Elle s’appuie sur une analyse comparative de la mise en application des dispositions environnementales dans six pays membres de l’OCDE (États-Unis, Finlande, France, Japon, Pays-Bas et Royaume-Uni), ainsi qu’en Chine et en Russie. L'étude propose aux responsables de l’action publique et aux organismes chargés de la réglementation sur l'environnement et autres parties prenantes une analyse approfondie de la conception, de la gestion et des principaux éléments qui constituent les programmes mis en place par les pouvoirs publics pour veiller au respect de la réglementation. Mettant plus particulièrement l’accent sur la promotion et la surveillance de la conformité aux réglementations et sur les mesures prises en cas de non-respect, elle recense et compare les bonnes pratiques observées dans les pays étudiés, les situe dans le contexte de la culture réglementaire de chaque pays et met en évidence les tendances clés observées à l’échelle internationale.

    Abstract: Damages to economic assets resulting from natural disasters have soared in the past fifteen years, and climate change models forecast intensified exposure to extreme weather in many OECD countries. This OECD review of risk management policies focuses on Japan, because the geography, topography and climate of its national territory subject it to serious natural hazards, especially seismic activity and typhoons. The report looks at Japan’s policies in the areas of monitoring, preparing for and responding to floods and earthquakes, seeking out and identifying good practices and areas where improvements could be made. The case studies consider several issues of particular interest to policy makers, such as how to take climate change into account for long term policy planning related to large scale floods, and Japan’s unique earthquake insurance scheme for damages whose probability and impact are hard to accurately assess.

Yet since the early 1970s, the fragility of Piedmont's production system has slowly became evident. This report reviews how Piedmont’s new regional strategy supports innovation and how its efforts can be improved.

    Abstract: The 2005 Paris Declaration on Aid Effectiveness defines the principles and commitments by which donors and developing countries intend to ensure that aid is as effective as possible in contributing to the Millennium Development Goals and other internationally agreed development objectives. This report is a mid-term review of progress towards these commitments, drawing on the 2008 Paris Declaration Monitoring Survey and the Evaluation Synthesis Report among many other sources. Part I highlights the main actionable lessons and messages emerging from the analysis of progress to date. Part II covers the commitments under the five Partnership Principles related to ownership, alignment, harmonisation, development results and mutual accountability, together with four subjects of critical relevance: sector perspectives, the role of civil society organisations, situations of fragility and conflict, and the changing aid architecture.

    Abstract: Despite progress in recent years, there is growing evidence that OECD countries are not on track to reach some of their key environmental goals. This report examines the strategies and instruments that governments use to ensure compliance with pollution prevention and control regulations, particularly in the industrial sector. It compares the compliance assurance systems of six OECD countries – Finland, France, Japan, the Netherlands, the United Kingdom and the United States – as well as those of China and Russia. The report provides policy makers, environmental regulators, and other stakeholders with a comprehensive analysis of the design, management aspects, and the main elements of government compliance and enforcement programmes. Focusing on compliance promotion, compliance monitoring, and non-compliance response, it identifies and compares good practices, sets them in context of different countries’ regulatory cultures and highlights the key international trends.

    Abstract: The Pan Yellow Sea Region (PYSR) covers the coasts of Northern China (Bohai Rim), western and southern Korea and south-western Japan (Kyushu). It has been one of the fastest growing economic zones in East Asia since China’s opening in the early 1990s, thanks to the region’s extensive manufacturing and transportation networks. Development has been driven by cities such as Dalian, Qingdao and Tianjin in China, Busan and Incheon in Korea, and Fukuoka and Kitakyushu in Japan. However, the PYSR has yet not fully utilised its assets nor reached its potential for growth. Further economic integration has been hindered by excessive competition and inadequate co-operation within the region. The regional transportation system requires structural changes to be integrated, especially in the container transportation market. Deepening the region’s social and cultural network remains a challenge. And environmental concerns are increasingly attracting attention. This report analyses these factors and assesses a wide range of policies to improve the PYSR’s competitiveness and integration. In particular, the report examines the PYSR’s trans-border governance system, which has emerged since the 1990s as a key regional policy agenda. The harmonisation of authorities within the region is a prerequisite to achieving economic success and addressing the PYSR’s diverse challenges. A comparative analysis of trans-border cooperation in OECD countries in Europe and North America is also included in an annex. This report will be of special interest to policy makers, researchers, NGOs and others active in trans-border development or Asian economic development.

