    Abstract: For a large number of companies from different countries, the authors analyze how company corporate governance practices and country regulatory regimes interact in terms of company valuation. They confirm that corporate governance plays a crucial role in efficient company monitoring and shareholder protection, and consequently positively impacts valuation. They find substitution in valuation impact between corporate governance measures at the company and country level, with a possibility of over-regulation. Corporate governance appears more valuable for companies that rely heavily on external financing, consistent with the hypothesis that the main role of corporate governance is to protect external financiers

    Abstract: While the literature on consumption insurance is growing fast, little research has been conducted on how rural consumption insurance is affected by democracy. In this paper the authors examine how consumption insurance of Chinese rural residents is affected if the local leader is democratically elected. Exploring a unique panel data set of 1,400 households from 1987 to 2002, they find that consumption insurance is more complete when the households are in villages with elected village leaders. Furthermore, democracy improves consumption insurance only for the poor and middle-income farmers, but not for the rich. These findings underline the importance of democratic governance for ensuring better rural consumption insurance and poverty reduction

    Abstract: Autocratic regimes are quite often short-lived kleptocracies formed and maintained through force and used to appropriate wealth from subjects. Some of these autocracies collapse after only a year or two of plundering while others manage to survive for 15 or 20 years. This paper asks why some autocratic regimes survive while others fail. A database of political regimes from 1960 to 2003 is introduced and accompanies the paper in an appendix. A model of political survival suggests that autocrats exchange constraints on their executive power for their continued survival. The relationship between payouts from successful rebellion and ease of rebellion determines how willing kleptocrats are to extend the political franchise and protect their power. Results show that extremely oppressive regimes and great expenditures on security are likely to accompany the most difficult environments for defense of the state. The model is used to identify the costs of pervasive political conflict and to decompose the "civil peace dividend" enjoyed by inclusive democracies that do not suffer from the malady of kleptocratic rule. Finally, the model suggests that slow democratization pushed by the autocratic elites to guarantee their survival, accompanied by stable development, may be the best path toward a democratic future for many fragile states

    Abstract: Several studies of civil war have concluded that economic inequality between individuals does not increase the risk of internal armed conflict. This is perhaps not so surprising. Even though an individual may feel frustrated if he is poor compared with other individuals in society, he will not start a rebellion on his own. Civil wars are organized group conflicts, not a matter of individuals randomly committing violence against each other. Hence, we should not neglect the group aspect of human well-being and conflict. Systematic inequalities that coincide with ethnic, religious, or geographical cleavages in a country are often referred to as horizontal inequalities (or inter-group inequalities). Case studies of particular countries as well as some statistical studies have found that such inequalities between identity groups tend to be associated with a higher risk of internal conflict. But the emergence of violent group mobilization in a country with sharp horizontal inequalities may depend on the characteristics of the political regime. For example, in an autocracy, grievances that stem from group inequalities are likely to be large and frequent, but state repression may prevent them from being openly expressed. This paper investigates the relationship between horizontal inequalities, political environment, and civil war in developing countries. Based on national survey data from 55 countries it calculates welfare inequalities between ethnic, religious, and regional groups for each country using indicators such as household assets and educational levels. All the inequality measures, particularly regional inequality, are positively associated with higher risks of conflict outbreak. And it seems that the conflict potential of regional inequality is stronger for pure democratic and intermediate regimes than for pure autocratic regimes. Institutional arrangements also seem to matter. In fact it seems that the conflict potential of horizontal inequalities increases with more inclusive electoral systems. Finally, the presence of both regional inequalities and political exclusion of minority groups seems to make countries particularly at risk for conflict. The main policy implication of these findings is that the combination of politically and economically inclusive government is required to secure peace in developing countries

