    Abstract: "By the start of the nineteenth century, the impact of the geological sciences and advancements in the field had radically expanded people's perception of the Earth's age. In How the Earth Feels, Dana Luciano maps the emergence of a "geological fantasy," in which increased knowledge of planetary life was used to racialize Native peoples as fossils and curiosities. Further, the geological fantasy served to cement the notion that the Earth had been preparing for the presence of humans, and that humans were in fact the ultimate expression of the Earth's teleological development in a both scientific and spiritual sense. Counterposing a range of texts-from early European and US geological texts to Indigenous accounts of earthquakes to African American men's anti-slavery writing featuring geological tropes-Luciano reveals the workings of the geological fantasy as it operated across the racial and biopolitical discourses of the nineteenth-century United States. Luciano offers a rich and historically nuanced account of how imagined relations with the non-human world have long served as a means of avoiding engagement with the dynamics of racial and colonial power"

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

The Invention of the English Landscape examines these journeys and investigations to explore how the natural and historic English landscape was reconfigured to become a widely enjoyed cultural and leisure resource.Peter Borsay considers the manifold forces behind this transformation, such as the rise of consumer culture, the media, industrial and transport revolutions, the Enlightenment, Romanticism, and the Gothic revival. In doing so, he reveals the development of a powerful bond between landscape and natural identity, against the backdrop of social and political change from the early modern period to the start of the Second World War. Borsay s interdisciplinary approach demonstrates how human understandings of the natural world shaped the geography of England, and uncovers a wealth of valuable material, from novels and poems to paintings, that expose historical understandings of the landscape.     Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

    Abstract: Dieses Lehrbuch stellt zunächst eine Reihe von klassischen philosophischen Ansätzen vor, um zu zeigen, dass sie als Grundlage für die Menschenrechte ungeeignet sind. Nur das Konzept der Menschenwürde - basierend auf der kantischen Unterscheidung von Preis und Würde – ist als Grundlage geeignet. Dies wiederum ermöglicht es, (1) die Menschenrechte sinnvoll zu interpretieren, (2) zwischen echten und unechten moralischen Menschenrechten zu unterscheiden, (3) den Schutzumfang vieler kodifizierter Menschenrechte nach den Kriterien „Kern“ und „Hof“ zu differenzieren und bietet (4) einen Ausgangspunkt für die „Entdeckung“ neuer, ungeschriebener Menschenrechte. Diese philosophische Grundlage ermöglicht eine grundlegende Neubewertung der Rechtsprechung zu den Menschenrechten, die es letztlich ermöglichen wird, sie im Hinblick auf Rechtssicherheit, Klarheit und Schlüssigkeit zu verbessern. Das Lehrbuch richtet sich in erster Linie an fortgeschrittene Studierende der Rechtswissenschaft, die an einem tieferen Verständnis der Menschenrechte interessiert sind.     Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Genocide addresses these tensions and tests the limits of the concept in cases ranging from the role of sexual violence during the Holocaust and state-induced mass starvation in Kazakh and Ukrainian history to what the Armenian, Rwandan, and Burundi experiences reveal about the uses and pitfalls of reading history and conducting politics through the lens of genocide.     Abstract: Der Konferenzband diskutiert aus interdisziplinären Perspektiven das Kopftuch im Kontext von Verbotsdebatten im deutschsprachigen Raum und möglichen Konsequenzen für das gesellschaftliche Miteinander.     Abstract: "Uncovering the role of literature, late imperialism, and the rise of new models of internationalism as integral to the invention of Global English, this book focuses on three key figures from the "Vocabulary Control Movement" - C.K. Ogden, Harold Palmer, and Michael West - who competed for market share for their respective language teaching systems - Basic English, the Palmer Method, and the New Method - through battles over word lists and teaching methods in the 1920s and 30s. Drawing on archives from the Carnegie Corporation and considering language teaching in eight global sites, this book analyzes how a series of conferences in New York and London resolved their conflicts and produced a consolidated, international standard form of English. As a postcolonial approach to the development of the field of English Language Teaching, it reveals how these language debates were proxy battles over an idealized global subject: an urban, secular, consumer moving seamlessly between the tribal and global, speaking both mother tongues and an international lingua franca, Global English. Featuring analysis of the primary texts of each of the three key figures in this book as well as close readings of their readers, which featured adaptations of well-known literary texts from writers like Poe, Dickens, Wordsworth, Milton and Wells, it recovers a neglected history of English as it was redefined as an international language through anti-colonial resistance in the peripheries and transatlantic power struggles in the metropole during the interwar period."--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "Cool Britannia and Multi-Ethnic Britain: Uncorking the Champagne Supernova attempts to move away from the melancholia of Cool Britannia and the discourse which often encases the period by repositioning this phenomena through an ethnic minority perspective. In March 1997 the front page of the magazine Vanity Fair announced 'London Swings! Again!' This headline was a direct reference to the swinging London of the 1960s. The English capital which became the era-defining epicentre of the world for its burgeoning rock and pop music scene, with its daring new youth culture, and the boutique fashion houses of Carnaby Street captured most indelibly by the Mods, Rockers and psychedelic hippies of the time. In the 1990's this renewed interest in the swinging 60's seemed to reinvigorate popular culture after a global period in the 1980's which would see the collapse of traditional communism and the ending of Cold War, while ushering in the beginnings of a new technological age spread-headed by Apple, Mircosoft and IBM. The dawn of the 1990's meant that Peace and Love would once reign supreme again; with Britannia being at the forefront of 'cool' again. Godfathers of the Mancunian Rock scene, New Order would declare 'Love had the world in motion' and for a fleeting period, Britain was about to encounter its second coming as the cultural epicentre of the world. While history proffers a period of utopia, inclusion and cultural integration, the narrative considerably alters when exploring this euphoric period through a discriminatory and racialized lens. This book repositions the ethnic minority lived experience during the 1990's from the societal and political margins to the centre. The lexicon explored attempts to provide an altogether different discourse that allows us to reflect on seminal and racially discriminatory episodes during the 1990's that subsequently illuminated

