    Abstract: The Theory of Contestation advances critical norms research in international relations. It scrutinises the uses of ‘contestation’ in international relations theories with regard to its descriptive and normative potential. To that end, critical investigations into international relations are conducted based on three thinking tools from public philosophy and the social sciences: The normativity premise, the diversity premise and cultural cosmopolitanism. The resulting theory of contestation entails four main features, namely types of norms, modes of contestation, segments of norms and the cycle of contestation. The theory distinguishes between the principle of contestedness and the practice of contestation and argues that, if contestedness is accepted as a meta-organising principle of global governance, regular access to contestation for all involved stakeholders will enhance legitimate governance in the global realm

    Abstract: The papers in this book question the tyranny of typological thinking in archaeology through case studies from various South American countries (Venezuela, Colombia, Bolivia, Argentina, and Brazil) and Antarctica. They aim to show that typologies are unavoidable (they are, after all, the way to create networks that give meanings to symbols) but that their tyranny can be overcome if they are used from a critical, heuristic and non-prescriptive stance: critical because the complacent attitude towards their tyranny is replaced by a militant stance against it; heuristic because they are used as means to reach alternative and suggestive interpretations but not as ultimate and definite destinies; and non-prescriptive because instead of using them as threads to follow they are rather used as constitutive parts of more complex and connective fabrics. The papers included in the book are diverse in temporal and locational terms. They cover from so called Formative societies in lowland Venezuela to Inca-related ones in Bolivia; from the coastal shell middens of Brazil to the megalithic sculptors of SW Colombia. Yet, the papers are related. They have in common their shared rejection of established, naturalized typologies that constrain the way archaeologists see, forcing their interpretations into well known and predictable conclusions. Their imaginative interpretative proposals flee from the secure comfort of venerable typologies, many suspicious because of their association with colonial political narratives.     Abstract: Corruption is usually understood as hampering political development, economic growth and democratic participation of citizens, but comparing the effects of corruption for different political regimes presents astonishingly complex findings. The ongoing persistence of corruption underlines that it is not only dysfunctional, but can be highly functional as well. This special issue brings together contributions from comparative politics, political science and economics which precisely focus on these (dys)functionalities of corruption in political regimes across various world regions. The question of methodological pluralism is especially important for studying corruption comparatively. While on an international level a trend towards an increased use of quantitative methods in political science as well as in economics can be observed, the special issue underlines the importance of having a pluralistic approach for grasping the complex and multi-layered effects of the phenomenon. Of similar importance is the adoption of a comparative perspective that includes different world regions in order to understand the different roles of corruption in developing, transforming and developed countries alike.     Abstract: Hadrian’s Wall was inscribed as a World Heritage Site (WHS) in 1987 and, with the German Limes, became one of the first two parts of the transnational ‘Frontiers of the Roman Empire’ (FRE) WHS in 2005. The World Heritage Site of Hadrian's Wall is unusual, although not unique, among World Heritage sites in its scale and linear nature: stretching from Ravenglass on the west coast of England to Newcastle upon Tyne on the east coast - over 150 miles. Along its length it passes through two major urban centres and a variety of rural landscapes and its remains vary from substantial upstanding architectural features to invisible below ground archaeology. Traditionally many of the constituent parts of Hadrian's Wall, forts etc, have been managed as separate entities by different State and private organisations. These and other issues make it an extremely complex WHS to manage. This book not only chronicles the past management of the Wall but also looks towards the future as more countries aspire to have their Roman frontiers added to the FRE. The experience gained over the last two decades illustrates developments in the management of large scale complex heritage sites that will be of value as a detailed case study to those involved in (and affected by) heritage management, as well as academics, and students. Many of the issues raised will find resonance in those faced by many other large (World) heritage sites

    Abstract: This book uses a multi-methods study of incarcerated youths to examine the pathways to gang involvement, the drug distribution system and hierarchy within gangs, levels of traumatic stress and depression among gang-involved youths, and other mechanisms of control and retention within the system of gangs. Based on a study of young inmates in Norway, with international backgrounds including Africa, Pakistan, Middle East and Western Europe, the findings explained in this book are broadly applicable. It aims to create a picture of the entire system of gang membership, while revealing a research framework that could be applied to other studies. Gang members were found in high levels to be suffering from depression and traumatic stress, and were often heavily indebted (financially and otherwise) to persons in the outside world. Owing money, violence and other threats, all make it difficult to leave the system, despite the pains they suffer within it. In order understand young peoples’ life within the system, and its hold on them, and in order to reduce its continuation and growth, this important analysis helps researchers and policy makers, particularly those interested in juvenile justice, youth gangs, and drug trafficking understand its logic and identify its weak points and possible ways out