    Abstract: This paper reports on the latest update of the Worldwide Governance Indicators (WGI) research project covering 212 countries and territories and measuring six dimensions of governance between 1996 and 2006: voice and accountability, political stability and absence of violence, government effectiveness, regulatory quality, rule of law, and control of corruption. This latest set of aggregate indicators are based on hundreds of specific and disaggregated individual variables measuring various dimensions of governance taken from 33 data sources provided by 30 different organizations. The data reflect the views on governance of public sector, private sector, and nongovernmental organization experts, as well as thousands of citizen and firm survey respondents worldwide. The paper also explicitly reports the margins of error accompanying each country estimate. These reflect the inherent difficulties in measuring governance using any kind of data. It finds that even after taking margins of error into account, the WGI permit meaningful cross-country comparisons, as well as monitoring progress over time. In less than a decade, a substantial number of countries exhibit statistically significant improvements in at least one dimension of governance, while other countries exhibit deterioration in some dimensions. The decade-long aggregate indicators, together with the disaggregated individual indicators, are available in a newly-redesigned website at www.govindicators.org

    Abstract: This paper focuses on an evaluation and benchmarking of the governance of regulatory agencies in the electricity sector in Latin American Countries (LAC). Using a unique database, we develop an index of regulatory governance and rank all the agencies in the LAC countries. The index is an aggregate number of the evaluation of four key governance characteristics: autonomy, transparency, accountability, and regulatory tools, including not only formal aspects of regulation but also indicators related to actual implementation. Based on 18 different indexes, we analyze the positions of agencies with regard to different aspects of their regulatory governance, considering not only performance in each variable but also scores in the different components of each category. This evaluation allows for the identification of particular country shortcomings regarding governance, and indicates needed improvements. Although the region shows an overall good governance design of their regulatory agencies, the implementation of the independent regulator model still faces several challenges. This is particularly evident in political autonomy and in the informal aspects of governance, where the region shows the largest number of countries with the lowest scores. Trinidad and Tobago and Brazil show the best results and Ecuador, Honduras, and Chile the poorest performances. The rest of the countries vary according to the different indexes. We give each governance variable equal weights and positively test the robustness of our approach using Principal Component Analysis

    Abstract: Low and highly volatile growth define Africa's growth experience. But there is no evidence that growth volatility is associated to long term economic performance. This result may be misleading if it suggests that volatility is not important for economic and social progress. In this paper we use a variant of the method developed by Hausmann, Pritchett, and Rodrik (2005) to identify both growth acceleration and deceleration episodes in Africa between 1975 and 2005. The authors find that Africa has had numerous growth acceleration episodes in the last 30 years, but also nearly a comparable number of growth collapses, offsetting most of the benefits of growth. Had Africa avoided its growth collapses, it would have grown 1.7 percent a year instead of 0.7 percent, and its GDP per capita would have been more than 30 percent higher in 2005. The authors also find that growth accelerations and decelerations have an asymmetric impact on human development outcomes. Finally, our results suggest that it is easier to identify the likely institutional and policy origins of growth decelerations than of growth accelerations

    Abstract: Democracies rarely if ever fight one another, but they participate in wars as frequently as autocracies. They tend to win the wars in which they participate. Democracies frequently build large alliances in wartime, but not only with other democracies. From time to time democracies intervene militarily in ongoing conflicts. The democratic peace may contribute to a normative justification for such interventions, for the purpose of promoting democracy and eventually for the promotion of peace. This is reinforced by an emerging norm of humanitarian intervention. Democracies may have a motivation to intervene in non-democracies, even in the absence of ongoing conflict, for the purpose of regime change. The recent Iraq War may be interpreted in this perspective. A strong version of this type of foreign policy may be interpreted as a democratic crusade. The paper examines the normative and theoretical foundations of democratic interventionism. An empirical investigation of interventions in the period 1960-96 indicates that democracies intervene quite frequently, but rarely against other democracies. In the short term, democratic intervention appears to be successfully promoting democratization, but the target states tend to end up among the unstable semi-democracies. The most widely publicized recent interventions are targeted on poor or resource-dependent countries in non-democratic neighborhoods. Previous research has found these characteristics to reduce the prospects for stable democracy. Thus, forced democratization is unpredictable with regard to achieving long-term democracy and potentially harmful with regard to securing peace. But short-term military successes may stimulate more interventions until the negative consequences become more visible