    Abstract: Expecting substantial savings and improved public services – a trend further accentuated by the financial and economic crisis beginning in 2008 – OECD countries have invested in the development of e-government services over the past 10-15 years. However, despite the initial exceptional take-up, governments later saw low adoption and low use of e-government services which are still far from satisfactory today. This report gives a broad description of the shift in governments' focus on e-government development – from a government-centric to a user-centric approach. It gives a comprehensive overview of challenges to user take-up of e-government services in OECD countries and of the different types of approaches to improving it. The monitoring and evaluation of user take-up are also discussed, including the existence of formal measurement frameworks. Good practices are presented to illustrate the different concrete approaches used by OECD countries.

    Abstract: This report examines why some policy reforms get implemented and others languish by examining 20 structural reform efforts in 10 OECD countries over the past two decades. The case studies cover a wide variety of reform attempts in three key areas: pensions, labour- and product-market regulation. Key factors in the political, economic and reform-specific arenas are identified as helping or hindering reform, and these findings are cross-checked using a relatively simple set of Spearman rank correlations. The report’s two-pronged analytical approach – quantitative and qualitative – results in unique insights for policy makers designing, adopting and implementing structural policy reforms.

Inaction on key environmental challenges, such as climate change, could lead to severe economic consequences in the future. It is important that the measures governments are taking now to address the economic crisis are designed so that they support – and at least do not compromise – sustainable long-term, environmentally friendly growth in the future. This discussion paper highlights some of the measures governments are already taking to 'green' their approches to economic recovery, and some of the key issues they may wish to further consider going forward regarding the impact of these approaches on the environment.

    Abstract: Why do some regions grow faster than others, and in ways that do not always conform to economic theory? This is a central issue in today’s economic climate, when policy makers are looking for ways to stimulate new and sustainable growth. OECD work suggests that there is no one-size-fits-all answer to regional growth policy. Rather, regions grow in very varied ways and the simple concentration of resources in a place is not sufficient for long-term growth. This report draws on OECD analysis of regional data (including where growth happens, country-by-country), policy reviews and case studies. It argues that it is how investments are made, regional assets used and synergies exploited that can make the difference. Public investment should prioritise longer-term impacts on productivity growth and combine measures in an integrated way. This suggests an important role for regional policies in shaping growth and economic recovery policies, but also challenges policy makers to implement policy reforms.

    Abstract: China has made enormous progress in developing the modern legal and regulatory foundation for the market economy. The private sector is now the main driver of growth, and new laws have gone a long way toward establishing private property rights, competition, and mechanisms for entry and exit comparable to those of many OECD countries. At the same time important challenges remain, including further clarification of the scope of state ownership, reform of relations among central and local governments, firmer establishment of the rule of law, and strengthening of regulatory institutions and processes. This review of China's regulatory system focuses on the overall economic context for regulatory reform, the government’s capacity to manage regulatory reform, competition policy and enforcement, and market openness. The review also examines the regulatory framework in the electricity, water and health care sectors. As for OECD countries, the review follows a multidisciplinary and highly interactive approach. A number of OECD instruments and policies are used in this assessment, although the review also takes into account the specific challenges faced by the Chinese authorities. The review includes a comprehensive set of policy recommendations.

    Abstract: Many countries have recognised that greater use of nuclear power could play a valuable role in reducing carbon dioxide emissions. However, given the high capital cost and complexity of nuclear power plants, financing their construction often remains a challenge. This is especially true where such financing is left to the private sector in the context of competitive electricity markets. This study examines the financial risks involved in investing in a new nuclear power plant, how these can be mitigated, and how projects can be structured so that residual risks are taken by those best able to manage them. Given that expansion of nuclear power programmes will require strong and sustained government support, the study highlights the role of governments in facilitating and encouraging investment in new nuclear generating capacity.

