    Abstract: Zugang zu Land ist begehrt und umkämpft. Das verdeutlichen Konflikte, die weltweit im Zusammenhang mit land grabbing auftreten. Wie aber lassen sich Entstehung und Verlauf dieser Konflikte erklären? Dieser Frage nähert sich Sarah Kirst in einer Fallstudie zu zwei Konflikten um Zugang zu Land im Kontext der Umsetzung agrarindustrieller Vorhaben in Ghana. Aus machtkritischer Perspektive beleuchtet sie die Rolle traditioneller Autoritäten, die zentrale Akteur*innen in diesen Konflikten sind. Ihre Analyse entschlüsselt die Bedeutung unterschiedlicher Machtformen für Konfliktentstehung und -verlauf und zeigt soziale Ungleichheitsverhältnisse im Kontext von land grabbing auf

    Abstract: Dieses Buch analysiert grundlegend die Rechtsprechung nationaler und supranationaler Verfassungsgerichte in Mehrebenenordnungen. Anknüpfend an den Verfassungspluralismus und die Netzwerktheorie entwickelt es mit „Konstitutionalismus im Netzwerk“ ein verfassungstheoretisches Modell der Rolle der Verfassungsgerichtsbarkeit jenseits des Nationalstaats. Es erklärt, wie sich Verfassungsgerichte durch richterrechtliche Normbildungsprozesse auf ein europäisches und globales Gemeinverfassungsrecht verständigen. Auf dieser Folie untersucht das Buch rechtsvergleichend rechtsordnungsübergreifende Rechtsprechungsentwicklungen zum Verhältnis zwischen den Rechtsordnungen, etwa zur Bindungswirkung internationaler Gerichtsurteile, zur Kontrolle völkerrechtlicher Gründungsverträge, zur Verfassungsidentität, zum Solange-Grundsatz und zur Ultra-Vires-Kontrolle und erörtert, inwieweit sich diese als Bausteine für eine nach den Prinzipien des Konstitutionalismus zu gestaltende vernetzte Weltordnung eignen.

    Abstract: Urban Sustainability and Justice presents an innovative yet practical approach to incorporate equity and social justice into sustainable development in urban areas, in line with the commitments of the UN’s Sustainable Development Goals and the New Urban Agenda. This open access work proposes a feminist reading of just sustainabilities' principles to reclaim sustainability as a progressive discourse which informs action on the ground. This work will help the committed activist (whether they are on the ground, working in a community, in a non-governmental organization (NGO), in a business, at a university, in any sphere in government) to connect their work to international efforts to deliver environmental justice in cities around the world. Drawing on a comparative, international analysis of sustainability initiatives in over 200 cities, Castán Broto and Westman find limited evidence of the implementation of just sustainabilities principles in practice, but they argue that there is considerable potential to develop a justice-oriented sustainability agenda. Highlighting current successes while also assessing prospects for the future, the authors show that just sustainabilities is not merely an aspirational discourse, but a frame of reference to support radical action on the ground.     Abstract: Dieses Buch analysiert, ob und wie transnationale Unternehmen durch rechtliche Bindungen effektiv zur Einhaltung elementarer Menschenrechte verpflichtet werden können. Darüber hinaus werden auch die gesellschaftspolitischen Aussichten möglicher Strategien reflektiert. Das Buch zielt zwar auf alle Arten von Menschenrechten. Der Untersuchungsgegenstand ist jedoch bewusst auf die Kernarbeitsnormen der ILO beschränkt. Das Werk berücksichtigt gesellschaftsrechtlich verbundene Unternehmen ebenso wie die Möglichkeit einer Regulierung zum Schutz vor Menschenrechtsverletzungen im Zusammenhang mit wirtschaftlichen Aktivitäten von Unternehmen in globalen Lieferketten. Das Buch untersucht privatrechtliche und völkerrechtliche Strategien. Anhand ausgewählter Ansätze kommt die Autorin zu dem Ergebnis, dass keine rechtliche Notwendigkeit für den gegenwärtigen Zustand eines defizitären Schutzes vor Menschenrechtsverletzungen im Zusammenhang mit wirtschaftlichen Aktivitäten von Unternehmen besteht. Die Autorin legt dar, dass Defizite der Diskussion auch darin bestehen, dass regelmäßig eine Reflexion der Durchsetzungschancen und -möglichkeiten der an sich notwendigen rechtspolitischen Strategien fehlt