    Abstract: The construction industry accounts for about one-third of gross capital formation. Governments have major roles as clients, regulators, and owners of construction companies. The industry is consistently ranked as one of the most corrupt: large payments to gain or alter contracts and circumvent regulations are common. The impact of corruption goes beyond bribe payments to poor quality construction of infrastructure with low economic returns alongside low funding for maintenance-and this is where the major impact of corruption is felt. Regulation of the sector is necessary, but simplicity, transparency, enforcement, and a focus on the outcomes of poor construction are likely to have a larger impact than voluminous but poorly enforced regulation of the construction process. Where government is the client, attempts to counter corruption need to begin at the level of planning and budgeting. Output-based and community-driven approaches show some promise as tools to reduce corruption. At the same time they will need to be complimented by a range of other interventions including publication of procurement documents, independent and community oversight, physical audit, and public-private anticorruption partnerships

    Abstract: Corporate governance arrangements define the responsibilities, authorities and accountabilities of owners, boards of directors, and executive managers of a company. Good corporate governance is as important for state financial institutions as for private sector companies. Many of the problems that commonly afflict state financial institutions can be associated with, if not attributed directly to, weaknesses in corporate governance. This note draws on guidelines recently published by the OECD and the Basel Committee for Banking Supervision to compile a comprehensive corporate governance evaluation framework relevant to state-owned commercial and development finance institutions. It highlights aspects of this framework that are considered to be of particular importance to state financial institutions by citing innovative practices in a number of countries. Finally, it presents a detailed case study of the governance arrangements in place at the Development Bank of Southern Africa

    Abstract: Governance is central to development outcomes in infrastructure, not least because corruption (a symptom of failed governance) can have significantly negative impact on returns to infrastructure investment. This conclusion holds whether infrastructure is in private or public hands. This paper looks at what has been learned about the role of governance in infrastructure, provides some recent examples of reform efforts and project approaches, and suggests an agenda for greater engagement - primarily at the sector level - to improve governance and reduce the development impact of corruption. The discussion covers market structure, regulation, state-owned enterprise reform, planning and budgeting, and project design

    Abstract: This report is a review of Kazakhstan’s legal and institutional framework for fighting corruption, in accordance with the framework provided by the Anti-Corruption Network for Transition Economies, based at the OECD. The review examines: (1) national anti-corruption policy and institutions currently in place in Kazakhstan; (2) national anti-corruption legislation and preventive measures to ensure integrity of civil service; and (3) effective financial control. The review process is based on the OECD practice of mutual analysis and policy formulation. The main input for the review was the self-assessment report prepared by the government of Kazakhstan. An international group of peers then provided an expert assessment and draft recommendations. Finally, a review meeting (attended by national governments, international organisations, civil and business associations) discussed the report and its expert assessment, and endorsed the recommendations for Kazakhstan. This publication contains all the recommendations, as well as the full text of the self-assessment report provided by the government of Kazakhstan. Thus, it provides an important guide for the country as it develops its anti-corruption actions, and it will serve as a useful reference for other countries reforming their anti-corruption policies, legislation and institutions. While these recommendations are not legally binding, they represent Kazakhstan’s commitment to fighting corruption. Implementation of these recommendations will also help the country meet its legally binding obligations under the United Nation’s Convention on Corruption and the Council of Europe’s Criminal Law Convention on Corruption. The results of this review will also be used to regularly monitor Kazakhstan’s progress in implementing the recommendations.