    Abstract: This report covers a broad range of SME taxation issues, including possible effects of taxation on the creation and growth of SMEs, and considerations arising from a relatively high compliance burden. Differing income tax and social security contribution burdens of unincorporated and incorporated SMEs are considered in detail, with analysis of average statutory tax rates carried out to investigate possible tax distortions to business creation and business structure decisions of a single worker/owner of an SME. Various arguments are presented for and against the targeting of tax incentives at SMEs. Country examples of SME tax incentives and compliance cost reduction measures are provided in the report.

    Abstract: Chile has achieved strong economic growth during the last 20 years. Nevertheless, its economy depends on a few resource-based sectors located in a small number of regions. The performance of Chilean regions varies significantly and regional disparities in GDP per capita are very high compared to those in OECD countries. Chilean regions have thus far so not fully utilised their assets and reached their potential for growth. This report recommends moving towards a territorial approach to development in Chile in order to better adapt public management to the different opportunities and needs of the diverse territories of the country. Chilean regions would particularly benefit from context-specific policies to boost productivity, such as those targeting innovation and entrepreneurship, and to improve education and training.

    Abstract: The radical transformation that Spanish rural areas have experienced in the past few decades suggest, as it has occurred in many OECD countries, a new approach to rural policy. Spain has recently undertaken a major reform of its rural policies, including the merger of the Ministry of Agriculture with the Ministry of the Environment and the recently approved Law on Sustainable Development of Rural Areas. This new framework creates a multi-sectoral and place-based “rural policy of state”, making Spain better equipped to address the challenges and opportunities of rural areas. This report – undertaken at the same time as the reforms were being implemented – will interest both policy makers engaged in similar reform processes and others working on issues such the “political economy” of reforms, rural tourism, renewable energies, rural clusters, development of peri-urban areas and public service delivery in remote rural areas.

    Abstract: The Internet has been remarkably successful in developing greater opportunities for communication access - and economic growth and social development - for the first billion users. The majority of the next several billion users will be mainly from developing countries and will connect to the Internet principally via wireless networks. But there are substantial discrepancies in access to ICTs between developed and developing countries and also within countries, depending on factors such as gender, rural coverage, skills and educational levels. This book examines how the market for internet traffic exchange has evolved and explores the coherence of policies pursued by developed and developing countries. It notes the increasing innovation occurring in a number of developing countries with competitive markets and discusses how liberalisation has helped to expand of access networks and make ICT services increasingly affordable and available to the poor. The report also highlights the employment, micro-entrepreneurial and social development opportunities which have emerged as access levels have risen among low-income users. The study notes that gateway service monopolies - still in 70 countries - raise the prices for accessing international capacity and reduce the affordability of Internet access to business and end users.

    Abstract: Car ownership is set to triple by 2050, trucking activity will double and air travel could increase fourfold. This book examines how to enable mobility without accelerating climate change. It finds that if we change the way we travel, adopt technologies to improve vehicle efficiency and shift to low-CO2 fuels, we can move onto a different pathway where transport CO2 emissions by 2050 are far below current levels, at costs that are lower than many assume. The report discusses the prospects for shifting more travel to the most efficient modes and reducing travel growth rates, improving vehicle fuel efficiency by up to 50% using cost-effective, incremental technologies, and moving toward electricity, hydrogen, and advanced biofuels to achieve a more secure and sustainable transport future. If governments implement strong policies to achieve this scenario, transport can play its role and dramatically reduce CO2 emissions by 2050.

