    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: Spider Web, Labyrinth, Tightrope Walk explores the shifting functions of the network as a metaphor, model, and as an epistemological framework in US American literature and culture from the 19th century until today. The book critically inquires into the literary, cultural, philosophical, and scientific rhetoric, values, and ideological underpinnings that have given rise to the network concept. Literature and culture play a major role in the ways in which networks have been imagined and how they have evolved as conceptual models. This study regards networks as historically emergent and culturally constructed formations closely tied with the development of knowledge technologies in the process of modernization as well as with an increasingly critical awareness of network technologies and infrastructures.     Abstract: "In the antebellum United States, formerly enslaved men and women who told their stories and advocated for abolition helped establish a new genre with widely recognized tropes: the slave narrative. This book investigates how enslaved black Africans conceived of themselves and their stories before the War of American Independence and the genre's development in the nineteenth century. Zachary McLeod Hutchins argues that colonial newspapers were pivotal in shaping popular understandings of both slavery and the black African experience well before the slave narrative's proliferation. Introducing the voices and art of black Africans long excluded from the annals of literary history, Hutchins shows how the earliest life writing by and about enslaved black Africans established them as political agents in an Atlantic world defined by diplomacy, war, and foreign relations. In recovering their stories, Hutchins sheds new light on how black Africans became Black Americans; how the earliest accounts of enslaved life were composed editorially from textual fragments rather than authored by a single hand; and how the public discourse of slavery shifted from the language of just wars and foreign policy to a heritable, race-based system of domestic oppression."--

They sang for justice and fairness, food and shelter, and equality and freedom; they sang to be acknowledged. Sometimes they also sang to oppress. This book uncovers the history of these people and their songs, from the moment Columbus made fateful landfall to the start of the Second World War, when 'protest music' emerged as an identifiable brand.     Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: How the rhetoric of terrorism has been used against high-profile movements to justify the oppression and suppression of Indigenous activists. New Indigenous movements are gaining traction in North America: the Missing and Murdered Women and Idle No More movements in Canada, and the Native Lives Matter and NoDAPL movements in the United States. These do not represent new demands for social justice and treaty rights, which Indigenous groups have sought for centuries. But owing to the extraordinary visibility of contemporary activism, Indigenous people have been newly cast as terrorists—a designation that justifies severe measures of policing, exploitation, and violence. The Red Scare investigates the intersectional scope of these four movements, and the broader context of the treatment of Indigenous social justice movements as threats to neoliberal and imperialist social orders. In The Red Scare, Joanne Barker shows how US and Canadian leaders leverage the fear-driven discourses of terrorism to allow for extreme responses to Indigenous activists, framing them as threats to social stability and national security. The alignment of Indigenous movements now with broader struggles against sexual, police, and environmental violence puts them at the forefront of new intersectional solidarities in prominent ways. The activist-as-terrorist framing is cropping up everywhere, but the historical and political complexities of Indigenous movements and state responses are unique. Indigenous criticisms of state policy, resource extraction and contamination, intense surveillance, and neoliberal values are met with outsized and shocking measures of militarized policing, environmental harm, and sexual violence. The Red Scare provides students and readers with a concise and thorough survey of these movements and their links to broader organizing; the common threads of historical violence against Indigenous people; and the relevant alternatives we can find in Indigenous forms of governance and relationality

    Abstract: A view of transatlantic slavery's afterlife and modern Blackness through the lens of age. Although more than fifty years apart, the murders of Emmett Till and Trayvon Martin share a commonality: Black children are not seen as children. Time and time again, excuses for police brutality and aggression-particularly against Black children- concern the victim "appearing" as a threat. But why and how is the perceived "appearance" of Black persons so completely separated from common perceptions of age and time? Black Age: Oceanic Lifespans and the Time of Black Life posits age, life stages, and lifespans as a central lens through which to view Blackness, particularly with regard to the history of transatlantic slavery. Focusing on Black literary culture of the late twentieth and early twenty-first centuries, Habiba Ibrahim examines how the history of transatlantic slavery and the constitution of modern Blackness has been reimagined through the embodiment of age. She argues that Black age-through nearly four centuries of subjugation- has become contingent, malleable, and suited for the needs of enslavement. As a result, rather than the number of years lived or a developmental life stage, Black age came to signify exchange value, historical under-development, timelessness, and other fantasies borne out of Black exclusion from the human.Ibrahim asks: What constitutes a normative timeline of maturation for Black girls when "all the women"-all the canonically feminized adults-"are white"? How does a "slave" become a "man" when adulthood is foreclosed to Black subjects of any gender? Black Age tracks the struggle between the abuses of Black exclusion from Western humanism and the reclamation of non-normative Black life, arguing that, if some of us are brave, it is because we dare to live lives considered incomprehensible within a schema of "human time.

