    Abstract: "According to a common narrative, identity politics derives from leftist postmodernism and is antithetical to liberalism and Enlightenment universalism. However, in this book, Holtug argues that this narrative is false. Identity politics is propagated not only by the left but also by the right, is not tied to postmodernism, and various forms of it are quite compatible with liberalism and Enlightenment values. Indeed, based on a liberal egalitarian political framework, he argues that some forms of identity politics are well worth pursuing, while others should clearly be resisted. Among other things, identity politics can serve to increase the opportunities of worse off, marginalized groups. Along the way, the book deals with conceptual issues (what is identity politics?), the normative political basis for assessing identity politics, as well as empirical issues, such as whether identity politics fractures society and drives down social solidarity. Furthermore, specific identity policies are considered and assessed, including affirmative action for African Americans, opposition to the n-word and blackfacing, opposition to cultural appropriation and out-group representation in art, as well as forms of 'cancel culture' such as no platforming and pulling down statues of morally compromised historical figures. Holtug also critically discusses forms of identity politics that are more specific to the political right, including White supremacism, White nationalism, and ethnopluralism, but also less extreme forms of nationalism such a liberal nationalism"--

    Abstract: It is generally accepted that the contingencies of manuscript survival have disproportionately destroyed some sorts of manuscripts and not others. But there is no consensus as to which sorts. Loosely-bound books, deluxe books, secular books, and purely liturgical books are all thought to have been disproportionately destroyed. Nor is there any consensus about how or when the bulk of this destruction happened. Although it is usually believed that the Dissolution of the Monasteries was the single most significant event in England’s history of medieval manuscript loss, it is not clear what mark it left on the record. How did Reformation-era losses compare to those that preceded the Reformation and to those that followed it? How did the kinds of losses caused by sectarian conflicts compare to more everyday kinds of loss, such as improper storage or deliberate deacquisition? Which manuscripts were targeted, when, and how can we expect the record to be skewed? These questions, which lie at the heart of this study, are important for researchers working in multiple fields, including literary studies, book history, and archival sciences. Blending more traditional book history approaches with methods drawn from quantitative codicology, this study explores the most significant moments of manuscript loss in the history of England. As this study shows, a focus on book lists from institutional libraries has led to a tendency to misrepresent and underestimate the destruction of medieval manuscripts. The evidence suggests that this destruction was much more limited in its targets, but far more extensive in scope, than is usually acknowledged

    Abstract: The idea that a child is intellectually ‘gifted’ has a social and cultural history. This book analyses that social history at multiple scales, and makes the ‘voices’ of the gifted young themselves central. In daily encounters, those labelled ‘gifted’ sometimes loved this label, and felt special in comparison to peers at school and siblings at home. For others, ‘gifted’ was a silly or embarrassing label, and many questioned the idea of separating off young people in terms of intelligence, as well as specific forms of testing. Ideas of the gifted child also reshaped family lives—parents dedicated time to providing special leisure spaces, running them in their own homes and taking their children significant distances to spend time with others. Voluntary organisations were critical here, as the network through which young people and adults encountered the term, ‘gifted’, and lived and created it relationally. Voluntary organisations, looking to gain attention and visibility, also critically shaped the idea that the gifted young were elites of ‘the future’, central to answering challenges of economic decline, global warfare, or humanitarian aid. The hopes placed on gifted children between the 1960s and the 1990s were often sky high—yet many gifted young still felt that the community ‘wasted’ their talents, and did not support them. This book, then, provides new perspectives on the tensions between elitism and equality in modern Britain. It also offers vivid stories of optimism, hope, disappointment, and criticism, in which young people themselves play a central role.

    Abstract: The recognition of the freedom to conduct a business as a fundamental right within European Union law has reignited debate as to the proper place of competing economic freedoms and fundamental social rights within the European Union legal order. In particular, the Court of Justice of the European Union has relied on freedom of contract as a component of the freedom to conduct a business in order to undermine the protection of competing employment rights. Using the employment law context as a case study, this book argues that the potential regulatory consequences of the freedom to conduct a business as a fundamental right can only properly be understood within its wider constitutional and social dimensions. A holistic assessment of the value placed on business freedoms within the legal reasoning of the Court of Justice of the European Union demonstrates that there is nothing inherently deregulatory in granting fundamental rights status to such freedoms, with the freedom to conduct a business as a fundamental right also being contoured by competing ‘social’ rights, interests, and values. The freedom to conduct a business is thereby also shown to be a malleable fundamental rights concept in that its precise reach remains dependent on the underlying constitutional context whether that be within national constitutional law, the general principles of EU law, the Charter of Fundamental Rights, or in those arrangements governing the United Kingdom’s departure from—and new relationship with—the European Union.