    Abstract: Innovation is crucial to long-term economic growth, even more so in the aftermath of the financial and economic crisis. In this volume, the OECD and the World Bank jointly take stock of how globalisation is posing new challenges for innovation and growth in both developed and developing countries, and how countries are coping with them. The authors discuss options for policy initiatives that can foster technological innovation in the pursuit of faster and sustainable growth. The various chapters highlight how the emergence of an integrated global market affects the impact of national innovation policy. What seemed like effective innovation strategies (e.g. policies designed to strengthen the R&D capacity of domestic firms) are no longer sufficient for effective catch-up. The more open and global nature of innovation makes innovation policies more difficult to design and implement at the national scale alone. These challenges are further complicated by new phenomena, such as global value chains and the fragmentation of production, the growing role of global corporations, and the ICT revolution. Where and why a global corporation chooses to anchor its production affects the playing field for OECD and developing economies alike.     Abstract: Lobbying can improve policy making by providing valuable insights and data, but it can also result in unfair advantages for vested interests if the process is opaque and standards are lax. Lobbying is resource intensive. The financial services sector in the United States spent USD 3.4 billion lobbying the federal government between 1998 and 2008, principally promoting the deregulation of the financial sector. Legions of lobbyists provide “guns for hire” worldwide. In 2008, there were over 5 000 registered lobbyists in Canada at the national level, while the European Commission in Brussels had over 2 000 registered as of August 2009. This report reviews the experiences of Australia, Canada, Hungary, Poland, the United Kingdom and the United States with government regulations designed to increase scrutiny for lobbying and lobbyists. Current approaches, models, trends and state-of-the-art solutions are examined to support a deeper understanding of the potential and limitations of existing norms.     Abstract: The movement for greater fiscal transparency has been gaining momentum in recent years. To contribute to these efforts, the International Budget Partnership (IBP) developed the Open Budget Survey in 2006. The 2008 survey finds that the state of budget transparency around the world is deplorable, although a number of countries have improved their performance over the past two years.     Abstract: Tous les pays utilisent des preuves indirectes dans les affaires d'entente. La meilleure pratique consiste à utiliser des preuves indirectes dans une perspective d'ensemble, afin de générer un effet cumulatif, plutôt que sur une base individuelle. Les législations nationales sur la concurrence contiennent des dispositions qui compliquent l'utilisation de preuves indirectes car elles ne donnent pas toutes la même définition de la nature des " accords " soumis à la loi. Il existe deux catégories générales de preuves indirectes : celles fondées sur une communication et celles de nature économique. Des deux, les preuves fondées sur une communication sont considérées comme les plus importantes. Les preuves de nature économique sont presque toujours ambiguës. Elles peuvent corroborer l'existence d'une entente comme celle d'une action indépendante. C'est pourquoi une analyse détaillée est de mise. Le traitement national des ententes, considérées comme un délit pénal ou une infraction administrative, peut influer sur la charge de la preuve qui s'applique à l'affaire, et donc sur l'utilisation des preuves indirectes. Il peut être difficile de convaincre les tribunaux d'accepter des preuves indirectes dans des affaires d'entente, surtout lorsque la responsabilité potentielle liée à la violation de dispositions prohibant les ententes contenues dans la législation sur la concurrence est élevée. Dans les pays dans lesquels l'application de la législation contre les ententes est relativement récente, certaines circonstances peuvent influer sur la confiance accordée aux preuves indirectes.

    Abstract: Cet article porte sur les avantages et les risques que comporte la création, hors du circuit normal des ministères et des départements, « d’agences » publiques régies par des règles spéciales de contrôle central et de fonctionnement interne. Dans les pays de l’OCDE, les économies en transition et le Tiers monde, un engouement pour les agences s’est déclaré pendant les années 80 et 90. Ces « agences » passent parfois pour un phénomène typiquement « anglo-saxon », une mode de la Nouvelle gestion publique illustrée par les Next Steps executive agencies au Royaume-Uni. Or, la plupart des pays de l’OCDE connaissent depuis longtemps plusieurs types d’organisations publiques à côté des ministères et, dans plusieurs d’entre eux, en dehors du Royaume-Uni, les fonctionnaires qui travaillent dans les « administrations centrales » sont minoritaires. Cette diversité de l’organisation ne s’explique-t-elle que par les traditions administratives nationales ou peut-on en tirer des enseignements sur l’adéquation des différentes formes d’organisation aux missions des administrations publiques ? Quels sont les avantages et les risques d’un génie génétique appliqué à l’organisation des administrations publiques ? Les économies en transition et les pays en développement peuvent-ils apprendre de l’expérience des pays de l’OCDE quelque chose d’utile sur les formes d’organisation de leur propre secteur public ?

