Abstract: 1 introduction: legislating for the digital reality: a moving target -- 2. Welcoming digital innovation: why america seems to get it right -- 3. The mechanics of flexibility -- 4 Jewels in the sand: supporting creativity in a mass networked environment -- 5 EU (non) remedies to inflexible copyright: contracts as a policy tool -- 6 Courts of law v. Choke points for technological innovation -- 7 Conclusions.
Abstract: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. How can the population’s creative potential best be fostered? What do software innovations have in common with the evolution of living organisms? What are the vulnerabilities of distributed creativity? Answers are sought in the processes that came into being during the early years of the digital revolution and were then forced to take a back seat as control of the means of production was increasingly placed in the hands of tech companies. The findings and insights presented here are highly relevant for today’s digital policymaking. Market concentration processes in innovation haven’t ceased; they are ongoing. And in an age where data-driven services are creating and reinforcing global oligopolies, the question posed by the U.S. Supreme Court in Google v. Oracle is now more relevant than ever: who should hold the keys to digital innovation?

Abstract: "Defence procurement has bedeviled governments in Canada, and indeed around the world, for decades. Jeffrey Collins provides an important contribution to finding a better way forward. A must-read for current and aspiring leaders." - Michael Wernick, Clerk of the Privy Council (2016-2019), Jarislowsky Chair in Public Sector Management, University of Ottawa and author of Governing Canada. "If everyone in the business reads this book, Canada saves billions buying kit and it's instantly the most valuable book ever published." - Dr. Ian Brodie, Professor of Political Science, University of Calgary, Chief of Staff to Prime Minister Stephen Harper (2006-2008) and author of At the Centre of Government. "This well-research and authoritative book takes a commonly misunderstood and often maligned process, sheds light on its many challenges, and offers some potentially pragmatic solutions. It is a “should read” for anyone interested in this important topic; and, a “must read” for government officials, elected representatives and media pundits alike.” - Mark Norman, Vice-Admiral, Royal Canadian Navy (Ret’d) This book challenges the perceived underlying causes and culprits of the ongoing challenges in Canadian defence procurement, arguing that although headlines often put the blame on the political leadership, the defence procurement bureaucracy, ongoing pressures in the defence industry and continuous demands placed on Canada though its alliances also carry a large part of the responsibility. Focusing on four main case studies: the Fixed Wing Search and Rescue Plane, the Joint Support Ships, the Medium Support Vehicle System and the Halifax Class Modernization, the author offers a comparative analysis of how these ongoing procurement efforts were dealt with by different administrations, from Jean Chrétien and Paul Martin to Stephen Harper. Jeffrey F. Collins is Adjunct Professor at the University of Prince Edward Island.

Abstract: Can informal actors such as NGOs mediate peace agreements? If so, how does it work and what are the consequences for international peace mediation? This book tackles these questions and more through looking at the role of nongovernmental (NGO) mediators in promoting “inclusive peace” to negotiating parties in Myanmar’s Nationwide Ceasefire Agreement (NCA) negotiations from 2011-2015. The author argues that NGO mediators, traditionally seen as part of civil society or as weak mediators with little power or leverage, have become established mediation actors alongside more formal actors and are redefining the mediation field through norm promotion. However, even if NGO mediators can promote norms, the book questions whether they should promote norms in the first place, as the NCA process shows how the promotion of inclusivity contributed to a more exclusive outcome of years of peace negotiations in Myanmar. The outcome of the NCA process presents a critical and cautionary tale of promoting a presumed universal norm into a given locale and expecting a certain outcome without understanding how an external norm interacts with existing normative frameworks. Abstract: Why are we willing to believe that technology can bring about war… but not peace? PeaceTech: Digital Transformation to End War is the world's first book dealing with the use of technological innovation to support peace and transition processes. Through an interwoven narrative of personal stories that capture the complexity of real-time peace negotiation, Bell maps the fast-paced developments of PeaceTech, and the ethical and practical challenges involved. Bell locates PeaceTech within the wider digital revolution that is also transforming the conduct of war. She lays bare the ‘double disruption’ of peace processes, through digital transformation, and through changing conflict patterns that make processes more difficult to mount. Against this backdrop – can digital peacebuilding be a force for good? Or do the risks outweigh the benefits? PeaceTech provides a 12-Step Manifesto laying out the types of practice and commitment needed for successful use of digital tools to support peace processes. This open access book will be invaluable primer for business tech entrepreneurs, peacebuilders, the tech community, and students of international relations, informatics, comparative politics, ethics and law; and indeed for those simply curious about peace process innovation in the contemporary world. Christine Bell is Professor of Constitutional Law. Assistant Principal (Global Justice), and Executive Director of the Peace and Conflict Resolution Evidence Platform (PeaceRep), based at the School of Law, at the University of Edinburgh. A long-time expert and practitioner in the field of peace processes and constitution-making, she manages digital and PeaceTech innovation.