    Abstract: Ever since the signing of the World Heritage Convention 40 years ago and ratified by 33 African countries, to date, only 43 cultural heritage sites have been successfully proclaimed as World Heritage Sites in Africa. These include archaeological and historical sites, religious monuments and cultural landscapes. This book is a re-evaluation of the nomination and management of cultural World Heritage sites in Africa from the late 1970s when the Island of Gorée of Senegal and the Rock-Hewn Churches of Ethiopia were first inscribed on the WHL until today. It considers whether a credible and well balanced WHL has been attained, especially in regards to the nomination of more sites in Africa. The book also examines the roles and contribution of various heritage organizations and African governments to the nomination and management of cultural World Heritage sites in Africa. Lastly, the volume also scrutinizes economic development, which may result from the nomination and successful management of cultural World Heritage sites in Africa

    Abstract: This volume provides an up-to-date and in-depth summary and analysis of the political practices of pre-Columbian communities of the Araucanians or Mapuche of southcentral Chile and adjacent regions. This synthesis draws upon the empirical record documented in original research, as well as a critical examination of previous studies. By applying both archaeological and ethnohistorical approaches, the latter including ethnography, this volume distinguishes itself from many other studies that explore South American archaeology. Archaeological and traditional-historical narratives of the pre-European past are considered in their own terms and for the extent to which they can be integrated in order to provide a more rounded and realistic understanding than otherwise of the origins and courses of ecological, economic, social and political changes in the south-central Andes from late pre-Hispanic times, through the contact period and up to Chile’s independence from Spain (ca. AD 1450-1810). Both the approach and the results are discussed in the light of similar situations elsewhere.   Throughout its treatment, the volume continually comes back to two central questions: (1) how did the varied practices, institutions, and worldviews of the Mapuche’s ancient communities emerge as a historical process that resisted the Spanish empire for more than 250 years, and (2) how were these communities reproduced and transformed in the face of ongoing culture contact and landscape change during the early Colonial period? These questions are considered in light of contemporary theoretical concepts regarding practice, landscape, environment, social organization, materiality, community, and what the author refers to as a teleoscopic political formation that will make the book relevant for students and scholars interested in similar processes elsewhere

    Abstract: The role of civil society organisations in Brussels is debated. Some view them as representatives of their members and thus as legitimising agents for policy-making in the European Union. Others see them as being elitist and out of touch with their membership bases, therefore ill-suited to promote democracy at the EU level. Taking civil society organisations in the EU’s external relations as an example, Meike Rodekamp submits these controversial views to a reality check.     Abstract: This book provides a unique empirical study of criminal trials in China. Western observers such as the media, politicians and the legal scholars alike, have rarely had the exposure to the vast majority of the ordinary criminal trials in China. A number of legal reforms have been implemented in Chinese criminal courts in recent years, but there has been little research on whether these reforms have been effective. This book fills that gap, by unveiling the day-to-day reality of criminal cases tried by the lowest level courts in China. The data used in this study include hundreds of criminal trial observations, complete criminal case dossiers, and a comprehensive questionnaire survey of criminal justice practitioners from one large province located in China’s Southeast coast. These data were collected over a two-year period, with a generous research grant from the John D. and Catherine T. MacArthur Foundation, by scholars already working in the Chinese legal system. The work opens with a historical framework of the Chinese criminal justice system, both Western and Chinese interpretations, and an overview of the current state of the system. It will provide unique analysis of how criminal trials are being carried out in China, with a useful context for scholars with varying levels of familiarity with the current system. The research framework for gathering data discussed in this book will also provide a useful basis for studying the criminal justice system in other regions

