    Abstract: Dieses Open-Access-Buch behandelt umfassend die rechtlichen Grundlagen der im Jahr 2017 eingeführten Echtzeitüberweisung (SEPA Instant Payment). Der Autor stellt wiederholt Inkonsistenzen zwischen dem europarechtlich harmonisierten Zahlungsverkehrsrecht und dem maßgeblichen Interbankenabkommen heraus und zeigt an diesen Stellen bereits detailliert neue Lösungen auf Grundlage des gegenwärtigen Rechts auf. In einem weiteren Schwerpunkt wird die Rolle der Echtzeitüberweisung in der Digitalisierung der Bankenbranche, insbesondere im Verhältnis zum Bargeld und zu weiteren Bezahldiensten wie PayPal, erörtert. De lege ferenda schlägt der Autor größere Anpassungen im Fristenregime und die Einführung eines Chargeback-Systems, wie es aus der Kreditkartenzahlung bekannt ist, in konkreter Ausgestaltung vor. Die Anregungen im rechtspolitischen Teil des Werks zielen auf einen Einklang der sich ergänzenden Rechtsquellen sowie eine Erhöhung der Attraktivität der Echtzeitüberweisung in der Praxis ab.     Abstract: Gegenstand dieses Buches ist die Zurechnung des Wissens der Aufsichtsratsmitglieder einer deutschen AG. Hierbei handelt es sich um eine für die Praxis äußerst aktuelle Problematik, die dem komplexen und in der Rechtswissenschaft hoch umstrittenen Gebiet der Wissenszurechnung bei juristischen Personen angehört. Da die Thematik rund um das Wissen des Aufsichtsrats nicht ohne ein Grundverständnis der Wissenszurechnung im Ganzen analysiert werden kann, arbeitet der Autor zunächst die Entwicklungen dieses Rechtsinstituts auf und geht dabei insbesondere auf ungeklärte Aspekte ein, die an späterer Stelle für den Aufsichtsrat von Bedeutung sind. Hierauf folgt eine Untersuchung aller rechtlichen und tatsächlichen Entwicklungen des Aufsichtsorgans in den letzten Jahrzehnten, die für die Wissenszurechnung relevant sind und deren Berücksichtigung in der Literatur bislang ausblieb. Das auf dieser Grundlage vom Autor entwickelte Lösungsmodell bietet der Praxis ein eingängiges Instrument, welches nicht nur auf das Wissen des Aufsichtsrats anwendbar ist, sondern nahezu alle denkbaren Konstellationen der zivilrechtlichen Wissenszurechnung einbezieht. Der Autor Richard Heinrichs hat Rechtswissenschaften an der Universität zu Köln studiert. Sein Referendariat hat er unter anderem bei der BaFin absolviert. Seit 2021 arbeitet er als Rechtsanwalt in einer internationalen Wirtschaftskanzlei in Frankfurt a.M. und ist spezialisiert auf die Bereiche Gesellschaftsrecht sowie Mergers & Acquisitions.

    Abstract: Spätestens seit den 1990-er Jahren erscheint der Begriff Beteiligung in diversen gesellschaftlichen Bereichen als allgemein anerkannter Imperativ, der von unterschiedlichen Akteur*innen als Allheilmittel angepriesen wird. Doch wenn Beteiligung proklamiert wird, bedeutet das mitnichten eine Garantie für gesellschaftliche Teilhabe. Mit Hilfe einer dispositivanalytischen Untersuchung von top-down Beteiligungsmaßnahmen in der Berliner Quartiersentwicklung zeigt Magdalena Otto, wie der Begriff Beteiligung verschiedenartig anschlussfähig ist und dadurch eine kaum hinterfragte Legitimationskraft ausstrahlt. Im Zentrum der hier entwickelten Theorie über den Beteiligungsimperativ steht die Rekonstruktion von vier idealtypisch zu verstehenden Deutungsmustern zur Legitimation von Beteiligungsmaßnahmen sowie ihre intendierten und unbeabsichtigten Folgen. Der konstatierte Beteiligungsimperativ zeigt sich dabei als eine auf Aktivierung setzende, neoliberale Gouvernementalität in Reaktion auf städtische Segregations- und Marginalisierungsprozesse, die Krise des Kommunalstaats und damit einhergehende veränderte Steuerungserfordernisse für Regierungshandeln. Die Autorin Magdalena Otto promovierte zur Beteiligung von Bürger*innen in der Quartiersentwicklung. Zu ihren Forschungsschwerpunkten zählen (Anti-)Diskriminierung, soziale Ungleichheit und Partizipation. Seit 2023 arbeitet sie für das Deutsche Institut für Menschenrechte.

