    Abstract: This open access volume of LIDC contributions focuses on how competition and intellectual property laws incorporate sustainability objectives. Businesses are increasingly embracing sustainability objectives, driven by the international community. Although competition and intellectual property law are certainly not the only tools for addressing sustainability issues, they can play a role in moving toward a more sustainable society. Sustainability has gained prominence in competition law in all jurisdictions covered in this volume. The contributions focus on classic questions such as whether sustainability agreements restrict competition and, if so, to what extent businesses can be exempted on efficiency grounds. The papers also raise a number of questions, in particular concerning the treatment of non-market efficiencies. The soft law and case law produced by competition authorities are examined, and the leadership role of some competition authorities in the field – from advocacy to policy papers and sustainability guidelines – is highlighted. The authors call for more individual guidance to provide enhanced transparency and clarity to industry, advisors and society at large on sustainability issues, with guidelines or sustainability-related block exemptions providing even greater legal certainty. With regard to intellectual property, the contributions examine various important issues, such as the need for intellectual property rights to remain technology-neutral, ways to promote the use of sustainable technologies and incentives for licensing, and ways to promote the dissemination of sustainable technologies, including compulsory licensing, cross-licensing, open source or FRAND licensing, and replacing the destruction of counterfeit goods with recycling. The papers also discuss greenwashing and how it can be addressed through revisions to trademarks and related rights

    Abstract: This open access textbook introduces and defines digital humanism from a diverse range of disciplines. Following the 2019 Vienna Manifesto, the book calls for a digital humanism that describes, analyzes, and, most importantly, influences the complex interplay of technology and humankind, for a better society and life, fully respecting universal human rights. The book is organized in three parts: Part I “Background” provides the multidisciplinary background needed to understand digital humanism in its philosophical, cultural, technological, historical, social, and economic dimensions. The goal is to present the necessary knowledge upon which an effective interdisciplinary discourse on digital humanism can be founded. Part II “Digital Humanism – a System’s View” focuses on an in-depth presentation and discussion of the main digital humanism concerns arising in current digital systems. The goal of this part is to make readers aware and sensitive to these issues, including e.g. the control and autonomy of AI systems, privacy and security, and the role of governance. Part III “Critical and Societal Issues of Digital Systems” delves into critical societal issues raised by advances of digital technologies. While the public debate in the past has often focused on them separately, especially when they became visible through sensational events the aim here is to shed light on the entire landscape and show their interconnected relationships. This includes issues such as AI and ethics, fairness and bias, privacy and surveillance, platform power and democracy. This textbook is intended for students, teachers, and policy makers interested in digital humanism.     Abstract: This open access book studies how foreign models of economic development can be effectively learned by and applied to today’s latecomer countries. Policy capacity and societal learning are increasingly stressed as pre-conditions for successful catch-up. However, how such learning should be initiated by individual societies with different features needs to be explained. The book answers this pragmatic question from the perspective of Japan’s past experience and its extensive development cooperation in Asia, Africa, and Latin America. Since the late nineteenth century, Japan has developed a unique philosophy and method for adopting advanced technologies and systems from the West; the same philosophy and method govern its current cooperation with the developing world. The key concepts are local learning and translative adaptation. Local learning says that development requires the learner to adopt a proactive mindset and the goal of graduating from receiving aid. Meanwhile, translative adaptation requires foreign models be modified to fit local realities given the different structures of the home and foreign society. The development process must be wholly owned by the domestic society in rejection of copy-and-paste acceptance. These ideas not only informed Japan but are key to successful development for all. The book also asks how this learning method should—or should not—be revised in the age of SDGs and digitalization. Following the overview section that lays out the general principles, the book offers many real cases from Japan and other countries. The concrete actions outlined in these cases, with close attention to individual growth “ingredients” as opposed to general theories, are crucial to successful policy making. The book contains materials that are highly useful for national leaders and practitioners within developing countries as well as students of development studies