Insbesondere hat sich der Gerichtshof der Europäischen Union auf die Vertragsfreiheit als Bestandteil der unternehmerischen Freiheit gestützt, um den Schutz konkurrierender Arbeitnehmerrechte zu untergraben.     Abstract: Politicians want to stay in power. Because winners attain office under a given set of electoral rules, any change to these rules is puzzling. When electoral reform does take place, it is expected that changes will better serve those already in power. Perhaps more than any other type of electoral rule, gender quotas are explicit about who is set to win and lose from their adoption. As positive discrimination in favor of women, gender quotas limit the space for men, the clear majority of incumbents. Despite this, gender quotas are now present in every region of the world. But how has this happened? In other words, under what conditions are (men) legislators more likely to support the adoption of gender quotas? Reconstructing three decades of power struggles over quota policymaking in Latin America, the book argues that men legislators are more likely to support gender quotas when opposing the policy also imposes potential costs to their future career prospects—a scenario that has implications for the timing, strength of design, and length of the process of quota policymaking. As the first book to closely trace legislators’ behavior toward gender quotas since the policy made its way into plenary debates, Resistance to Gender Quotas in Latin America employs a wealth of experimental, quantitative, and qualitative data to show how an institution that explicitly seeks to replace incumbents has successfully diffused throughout Latin America despite incumbents’ resistance.

How do nongovernmental organizations (NGOs) create the spaces in which they act, despite all the odds against them? How do NGOs seem to meet the requirements of the moment, often being in the right place at the right time? Why is the sum of NGO activity frequently greater than the parts? These questions cannot be answered simply by looking at NGOs' organizational attributes or outcomes. To truly grasp the power of NGOs it is necessary to examine how they relate to each other, as well as with states, intergovernmental organizations, businesses, and other actors. This volume argues for more detailed attention to the forms and processes of interactions between NGOs, and a broader conceptualization of NGO-NGO relationships to better understand their power and agency in global politics.     Abstract: This book examines how the evolution of higher education in Egypt affects students and student politics. It aims to look beyond the historical representations of the student movement as protests for national and regional causes in order to account for the impact of the socio-economic shift in the 1990s, the revolution in 2011, and the restrictive context post-2013. Egyptian Students and Politics beyond Protest uncovers the diverse locations where politics emerge among students such as student unions, partisan student organizations, student clubs and associations including simulation models, in addition to activist groups. The book draws on interviews conducted in Egypt between 2013 and 2015 with members of these groups and ethnographic observation of their activities. As students collectively and individually negotiate the scope of their political activities and the meanings they attribute to these activities, the resulting student politics are, not only diverse, but also unexpected.

    Abstract: This book examines the design and evolution of European law from the perspective of economics. It draws on various branches of the economic sciences—including rational choice and game theory, and institutional and behavioural economics—to expand our understanding of EU law and its effects. It seeks to complement doctrinal research on EU law by generating insights that are typically ignored in discussions of legal doctrine—including why the EU Treaties are designed as they are, how the Treaties and secondary EU law should be crafted, and how EU rules should be interpreted. While legal scholars draw on a range of interpretive methods, economics furnishes an alternative set of tools for explaining core legal principles such as conferral, subsidiarity, and mutual recognition. The law considers the actions of EU institutions in terms of their competences and instruments; economics, by contrast, can shed light on underlying motive dynamics—that is, on why Union institutions behave as they do within existing legal frameworks. This book devotes attention to EU Treaties and secondary law, as well as their adjudicative interpretation. The aim of the book is not to correct or revise existing legal perspectives, but rather to offer additional descriptive and normative metrics that expand our understanding of various issues, including in particular the decision-making behaviour of EU institutions and Member States. The book vividly demonstrates the immense value of harnessing the multifarious tools and methods of economics to analyse various issues in EU law, not least in relation to current reform debates