    Abstract: Mit dem Gesetz zur Modernisierung des Besteuerungsverfahrens stellte der Gesetzgeber die Weichen für einen grundlegenden Wandel der Amtsermittlung hin zu einer digitalisierten Sachverhaltsermittlung im Besteuerungsverfahren. Der Autor widmet sich diesem grundlegenden Paradigmenwechsel aus verfassungsrechtlicher Sicht und untersucht dabei eingehend die Auswirkungen auf die Wahrung der Gesetz- und Gleichmäßigkeit der Besteuerung sowie auf etwaige Freiheitsgrundrechte und die Gewährung von Rechtsschutz. Er stellt hierfür die Relevanz einer korrekten Sachverhaltsfeststellung für die Verwirklichung von Gleich- und Gesetzmäßigkeit heraus, kommt aber auch zu dem Schluss, dass die konkreten Vollzugsbedingungen eine gezielte Sachverhaltsermittlung erforderlich machen. Den Einsatz von Risikomanagementsystemen zur Steuerung der Sachverhaltsfeststellung unterzieht der Autor einer umfangreichen Bewertung und gelangt dabei zu dem Schluss, dass die gesetzlichen Regelungen in Teilen den Anforderungen des Vorbehalts des Gesetzes nicht genügen, und auch die konkrete Anwendung kritisch zu sehen sei, da zu befürchten sei, dass es zu einer pauschalen Anwendung des Steuerrechts komme, welche sich vom materiellen Recht in Teilen löse. Der Autor definiert deswegen verfassungsrechtliche Rahmenbedingungen, welche eingehalten werden müssen, um zu einer verfassungsgemäßen digitalisierten Sachverhaltsermittlung zu gelangen. Das Wegsehen und rationalisierende Verdrängen seitens Vorgesetzter, Kolleginnen und Kollegen ist unbedingt aufklärungsbedürftig. Ziel des Buches ist die Schaffung einer interdisziplinären Grundlage für die Reflexion vergleichbarer Fälle in der ,,Organisation mit Gewaltlizenz" und damit die Initiierung eines organisationalen Lernprozesses, der solche Fälle zu verhindern hilft.

    Abstract: Die "Verrohung der Debattenkultur" in sozialen Netzwerken wie Facebook, Instagram, YouTube und Twitter ist vor einiger Zeit in der breiten Öffentlichkeit angekommen und bietet nach wie vor viel Anlass für Diskussionen. Vorläufiger Höhepunkt in der Debatte um einen effektiven Umgang mit sog. Hasskriminalität stellt das Netzwerkdurchsetzungsgesetz dar, das erstmals konkrete Beschwerdeverfahren für soziale Netzwerke vorsieht - und bei einem Verstoß mit einem hohen Bußgeld droht. Diese Arbeit geht der Frage nach, ob das Netzwerkdurchsetzungsgesetz das richtige Instrument ist, um Hasskriminalität in sozialen Netzwerken effektiv zu begegnen. Dabei erklärt die Autorin zunächst, warum die zivilrechtliche Inanspruchnahme von Verfasser*innen rechtswidriger Inhalte sowie die Strafverfolgung oftmals an ihre Grenzen stoßen und aus diesem Grund eine Inanspruchnahme der sozialen Netzwerke unumgängiglich ist. Die Arbeit kommt zu dem Ergebnis, dass das Netzwerkdurchsetzungsgesetz und seine Novelle zwar ein wichtiger Schritt in die richtige Richtung sind, allerdings nach wie vor gesetzgeberischer Handlungsbedarf besteht. Die Autorin Sandra Niggemann ist gegenwärtig Rechtsreferendarin am Kammergericht Berlin und hat unter anderem eine Ausbildungsstation im Bundeskanzleramt absolviert. Sie hat am Institut für Informations-, Telekommunikations- und Medienrecht, Öffentlich-rechtliche Abteilung, der Westfälischen Wilhelms-Universität in Münster promoviert.