    Abstract: "In PHOTOGRAPHIC RETURNS Shawn Smith sets out to examine works of contemporary art, only to find that many of the works refer back to the past, to photography's many intersections with the history of racial justice in the U.S. Smith focuses on flashpoints in that history -- spanning from the abolitionist movement, to the Civil War, lynching, and mass incarceration-- to mark the roles that photography has played in documenting the exigencies of Black life, and as a tool for resisting those racial regimes. For each of these moments, Smith shows how contemporary photographers utilize their medium as a way to recall, revise, or amplify the relationship between racial politics in the past and in the present. She argues that the tendency of African-American photographers and other artists to return to the archive of early photography does not simply point to the usefulness of early photography as document of the past, but to the recursive nature of photography itself. This study expands our theories of photography and memory by arguing that the recursive temporality of photography is central to its role in recording and remembering history. It also asserts that photography is an invaluable tool for critical practice of racial justice"--

    Abstract: "Most Americans would agree that devoted wives and mothers make families strong and that strong families are the bedrock of society. Yet, throughout this nation's history, black women have managed to become model mothers and wives, but their doing so has not kept them from being mistaken for "welfare queens" and "baby mamas," the stereotypes that most consistently shape U.S. public policy. In this book, Koritha Mitchell shows the evolving connections between black women's homemaking and citizenship from domesticities of the slave cabin and to Michelle Obama in the White House. Drawing on canonical texts by and about African American women, Mitchell begins by connecting the roles of black women as rape survivor, race mother, single lady, matriarch, the strong black woman, and the evolving black women to the various roles that the site of the home served in the eras of post-emancipation, the New Negro, Civil Rights, post-civil rights, and the "post-racial." By looking at key protagonists in literary texts by authors like Frances Harper, Zora Neale Hurston, Lorraine Hansberry, Octavia Butler, and Alice Walker, Mitchell exposes us to the palpable tension that emerges when African Americans, especially women, continue to invest in traditional domesticity even while seeing the signs that it will not yield for them the respectability and safety it should--black women might become decent housekeepers, but never homemakers. All in all, the confluence of these domestic locations and scripts shows that at every juncture, the home was a site where African American women and families negotiated and reasserted their citizenship in a society and culture that consistently and persistently continues to marginalize and assert violence against African Americans, regardless of how they met standards of respectability and citizenry."

    Abstract: In Photographic Returns Shawn Michelle Smith traces how historical moments of racial crisis come to be known photographically and how the past continues to inhabit, punctuate, and transform the present through the photographic medium in contemporary art. Smith engages photographs by Rashid Johnson, Sally Mann, Deborah Luster, Lorna Simpson, Jason Lazarus, Carrie Mae Weems, Taryn Simon, and Dawoud Bey, among others. Each of these artists turns to the past—whether by using nineteenth-century techniques to produce images or by re-creating iconic historic photographs—as a way to use history to negotiate the present and to call attention to the unfinished political project of racial justice in the United States. By interrogating their use of photography to recall, revise, and amplify the relationship between racial politics of the past and present, Smith locates a temporal recursivity that is intrinsic to photography, in which images return to haunt the viewer and prompt reflection on the present and an imagination of a more just future.

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law.     Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.