This assessment is carried out in light of the OECD’s previous recommendations to shift KFTC priorities and resources toward core competition problems related to efficiency goals and away from its historic focus on conglomerate financial structure and governance; the need for further improvements in investigative powers and a clearer rule against hard-core cartels; implementation of recommendations to repeal exemptions for “small” business and exclusions of professional services and co-ordination with sectoral regulators about competition problems; and recent institutional changes to join the KFTC with the system for applying consumer protection law. This report was the basis for a monitoring review in the October 2006 session of the Competition Committee.

    Abstract: Les sanctions infligées aux entreprises sont rarement suffisamment sévères pour avoir un effet dissuasif optimal sur les ententes ; les sanctions contre des personnes physiques peuvent les compléter. On ne dispose pas de données prouvant les effets dissuasifs de sanctions contre des personnes physiques et/ou évaluant si ces sanctions peuvent se justifier. Les pays ont tendance à accepter comme allant de soi que des sanctions individuelles, y compris des peines de prison, peuvent utilement faire partie de l'arsenal visant à faire appliquer la loi efficacement. Si un pays prévoit des sanctions individuelles, on peut argumenter que des peines de prison relativement courtes sont le moyen de dissuasion le plus efficace du point de vue du coût. Il y a cependant également des raisons pour prévoir dans certains pays des peines de prison plus longues: seules les peines plus longues prévues par la loi expriment comme il convient la condamnation des ententes injustifiables par une collectivité. Les sanctions infligées à des individus relèvent les niveaux de dissuasion; elles constituent également une puissante incitation à révéler des informations sur les ententes existantes et à coopérer aux enquêtes. Le droit international ne reconnaît pas le principe de double incrimination qui empêcherait les autorités de différents pays de poursuivre la même personne pour sa participation à la même entente. Néanmoins, lorsque des ententes font l'objet d'instructions dans un contexte multi-juridictionnel, les juridictions peuvent envisager des arrangements de sorte qu'une seule d'entre elles poursuive la personne.

Cette évaluation est menée à la lumière de divers facteurs : les recommandations de l'OCDE demandant à la KFTC de redéfinir ses priorités et de réorienter ses ressources pour cibler les problèmes fondamentaux de concurrence liés à des objectifs d'efficience, alors qu'elle se concentrait traditionnellement sur la structure financière et la gouvernance des conglomérats; la nécessité de renforcer les pouvoirs d'investigation et d'adopter des dispositions plus claires contre les ententes injustifiables; la mise en oeuvre des recommandations visant à supprimer les exemptions qui protègent les petites entreprises de la concurrence et les exclusions des services professionnels, et d'assurer une coordination avec les autorités sectorielles de réglementation sur les problèmes de concurrence ; enfin, les changements institutionnels récents destinés à intégrer la KFTC au système d'application du droit des consommateurs. Le Comité de la concurrence s'est appuyé sur ce rapport pour effectuer un examen de suivi lors de sa réunion d'octobre 2006.

    Abstract: Circumstantial evidence is employed in cartel cases in all countries. The better practice is to use circumstantial evidence holistically, giving it cumulative effect, rather than on an item-by-item basis. Complicating the use of circumstantial evidence are provisions in national competition laws that variously define the nature of agreements that are subject to the law. There are two general types of circumstantial evidence: communication evidence and economic evidence. Of the two, communication evidence is considered to be the more important. Economic evidence is almost always ambiguous. It could be consistent with either agreement or independent action. Therefore it requires careful analysis. National treatment of cartels, such as whether they are prosecuted as crimes or as administrative violations, can affect the burden of proof that applies to the cases, and hence the use of circumstantial evidence. It can be difficult to convince courts to accept circumstantial evidence in cartel cases, especially where the potential liability for having violated the anti-cartel provisions of the competition law is high. There are circumstances in countries that are relatively new to anti-cartel enforcement that could affect the extent to which they rely on circumstantial evidence in their cases.