    Abstract: "A rich investigation into Morocco's urban politics Over the past thirty years, Morocco's cities have transformed dramatically. To take just one example, Casablanca's medina is now obscured behind skyscrapers that are funded by global capital and encouraged by Morocco's monarchy, which hopes to transform this city into a regional leader of finance and commerce. Such changes have occurred throughout Morocco. Megaprojects are redesigning the cityscapes of Rabat, Tangiers, and Casablanca, turning the nation's urban centers into laboratories of capital accumulation, political dominance, and social control. In Globalized Authoritarianism, Koenraad Bogaert links more abstract questions of government, globalization, and neoliberalism with concrete changes in the city. Bogaert goes deep beneath the surface of Morocco's urban prosperity to reveal how neoliberal government and the increased connectivity engendered by global capitalism transformed Morocco's leading urban spaces, opening up new sites for capital accumulation, creating enormous class divisions, and enabling new innovations in state authoritarianism. Analyzing these transformations, he argues that economic globalization does not necessarily lead to increased democratization but to authoritarianism with a different face, to a form of authoritarian government that becomes more and more a globalized affair. Showing how Morocco's experiences have helped produce new forms of globalization, Bogaert offers a bridge between in-depth issues of Middle Eastern studies and broader questions of power, class, and capital as they continue to evolve in the twenty-first century."     Abstract: "If you want a simple representation of the twentieth-century economy, picture a large corporation as a box. To do the same for today's economy, though, we need to blow up that box and reassemble the pieces into a network. The network is global, stretching across the planet untethered to political and legal boundaries. This is the economy of the twenty-first century, characterized by ever-expanding global supply chains and communication systems. In 2005, Thomas Friedman reduced this phenomenon to one phrase, the title of his massively successful book: The World is Flat. Of course, the phrase is misleading. The world may be getting flatter in some places, but there are still many factors that tilt the odds in favor of some locations over others. Law and economics professor Gillian Hadfield picks up where Friedman's book left off, by peeling back the technological layer to look at what lies beneath-our legal infrastructure-and argues that the outdated legal system is, in fact, largely responsible for our still-slanted world. Put simply, the law and legal methods on which we currently rely have failed to evolve along with technology. Hadfield argues that not only are these systems too slow, costly, and localized to support economic complexity, they also fail to address looming challenges such as global warming, poverty, and oppression in developing countries. The answer, however, is not the one critics usually reach for-to have less of it. Through an ethnographic study of Bogotá's recent development experience and the city's changing relation to its illegal neighbourhoods, Luis Eslava interrogates this rationale and exposes the contradictions involved in the international turn to the local.     Abstract: This book examines the impact and shortcomings of the TRIPS Agreement, which was signed in Marrakesh on 15 April 1994. Over the last 20 years, the framework conditions have changed fundamentally. New technologies have emerged, markets have expanded beyond national borders, some developing states have become global players, the terms of international competition have changed, and the intellectual property system faces increasing friction with public policies. The contributions to this book inquire into whether the TRIPS Agreement should still be seen only as part of an international trade regulation, or whether it needs to be understood – or even reconceptualized – as a framework regulation for the international protection of intellectual property. The purpose, therefore, is not to define the terms of an outright revision of the TRIPS Agreement but rather to discuss the framework conditions for an interpretative evolution that could make the Agreement better suited to the expectations and needs of today’s global economy.

    Abstract: Whether in global markets, in the EU, or in international law - constitutions are long being formed beyond the state with severe consequences. In this post-democratic constitutionalism, a market-liberal program is given the status of an unquestionable consensus, reinforced by a higher-ranking law. Kolja Möller connects system theory, post-Marxist resources, and democracy theory to show, using different examples: Neither returning to national democracy nor spreading individual global citizen rights will improve this situation. Instead, a deposing power is needed to resolve the substantive over-formation of constitutions beyond the state. The new and critical constitutional theory thus created challenges the current diagnoses of declining status of democracy, and sheds a new light on the "democratic deficit" of globalization

    Abstract: Over the last three decades there has been a rapid expansion of intensive production of fresh fruit and vegetables in the Mediterranean regions of south and west Europe. Much of this depends on migrating workers for seasonal labour, including from Eastern Europe, North Africa and Latin America. This book is the first to address global agro-migration complexes across the region. It is argued that both intensive agricultural production and related working conditions are highly dynamic. Regional patterns have developed from small-scale family farming to become an industrialized part of the global agri-food system, which increasingly depends on seasonal labour. Simultaneously, consumer demand for year-round supply has caused relocations of the industry within Europe; areas of intensive greenhouse production have moved further south and even into North Africa. The authors investigate this Mediterranean agri-food system that transcends borders and is largely constituted by invisible seasonal work. By revealing the story of food commodities loaded with implications of private profit seeking, exploitation, exclusion and multiple insecurities, the book unmasks the hidden costs of fresh food provisioning. Three case study areas are considered in detail: the French region of Provence, a traditional centre of fresh fruit and vegetable cultivation; the Spanish Almeria region where intensive production has, accelerated dramatically since the 1970s; and Morocco where counter-seasonal production has recently been expanding. The book also includes commentaries that refer to complemetary insights on US-Mexico, Philippines-Canada and South Pacific mobilities.