    Abstract: In dem vorliegenden Buch werden Strafverfahrensakten aus Nordrhein-Westfalen und Sachsen analysiert. Die Akten haben die von den staatlichen Registrierungsbehörden als PMK-rechts eingeordneten Brandstiftungs- und Sprengstoffdelikte der Jahre 2015, 2016 und 2017 zum Gegenstand. Diese Jahre wurden aufgrund der hohen Fallzahlen und des betrachteten Kontexts der Zuwanderungsbewegung gewählt. Im Fokus der Studie stehen die Hintergründe der Taten sowie deren Täter*innen. Im Wege einer Aktenanalyse werden Umstände der Taten (wie Deliktsart, Uhr- und Tageszeit, Tatort) sowie Merkmale zu den Täter*innen (wie Alter, Geschlecht, Herkunft) erhoben. Ebenfalls werden der Verlauf des Strafverfahrens und Merkmale der Opfer untersucht, soweit dies möglich ist. Für einen Überblick werden außerdem umfassend die zur Verfügung stehenden staatlichen und nichtstaatlichen Statistiken zur Entwicklung der rechts motivierten Brand- und Sprengstoffdelikte ausgewertet. Die Autorin Jana Berberich war während ihrer Promotionszeit am Lehrstuhl für Kriminologie der Ruhr-Universität Bochum als wissenschaftliche Mitarbeiterin für Herrn Prof. Dr. Tobias Singelnstein in Lehre und Forschung tätig. Ihre Forschungsschwerpunkte beinhalten rechts motivierte Gewalt, politisch motivierte Brandanschläge sowie Straftaten gegen die körperliche Unversehrtheit.

    Abstract: This book explores the main challenges against multiculturalism. It aims to examine whether liberalism and multiculturalism are reconcilable, and what are the limits of liberal democratic interventions in illiberal affairs of minority cultures within democracy. In the process, this book addresses three questions: whether multiculturalism is bad for democracy, whether multiculturalism is bad for women, and whether multiculturalism contributes to terrorism. Just, Reasonable Multiculturalism argues that liberalism and multiculturalism are reconcilable if a fair balance is struck between individual rights and group rights. Raphael Cohen-Almagor contends that reasonable multiculturalism can be achieved via mechanisms of deliberate democracy, compromise and, when necessary, coercion. Placing necessary checks on groups that discriminate against vulnerable third parties, the approach insists on the protection of basic human rights as well as on exit rights for individuals if and when they wish to leave their cultural groups

    Abstract: Exhibitions of Islamic artefacts in European museums have since 1989 been surrounded by a growing rhetoric of cultural tolerance, in response to the dissemination of images of Islam as misogynist, homophobic and violent. This has produced a new public context for exhibitions of Islam and has led to major recent investments in new galleries for Islamic artefacts, often with financial support from the Gulf and Saudi Arabia. This Element addresses contemporary framings of Islam in European museums, focusing on how museums in Germany and the UK with collections of Islamic heritage realise the ICOM (International Council of Museums) definition of museums as institutions in the service of society.     Abstract: Mehrstufige arbeitsteilige Organisationen des unternehmerischen Geschäftsbereiches sind - insbesondere mit Blick auf Großunternehmen - aus dem modernen Wirtschaftsleben nicht mehr wegzudenken. Der Geschäftsherr hat sich zur gewünschten Ausweitung seines Aktionsradius sowie des Erhalts seiner Handlungsflexibilität mehr oder weniger zwingend der Tätigkeit von Gehilfen zu bedienen. Vor dem Hintergrund der (betriebs-)wirtschaftlichen Bedeutung des Topos der mehrstufigen arbeitsteiligen Organisation stellt sich aus haftungsrechtlicher Frage, ob und mit welcher Maßgabe im Rahmen einer Inanspruchnahme nach § 831 Abs. 1 BGB der Entlastungsbeweis nach Satz 2 zugunsten des Geschäftsherrn zur Anwendung zu bringen ist. Für den Fall einer Unmöglichkeit einer persönlichen Auswahl des schadenstiftenden Gehilfen durch den Geschäftsherrn aufgrund betriebsbezogener Umstände erachtete das Reichsgericht eine Delegation der Aufgabe der Auswahl und Überwachung rangniedere Gehilfen auf eine Zwischenperson als zulässig und verlangte vom Geschäftsherrn, dass er sich lediglich im Hinblick auf seine Zwischenperson exkulpieren muss. Später ging die reichs- und auch bundesgerichtliche Rechtsprechung jedoch dazu über, die Frage der deliktsrechtlichen Behandlung der mehrstufigen arbeitsteiligen Organisation allein im Rahmen des § 823 Abs. 1 BGB unter dem Begriff der – betrieblichen und körperschaftlichen – Organisationspflichten zu erörtern. Unter kritischer Darstellung sowohl der Lehre vom dezentralisierten Entlastungsbeweis als auch des Topos der Organisationspflichten zeigt der Autor auf, dass ein rechtspolitisch befriedigender Zustand nur dadurch erreicht werden kann, dass mit jeder Mehrstufigkeit von arbeitsteiliger Organisation auch stets eine Mehrstufigkeit des vom Geschäftsführer zu führenden Entlastungsbeweises einherzugehen hat. Der Autor Burak Firat studierte Rechtswissenschaften an der Humboldt-Universität zu Berlin und ist als Rechtsanwalt in Berlin tätig. .