    Abstract: Madrid has experienced impressive dynamic economic growth in recent years, making the best of the positive business cycle in Spain. The capital region absorbs more than a half of the total FDI in Spain and has extended its economic relations with Latin American countries. Growth has occurred largely in the service sector (financial, banking, business services) as well as in logistics (Madrid Barajas Airport is the largest employer in the region). The large investment in public goods, and particularly in transportation infrastructure and cultural amenities, has contributed to attracting firms and workers, creating a virtuous cycle of accumulated wealth. Unemployment has reached a low level (6.5% in 2006) and the growth rate has surpassed the national average as well as the average for OECD metro-regions. There is, however, a concern with how to sustain this positive economic path in the long run. The main challenges to be addressed include a relatively low productivity level, insufficient specialisation in high-value added manufacturing activities, a low innovation capacity, job-skills mismatches (especially for immigrants), transport congestion and housing rental shortage. Public policy making and the governance framework have evolved to provide the metro-region with many of the institutional resources that are needed to make decisions and effectively implement public policies. However, some adaptations will be necessary to effectively address the forthcoming challenges. The Territorial Review of Madrid is integrated into a series of thematic reviews on metropolitan regions undertaken by the OECD Territorial Development Policy Committee. The overall aim of these case studies is to draw and disseminate horizontal policy recommendations for national governments.

Ohne Gegenmaßnahmen kann eine Kultur der Korruption entstehen und das finanzielle wie auch das politische Wohlergehen eines Staats sabotieren.Der zunehmend komplexe Charakter der Bestechungsstrukturen wirft die Frage auf, wie sich Korruptionshandlungen im öffentlichen Auftragswesen feststellen lassen. Der vorliegende Bericht beschreibt, wie in den verschiedenen Stadien öffentlicher Vergabeverfahren Bestechungshandlungen begangen werden, in welchem Zusammenhang die Bestechung im öffentlichen Auftragswesen zu anderen Straftaten, wie Betrug und Geldwäsche, steht und wie sich derartige Straftaten verhindern und sanktionieren lassen. Es werden zehn Fallbeispiele angeführt.     Abstract: Le Grand-Duché de Luxembourg a engagé avec succès une profonde mutation de son économie en l’espace de quelques décennies, passant d’un tissu productif basé essentiellement sur la sidérurgie à une économie basée sur le secteur financier. Cette reconversion, plaçant le Grand-Duché en tête des pays de l’OCDE pour le revenu par habitant, a fait largement appel à une main-d’œuvre étrangère dans différents secteurs et tout particulièrement celui de la finance. 39,5% des habitants sont étrangers (taux le plus élevé parmi les pays membres) et plus de 130 000 étrangers franchissent quotidiennement la frontière pour travailler au Luxembourg. Ces flux augmentent régulièrement et cela pose de sérieux problèmes en termes d’infrastructures de transport, d’environnement et de logement, d’autant que le prix élevé des terrains, surtout dans la région capitale, induit également un développement du navettage des résidents. Comment mieux maîtriser ces flux pour assurer un développement durable de l’économie? Comment opérer ces mutations stratégiques en coopération avec les pays voisins dans le cadre de la « Grande-Région » en conjuguant l’intérêt national du Grand Duché avec les aspirations des régions voisines de trois autres pays ? Les stratégies ambitieuses mises en place par le Luxembourg, notamment par un développement significatif des transports en commun et de logements neufs, peuvent-elles répondre aux attentes sans un concours plus actif de ses partenaires ? Enfin, la réforme régionale peut-elle, par ses liens directs avec l’aménagement du territoire, contribuer à mieux équilibrer la répartition des activités ? L’Examen territorial du Luxembourg s’inscrit dans le cadre d’un programme plus large d’examens territoriaux nationaux entrepris par le Comité des politiques de développement territorial de l’OCDE.     Abstract: The Baltic Sea Region is rapidly becoming one of the world’s more competitive regions. The region is capitalising on its strengths and making the most of its diversity to stimulate innovation, build a strong pool of skilled labour and foster entrepreneurship. A deep spirit of co-operation and integration has led the Baltic Sea countries to set up ambitious governance frameworks to pursue economic development objectives jointly from Oslo to St. Petersburg. Yet major challenges at the local level lie ahead for the Eastern shores of the Baltic, where economic transition still needs to be accompanied by more innovative strategic planning, new forms of governance and dynamic civic entrepreneurship. Policies will need to be made more adaptable and capacities will need to be strengthened if prosperity and living standards are to increase on the Baltic Rim. Fortunately, the Baltic Sea Region includes some of the world’s most innovative countries. From Denmark to Finland, the Region possesses a breadth of experience in facilitating policy co-ordination, adjusting policy to local conditions and involving business and civil society in shaping policy measures. There is a great deal that other countries can learn from this experience in setting up partnerships, regional strategic frameworks and other forms of governance. The learning process has already started, with the Baltic Rim becoming a unique laboratory for governance. This book analyses the new governance developments in the Baltic States and Northwest Russia and provides suggestions on how to speed up this progress. It is essential reading for all stakeholders in the Baltic Sea Region and for those elsewhere wishing to apply emerging lessons to their region of the world.

