    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Abstract: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

Damit reagiert es auf die negative soziale Dynamik mit optimistischen Antworten und hat zum Ziel, den sozialen Zusammenhalt vor Ort zu stärken - eine Aufgabe, die gerade die post-pandemische Gesellschaft herausfordern wird.

    Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. All countries are members of the European Union and share common European norms and values, but the Covid-19 pandemic can serve as an example of how these norms and values are interpreted differently with regard to people’s trust in public institutions, governmental control strategies, dealing with fear, anxiety and other emotional responses to the new virus, crime patterns and law enforcement priorities to prevent and combat them. The volume provides empirical data based on available statistics, media analysis and qualitative data from interviews and observations, and examines the similarities and differences in crime patterns and the consequences for local communities and law enforcement priorities. .

    Abstract: Das Handbuch bietet einen Gesamtüberblick über Industrie 4.0 und gibt zugleich Lösungen für wichtige praktische Fragen.     Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience.     Abstract: Die britische Mathematikenthusiastin ("Mathematik der Liebe"), Professorin in London, schreibt über das Wirken von Algorithmen in den Daseinsdimensionen "Macht, Daten, Justiz, Medizin, Autos, Kriminalität, Kunst." Die Algorithmen entscheiden für uns oder bereiten Entscheidungen vor, doch sie sind indiskret, fehlerbehaftet (wie menschliches Handeln), ungerecht und gaukeln eine Sicherheit vor, die sie nur bedingt geben können. Die Autorin referiert die z.T. bekannten Beispiele. Vieles grenze, vor allem in der sogenannten KI, die sie lieber eine erweiterte Computerstatistik nennen wolle, an "Zauberei", vor allem dann, wenn nicht mehr erklärt werden könne, wie die Ergebnisse zustande kämen. Die Kernfrage bleibe also, wie sehr wir den Algorithmen trauen und sie als Autorität in unserem/über unser Leben anerkennen. Man muss nicht zum Cyborg werden, aber ein vernünftiges und rationales Miteinander von menschlichen und algorithmisierten Verfahren sei ein anstrebenswertes Ziel. Sehr gut zu lesen, gut neben z.B. K.     Abstract: "This book describes the most important kinds of texts in English and introduces the methodological techniques used to analyze them. Three analytical approaches are introduced and compared, describing a wide range of texts from the perspectives of register, genre, and style. The primary focus of the book is on the analysis of registers. Part 1 introduces an analytical framework for studying registers, genre conventions, and styles. Part 2 provides detailed descriptions of particular text varieties in English, including spoken interpersonal varieties (conversation, university office hours, service encounters), written varieties (newspapers, academic prose, fiction), and emerging electronic varieties (e-mail, internet forums, text messages). Finally, Part 3 introduces advanced analytical approaches using corpora, and discusses theoretical concerns, such as the place of register studies in linguistics, and practical applications of register analysis.     Abstract: In dieser rechtsvergleichenden Studie entwickelt Antje G. I. Tölle einen Vorschlag de lege ferenda für den Vertragsschluss im elektronischen Geschäftsverkehr, der auf einer Abwägung zwischen den widerstreitenden Interessen nach Sicherheit und Flexibilität beruht. Dabei ordnet er etwa das Downloadshopping als verbindliches Angebot ein und ermöglicht seine Rücknahme. Weitere Themenkomplexe sind der Zugang und Widerruf eines Angebots, sein Erlöschen durch Zeitablauf, Ablehnung oder Verlust der Geschäftsfähigkeit oder den Tod. Für die Analyse werden insgesamt sechs europäische Rechtsordnungen, namentlich Deutschland, England, Frankreich, die Schweiz, die Niederlande und Ungarn herangezogen. Darüber hinaus berücksichtigt die Studie die europäischen Modellgesetze der PECL, des DCFR und des GEK zusammen mit dem UN-Kaufrecht neben diversen historischen Regelwerken wie etwa dem Allgemeinen Preußischen Landrecht oder dem Bürgerlichen Gesetzbuch Sachsens.     Abstract: Der Band enthält Untersuchungen zu zivil- und strafrechtlichen Konsequenzen unternehmerischen Handelns bei Menschenrechtsverletzungen. Im Zentrum stehen dabei deutsches Zivil-, Handels- und Internationales Privatrecht sowie deutsches und internationales Strafrecht. Hinzu treten Analysen des englischen und US-amerikanischen Haftungsrechts. Die Beiträge dieses Bandes fassen den aktuellen Forschungs- und Diskussionsstand zusammen und zeigen sowohl rechtspolitische Handlungsmöglichkeiten als auch weiteren Forschungsbedarf auf. Die in dem Band erörterten und analysierten Fragen sind zugleich als Ausgangspunkt und Referenzrahmen für ein besseres Verständnis und eine Weiterentwicklung des Zusammenhangs von Wirtschaft und Menschenrechten.