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse.     Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: Die Autorin analysiert und vergleicht die verfassungsrechtlichen und einfachgesetzlichen materiell-rechtlichen und verfahrensrechtlichen Vorgaben zur Familienzusammenführung in Deutschland und den USA. Ein Schwerpunkt der Untersuchung liegt auf dem Schnittpunkt von Einwanderung und dem Schutz der nationalen Sicherheit. Bei der Ausbalancierung der hier vorzufindenden gegenläufigen Interessen spielen Verfahrensrechte eine erhebliche Rolle. Die Autorin geht daher der Frage nach, ob bzw. welche materiellen und prozessualen Rechte einer einreisewilligen Person in einem Konsulat des Zielstaates auf ausländischem Territorium im Visumverfahren zustehen und welche Rechte der stammberechtigten Person in dem Zielstaat selbst zukommen. Die Beantwortung der Frage wird maßgeblich durch die Einbindung eines Staates in eine internationale bzw. supranationale Rechtsordnung bestimmt, weshalb ein besonderer Fokus auf dem Völkerrecht, dem Unionsrecht und dem europäischen Menschenrechtsregime liegt.

    Abstract: Traces the history of racial caricature and the ways that Black cartoonists have turned this visual grammar on its headRevealing the long aesthetic tradition of African American cartoonists who have made use of racist caricature as a black diasporic art practice, Rebecca Wanzo demonstrates how these artists have resisted histories of visual imperialism and their legacies. Moving beyond binaries of positive and negative representation, many black cartoonists have used caricatures to criticize constructions of ideal citizenship in the United States, as well as the alienation of African Americans from such imaginaries. The Content of Our Caricature urges readers to recognize how the wide circulation of comic and cartoon art contributes to a common language of both national belonging and exclusion in the United States.Historically, white artists have rendered white caricatures as virtuous representations of American identity, while their caricatures of African Americans are excluded from these kinds of idealized discourses. Employing a rich illustration program of color and black-and-white reproductions, Wanzo explores the works of artists such as Sam Milai, Larry Fuller, Richard "Grass" Green, Brumsic Brandon Jr., Jennifer Cruté, Aaron McGruder, Kyle Baker, Ollie Harrington, and George Herriman, all of whom negotiate and navigate this troublesome history of caricature. The Content of Our Caricature arrives at a gateway to understanding how a visual grammar of citizenship, and hence American identity itself, has been constructed

    Abstract: "Across more than two centuries Afro-America has created a huge and dazzling variety of literary self-expression. Designs of Blackness provides less a narrative literary history than, precisely, a series of mappings - each literary-critical and comparative while at the same time offering cul-tural and historical context. This carefully re-edited version of the 1998 publication opens with an estimation of earliest African American voice in the names of Phillis Wheatley and her contemporaries. It then takes up the huge span of autobiography from Frederick Douglass through to Maya Angelou. "Harlem on My Mind," which follows, sets out the liter-ary contours of America's premier black city. Womanism, Alice Walker's presiding term, is given full due in an analysis of fiction from Harriet E. Wilson to Toni Morrison. Richard Wright is approached not as some regu-lation "realist" but as a more inward, at times near-surreal, author. Decadology has its risks but the 1940s has rarely been approached as a unique era of war and peace and especially in African American texts. Beat Generation work usually adheres to Ginsberg and Kerouac, but black Beat writing invites its own chapter in the names of Amiri Baraka, Ted Joans and Bob Kaufman. The 1960s has long become a mythic change-decade, and in few greater respects than as a black theatre both of the stage and politics. In Leon Forrest African America had a figure of the postmodern turn; his work is explored in its own right and for how it takes its place in the context of other reflexive black fiction. "African American Fictions of Passing" unpacks the whole deceptive trope of "race" in writing from Williams Wells Brown through to Charles Johnson. The two newly added chapters pursue African American literary achievement into the Obama-Trump century, fiction from Octavia Butler to Darryl Pinkney, poetry from Rita Dove to Kevin Young"--