    Abstract: While international organizations (IOs) have played a central role in global governance in the post-Cold War period, during the last decade many have struggled. Due to the rise of populism, the Trump presidency, and the renewed assertiveness of the emerging powers, various IOs have been challenged in ways that put their ability to perform core functions at risk. This book studies the responses of IOs to such existential challenges. It focuses on the central institutional actors inside IOs—IO leaders and their bureaucracies—which have a strong interest in the survival and well-being of their organizations. Presenting six case studies and drawing on more than 100 interviews, the book highlights the variation in the way in which these institutional actors try to cope with and counter existential challenges: Some fight tooth and nail to keep their IOs relevant, while other institutional actors are more circumspect in their actions. The book shows that institutional actors try to tailor their responses to the specific types of existential challenges, but their ability to do so depends on the quality of their leadership, organizational structure, and embedding in external networks. This book is thus about the IOs themselves. It is about those who lead IOs at the top but equally about the desk officers who keep the machinery running. By providing a view from behind the scenes, the book uncovers important processes about the survival of IOs and international institutions

    Abstract: Politicians want to stay in power. Because winners attain office under a given set of electoral rules, any change to these rules is puzzling. When electoral reform does take place, it is expected that changes will better serve those already in power. Perhaps more than any other type of electoral rule, gender quotas are explicit about who is set to win and lose from their adoption. As positive discrimination in favor of women, gender quotas limit the space for men, the clear majority of incumbents. Despite this, gender quotas are now present in every region of the world. But how has this happened? In other words, under what conditions are (men) legislators more likely to support the adoption of gender quotas? Reconstructing three decades of power struggles over quota policymaking in Latin America, the book argues that men legislators are more likely to support gender quotas when opposing the policy also imposes potential costs to their future career prospects—a scenario that has implications for the timing, strength of design, and length of the process of quota policymaking. As the first book to closely trace legislators’ behavior toward gender quotas since the policy made its way into plenary debates, Resistance to Gender Quotas in Latin America employs a wealth of experimental, quantitative, and qualitative data to show how an institution that explicitly seeks to replace incumbents has successfully diffused throughout Latin America despite incumbents’ resistance

    Abstract: Significant changes in social sciences often herald changes in legal theory, including in international legal theory. In light of the cognitive turn in social sciences, this volume seeks to explore the implications of this ‘turn’ for international legal theories. Cognitive and behavioural studies are making inroads into international law literature and international policy-making, yet their implications for international legal theory remain under-explored. The book aims to fill this gap by systematically analysing if, to what extent, and how insights gained from cognitive-behavioural sciences influence the principal theoretical approaches to international law. The chapters indicate that while insights drawn from cognitive and behavioural literature often underlie or complement some international legal theories, interactions between some legal theories and cognitive-behavioural studies are characterized by tensions. Exploring the implicit and explicit cognitive-behavioural assumptions of international legal theories has the potential to build bridges between these fields

    Abstract: This book aims to increase knowledge about (i) the key drivers of domestic saving rates in sub-Saharan Africa (SSA); (ii) whether alternative approaches, such as pension funds or fintech, could provide new solutions to increase domestic savings; (iii) lessons learnt from the experiences so far in different countries in SSA; and (iv) what can SSA learn from the experience of other regions which have been more successful in raising savings rates. The book consists of two parts: (I) thematic studies and (II) country studies. The thematic studies examine the implications of new developments in African financial markets on savings behaviour, the role of sovereign wealth funds, pensions, and capital markets in augmenting savings and in economic development, the challenges of the debt crisis in Africa, the implications of financial liberalization for private saving in SSA, and lessons on how to increase savings rates from East and South Asia. The four country studies—Tanzania, Ghana, Cameroon, and Ghana—examine the determinants of domestic savings. The countries were selected based on criteria that capture the diversity of savings performance in SSA. Each case study uses a common conceptual framework drawn from the life-cycle theory of savings and the same empirical methods to test for the determinants of savings using time-series data for the country in question. The findings of the book provide clear recommendations on how to increase savings in sub-Saharan Africa

