    Abstract: Die Zuordnung zu einem Geschlecht hat für die individuelle Identität eines Menschen herausragende Bedeutung. Gleichzeitig wird diese Frage von den Rechtsordnungen der Europäischen Union nach wie vor sehr unterschiedlich beantwortet. Während immer mehr Staaten dazu übergehen, einer Person eine selbstbestimmte Entscheidung über ihr rechtliches Geschlecht zu ermöglichen, stellen zahlreiche Staaten weiterhin hohe Anforderungen an dessen Änderung. Angesichts der Diversität nationaler Regelungen untersucht Alix Schulz, wie das rechtliche Geschlecht eines Menschen in grenzüberschreitenden Sachverhalten bestimmt wird und welche grund- und menschenrechtlichen Vorgaben hierbei zu beachten sind

    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: In Social Movements: A Theoretical Approach, Dieter Rucht offers a theoretically and historically informed approach to social movements as a phenomenon of modern societies. He links the analysis of social movements to general theories of society and processes of social change, and combines three basic perspectives: interactionist, constructivist, and process-oriented (ICP-approach). Drawing mainly on ideas from Jürgen Habermas, Pierre Bourdieu, and Anthony Giddens, Rucht recommends several revisions and highlights the important role of the public sphere as the central stage for social movements. He argues that it is a realm in its own right and the major domain in which social movements make themselves seen and heard, garner support, and possibly succeed in changing basic societal structures. This comprehensive treatise analyzes the external and internal activities of social movements, the role of different kinds of opportunities and restrictions, collective identities and framing, organizing, networking, and strategizing. It lucidly examines the complexity of social movements that have a status as both actors and systems, and whose logic cannot be reduced to either strategic or communicative action.

    Abstract: "Feminist AI: Critical Perspectives on Data, Algorithms and Intelligent Machines is the first volume to bring together leading feminist thinkers from across the disciplines to explore the impact of artificial intelligence (AI) and related data-driven technologies on human society. Recent years have seen both an explosion in AI systems and a corresponding rise in important critical analyses of these technologies. Central to these analyses has been feminist scholarship, which calls upon the AI sector to be accountable for designing and deploying AI in ways that further, rather than undermine, the pursuit of social justice. Feminist AI showcases the vital contributions of feminist scholarship to thinking about AI, data, and intelligent machines as well as laying the groundwork for future feminist scholarship on AI.     Abstract: Towards a Vigilant Society sheds light on the emergence of a new society of vigilance, in particular the actions of anti-migrant groups around Dover and Calais. Based on field research on both sides of the channel, it studies the dynamics of these groups – midway between a social movement and vigilantism – at these two key points in the international migration route between the European Union and the United Kingdom. In recent years, a series of anti-migrant groups have been mobilising on both sides of the Channel to counter migrations. Their actions range from demonstrations, to violence against migrants. And by staging their actions on social media, which is an extraordinary sounding board, these groups can build an online community and a mass audience, influencing public opinion and even the migration policies of states.

Ryan Lee Cartwright contends that, during the last hundred years, rural American gossip about queer and peculiar white neighbors crystallized into a national optic of white social degeneracy. Cartwright points to a tension between the idyll (rooted in the national myth of the Jeffersonian yeoman farmer and his idealized family) and the anti-idyll (the aberrant sexuality, gender transgression, and anomalous bodies and minds that are associated with rural white populations).

    Abstract: Alongside the importance of 'chosen families' in the queer community, Rin Reczek and Emma Bosley-Smith found that very few LGBTQ people choose to become estranged from their parents, even if those parents refuse to support their gender identity, sexuality, or both. Drawing on interviews with over 75 LGBTQ people and their parents, Reczek and Bosley-Smith explore the powerful ties that bind families together, for better or worse. They show us why many feel obliged to maintain even troubled - and sometimes outright toxic-relationships with their parents. They argue that this relationship persists because what we think of as the 'natural' and inevitable connection between parents and adult children is actually created and sustained by the sociocultural power of compulsory kinship.

    Abstract: Frankfurt School Critical Theory describes itself as an unmasking critique of power. However, it has surprisingly little to say about major structural oppressions, including gender. A distinctive feature of critique is that, in diagnosing what is wrong with the world, it ought to be guided by the experiences of oppressed groups. Yet, in practice, it tends to pay little heed to these experiences. 'The Gender of Critical Theory' shows how these oversights and tensions stem from the preoccupation with normative foundations that has dominated Frankfurt School theory since Habermas and has given rise to a mode of paradigm-led inquiry that undermines an effective critique of oppression.

In this book, Louise Marie Roth explores the process of giving birth, and the ways in which medicine and law interact to shape maternity care. Focusing on the United States, Roth explores how the law creates an environment where medical providers, malpractice attorneys, and others limit women's rights and choices during birth. She shows how a fear of liability risk often drives the decision-making process of medical providers, who prioritise hospital efficiency over patient safety, to the detriment of mothers themselves.