    Abstract: The Critical Black Studies Reader is a ground-breaking volume whose aim is to criticalize and reenvision Black Studies through a critical lens. The book not only stretches the boundaries of knowledge and understanding of issues critical to the Black experience, it creates a theoretical grounding that is intersectional in its approach. Our notion of Black Studies is neither singularly grounded in African American Studies nor on traditional notions of the Black experience. Oliver Jedynak untersucht die besonderen Schwierigkeiten bei internen Erhebungen, bei denen die Anforderungen unterschiedlicher Rechtsgebiete zu beachten sind.     Abstract: Das Spannungsverhältnis zwischen Einheit und Vielfalt durchzieht und charakterisiert föderale Systeme. Holger P. Hestermeyer arbeitet dieses anhand des Gegensatzpaares Eigenständigkeit und Homogenität auf. Dabei werden die föderalen Systeme Deutschlands, der USA und der EU verglichen und der Vergleich um den historischen Kontext bereichert. Vier, die Eigenständigkeit der Gliedstaaten betonende Topoi und drei, die Verfassungsräume eines föderalen Systems homogenisierende Mechanismen werden untersucht, Verfassungsrhetorik von Verfassungsrealität getrennt und gezeigt, welches Gleichgewicht zwischen zentripetalen und zentrifugalen Kräften die Systeme gefunden haben. Dabei geht der Verfasser davon aus, dass keine »optimale« Balance zwischen den beiden Polen existiert, sondern vielmehr jede Generation für sich neu entscheiden muss, welches Maß an Homogenität und welches Maß an Eigenständigkeit der Gliedstaaten ihr angemessen erscheint.

Hestermeyer compares the German, US and EU federal systems, including their historical contexts, and reveals the balance that has been struck in each between the two opposing tendencies.

    Abstract: Internetquellen spielen in der Praxis der deutschen Zivilgerichte eine wichtige Rolle. Gleichzeitig sind die Grundlagen und Voraussetzungen ihrer Berücksichtigung weitgehend ungeklärt. Vielfach wird das Rechtsinstitut der Offenkundigkeit gemäß § 291 ZPO herangezogen, um gerichtliche Internetrecherchen zu legitimieren. Dem widerspricht Georg Haas anhand einer umfassenden Auslegung der Vorschrift und zeigt auf, dass die Berücksichtigung von Internetquellen grundsätzlich im Rahmen des Beweisverfahrens zu erfolgen hat. Auf dieser Grundlage kann sich eine Befugnis des Gerichts zu Internetrecherchen insbesondere aus den Regeln über die Beweisaufnahme von Amts wegen ergeben. Diese Befunde werden durch eine rechtsvergleichende Untersuchung des US-amerikanischen Zivilprozessrechts erhärtet. Zudem zeigen die Erkenntnisse aus dem Bereich der Kognitionspsychologie, dass unbeschränkte richterliche (Internet-)Recherchen erhebliche Risiken bergen.     Abstract: Within the history of African American struggle against racist oppression that often verges on dystopia, a hidden tradition has depicted a transfigured world. Daring to speculate on a future beyond white supremacy, black utopian artists and thinkers offer powerful visions of ways of being that are built on radical concepts of justice and freedom. They imagine a new black citizen who would inhabit a world that soars above all existing notions of the possible.In Black Utopia, Alex Zamalin offers a groundbreaking examination of African American visions of social transformation and their counterutopian counterparts. Considering figures associated with racial separatism, postracialism, anticolonialism, Pan-Africanism, and Afrofuturism, he argues that the black utopian tradition continues to challenge American political thought and culture. Black Utopia spans black nationalist visions of an ideal Africa, the fiction of W. E. B. Du Bois, and Sun Ra’s cosmic mythology of alien abduction. Zamalin casts Samuel R. Delany and Octavia E. Butler as political theorists and reflects on the antiutopian challenges of George S. Schuyler and Richard Wright. Their thought proves that utopianism, rather than being politically immature or dangerous, can invigorate political imagination. Both an inspiring intellectual history and a critique of present power relations, this book suggests that, with democracy under siege across the globe, the black utopian tradition may be our best hope for combating injustice

    Abstract: In der europaweit geführten Diskussion über Verfahren des kollektiven Rechtsschutzes rücken anstelle der Sammelklagen zunehmend Instrumente der einvernehmlichen Streitbeilegung in den Mittelpunkt.     Abstract: During the nineteenth century, Americans sought the cultural transformation and the physical displacement of American Indian nations. Native people resisted these efforts. Though this process is often understood as a clash of rival economic systems or racial ideologies, it was also a profound spiritual struggle. The conflict over Indian Country sparked crises for both Natives and Americans. In the end, the experience of intercultural encounter and conflict over land produced religious transformations on both sides. This work focuses on Kiowa Indians during Americans' hundred-year effort to acquire, explore, and seize their homeland between 1803 and 1903.