    Abstract: This volume explores a wide range of structural phenomena in typologically diverse heritage languages using current Minimalist theoretical approaches. Heritage languages have been the focus of extensive research in the last three decades; by virtue of their inherent diversity stemming from initial learning conditions, they pose significant challenges to traditional methods of linguistic description that rely on uniform conceptions of what “knowledge of language” should be. Despite the existence of inter- and intra-speaker variation in the grammars of heritage languages, there are also significant shared development trends and structural outcomes that cannot be considered to be purely circumstantial. The studies presented in this volume illustrate the practicality and usefulness of subjecting domains of heritage language syntax to rigorous formal analysis. The chapters also have implications for theory-building efforts within the current Minimalist landscape; they force a reassessment of our understanding of the ideal speaker-hearer (Chomsky 1965) in the context of bi- and multi-competent individuals and communities. In line with recent trends in contemporary Minimalism that largely eschew the notion of traditional parameters and an enriched view of Universal Grammar, the integration of heritage languages into syntactic theory adds an important piece of the puzzle relating to linguistic competence. The volume also in some respects calls for a re-evaluation of the prevailing stance that the syntax of heritage languages is predominantly immune to significant decay or change

    Abstract: This volume shows how waste in its manifold variety provides an innovative starting point for interrogating twenty-first-century society. Waste in and of itself, along with those who work with it, may suffer from social stigma. As an epistemological point of departure however, waste offers an advantageous platform for social inquiry. Drawing on the contributions from an international team of interdisciplinary authors from discard and waste studies, this volume showcases the potential for waste as a revelatory lens through which the social world may be critically re-examined and assessed. Among the topics subjected to this critical analysis are anthropocentrism, disposability, economic growth, efficacy, environmental justice, matters of concern, racism, ownership, stigma, social innovation, and techno-utopianism. The contents of this volume elaborate a novel, critical waste-based epistemology that addresses four broad thematic concerns: materiality, society, economy, and temporality.     Abstract: The idea that a child is intellectually ‘gifted’ has a social and cultural history. This book analyses that social history at multiple scales, and makes the ‘voices’ of the gifted young themselves central. In daily encounters, those labelled ‘gifted’ sometimes loved this label, and felt special in comparison to peers at school and siblings at home. For others, ‘gifted’ was a silly or embarrassing label, and many questioned the idea of separating off young people in terms of intelligence, as well as specific forms of testing. Ideas of the gifted child also reshaped family lives—parents dedicated time to providing special leisure spaces, running them in their own homes and taking their children significant distances to spend time with others. Voluntary organisations were critical here, as the network through which young people and adults encountered the term, ‘gifted’, and lived and created it relationally. Voluntary organisations, looking to gain attention and visibility, also critically shaped the idea that the gifted young were elites of ‘the future’, central to answering challenges of economic decline, global warfare, or humanitarian aid. The hopes placed on gifted children between the 1960s and the 1990s were often sky high—yet many gifted young still felt that the community ‘wasted’ their talents, and did not support them. This book, then, provides new perspectives on the tensions between elitism and equality in modern Britain. It also offers vivid stories of optimism, hope, disappointment, and criticism, in which young people themselves play a central role

    Abstract: This book critically examines justice responses to non-recent institutional abuses across the island of Ireland, comprising Northern Ireland and the Republic of Ireland within an international context, drawing on insights from interdisciplinary literature (eg law, political science, history, sociology, criminology, and social policy) and extensive primary research. Utilising the island of Ireland, North and South, as its primary case study, it comparatively examines the dominant forms of justice responses to non-recent institutional abuses, including prosecutions and civil litigation, inquiries, redress, and apologies in both Anglophone and non-Anglophone countries. Drawing on the literature related to restorative justice, transitional justice, and transformative justice, the book advances a re-imagined hybrid approach to justice which draws on conventional and innovative justice approaches and seeks to bridge the accountability gap between seeking and achieving justice for non-recent institutional abuses. The critical analysis of justice responses is set against the complexities of the legal, historical, cultural, institutional, and political realities of addressing non-recent institutional abuses. In including the voices of multiple key stakeholders and their experiences of justice processes—victim/survivors as well as church and state actors—in a unique project, it considers how we might reframe discourses on accountability and responsibility, improve justice processes at the level of praxis, and increase engagement between victim/survivors and institutional actors in order to better address the complexities of non-recent institutional abuses and improve justice processes and outcomes

Through an innovative methodology of collaborative critical family history, Living with the Dead features interviews, personal archives, and the results of a collaboration with fifteen family historians, including the author’s own family. What results is a unique way of getting inside families in the past, of charting not only how families have remembered their dead and passed on their histories over time, but the mechanisms of how histories are constructed and shared.