    Abstract: Datenverarbeitungen finden im 21. Jahrhundert ubiquitär statt. Das neue Datenschutzrecht hält zur Erfassung der oft multipolaren Datenverarbeitungen in Art. 26 DSGVO das Instrument gemeinsamer Verantwortlichkeit parat. Dessen Tatbestand und Rechtsfolgen sind oft unklar. In Anbetracht der legislativen Lücken untersucht diese Arbeit das Innenverhältnis zwischen mehreren gemeinsamen Verantwortlichen im System des Unionssekundärrechts. Besondere Berücksichtigung findet dabei die tatbestandliche Begründung des Art. 26 Abs. 1 S. 1 DSGVO in Anlehnung an die bislang ergangene Judikatur des EuGH in den Rechtssachen Fanpages, Zeugen Jehovas und Fashion ID. Ein weiterer Schwerpunkt liegt auf der Eruierung formeller sowie materieller Voraussetzungen der internen Vereinbarung gemäß Art. 26 Abs. 1 S. 2 DSGVO. Schließlich begutachtet die Arbeit die Rechtsfolgen im Innenverhältnis gemeinsamer Verantwortlichkeit. Dabei werden nach der Bestimmung des anwendbaren Sachrechts ein Anspruch auf Abschluss der internen Vereinbarung, Zahlungs-, Auskunfts- sowie Unterlassungs- und Beseitigungsansprüche erarbeitet. Die Arbeit schließt im Kontext der sog. "privacy litigation" mit Untersuchungen zu Gerichtsständen und Gerichtsstandsvereinbarungen im Geltungsregime der DSGVO. Der Autor Ruben Schneider war von 2019 bis 2021 Wissenschaftlicher Mitarbeiter am Lehrstuhl für Bürgerliches Recht, Informations- und Datenrecht der Universität Bonn.     Abstract: Gerade das Wirtschafts(straf)recht wird immer unklarer und der präventive Beratungsbedarf steigt dadurch erheblich. Die vorliegende Arbeit befasst sich vor diesem Hintergrund mit der Frage, unter welchen Voraussetzungen ein durch einen Akteur im Wirtschaftsleben eingeholtes Rechtsgutachten, welches zum Ergebnis der Erlaubtheit einer geplanten Handlung kommt, einen unvermeidbaren Verbotsirrtum bei dem Auskunftsersuchenden auslöst, wenn sich das Verhalten ex post doch als strafbar erweist. Hierbei wird ein besonderer Schwerpunkt auf Situationen gelegt, in denen der Gutachter bei Gutachtenerstattung darauf hingewiesen hat, dass die Rechtslage nicht eindeutig ist. Zudem werden Kriterien entwickelt, die dem Spannungsfeld zwischen der Angewiesenheit des Bürgers auf präventiven Rechtsrat und der damit einhergehenden Missbrauchsgefahr angemessen Rechnung tragen. Die Autorin Laura Borgel studierte Rechtswissenschaft in Hamburg, Oxford und München sowie Betriebswirtschaftslehre in Vallendar.     Abstract: This book adds to the growing literature on dynamics of regional development in the global South by mapping the politics and processes contributing to the distinct developmental trajectory of Tamil Nadu, southern India. Using a novel interpretive framework and drawing upon fresh data and literature, it seeks to explain the social and economic development of the state in terms of populist mobilization against caste-based inequalities. Dominant policy narratives on inclusive growth assume a sequential logic whereby returns to growth are used to invest in socially inclusive policies. By focusing more on redistribution of access to opportunities in the modern economy, Tamil Nadu has sustained a relatively more inclusive and dynamic growth process. Democratization of economic opportunities has made such broad-based growth possible even as interventions in social sectors reinforce the former. The book thus also speaks to the nascent literature on the relationship between the logic of modernisation and status based inequalities in the global South.