    Abstract: Updated to include the Black Lives Matter movement, the presidency of Barack Obama, the rise of hate speech on the Internet, and moreSince the publication of the first edition of Critical Race Theory in 2001, the United States has lived through two economic downturns, an outbreak of terrorism, and the onset of an epidemic of hate directed against immigrants, especially undocumented Latinos and Middle Eastern people. On a more hopeful note, the country elected and re-elected its first black president and has witnessed the impressive advance of gay rights. As a field, critical race theory has taken note of all these developments, and this primer does so as well. It not only covers a range of emerging new topics and events, it also addresses the rise of a fierce wave of criticism from right-wing websites, think tanks, and foundations, some of which insist that America is now colorblind and has little use for racial analysis and study. Critical Race Theory is essential for understanding developments in this burgeoning field, which has spread to other disciplines and countries. The new edition also covers the ways in which other societies and disciplines adapt its teachings and, for readers wanting to advance a progressive race agenda, includes new questions for discussion, aimed at outlining practical steps to achieve this objective

    Abstract: American political thought has been shaped by those who fought back against social inequality, economic exclusion, the denial of political representation, and slavery, the country's original sin. Yet too often the voices of African American resistance have been neglected, silenced, or forgotten. In this timely book, Alex Zamalin considers key moments of resistance to demonstrate its current and future necessity, focusing on five activists across two centuries who fought to foreground slavery and racial injustice in American political discourse. Struggle on Their Minds shows how the core values of the American political tradition have been continually challenged—and strengthened—by antiracist resistance, creating a rich legacy of African American political thought that is an invaluable component of contemporary struggles for racial justice.Zamalin looks at the language and concepts put forward by the abolitionists David Walker and Frederick Douglass, the antilynching activist Ida B. Wells, the Black Panther Party organizer Huey Newton, and the prison abolitionist Angela Davis. Each helped revise and transform ideas about power, justice, community, action, and the role of emotion in political action. Their thought encouraged abolitionists to call for the eradication of slavery, black journalists to chastise American institutions for their indifference to lynching, and black radicals to police the police and to condemn racial injustice in the American prison system. Taken together, these movements pushed political theory forward, offering new language and concepts to sustain democracy in tense times. Struggle on Their Minds is a critical text for our contemporary moment, showing how the political thought that comes out of resistance can energize the practice of democratic citizenship and ultimately help address the prevailing problem of racial injustice.

    Abstract: Dieses Buch befasst sich mit dem Konflikt, dem Unternehmen im amerikanischen Zivilprozess ausgesetzt sind, wenn sie während der Discovery dem BDSG unterfallende personenbezogene Daten vorlegen müssen. Die Autorin verdeutlicht, dass sich der seit den 1980er Jahren bestehende transatlantische Justizkonflikt dabei in verstärkter Form zeigt, da nicht nur die unterschiedlichen Vorstellungen Deutschlands und der USA bei der Sachverhaltsaufklärung im Zivilprozess, sondern auch im Datenschutz aufeinandertreffen. Personenbezogene Daten dürfen nur dann in die USA übermittelt werden, wenn die verantwortliche Stelle ausreichende Garantien für das Persönlichkeitsrecht der Betroffenen im Sinne von § 4c Abs. 2 Satz 1 BDSG herstellt. Dies ist lediglich durch die Vereinbarung von Vertragsklauseln zwischen der verantwortlichen Stelle, ihren Anwälten und den Anwälten der Gegenseite möglich.     Abstract: Post-9/11 Representations of Arab Men by Arab American Women Writers: Affirmation and Resistance examines the portrayals of Arab masculinities in novels published after September 11, 2001, by women of Arab descent in the United States. The book provides a historical account of the mainstream representations of Arab masculinities in the United States, using them as a contrast to the realities experienced by Arab men in the American diaspora. Considering the construction of male and female Arab American identities, this book illustrates the role of feminism in Arab American literature written by women and its influence on women’s depictions of Arab men. Through an analysis of representative works by Diana Abu-Jaber, Laila Halaby, and Randa Jarrar, among others, this volume demonstrates how Arab American women’s anti-racist and anti-sexist struggles inform their nuanced portrayals of Arab men. This book will be essential for professors and students of ethnic American literatures in general and Arab American studies in particular, as well as for those interested in women’s studies and masculinity studies