    Abstract: Corporate sanctions rarely are sufficiently high to be an optimal deterrent against cartels. Sanctions against natural persons can thus complement them. There is no systematic evidence proving the deterrent effects of sanctions on individuals, and/or assessing whether such sanctions can be justified. There is a trend among countries to accept as self-evident that individual sanctions, including imprisonment, can be a useful part of effective anti-cartel enforcement. If a country provides for individual sanctions, a strong argument can be made that relatively short prison sentences are the most cost effective deterrent. However, there are also reasons why countries may provide for longer prison sentences, most importantly that only longer statutory sentences adequately express a society’s condemnation of hard-core cartels. In addition to increasing levels of deterrence, sanctions against individuals can be a powerful incentive for individuals to reveal information about existing cartels and to cooperate in investigations. International law does not recognise the principle of double jeopardy that would prevent authorities in different countries from prosecuting the same person for participation in the same cartel. Nevertheless, where cartels are investigated in a multi-jurisdictional context, jurisdictions may consider arrangements to ensure that only one of them prosecutes an individual.

    Abstract: Mesdames et Messieurs, c’est pour moi un grand plaisir de pouvoir formuler quelques observations liminaires sur cette conférence. La politique budgétaire est un thème récurrent dans ma carrière. En 1975, j’ai commencé celle-ci au ministère des Finances, à la Direction du budget. Plus tard, en qualité de directeur du Centraal Planbureau (CPB, Bureau d’analyse de la politique économique des Pays-Bas), j’ai participé à la préparation d’importantes réformes de notre régime budgétaire. Et aujourd’hui, comme Ministre des Finances, je suis plus que jamais convaincu de l’importance d’une politique budgétaire nationale adaptée. Cela ne tient pas (seulement, devrais-je dire) à ce que j’aime les chiffres, mais aussi à ce que les chiffres ont des conséquences directes et graves pour les conditions de vie des citoyens. Sans politique budgétaire rationnelle, pas de système viable de protection sociale, pas de financement pour une politique adaptée d’éducation et pas d’assise pour une croissance économique durable. Je pense donc que l’effort de réforme et de modernisation de l’appareil budgétaire national est l’une des meilleures orientations que puisse suivre un gouvernement soucieux des impératifs sociaux.

    Abstract: Oil prices have been rising significantly since 2002, reaching a high of USD 145 per barrel in July 2008.1 The huge flows of revenues present an excellent opportunity for large oil exporters, providing access to fresh capital inflows that could be allocated to savings, investment, or external debt cancellation. However, oil price volatility and inefficient management of oil revenues can also generate non-desired effects. Some of the symptoms of the so-called “Dutch disease” include overheating the economy, reducing incentives to improve the tax system, and increasing pressure for exchange rate appreciation or exchange rate volatility.

    Abstract: Over the past decade, Mexico has undergone significant economic and political reform. This period has witnessed important improvements in the health of public finances. The government’s narrow measure of the budget deficit has been below 1% of GDP for the past five years (2003-08). Furthermore, the public sector borrowing requirement – the broader definition of budget deficit1 – has been below 3% of GDP for the same period. Although these improved fiscal balances have been aided by higher revenues as a result of significant increases in oil prices, Mexico’s recent public finances have clearly reflected an era of fiscal responsibility. This improved fiscal situation should place Mexico in a better position to withstand the current global economic crisis.

    Abstract: Mexico, like most OECD countries, is under pressure to enhance the efficiency and effectiveness of public spending. An important step in this process is to obtain objective information on the performance of programmes and agencies. Performance information allows governments to measure progress towards achieving their goals and to know what programmes and policies are working and those that are not. The majority of OECD countries are seeking to improve the development and use of performance information through performance management and budgeting reforms. These reforms aim to shift the emphasis of budgeting and management away from a focus on controlling inputs and following rules and regulations towards a focus on results.

    Abstract: This chapter reviews the role of the Mexican legislature in the budget process. Over the past decade, the Mexican Chamber of Deputies has become a much more active participant in the budget process. This development reflects the changes in the political system and the nature of the legislative-executive relationship. On a number of occasions, the budget process has become the focal point of conflict between the two branches. Recent reforms to the legislative budget process have provided tools to strengthen legislative oversight and have helped to some extent to clarify the respective roles of the legislature and the executive. Combined with a growing cross-party willingness to co-operate on the budget and greater emphasis on fiscal responsibility, the legislative budget process has been greatly improved.