Abstract: This book provides new and established researchers with innovative methodologies and research strategies to explore European security integration from a different perspective, challenging traditional theoretical interpretations. It takes a step back from well-established theoretical approaches to the European Union’s (EU) Common Foreign and Security Policy (CFSP) and Common Security and Defence Policy (CSDP) to ask more fundamental questions about the core assumptions underpinning research on European security integration. It supports methodological innovations with an analysis of the most significant empirical problems of European security governance, including the war in Ukraine or the role of Russia in European security. In the last chapter, the author offers ideas for new pedagogical approaches to teaching European Studies. Kamil Zwolski is Associate Professor in International Politics at the University of Southampton, UK, and Jean Monnet Chair of European Security Governance. His research interests include the theory and practice of European security and its governance, Europe-Russia relations and the role of the EU/NATO in European security. His previous book, European Security in Integration Theory (2018), examines federalism and functionalism – two fundamentals, yet largely forgotten, theories of international integration, in the context of the war in Ukraine and contemporary European security order.

Abstract: This book embarks on a comprehensive exploration of the jurisdiction of the International Criminal Court (ICC) and elucidates the three foundational aspects of its jurisdiction as laid out in the Rome Statute: the preconditions for exercising jurisdiction (Article 12 ICCRSt), its substantive competence regarding core crimes (Articles 5-8bis ICCRSt), and the principle of complementarity (Article 17§1(a) ICCRSt). This principle, crucial to understanding the ICC’s ‘ultimate jurisdiction’, is invoked only when a State Party demonstrates an inability or unwillingness to genuinely undertake investigation or prosecution. The book further probes the ‘negative preconditions’ of the Court’s jurisdiction, in particular, immunities (Article 27 ICCRSt) and exceptions through Security Council referrals (Articles 13(b) and 15 ICCRSt). Intended for students, scholars, and practitioners alike, this second edition offers invaluable insights into the ICC’s jurisdiction, making a notable contribution to the existing literature. Importantly, it also navigates emerging fields of international criminal law, addressing topical and thought-provoking subjects such as ecocide, cyber warfare, automated lethal weapons, artificial intelligence, and the legal complexities arising from the Russian invasion of Ukraine.

Abstract: “This collection is the kick-start to the kind of important global discussion that is needed.” — Frank J. Porporino, Criminal Justice Consultant; ICPA Group Chair, Research and Development Network “This outstanding collection shines the spotlight on the most overlooked, but surely most important professionals in the ‘correctional’ equation.” —Shadd Maruna, Professor of Criminology; author of Making Good: How Ex-Convicts Reform and Rebuild their Lives This edited collection brings together academics, lawyers, civil servants, and researchers working in the human rights NGO sector, to explore the work and role of prison officers around the world. Each chapter offers a distinctive perspective on the work of prison officers within localised socio-economic and criminal justice contexts, to provide a unique overview and insight into the realities and complexities of the role through accessible scholarly interpretations of their work. The aim of the book is to advance knowledge and understanding of the crucial role that prison officers occupy within carceral systems. The collection has widespread applicability with relevance beyond academia into criminal justice practice and policy internationally. Helen Arnold is Associate Professor in Criminology at the University of East Anglia, UK. Matthew Maycock is Senior Lecturer in Criminology at Monash University, Australia. Rosemary Ricciardelli is Professor and Research Chair in Safety, Security, and Wellness at the Fisheries and Marine Institute at Memorial University of Newfoundland, Canada.