    Abstract: This Brief takes a provocative look at existing socio-legal literature with a comparative study of terrorism control orders, focusing on how the concept of pre-emption fits within a traditional criminological framework. This timely work examines how such measures might be conceived and interpreted within a situational crime prevention approach. Over the past decade, socio-legal scholars have identified a rise in pre-emptive control mechanisms to respond to terrorism and other threats in the post-9/11 world. Many have argued that this pre-emptive rationale has been used to justify the introduction of measures that transcend established legal and risk frameworks, to deal with individuals or groups thought to pose a threat to the state or its citizens.     Abstract: Cyberspace is everywhere in today’s world and has significant implications not only for global economic activity, but also for international politics and transnational social relations. This compilation addresses for the first time the “cyberization” of international relations - the growing dependence of actors in IR on the infrastructure and instruments of the internet, and the penetration of cyberspace into all fields of their activities.     Abstract: The Bologna Process opened a new chapter in the history of the European higher education. The idea of a common European Higher Education Area was developed in Western Europe and accelerated increasingly there in the second half of the 20th century, as a phenomenon of globalization. For the post-communist states in Eastern Europe the complete change of the political system made it possible to join the European Union and the Bologna Process.     Abstract: Dominant parties and democracies - are they really strange bedfellows? Malte Kaßner sheds light on the relation between one-party dominance and democracy from a comparative perspective. The study examines the key question how different types of dominant parties influence democracy in multicultural societies with the help of two case studies: South Africa and Malaysia. Both countries are characterized by an ethnically, linguistically and religiously plural society. The author analyses the two dominant parties African National Congress (ANC) and United Malays National Organization (UMNO) and their implications on democracy in the two countries. The outcome suggests that one-party dominance per se cannot be assessed as beneficial or harmful for democratic development. Rather, dominant parties deserve a stronger analytical differentiation.     Abstract: This book provides an early exploration of the new field of disaster bioethics: examining the ethical issues raised by disasters. Healthcare ethics issues are addressed in the first part of this book. Large-scale casualties lead to decisions about who to treat and who to leave behind, cultural challenges, and communication ethics. The second part focuses on disaster research ethics. With the growing awareness of the need for evidence to guide disaster preparedness and response, more research is being conducted in disasters. Any research involving humans raises ethical questions and requires appropriate regulation and oversight. The authors explore how disaster research can take account of survivors? vulnerability, informed consent, the sudden onset of disasters, and other ethical issues. Both parts examine ethical challenges where seeking to do good, harm can be done. Faced with overwhelming needs and scarce resources, no good solution may be apparent. But choosing the less wrong option can have a high price. In addition, what might seem right at home may not be seen to be right elsewhere. This book provides in-depth and practical reflection on these and other challenging ethical questions arising during disasters.     Abstract: This work provides clear application of a new statistical modeling technique that can be used to recognize patterns in victimization and prevent repeat victimization. The history of crime prevention techniques range from offender-based, to environment/situation-based, to victim-based. The authors of this work have found more accurate ways to predict and prevent victimization using a statistical modeling, based around crime concentration and sub-group profiling with regard to crime vulnerability levels, to predict areas and individuals vulnerable to crime. Following from this prediction, they propose policing strategies to improve crime prevention based on these predictions.     Abstract: Statistics in Criminal Justice takes an approach that emphasizes the application and interpretation of statistics in research in crime and justice. This text is meant for both students and researchers who want to gain a basic understanding of common statistical methods used in this field.     Abstract: This book reviews the global dilemma and tensions over whether to intervene or not to intervene in severe civil conflicts which test the validity of the new doctrine of Responsibility to Protect or R2P. Are there prospects for a tweaking or repositioning of R2P as advocated by some scholars and governments to make the concept more acceptable to the global community, including Southeast Asia? Has the Westphalian doctrine of state sovereignty and non-intervention become superfluous as a result of the rise of R2P? Will a new doctrine of “Eastphalia” or “non-intervention with East Asian characteristics” emerge in its place, led by China as well as like-minded Asian and other states?

    Abstract: The book analyzes the topic of judicial reforms in four countries of South-East Europe, focusing on two specific factors that have influenced the reforms in the past two decades: the role played by the European Union in light of the east Enlargement process and the legacies of the communist regimes. Specifically, the aim is to account for similarities and differences in the reform paths of Slovenia, Romania, Croatia, and Serbia. In each country, in fact, the influence of the EU policies has been differently mediated by national factors that, broadly conceived, may be considered as expressing the legacies of the past regimes. In some cases, these legacies challenged judicial reforms and inhibited the influence of the EU; in other cases, they were positively overcome by following the route suggested by the EU. Some explanatory factors for these differences will be proposed drawing from democratization studies, Europeanization literature, and comparative judicial systems. The book focuses on countries having different status vis-a` -vis the EU and differently involved, in term of timing, in the EU accession process: some of them are new member states entered in 2004 (Slovenia) or in 2007 (Romania); others were, until recently, acceding countries (Croatia) or candidates to the membership (Serbia). This comparison allows investigation of the power of EU conditionality in different phases of the EU enlargement process

    Abstract: Ending identity conflicts through negotiated agreements is an intractable process that is embedded complexly in the nation-building process. Ariel Hernandez looks on the complexity of the nation-building process in the Philippines and how its social and political context constrains the achievement of a peace agreement that would withhold new challenges as the process unfolds. Mediation as one of the possible modes of intervention to resolve identity conflicts is taken as the self-evident instrument to end the 40 year old conflict between the Filipino society at large and the Bangsamoro. The analysis confirms that mediation and other types of intervention are contributing to the intractability of identity conflicts by bringing in further complexities in the negotiation process. The conceptualization of “stumbling blocks” may provide knowledge based resources to develop strategies to “facilitate” the mediation process that allows negotiating parties to cope with the complexity of the bargaining table.     Abstract: In this edited volume leading scholars from different disciplinary backgrounds wrestle with social science integration opportunities and challenges. This book explores the growing concern of how best to achieve effective integration of the social science disciplines as a means for furthering natural resource social science and environmental problem solving. The chapters provide an overview of the history, vision, advances, examples, and methods that could lead to integration. The quest for integration among the social sciences is not new. Some argue that the social sciences have lagged in their advancements and contributions to society due to their inability to address integration related issues. Integration merits debate for a number of reasons. First, natural resource issues are complex and are affected by multiple proximate driving social factors. Single disciplinary studies focused at one level are unlikely to provide explanations that represent this complexity and are limited in their ability to inform policy recommendations. Complex problems are best explored across disciplines that examine social-ecological phenomenon from different scales. Second, multi-disciplinary initiatives such as those with physical and biological scientists are necessary to understand the scope of the social sciences. Too frequently there is a belief that one social scientist on a multi-disciplinary team provides adequate social science representation. Third, more complete models of human behavior will be achieved through a synthesis of diverse social science perspectives
