    Abstract: Marriage is the novel's traditional subject matter. But what happens to the novel when another genre of writing lays claim to the novel's traditional material? Primitive Marriage: Victorian Anthropology, the Novel, and Sexual Modernity shows how the foundational ideas of the new discipline of anthropology gave late-Victorian novelists and social scientists ways of rethinking heterosexual romance by referring to a new kind of history, one in which marriage systems, sexual behavior, and reproductive practices were temporalized and given historical agency. Temporalizing sexual relations, locating them in evolutionary and historical time, anthropologists and the novelists who wrote after them began to think modernity in sexual terms. This transformation of politics into sexual politics put sexuality and gender at the center of liberal stories of progress. The Victorian theorists responsible for this transformation--from well-known figures like Charles Darwin and Sigmund Freud to lesser-known writers like John McLennan and Henry Maine--and the novelists who engaged them--Anthony Trollope, George Eliot, Henry James, Sarah Grand, H. Rider Haggard, Thomas Hardy--not only helped produce sexually modern subjects, but also the theories about sexuality, time, and politics that we still draw upon to think modernity today.

This book is about the people who lived around the edges of the Desert and the different ways in which they responded to its challenges, establishing networks of communication across its expanse. But the Sahara has not always been a desert. From about 9000 BC the region began to enjoy a warm, humid period allowing vegetation to flourish and wild animals to move in. Humans soon followed practising pastoral economies but with the onset of harsher conditions once more around 3000 BC the desert reclaimed its own. Since then fluctuations in climate have continued to affect the lives of people living around the desert fringes. The communities occupying the North African Coast and in the Nile Valley have come under the influence of the states dominating the Near East and the Mediterranean but those living in in the Sahel to the south of the desert have developed their own distinctive cultures. The Taliban Courts in Afghanistan: Waging War by Law explores how the Taliban used the law as a resource in its conflict with militarily and technologically superior Western armies. While the international coalition set up an inadequate and corrupt legal system, the Taliban set up hundreds of courts in the countryside. By insisting on due process, impartiality of judges, and the enforcement of verdicts, this system of justice established itself as one of the few sources of predictability in the daily lives of Afghans. The armed movement used law to substantiate their claim to embody the state, disseminate their vision of society, and establish local legitimacy. Their courts attempted to balance the political agenda of the movement, the demands of Islamic law, the needs of the population, and the expectations of international legal actors whose implicit recognition they desired. In contemporary civil wars, where dispensing justice is at once a juridical activity, a political weapon, and a stake in the war, this book thus accounts for why the West lost the war and how the Taliban took over the country. Based on the author's extensive fieldwork in various provinces in Afghanistan and unique access to Taliban judges and court users, this socio-legal investigation offers new perspectives on a country that was at war for over four decades. Baczko proposes an innovative reflection on the place of law and courts in civil wars as well as a stark reminder of the dangers of foreign intervention.

Most work on climate displacement has tended to take an idealized 'climate refugee' as its focus. But focusing on the figure of the climate refugee obscures the complexity and heterogeneity of climate displacement. Instead, this book takes the empirical dynamics of climate displacement as its starting point. It examines the moral and political problems raised by the interaction of climate change and displacement in five domains: community relocation, territorial sovereignty, labour migration, refugee movement, and internal displacement. In each context, climate displacement raises distinct questions, which this book explores on their own terms. At the same time, this book treats climate displacement as a unified phenomenon by examining the overarching questions of responsibility and fairness that it raises.     Abstract: Sovereignty, International Law, and the Princely States of Colonial South Asia examines the role the doctrine of sovereignty played in debates over the legal status of the princely states of colonial South Asia, illustrating how different interpretations have shaped current understandings of international law and the modern Indian nation-state.This book examines the relationship between colonialism and international law by focusing on debates surrounding the legal status of the 'princely states' of colonial South Asia. The princely states were ruled by indigenous rulers and were not considered to be British territory. Instead, they remained subject to British influence exercised through political officers, resulting in enduring controversies over whether they were 'sovereign states'. This book traces how the language of sovereignty became the discourse for debating the legal status of the princely states and, in this way, mediated the exercise of political power in colonial South Asia. Focusing on the period between the mid-eighteenth and mid-twentieth centuries, it examines how international lawyers, British politicians, colonial officials, rulers and bureaucrats of princely states, and anticolonial nationalists continually redefined the concept of sovereignty. Assertions of sovereignty enabled these players to rely on the vocabulary of international law to resolve questions of legal status, the extent of rights, and the proper exercise of powers, and to construct a political order that was in line with their interests and aspirations. By invoking the vernacular of sovereignty in contrasting ways to support their differing visions of world order, these actors also attempted to reconfigure the boundaries among the spheres of the national, the imperial, and the international. Exploring the disputes and debates over the princely states is, therefore, key to understanding the history of sovereignty, the construction of the modern Indian nation-state, and the scope and stakes of international law itself.

    Abstract: Biodiversity is in accelerated decline and urgent action is needed. In 2020, the Strategic Plan for Biodiversity ended, and none of its Aichi Targets were met. Despite the legally disappointing situation on a global level, the role of national courts in adjudicating climate change litigation is showing potential for effective mitigation and adaptation, and judges have become key actors in linking internationally agreed goals with tangible national commitments to mitigate climate change. Can this pursuit of globally agreed goals at a local level be transposed and lead a similar trend for biodiversity governance? This edited collection gives readers an overview of the shape and reach of biodiversity litigation, drawing on specific case studies from countries such as Brazil, China, India and Canada. It considers two questions: Firstly, what is the influence of international biodiversity law on biodiversity litigation? Secondly, what are the trends of biodiversity litigation? Leading experts discuss these questions from the perspective of developing, developed and mega bio-diverse countries, promoting the concept of biodiversity litigation as a common notion of environmental law, and arguing for more creative legal thinking when dealing with and analysing biodiversity-related disputes.