Abstract: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena. The main purpose of this book is to identify and explore possible trajectories for the development of civil and criminal liability; for our understanding of the attribution link to autonomous systems; and, in particular, for the punishment of unlawful conduct in connection with their operation. AI decision-making processes – including judicial sentencing – also warrant close attention in this regard. Since AI is moving faster than the process of regulatory recalibration, this book provides valuable insights on its redesign and on the harmonization, at the European level, of the current regulatory frameworks, in order to keep pace with technological changes. Providing a broader and more comprehensive picture of the legal challenges posed by autonomous systems, this book covers a wide range of topics, including the regulation of autonomous vehicles, data protection and governance, personality rights, intellectual property, corporate governance, and contract conclusion and termination issues arising from automated decisions, blockchain technology and AI applications, particularly in the banking and finance sectors. The authors are legal experts from around the world with extensive academic and/or practical experience in these areas.

Abstract: Digital technologies are playing a growing role in achieving the UN’s Sustainable Development Goals (SDGs). They are both a tool both for achieving developmental outcomes and a driver of change. However, the use of digital technologies also entails certain legal challenges. The purpose of this book is to highlight these challenges and suggest solutions. Written by leading researchers from six countries, who analyse legislative solutions from around the world, it includes chapters on the benefits of asset tokenisation, the role of artificial intelligence in achieving sustainable development, legal issues in the green digital transformation, and human rights in a digital world. Through a mixture of fundamental analysis and real-world examples, readers will learn how emerging digital technologies can help achieve various SDGs and what legal challenges arise from their application. This important resource will be of interest to academics, government and legal officials whose work involves the legal regulation of the introduction and use of new digital technologies, as well as sustainable development challenges. Legal experts engaged in the design of new legal infrastructures during the current phase of digital, climatic and social transformation in private, public and social organizations will also find it useful.

Abstract: This book analyses new forms of human trafficking taking into account the transposition of the Directive 2011/36/UE which sets out minimum standards to be applied throughout the European Union in preventing and combating trafficking in human beings and protecting its victims. Sexual exploitation of trafficked persons is at its highest rate. After COVID-19, new forms of sexual exploitation have been identified, specifically in the Global South. The book analyses new forms of exploitation used by traffickers to coerce victims. Combining the perspectives of academic researchers with those of highly skilled professionals from governmental institutions, this book is a unique contribution, promoting collaboration in preventing and combating human trafficking crime, and in raising awareness of this ongoing problem.

Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .

Abstract: Introduction -- Case Study on MONUSCO, UNOCI and UNAMID -- Potential sources of law for a duty to apprehend core criminals -- Sovereignty-based limitations on extraterritorially apprehending core criminals -- International humanitarian law -- International human rights law -- Concluding remarks.
Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

Abstract: This book presents a fresh approach to cybersecurity issues, seeking not only to analyze the legal landscape of the European Union and its Member States, but to do so in an interdisciplinary manner, involving scholars from diverse backgrounds – ranging from legal experts to ICT and engineering professionals. Cybersecurity requirements must be understood in a broader context, encompassing not just conventional aspects, but also emerging topics. This can only be achieved through an interdisciplinary approach. Indeed, cybersecurity should be consistently considered in relation to cybercrime and/or cyber defense, while examining it through the lens of specific domains that are intertwined with various legal fields. Moreover, it is crucial to uphold ethical standards and safeguard fundamental rights, particularly regarding personal data protection. By adopting this comprehensive perspective, the significance of cybersecurity in the exercise of public authority becomes apparent. It also plays an essential role in upholding the fundamental values of both individual Member States and the EU as a whole, such as the rule of law. Moreover, it fosters trust, transparency, and effectiveness in market relations and public administration interactions. In turn, the book draws on the expertise of its authors to provide insights into ICT components and technologies. Understanding these elements holistically is essential to viewing every "cyber" phenomenon from a legal standpoint. In addition to the holistic and interdisciplinary approach it presents, the book offers a captivating exploration of cybersecurity and an engaging read for anyone interested in the field.

