewältigen und die sich eröffnenden Chancen zu nutzen. Die Beiträge sind überwiegend aus dem IV. Kolloquium des Instituts für Kriminalwissenschaften der Georg-August-Universität Göttingen (2. Juli 2010) hervorgegangen, wurden z.T. aber auch exklusiv für diesen Band erstellt.

    Abstract: The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by over 90 jurisdictions which participate in the work of the Global Forum on an equal footing. The Global Forum is charged with in-depth monitoring and peer review of the implementation of the standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004, which has been incorporated in the UN Model Tax Convention. The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. “Fishing expeditions” are not authorised, but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard. All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 plus Phase 2 – reviews. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes. All review reports are published once approved by the Global Forum and they thus represent agreed Global Forum reports.