    Abstract: This open access book presents a set of practical tools and collaborative solutions in multi-disciplinary settings to foster the Alpine Space health tourism industry's innovation and competitiveness. The proposed solutions emerge as the result of the synergy among health, environment, tourism, digital, policy and strategy professionals. The approach underlines the pivotal role of a sustainable and ecomedical use of Alpine natural resources for health tourism destinations, and highlights the need of integrating aspects of natural resources' healing effects, a shared knowledge of Alpine assets through digital solutions, and frames strategic approaches for the long-term development of the sector.     Abstract: Seit dem Mord an George Floyd durch den Polizeieingriff in den Vereinigten Staaten im Mai 2020 und der daraus erwachsenen (Social Media-)Bewegung #blacklivesmatter hat auch die Beschäftigung mit den verschiedenen Formen von Rassismus in Deutschland zugenommen. Konnte der Begriff vor wenigen Jahren in wissenschaftlichen wie öffentlichen Diskursen weitgehend nur schwierig oder selten genutzt werden, hat er sich inzwischen hierzulande auch als Gegenbegriff zur globalen Wirkmächtigkeit rechter Ideologien, die besonders Identitätskategorien zur Legitimation mörderischer Gewalt heranziehen, sowie im Kontext globaler Diversifizierungsmaßnahmen im Diskursmainstream durchgesetzt. Dieser Erfolg des Begriffs lässt auch die filmischen Produktionen zu Themen von Menschenfeindlichkeit, die auf Repräsentationskategorien basieren, in einem neuen Licht erscheinen. Filme zu Themen des Rassismus versuchen, Aufklärungsarbeit im Sinne anti-rassistischer Praxis zu leisten, während beispielsweise propagandistische Videos rechter und dschihadistischer Kreise zur (re-)produktiven Verhandlung von Rassismus beitragen. Andererseits lassen sich Filme, die scheinbar nichts mit Rassismus zu tun haben, bei einem genaueren analytischen Blick sehr wohl als Verstärkungs-, Reproduktions- oder Verschleierungsakteure von Rassismen verstehen. So sind Filme immer schon im Sinne von (Un-)Sichtbarkeitsmaschinen dazu geeignet, soziale Verhältnisse zu veräußerlichen und so ungedachte Zusammenhänge zu denken. In dieser argumentativen Bi-Perspektivität – Sichtbarwerden der Rassismusdiskurse und Filme als Sichtbarkeitsmedien sozialer Verhältnisse – geht der vorliegende Sammelband Diskursformen des Rassismus, seiner Filmkulturen und Möglichkeiten des (anti-rassistischen) Widerstands besonders/aber nicht nur im deutschsprachigen Kontext nach. Daran schließen sich folgende Fragen an: Wie sieht der Zusammenhang von (fiktionalen) Filmen und Formen des Rassismus in Film-kulturen aus?     Abstract: If piety, faith, and conviction constitute one side of the religious coin, then imperfection, uncertainty, and ambivalence constitute the other.     Abstract: This book examines social and medical responses to the disfigured face in early medieval Europe, arguing that the study of head and facial injuries can offer a new contribution to the history of early medieval medicine and culture, as well as exploring the language of violence and social interactions. Despite the prevalence of warfare and conflict in early medieval society, and a veritable industry of medieval historians studying it, there has in fact been very little attention paid to the subject of head wounds and facial damage in the course of war and/or punitive justice. The impact of acquired disfigurement —for the individual, and for her or his family and community—is barely registered, and only recently has there been any attempt to explore the question of how damaged tissue and bone might be treated medically or surgically. In the wake of new work on disability and the emotions in the medieval period, this study documents how acquired disfigurement is recorded across different geographical and chronological contexts in the period