Abstract: This book puts the spotlight on a different and neglected aspect of law drafting and reform: the question of size. Specifically, how does the size of a jurisdiction affect its ability to make and change its laws? Some of the challenges affecting small jurisdictions include: a lack of resources and paucity of policy/drafting capacity; the pressures and pull from sources outside the jurisdiction (e.g. international bodies or NGOs; larger states; treaty commitments); a vulnerability to domestic capture (e.g. criminal elements, big local businesses, strong domestic lobby groups); weak/bad governance (e.g. laws or institutions which themselves do not encourage or promote good governance, reflection and reform); the legacy of colonial legal systems and their interaction with indigenous or customary laws; and struggles to comply with constitutional norms such as accountability and transparency. Despite these difficulties small jurisdictions also have certain advantages when it comes to making and reforming law: they can be flexible and creative; they can legislate very quickly if the political will is there; and there is strong informal/formal accountability in a small jurisdiction. This edited collection explores law reform and law drafting in small jurisdictions through the themes of sovereignty; the impact of colonialism and legal plurality; the challenges of harmonising laws at regional and international levels; and constitutional reform. Of use to researchers and practitioners alike.

Abstract: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

Abstract: The Irish Repertory Theatre: Celebrating Thirty-Five Years Off-Broadway is the first book-length history of the multi-award winning Off-Broadway Irish Repertory Theatre Company, from its beginning in 1988 to its thirty-fifth season in 2023. The book considers how the Irish Rep’s plays and musicals reflect the Irish diaspora, the relationship between Ireland and America, and what it means to be Irish and Irish American, both historically, and in the twenty-first century, including how the Irish Rep is showcasing more diverse voices and experiences, from women, the LGBTQIA+ community, and Irish and Irish American people of color. Abstract: This book demonstrates the relevance of the historical perspective with respect to national and international payment systems. Its analysis of national and international payments develops along a dialectical path that starts with the work of the Classics (thesis), undergoes a radical turn with the advent of the neoclassical school (antithesis), and reaches the modern theory of emissions passing through Keynes’s contribution (synthesis). That the history of economic thought occupies a legitimate place in the field of historical studies is beyond dispute. What may be less well understood is that it can serve purposes beyond those of the academic community of historians. This book critically investigates the contributions of the greatest economists of the past to provide insights into the pathologies of today’s systems of national and international payments and into the reforms that are needed to correct them. It will be relevant to students and researchers interested in economic policy and the history of economic thought. Abstract: This book reconsiders the role of translation and own-language use in the EFL (English as a Foreign Language) classroom. It shows prospective teachers how to use the learners’ own language and translation optimally. The author surveys current research about the EFL classroom and presents both a theoretical framework and a didactic model for using translation and learners’ mother tongues. This is done through an action research project, assessing the proposed didactic model for optimal translation practice in English Language teaching (OTP in ELT) through its integration into teacher education. The book will be of interest to students and researchers in the areas of Translation Studies and Applied Linguistics (particularly EFL, ESL, TEFL and TESOL), as well as educators and designers of pre-service training programmes for language teachers. Abstract: Literary Cultures and Nineteenth-Century Childhoods explores the construction of the child and the development of texts for children in the nineteenth century through the application of fresh theoretical approaches and attention to aspects of literary childhoods that have only recently begun to be illuminated. This scope enables examination of the child in canonical nineteenth-century novels by Charles Dickens, Elizabeth Gaskell, Charlotte Brontë, and Thomas Hardy alongside well-known fiction intended for young readers by George MacDonald, Christabel Coleridge, and Kate Greenaway. The century was also distinctive for the rise of the children’s magazine, and this book broadens the definition of literary cultures to include magazines produced both by, and for, young people. The volume examines how the child and family are conceptualised, how children are positioned as readers in genres including the domestic novel, school story, Robinsonade, and fantasy fiction, how literary childhoods are written and politicised, and how childhood intersects with perceptions of animals and the natural environment. The range of chapters in this collection and the texts they consider demonstrate the variability and fluidity of literary cultures and nineteenth-century childhoods.