    Abstract: The distinction between humans and the natural world is an artefact and more a matter of linguistic communication than a conceptual separation. This Element proposes ecosemiotics as an epistemological tool to better understand the relationship between human and natural processes. Ecosemiotics with its affinity to the humanities, is presented here as the best disciplinary approach for interpreting complex environmental conditions for a broad audience, across a multitude of temporal and spatial scales. It is proposed as an intellectual bridge between divergent sciences to incorporate within a unique framework different paradigms. The ecosemiotic paradigm helps to explain how organisms interact with their external environments using mechanisms common to all living beings that capture external information and matter for internal usage. This paradigm can be applied in all the circumstances where a living being (man, animal, plant, fungi, etc.) performs processes to stay alive

    Abstract: Knowing Women is a study of same-sex desire in West Africa, which explores the lives and friendships of working-class women in southern Ghana who are intimately involved with each other. Based on in-depth research of the life histories of women in the region, Serena O. Dankwa highlights the vibrancy of everyday same-sex intimacies that have not been captured in a globally pervasive language of sexual identity. Paying close attention to the women's practices of self-reference, Dankwa refers to them as 'knowing women' in a way that both distinguishes them from, and relates them to categories such as lesbian or supi, a Ghanaian term for female friend. In doing so, this study is not only a significant contribution to the field of global queer studies in which both women and Africa have been underrepresented, but a starting point to further theorize the relation between gender, kinship, and sexuality that is key to queer, feminist, and postcolonial theories.     Abstract: Understanding how cultural diversity relates to international order is an urgent contemporary challenge. Building on ideas first advanced in Reus-Smit's On Cultural Diversity (2018), this groundbreaking book advances a new framework for understanding the nexus between culture and order in world politics. Through a pioneering interdisciplinary collaboration between leading historians, international lawyers, sociologists and international relations scholars, it argues that cultural diversity in social life is ubiquitous rather than exceptional, and demonstrates that the organization of cultural diversity has been inextricably tied to the constitution and legitimation of political authority in diverse international orders, from Warring States China, through early modern Europe and the Ottoman and Qing Empires, to today's global liberal order. It highlights the successive 'diversity regimes' that have been constructed to govern cultural difference since the nineteenth century, traces the exclusions and resistances these projects have engendered and considers contemporary global vulnerabilities and axes of contestation.

    Abstract: Focusing on the rising support for the populist right in Eastern Europe, this book examines how anger and resentment towards minorities is being utilized in politics. Bustikova details the process by which the acquisition of political power and demand for rights by ascendant minority groups precipitates a backlash of mobilization from the radical right. However, this book also argues that prejudice against minorities is not a sentiment exclusive to right-wing voters and is not the root cause of increasing support for the radical right. Rather, this study reveals variation in how minorities are accommodated by the government and explains the electoral successes and failures of radical right parties. By examining the capitalization on these feelings of discontent towards politically assertive minorities and with the governmental policies that yield to their demands, Bustikova exposes volatile, zeitgeist-dependent conditions under which once fringe right-wing parties have risen to prominent but precarious positions of power.