    Abstract: Violence is part and parcel of human history and of human nature. It is one of our most distinctive traits, the one thing that all cultures and societies, across time, share in common. It has defined not only the ways in which individuals relate to each other, but also how collective entities and states have interacted with each other over the millennia. All societies are violent and all individuals have the capacity for violence. However, not all societies and not all individuals are equally violent, and nor does violence exist with the same intensity across cultures. This Very Short Introduction examines the more visible, physical acts of violence - interpersonal, gendered, collective, religious, sexual, criminal, and political - in the modern world. It explores how violence in the pre-modern world was different from the modern world, and what is significant about those differences. It also discusses what violence is by examining understandings of the ideas, values, and cultural practices embedded in an act of violence, and considering acts of violence as the outcome of a process dependent on the cultural context in which they take place. Along the way Dwyer considers some core questions, asking whether violence is always 'bad', and if there are any limits to human violence? Why is it that what was once considered acceptable - wife beating, duelling, slavery - at some point becomes unacceptable in some societies and cultures, and yet continues in others? And finally, are we becoming more or less violent?

    Abstract: The realm of higher education, much like everything else in a global and mobile world, has rapidly altered in the last few decades. More and more universities and seats of higher education are using strategies towards 'internationalization'; by increasing heterogeneity in rank, student composition, resource endowments, faculty profiles, and their social spaces. The essays in this volume take a critical look at universities across South Asia, more specifically, at the dynamics of student mobility and mobilizations existing in such localized social spaces, and compares these with their counterparts in universities across the world. While elite universities in South Asia, as elsewhere, have been caught in a stiff international competition and are aspiring for the highest ranks, students from the most excluded communities and remote parts of the country seek entry to badly endowed universities, facing obstacles during their courses, and upon seeking entry into employment. The volume evaluates such universities as spaces for mobility opportunity and mobilizations in a globally networked world. It combines local and international perspectives with thorough observations of the dynamics in localized university spaces while embedding them in transnational processes.
    Abstract: Edited by Andrea Kolbel, Research Fellow, Institute for Innovation and Technology (iit), Berlin, Germany, Joanna Pfaff-Czarnecka, Full Professor, Bielefeld University, and Susan Thieme, Professor, Critical Sustainability Studies, University of Bern. Andrea Kölbel, DPhil (Oxon.), is a social and economic scientist with a specific interest in the changing nature of higher education, spatial (im)mobilities, social theory, and participative research methods. She holds a doctorate in human geography from the University of Oxford and an MBA from the Central European University in Budapest. With her research into young people's lives and social inequalities, she builds upon her professional experiences in the planning, implementation, and evaluation of education programmes on behalf of universities, ministries of education and research, and the UN Refugee Agency in countries in Asia, Africa, Europe, and the Middle East. Susan Thieme is Professor of Geography and Critical Sustainability Studies at the University of Bern, Switzerland. She holds a PhD and Habilitation (professorial thesis) from the University of Zurich and studied at the University of Potsdam, Germany, and Plymouth, UK. She was Visiting Fellow at the University of Sussex, UK, Institute of Social Studies, Netherlands, and the American University of Central Asia, Kyrgyzstan. Her research interests are transformation and sustainability, (im)mobilities, and in/justices in the context of education and work. Joanna Pfaff-Czarnecka is professor of social anthropology at the Faculty of Sociology, Bielefeld University, Germany. Until July 2019, she was Senate member of the German Research Foundation, Dean of her Faculty and Co-Director of the Centre of Interdisciplinary Research, ZIF. Her research focuses currently on knowledge production and circulation, on belonging as well as on the social life of universities (especially the nexus of inequality and heterogeneity). She studied at the University of Zurich where she worked for many years as academic collaborator. She then shifted to the Centre for Development Studies at the University of Bonn where she acted as Senior Research Fellow, as Deputy Director, and as Acting Director.

    Abstract: Culture from the Slums explores the history of punk rock in East and West Germany during the 1970s and 1980s. These decades witnessed an explosion of alternative culture across divided Germany, and punk was a critical constituent of this movement. For young Germans at the time, punk appealed to those gravitating towards cultural experimentation rooted in notions of authenticity-endeavors considered to be more 'real' and 'genuine.' Adopting musical subculture from abroad and rearticulating the genre locally, punk gave individuals uncomfortable with their societies the opportunity to create alternative worlds. Examining how youths mobilized music to build alternative communities and identities during the Cold War, Culture from the Slums details how punk became the site of historical change during this era: in the West, concerning national identity, commercialism, and politicization; while in the East, over repression, resistance, and collaboration. But on either side of the Iron Curtain, punks' struggles for individuality and independence forced their societies to come to terms with their political, social, and aesthetic challenges, confrontations which pluralized both states, a surprising similarity connecting democratic, capitalist West Germany with socialist, authoritarian East Germany. In this manner, Culture from the Slums suggests that the ideas, practices, and communities which youths called into being transformed both German societies along more diverse and ultimately democratic lines. Using a wealth of previously untapped archival documentation, this study reorients German and European history during this period by integrating alternative culture and music subculture into broader narratives of postwar inquiry and explains how punk rock shaped divided Germany in the 1970s and 1980s.