    Abstract: The Mexican state of Yucatán, with its strategically important location near the United States, Central America and the Caribbean, is one of the most dynamic regions in the OECD. Yucatán is also a land of contrasts. It is a lagging but growing region, offering a high quality of life and vast natural resources, yet suffering from problems of sustainability. Its tourism attractions are located in rural areas that do not benefit from them. It has both state and Peninsula medical services, but its health services coverage is uneven. Yucatan is a centre for higher education in the Peninsula, yet its graduates do not find jobs. It has a number of marginalised communities in fragmented administrative bodies, and although the Peninsular states share a common cultural heritage and attractiveness, their institutions do not co-operate.Clearly, Yucatán is not taking full advantage of its many resources, and in fact, challenges in the region threaten to undermine local assets. Among these is the need to upgrade activities to higher value-added innovation and design processes, and to foster primary activities to reach international markets. While the state government has proposed programmes to spur formalisation of the informal economy, measures such as better regulation, cutting red tape and providing employment opportunities and access to formal credit could have a greater impact. The lack of a shared, coherent long-term vision is a fundamental challenge to improving regional competitiveness and social cohesion in Yucatán. The OECD’s recommendations can only be part of a larger strategy to develop a collective vision of the state’s future.

    Abstract: Prosecution of corruption is a particularly difficult endeavor and successes in this field still too rare. The detection rate is often low due to the lack of verifiable information that is received from public servants or other citizens. Particular difficulties arise when an investigation involves prominent politicians and wealthy businessmen, or when dealing with international bribery cases that require the assistance from foreign jurisdictions in order to collect evidence. Shortcomings that are at the root of these problems can be found at legislative level; in addition, many law enforcement agencies are technically not apt to deal with complex crimes such as corruption in an appropriate manner. Considering the need for capacity building that countries of the Asian and Pacific region have expressed for capacity building in this reform area of the Action Plan, the ADB/OECD Initiative organized a master training seminar on Effective Prosecution of Corruption. This document assembles the seminar’s background papers and case studies, and the experts’ and participants’ views on the key topics that formed the basis for discussion at the seminar. As such, the publication aims to make the expertise exchanged and acquired during the seminar accessible to a broader public and thus to contribute to the overall aim of combating corruption in the new millennium.

    Abstract: The European Commission requested Sigma to carry out a study on the regulatory management capacities of the ten countries that joined the EU on 1 May 2004 to learn more about their Better Regulation practices, exchange good practices and make suggestions for further improvements. This study was carried out by way of peer reviews taking place between March 2005 and October 2006. The topics examined were notably: the origins of EU Better Regulation policy, regulatory management processes, the tools used in these processes (impact assessment, consultation, simplification, alternatives and accessibility), enactment processes and the enforcement and compliance of laws in the NMS, with reference to intellectual property law and environmental laws. Each peer reviews led to a country report that was sent to the Commission and the Member State in question. Publication of each country report was left to the discretion of the Member State in question. A synthesis was drawn up summarizing all findings and making recommendations addressed to all new Member States in general.