    Abstract: This study presents an alternative story of the 2011 Egyptian revolution by revisiting Egypt's moment of decolonisation in the mid-twentieth century. Anticolonial Afterlives in Egypt explores the country's first postcolonial project, arguing that the enduring afterlives of anticolonial politics, connected to questions of nationalism, military rule, capitalist development and violence, are central to understanding political events in Egypt today. Through an imagined conversation between Antonio Gramsci and Frantz Fanon, two foundational theorists of anti-capitalism and anticolonialism, Anticolonial Afterlives in Egypt focuses on issues of resistance, revolution, mastery and liberation to show how the Nasserist project, created by Gamal Abdel Nasser and the Free Officers in 1952, remains the only instance of hegemony in modern Egyptian history. In suggesting that Nasserism was made possible through local, regional and global anticolonial politics, even as it reproduced colonial ways of governing that continue to reverberate into Egypt's present, this interdisciplinary study thinks through questions of traveling theory, global politics, and resistance and revolution in the postcolonial world.

    Abstract: Despite labour shortages and rapidly shrinking working-age populations, Japan, South Korea, and Taiwan shared restrictive immigration policies and exclusionary practices toward immigrants until the early 2000s. While Taiwan maintained this trajectory, Japan took incremental steps to expand immigrant services at the grassroots level, and South Korea enacted sweeping immigration reforms. How did convergent policies generate these divergent patterns of immigrant incorporation? Departing from the dominant scholarship that focuses on culture, domestic political elites, and international norms, this book shows the important role of civil society actors - including immigrants themselves - in giving voice to immigrant interests, mobilizing immigrant actors, and shaping public debate and policy on immigration. Based on more than 150 in-depth interviews and focus groups with over twenty immigrant communities, Immigrant Incorporation in East Asian Democracies examines how the civic legacies of past struggles for democracy shape current movements for immigrant rights and recognition.

    Abstract: Cities are playing an ever more important role in the mitigation and adaption to climate change. This book examines the politics shaping whether, how and to what extent cities engage in global climate governance. By studying the C40 Cities Climate Leadership Group, and drawing on scholarship from international relations, social movements, global governance and field theory, the book introduces a theory of global urban governance fields. This theory links observed increases in city engagement and coordination to the convergence of C40 cities around particular ways of understanding and enforcing climate governance. The collective capacity of cities to produce effective and socially equitable global climate governance is also analysed. Highlighting the constraints facing city networks and the potential pitfalls associated with a city-driven global response, this assessment of the transformative potential of cities will be of great interest to researchers, graduate students and policymakers in global environmental politics and policy.

    Abstract: Philipp Nikolaus Adelberg untersucht Regelungen zum Verbleib oder zur Löschung eines nutzergenerierten Inhalts, denen die Betreiber sozialer Netzwerke im Internet unterworfen sind. Der Autor gibt einen Überblick über die Pflichten, die sich für die Betreiber in Bezug auf persönlichkeitsrechtsverletzende Inhalte ergeben. Zudem zeigt er die Grenzen auf, in denen sie sich im Rahmen der Nutzungsbedingungen Rechte im Umgang mit solchen Inhalten einräumen können und erörtert die Anwendbarkeit eines Modells Regulierter Selbstregulierung in diesem Kontext. This book is about the channels beyond direct repression through which China's authoritarian state controls protest and implements ambitious policies from sweeping urbanization schemes that have displaced millions to family planning initiatives like the one-child policy. Daniel C. Mattingly argues that China's remarkable state capacity is not simply a product of coercive institutions such as the secret police or the military. Instead, the state uses local civil society groups as hidden but effective tools of informal control to suppress dissent and implement far-reaching policies. Drawing on evidence from qualitative case studies, experiments, and national surveys, the book challenges the conventional wisdom that a robust civil society strengthens political responsiveness. Surprisingly, it is communities that lack strong civil society groups that find it easiest to act collectively and spontaneously resist the state.