    Abstract: Hegel and Global Justicedetails the relevance of the thought of G.W.F. Hegel for the burgeoning academic discussions of the topic of global justice. Against the conventional view that Hegel has little constructive to offer to these discussions, this collection, drawing on the expertise of distinguished Hegel scholars and internationally recognized political and social theorists, explicates the contribution both of Hegel himself and his 'dialectical' method to the analysis and understanding ofa wide range of topics associated with the concept of global justice, construed very broadly. These topics include universal human rights, cosmopolitanism, and cosmopolitan justice, transnationalism, international law, global interculturality, a global poverty, cosmopolitan citizenship, global governance, a global public sphere, a global ethos, and a global notion of collective self-identity. Attention is also accorded the value of Hegel's account of mutual recognition for analysing themes in global justice, both as regardsthe politics of recognition at the global level and the conditions for a general account of relations of people and persons under conditions of globalization. In exploring these and related themes, the authors of this book regularly compare Hegel to others who have contributed to the discourse on global justice, including Kant, Marx, Rawls, Habermas, Singer, Pogge, Nussbaum, Appiah, and David Miller.

    Abstract: This book offers a comprehensive, highly informative and interdisciplinary study on territorial integrity and the challenges globalization, self-determination and external interventions present. This study aims at not only to fill an epistemological gap in this regard, but also answer the question of whether International Law is adequately equipped to help states address these challenges. The author argues that the biggest threat that many states are confronted with today is their disintegration rather than their obsolescence, and that International Law has not often been able to prevent that eventuality. In fact, states, when they were not destroyed by war, managed to survive, thanks to the flexibility of territoriality, i.e. their ability to adjust to difficult situations as they arose. It is this understanding of adaptation that urges an increasing number of states today to revive territorial autonomy and restore an original understanding of self-determination in which democracy is a pivotal factor in establishing congruence between the states and their nations. While this move is endorsed by International Law, it is not the case for globalization; for their own sake, proponents of globalization should recognize that the states are irreplaceable as long as they remain the sole providers of protection for their peoples.

    Abstract: Globalisation is an issue that has been high on the research agenda for several years, spawning a vast and at times unwieldy literature. A concept often ill-defined, it has generated a plethora of unresolved and fiercely contested questions, the nature of which depends on which side of the ideological divide one stands. -- The 2008 global credit crunch, which in 2009 created the first global recession since the 1930s, demonstrated that the ‘capitalism unleashed’ model of globalisation which had been promoted from the 1980s onwards was both damaging and unsustainable. -- With contributions from the leading commentators in the field and an over-arching introduction from the editor, the concerns of this updated and revised handbook are two-fold. Firstly, to redefine the concept of globalisation and dispel the haze that surrounds it through a systematic and thorough examination of the debate. Secondly, to advance the frontiers of current critical thinking on the role and impact of globalisation, on the winners and losers in the process, and on the implications for society, the economy and governance. -- Offering a genuinely inter-disciplinary perspective, this Handbook represents the definitive guide to what is an all-pervasive issue.     Abstract: Das Lexikon erläutert in knapp 150 gut vernetzten Artikeln schwerpunktmäßig die sozialen und kulturellen Aspekte der Globalisierung. (Siegfried Lörcher)
    Abstract: Dieses verdienstvolle Lexikon ist seit 2002 im (organisatorischen und finanziellen) Rahmen der österreichischen Grundlagenforschung entstanden. So erfüllen die knapp 150 alphabetischen Artikel wissenschaftliche Ansprüche und sind doch auch verständlich und hilfreich für die Zielgruppe, nämlich "alle, die sich für soziale und kulturelle Aspekte von Globalisierung interessieren". Wirtschaftliche Aspekte werden nicht ausgeklammert, sind aber hier nicht so zentral wie etwa im Attac-"ABC der Globalisierung" aus 2005 (BA 1/06; vergriffen). Die Hauptartikel erläutern mit vielen Querverweisen die Begriffsgeschichte und diskutieren den jeweiligen Gegenstand unter Einbeziehung von (weltweiten) "Beobachtungen aus der Praxis" und Literaturhinweisen. Ein im ganzen Lexikon vertretenes Querschnittsthema ist das Gender-Problem, dem auch dadurch Rechnung getragen wurde, dass unter den 117 Autoren/Autorinnen der Frauenanteil 47% beträgt. Die Nutzbarkeit wird durch gute Personen-, (50-seitiges) Sach-, Regionen- (bzw. Ethnografien-) und Autoren/Autorinnen-Register erhöht. (2 A,S) (Siegfried Lörcher)