Elle les aide à s’orienter parmi les centaines de séries de données existantes sur les indicateurs de gouvernance, et montre que ces indicateurs sont très souvent mal employés aussi bien dans les comparaisons internationales que pour le suivi des variations de la qualité de la gouvernance dans tel ou tel pays. L’étude explique en outre l’évolution récente de l’offre d’indicateurs de gouvernance et affirme que, même si l’on ne disposera jamais d’un indicateur unique parfait, la mise au point et l’utilisation d’indicateurs de gouvernance plus transparents permettront de mieux répondre aussi bien aux besoins des utilisateurs qu’à ceux des pays en développement eux-mêmes.

    Abstract: This publication is based on a Sigma paper and on reports by EU Member States prepared in 2005 at the request of several new Member States. The original paper and some Member State reports were then used as background documentation for a Sigma workshop for countries in the CARDS region on the role of ministries in policy systems, held in November 2005. This revised version of the paper, prepared after the workshop, includes as an annex a summary of insights from EU Member States as well as comparative information concerning the CARDS region, which was gathered during the workshop on the basis of a questionnaire. This publication presents the steps in the policy process and offers a framework for assessing and developing the role of ministries in the policy process, as well as insights on how the policy process is currently organised in Western Balkan countries. Its contents complement the information provided in a previous Sigma paper, which had emphasised the structure and work of the government secretariat.

    Abstract: This report presents an overview of the policies, legislation and institutions involved in MLA and extradition in corruption cases in the Initiative’s members. The study covers three main areas: the legal basis and preconditions for extradition and MLA; procedures and measures that facilitate international cooperation; and the mechanisms for recovering proceeds of corruption. The report is based primarily on independent research, information that members of the Initiative provided in writing to the Secretariat, and on the findings of the March 2006 technical seminar on Denying Safe Haven to the Corrupt and the Proceeds of Corruption and the November 2006 Steering Group meeting, during which the draft report was discussed and adopted. The final report of the thematic review, which will include both a cross-regional analysis and country-specific reports, is expected to be available by end 2007.

    Abstract: This paper analyses the negotiations which will take place with the six Western Balkan countries (Albania, Bosnia & Herzogovina, Croatia, the former Yugoslav Republic of Macedonia, Montenegro and Serbia) and attempts to identify where the major problems are likely to lie. The experience of the fifth enlargement of the European Union to the 12 countries of Central and Eastern Europe is used extensively in this analysis for two reasons: firstly, because the offer made to these countries is likely to be the starting point for the offer to be made to the countries of the Western Balkans; secondly, because the problems which occurred in the negotiations for the fifth enlargement are likely to be the main areas of negotiation with the six countries.

    Abstract: Public works contracts mean big business. From road-building to high-tech communication infrastructure, public procurement averages 15% of GDP in OECD countries--substantially more in non-OECD economies--and it is a major factor in the world trade of goods and services. Given the growing complexity of bribe schemes in today’s globalised markets, the problem is how to identify corruption in public procurement so governments can work toward effective prevention and apply sanctions if necessary. This report provides insights on all three fronts. Based on contributions from law enforcement and procurement specialists, the report describes how bribery is committed through the various stages of government purchasing; how bribery in public procurement is related to other crimes, such as fraud and money laundering; and how to prevent and sanction such crimes. The typical motivations and conduct of the various actors engaging in corruption are also highlighted, as well as ten case studies.