    Abstract: How does international context influence state policies toward religious minorities? Using parliamentary proceedings, court decisions, newspaper archives, and interviews, this book is the first systematic study that employs international context in the study of state policies toward religion, and that compares Turkey and France with regard to religious minorities. Comparing Christians in Turkey and Muslims in France, this book argues that policy change toward minorities becomes possible when strong domestic actors find a suitable international context that can help them execute their policy agendas. The Turkish Islamists used the European Union to transform the Turkish politics that brought a reformist moment for Christians in the 2000s. The Far Right in France utilized the rise of Islamophobia in Europe to adopt restrictive policies toward Muslims. Ramazan Kılınç argues that the presence of an international context that can favor particular groups over others, shifts the domestic balance of power, and makes some policies more likely to be implemented than others.

    Abstract: Organizing Against Democracy investigates some of the most important challenges modern democracies face, filling a distinctive gap in the literature, both empirically and theoretically. Ellinas examines the attempts of three of the most extreme European far-right parties to establish roots in local societies, and the responses of democratic actors. He offers a theory of local party development to analyze the many factors affecting the evolution of far-right parties at the subnational level. Using extraordinarily rich data, the author examines the 'lives' of local far-right party organizations in Greece, Germany and Slovakia, studying thousands of party activities and interviewing dozens of party leaders and functionaries, and antifascists. He goes on to explore how and why extreme parties succeed in some local settings while, in others, they fail. This book broadens our understanding of right-wing extremism, illuminating the factors limiting its corrosiveness.

Kinship, as a principle of legitimacy and in the shape of dynasties, was fundamental to political order. Throughout the last one and a half millennia of European and Middle Eastern history, elite families and polities evolved in symbiosis. By demonstrating this symbiosis as a basis for successful polities, Peter Haldén unravels long-standing theories of the state and of modernity. Most social scientists focus on coercion as a central facet of the state and indeed of power. Instead, Halden argues that much more attention must be given to collaboration, consent and common identity and institutions as elements of political order. He also demonstrates that democracy and individualism are not necessary features of modernity.

    Abstract: Anger is a powerful mobilizing force in American politics on both sides of the political aisle, but does it motivate all groups equally? This book offers a new conceptualization of anger as a political resource that mobilizes black and white Americans differentially to exacerbate political inequality. Drawing on survey data from the last forty years, experiments, and rhetoric analysis, Phoenix finds that - from Reagan to Trump - black Americans register significantly less anger than their white counterparts and that anger (in contrast to pride) has a weaker mobilizing effect on their political participation. The book examines both the causes of this and the consequences. Pointing to black Americans' tempered expectations of politics and the stigmas associated with black anger, it shows how race and lived experience moderate the emergence of emotions and their impact on behavior. The book makes multiple theoretical contributions and offers important practical insights for political strategy.

    Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Abstract: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

    Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism

    Abstract: Irish emigration to America is one of the clich es of modern Irish history; much less familiar is the reverse process. Who were the people who chose to return to Ireland? What motivated them? How did this affect Irish society?     Abstract: This is an important, revisionist account of the origins of the British Empire in Asia in the early modern period. David Veevers uncovers a hidden world of transcultural interactions between servants of the English East India Company and the Asian communities and states they came into contact with, revealing how it was this integration of Europeans into non-European economies, states and societies which was central to British imperial and commercial success rather than national or mercantilist enterprise. As their servants skilfully adapted to this rich and complex environment, the East India Company became enfranchised by the eighteenth century with a breadth of privileges and rights - from governing sprawling metropolises to trading customs-free. In emphasising the Asian genesis of the British Empire, this book sheds new light on the foreign frameworks of power which fuelled the expansion of Global Britain in the early modern world.

This book takes up this pressing debate using Christianity in sub-Saharan Africa as its empirical base to demonstrate that religious teachings communicated in sermons can influence both the degree and the form of citizens' political participation. McClendon and Riedl document some of the current diversity of sermon content in contemporary Christian houses of worship and then use a combination of laboratory experiments, observational survey data, focus groups, and case comparisons in Zambia, Uganda, and Kenya to interrogate the impact of sermon exposure on political participation and the longevity of that impact. Pews to Politics in Africa leverages the pluralism of sermons in sub-Saharan Africa to gain insight into the content of cultural influences and their consequences for how ordinary citizens participate in politics.