Was Minderheiten ausmacht, beziehungsweise ob und wie sie sich in Europa Gehör verschaffen können, ist in hohem Maße durch die Kulturpolitik der Nationalstaaten und der EU bestimmt. Die Autoren und Autorinnen des Bandes richten ihren Blick auf die Anfänge einer modernen Minderheitenpolitik seit der Weimarer Republik, denn der Begriff der nationalen Minderheiten wurde nach dem Ersten Weltkrieg zu einem Gegenstand rechtlicher wie politischer Debatten und zu einer gesellschaftlichen 'Kategorie der Moderne'. Die Gründung des Völkerbundes, die Legitimierung des Selbstbestimmungsrechts der Völker und die Etablierung des Minderheitenschutzes auf internationaler Ebene bildeten den Ausgangspunkt für diese Entwicklungen.     Abstract: Nieuw in Nederland: Feesten en rituelen in verandering levert een bijdrage aan het publieke debat over immigranten, cultuur en nationalisme. Het boek stelt het idee ter discussie dat in Nederland migrantenculturen bestaan met elk hun eigen traditionele feesten en rituelen. De onderliggende aanname dat migranten vastomlijnde gemeenschappen met eigen culturen vormen, wordt aan de hand van etnografisch onderzoek weerlegd. In het boek staan feesten en rituelen centraal die in Nederland zijn ontstaan als gevolg van de komst van nieuwe Nederlanders: van een doop in een Ghanese pinksterkerk tot het multiculturele evenement Kwakoe. Anders dan vanuit een conventioneel perspectief, waarin deze vieringen als onderdeel van en behorende tot culturen van migranten worden gezien, laten de bijdragen zien dat deze vieringen voortkomen uit onze Nederlandse samenleving als geheel. Vieringen van nieuwe Nederlanders blijken een hybride waarin de Nederlandse geschiedenis even bepalend is als de tradities in het land van oorsprong. Feesten en rituelen lijken weliswaar stabiel, maar zijn voortdurend in verandering. Onder de noemer 'nieuwe Nederlandsheid' schetst Nieuw in Nederland niet zozeer een portret van immigrantenculturen, maar van cultuur in Nederland.

    Abstract: Controversies and problems with regard to language policy and language education still exist in Malaysia. Despite the attempts of language policy makers to promote multilingualism, the implementation has been marred by political and religious affiliations. Malaysia is a melting pot of many different cultures and ethnicities, the three largest being Malay, Chinese and Indian. Therefore, an analysis of the language variation in this polyglot nation will help in understanding the variety of languages and those who speak them. This book gathers the work of researchers working in the field of language change in Malaysia for over two decades. As there is no book published internationally on the language policy in Malaysia and the effects on the language change in urban migrant populations, this book is a timely contribution not only to an understanding of Malaysian linguistic pluralism and its undercurrents, but also to an understanding of the Indian Diaspora.

    Abstract: The nine essays of this volume, spanning from the eighteenth to mid-twentieth century, highlight the workings of, and reactions to, colonial domination in Asian contexts. The scholars, which include Victoria Haskins of the University of Newscastle, use a range of social science history methods to explore new paths to colonial history. How were individuals, groups, and social categories able to order their lives in the face of the implementation of external dominance? In other words, what was the agency enabling them to interact with, adapt to, use, counteract and in the end defeat colonialism? The essays emphasize colonialism as a multifaceted historical phenomenon which has taken a number of mutually incompatible forms. The various texts thus reflect on both the "early" colonialism build on indirect and informal practices, and the later forms marked by a high degree of authoritarian control.
    Abstract: In Responding to the West geven geschiedkundigen en sociologen hun visie op de methodologie en studie van het kolonialisme in Azië als historisch fenomeen. De negen essays geven hiervan een veelzijdig beeld. Ondanks de structurele onderdrukking was kolonialisme geen kwestie van eenrichtingsverkeer. De studie ervan vereist dan ook een grondige analyse van de continu veranderende verhoudingen tussen kolonisten en gekoloniseerden. Met Responding to the West wordt alvast een voorzet gegeven.

    Abstract: Most literature on the economic crisis in indonesia has focused on the negative macro-economic impacts during the "crisis- years" of 1997-99. The case studies presented in this book take a different perspective. With a longitudinal research perspective, this comparative study analyses a wide variety of responses to the crisis among communities and households. The case studies in this book cover the coping and adapting mechanisms of rural households under a variety of resource use practices and resource use regulations in different areas of Indonesia.
    Abstract: De meeste literatuur over de economische crisis in Indonesië richt zich vooral op de negatieve macro-economische effecten tijdens de hoogtijdagen van de crisis (1997-1999). De case-studies in dit boek beslaan niet alleen een langere periode, er worden ook diepteanalyses gemaakt van een verscheidenheid aan reponse- en bestaansstrategieën van huishoudens en rurale gemeenschappen tijdens en na de crisis. Pessimistische aannames ten aanzien van de weinig effectieve vooronderstellingen worden in dit boek tegengesproken. Het boek levert daardoor een bijdrage aan een effectiever beleid om gemeenschappen in crisissituaties weerbaarder te maken.