Ein Schwerpunkt der Veranstaltung lag auf der Frage nach dem Ist-Stand und den Perspektiven der kommunalen Integration junger Geflüchteter in der Praxis. Welches sind in diesem Zusammenhang die dringendsten Aufgaben? Und welche Herausforderungen sind damit fachlich, infrastrukturell und personell für die Kinder- und Jugendhilfe verbunden?

Mit juristischen, sozialpolitischen und empirischen Analysen widmet sich dieses Buch dem Zusammenspiel verschiedener Sozialschutzmechanismen und ihren Schwierigkeiten, sich den neuen Entwicklungen anzupassen. Es präsentiert die Impulse europäischer Instanzen und die Antworten verschiedener europäischer Staaten auf die Herausforderung, Flexibilisierung der Beschäftigung und Modernisierung der Sozialschutzsysteme in Einklang zu bringen. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection. By means of legal, socio-political and empirical analyses this book embarks on the interrelationship of different social protection mechanisms and the resulting difficulties of adapting to these new employment patterns.     Abstract: This is the story of how women in France and Britain between 1915 and 1933 appropriated the cultural identity of female war veteran in order to have greater access to public life and a voice in a political climate in which women were rarely heard on the public stage. The 'veterans' covered by this history include former nurses, charity workers, secret service agents and members of resistance networks in occupied territory, as well as members of the British auxiliary corps. What unites these women is how they attempted to present themselves as 'female veterans' in order to gain social advantages and give themselves the right to speak about the war and its legacies. Alison S. Fell also considers the limits of the identity of war veteran for women, considering as an example the wartime and post-war experiences of the female industrial workers who led episodes of industrial action