For the first time in over three decades, here is a study explaining what political interest is, where it comes from, and why it matters. Providing the most thorough description available of political interest in four Western democracies this study analyzes large household panel data sets rarely used in political science to explain how interest develops in people's lives.     Abstract: Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world?

    Abstract: Lanka, Ceylon, Sarandib: merely three disparate names for a single island? Perhaps. Yet the three diverge in the historical echoes, literary cultures, maps and memories they evoke. Names that have intersected and overlapped - in a treatise, a poem, a document - only to go their own ways. But despite different trajectories, all three are tied to narratives of banishment and exile. Ronit Ricci suggests that the island served as a concrete exilic site as well as a metaphor for imagining exile across religions, languages, space and time: Sarandib, where Adam was banished from Paradise; Lanka, where Sita languished in captivity; and Ceylon, faraway island of exile for Indonesian royalty under colonialism. Utilising Malay manuscripts and documents from Sri Lanka, Javanese chronicles, and Dutch and British sources, Ricci explores histories and imaginings of displacement related to the island through a study of the Sri Lankan Malays and their connections to an exilic past.

Seeking an alternate framework for understanding community and identity, Steven Fabian combines extensive archival sources from African and European archives alongside fieldwork in Bagamoyo to move beyond the category of 'Swahili' as it has been traditionally understood. Revealing how townspeople - Africans, Arabs, Indians, and Europeans alike - created a local vocabulary which referenced aspects of everyday town life and bound them together as members of a shared community, this first extensive examination of Bagamoyo's history from the pre-colonial era to independence uses a new lens of historical analysis to emphasize the importance of place in creating local, urban identities and suggests a broader understanding of these concepts historically along the Swahili Coast

    Abstract: Becoming Activists in Global China is the first purely sociological study of the religious movement Falun Gong and its resistance to the Chinese state. The literature on Chinese protest has intensively studied the 1989 democracy movement while largely ignoring opposition by Falun Gong, even though the latter has been more enduring. This comparative study explains why the Falun Gong protest took off in diaspora and the democracy movement did not. Using multiple methods, Becoming Activists in Global China explains how Falun Gong's roots in proselytizing and its ethic of volunteerism provided the launch pad for its political mobilization. Simultaneously, diaspora democracy activists adopted practices that effectively discouraged grassroots participation. The study also shows how the policy goal of eliminating Falun Gong helped shape today's security-focused Chinese state. Explaining Falun Gong's two decades of protest illuminates a suppressed piece of Chinese contemporary history and advances our knowledge of how religious and political movements intersect.

    Abstract: Why do some individuals participate in risky, anti-regime resistance whereas others abstain? The Revolution Within answers this question through an in-depth study of unarmed resistance against Israeli rule in the Palestinian Territories over more than a decade. Despite having strong anti-regime sentiment, Palestinians initially lacked the internal organizational strength often seen as necessary for protest. This book provides a foundation for understanding participation and mobilization under these difficult conditions. It argues that, under these conditions, integration into state institutions - schools, prisons and courts - paradoxically makes individuals more likely to resist against the state. Diverse evidence drawn from field research - including the first, large-scale survey of participants and non-participants in Palestinian resistance, Arabic language interviews, and archival sources - supports the argument. The book's findings explain how anti-regime resistance can occur even without the strong civil society organizations often regarded as necessary for protest and, thus, suggest new avenues for supporting civil resistance movements.

    Abstract: This is a study of Vietnam's socialist transition and state transformation, generally known as đổi mới. It examines the drivers of socialist-regime change, the nature of the đổi mới state, and the basis of regime legitimacy in Vietnam. The Element argues that despite its 'one-party rule' label, the party-state apparatus that channels said rule has become fragmented. State-building during the đổi mới period involved negotiations and bargaining that redefine authority and power relations within the state apparatus. The party-state's accountability projects are designed to target the specific self-aggrandizing tendencies of the state apparatus, its policies, and abuse of state power. At the leadership level, patterns of resource allocation underlying the đổi mới growth model as well as the VCP's cadre rotation approach have accommodated central and sub-national state elites across sectors and levels, helping shore up the legitimacy of the đổi mới state in the eyes of the state elite. The combination of sustained economic growth, expansion of political space, accountability, and tolerance of small-scale public protests have been factors in strengthening regime-society legitimization.