    Abstract: Die Forschungsarbeit analysiert vergleichend die straf- und gefahrenabwehrrechtlichen Vorschriften sowie die Polizeipraktiken hinsichtlich des Umgangs mit „Gefährdern“ in den Bereichen Terrorismus, Fußballgewalt und Rückfall von haftentlassenen Sexualstraftätern. Die Verfasserin stellt fest, dass sich gemeinsame rechtspolitische Ansätze zur Schaffung von Sicherheit in diesen Systemen finden lassen. Anhand der rechtsvergleichenden Ergebnisse zeigt die Autorin neue Entwicklungen im Strafrecht auf und diskutiert die Existenz eines sog. Sicherheitsstrafrechts. Da Terrorismus, Hooliganismus und Sexualgewalt die nationalen Rechtssysteme vor neue Herausforderungen stellen, ist die Frage, wie die Rechtssysteme Deutschlands, Frankreichs und Englands mit dieser Gefahr von schwerer Gewalt umgehen, von entscheidender Bedeutung. Nach einem Amoklauf ist in den Medien schnell von einer 'unfassbaren Tat' die Rede, eine geradezu ritualisierte Berichterstattung setzt ein. Sie ist, so der Soziologe Jörn Ahrens, eine Reaktion auf den Kontrollverlust, den ein Amoklauf für eine Gesellschaft bedeutet. Tatsächlich muss man sogar von einem doppelten Kontrollverlust sprechen: aufseiten der Gesellschaft und aufseiten des Täters. Denn es bedarf immer einer Gelegenheit zur Gewalttat und der Bereitschaft zu ihr. Dieses Buch untersucht, wie Gesellschaften auf Taten reagieren, bei denen exzeptionelle Gewalt angewendet wird, die prominent im öffentlichen Raum verübt werden und das gesellschaftlich akzeptierte Ausmaß an Regelverletzungen überschreiten. Es zeigt außerdem, wie das Vertrauen in die Sicherheit der Lebenswelt wiederhergestellt wird. Der Autor geht diesen Aspekten anhand der öffentlichen Reaktionen auf vier Amokläufe in Deutschland nach - und entwirft zugleich eine Soziologie der Gewalt. Jörn Ahrens ist Professor für Kultursoziologie an der Universität Gießen.     Abstract: This essay collection examines the Shakespearian culture of Cold War Europe - Germany, France, UK, USSR, Poland, Spain and Hungary - from 1947/8 to the end of the 1970s. Written by international Shakespearians who are also scholars of the Cold War, the essays assembled here consider representative events, productions and performances as cultural politics, international diplomacy and sites of memory, and show how they inform our understanding of the political, economic, even military, dynamics of the post-war global order. The volume explores the political and cultural function of Shakespearian celebration and commemoration, but it also acknowledges the conflicts they generated across the European Cold War ‘theatre’, examining the impact of Cold War politics on Shakespearian performance, criticism and scholarship.     Abstract: This book offers a cross-cultural comparison of French and British cosmetics advertisements and explores how the discourse of beauty advertising represents ideas about femininity in French and English language contexts. As the global beauty industry expands and consumers become more critical of the claims made, the topic of cosmetics advertising discourse is examined using Feminist Critical Discourse Analysis. One common theme underlying most cosmetics advertising discourse is that the female body always requires ‘work’ to fix its ‘problems’: flat skin, dry hair, and so on. The author uses themes of language and gender, media and identity, and advertising across cultures to expose exactly what is going on in the language of cosmetics advertising and to offer a first step towards challenging these ideas and thinking about alternatives. Helen Ringrow is Lecturer in Communication Studies and Applied Linguistics at the University of Portsmouth, UK. Prior to this, she completed her PhD in Linguistics at Queen’s University Belfast, Northern Ireland, where she also contributed to undergraduate teaching on language and power.

    Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This book provides a comparative perspective on one of the most intriguing developments in law: the influence of basic rights and human rights in private law. It analyzes the application of basic rights and human rights, which are traditionally understood as public law rights, in private law, and discusses the related spillover effects and changing perspectives in legal doctrine and practice. It provides examples where basic rights and human rights influence judicial reasoning and lead to changes of legislation in contract law, tort law, property law, family law, and copyright law. Providing both context and background analysis for any critical examination of the horizontal effect of fundamental rights in private law, the book contributes to the current debate on an important issue that deserves the attention of legal practitioners, scholars, judges and others involved in the developments in a variety of the world’s jurisdictions. This book is based on the General Report and national reports commissioned by the International Academy of Comparative Law and written for the XIXth International Congress of Comparative Law in Vienna, Austria, in the summer of 2014.

    Abstract: "The Making of English Popular Culture provides an account of the making of popular culture in the nineteenth century. While a form of what we might describe as popular culture existed before this period, John Storey has assembled a collection that demonstrates how what we now think of as popular culture first emerged as a result of the enormous changes that accompanied the industrial revolution. Particularly significant are the technological changes that made the production of new forms of culture possible and the concentration of people in urban areas that created significant audiences for this new culture. Consisting of fourteen original chapters that cover diverse topics ranging from seaside holidays and the invention of Christmas tradition, to advertising, music and popular fiction, the collection aims to enhance our understanding of the relationship between culture and power, as explored through areas such as 'race', ethnicity, class, sexuality and gender. It also aims to encourage within cultural studies a renewed historical sense when engaging critically with popular culture by exploring the historical conditions surrounding the existence of popular texts and practices.