    Abstract: This report presents detailed results on the quality of regulatory management systems, following the survey conducted in 2005-6. The goal of this report is to compare regulatory quality assurance systems; to measure progress and understand trends over time across countries, and to identify general patterns of regulatory management practice. Following initial discussions over the survey instrument in 2005, they survey was circulated in June 2005 and the results, corresponding to 2005, were then collected with final submissions received in Spring 2006. This paper has been revised following comments received from delegates in the Autumn 2006 and Spring 2007. The current set of results also links to previous regulatory governance indicators collected by the OECD in 1998 and 2000. Some of the early phase issues in terms of checks and a correction of the understanding of the concepts led to a revision of previous 1998 estimates. Therefore, this report is based on the corrected results for 1998 and 2000 received from the countries that had been surveyed then. These results also feed into the OECD Project on “Management in Government” (OECD (2007), “Towards Better Measurement of government”, OECD Working Papers on Public Governance, 2007/2, OECD Publishing. Doi:110.1787/301575636734). This paper restricts itself to a descriptive presentation of the materials collected. Further methodological work will be undertaken as this project evolves to conduct more technical statistical analysis and build aggregated indicators.     Abstract: This review discusses the challenges and opportunities of German rural areas. Significant differences between East and West persist and many of these have clear rural dimensions. Factors such as CAP reforms, ageing of the German population and migration trends will also have important rural implications. Many of these issues involve more than rural policy, but rural policy has a place in resolving all of the key issues. However, for rural policy to be an effective part of the policy process it will have to evolve beyond the existing limits in Germany. This review states that Germany's current approach to rural development and rural policy is mainly sectoral and thus does not fully capture the diversity of rural regions.

    Abstract: The challenges faced by Mexico’s rural areas are significant. Mexico's countryside is home to a large population (more than the overall population of many OECD countries) that is highly dispersed and largely living in poverty. The potential of these areas is however significant, as their vast (and young) human resources, their natural, cultural and physical assets could provide, in a more diversified economy, a greater contribution to national development. This review shows that the challenges and potential of rural areas are spatially differentiated and therefore require a place-based policy approach. The Mexican government has had significant success in framing a multi-sector rural policy. Some of these accomplishments can provide examples of best practice for other OECD countries. The continuity and institutionalization of these advances are a priority. In addition, efforts should be devoted to improving the efficiency and effectiveness of rural development programmes and to guaranteeing coherence with other major sectoral policies. This will contribute to addressing the country's major territorial and individual inequalities and will transform rural regions into sources of national development.

    Abstract: The Competition Committee (WP2 on Competition and Regulation) hold a roundtable discussion in June 2004 on Competition and Regulation in Agriculture: Monopsony Buying and Joint Selling. Monopsonistic purchasing practices and joint price-setting activities in the agro-food sector were examined, with a particular focus on regulation and on the potential improvements that could arise from more pro-competitive regulations. Joint activity by producers can have a number of beneficial effects, such as from promoting a brand or food that would not otherwise be promoted, promoting a style of production (like organic production) or purchasing in large quantity in order to obtain quantity discounts. Harms may arise when the joint activity involves price or qualitysetting and there is little competition from close substitutes. Cartellike activity by producers has often been supported by governments but is unlikely to achieve stated public policy goals because it often leads to higher consumer prices but enhance land values more than farmer income. Potentially monopsonistic purchasing practices in the agricultural sector were also considered. At times, price manipulation by large purchasers may occur. Competition authorities play an important role in assuring that activities of purchasers do not involve market power, particularly when purchases are concentrated in few, large firms and sellers have limited options besides selling into a highly concentrated market. However, to the extent that purchasers wish to contract for very specific forms of production, such as specific varieties of grain, there can be good commercial reasons that a purchaser would wish to focus on a specific forms of production and agriculture products should not be considered different from supplies in other sectors, which are customized for different purchasers.

    Abstract: This article addresses issues relating to the establishment and financial management of extrabudgetary funds (EBFs), a large group of government entities and accounts. The article develops a typology of EBFs and argues that they are frequently created because of budget system failures and political economy factors.     Abstract: A well-functioning public expenditure management system is considered a critical pillar of government efficiency. This article discusses PEM systems in developing countries using an analytical framework based on principal-agent theory. This simple model can be applied to various PEM systems and allows for comparisons between institutional settings. To illustrate this, the authors analyse the benefits derived from the use by the ministry of finance of ex post audits and ex ante controls, and assess their value in terms of their ability to deter cheating. The authors derive a set of possible “control regimes” which can be used by the ministry of finance.

La Commission européenne, avec l’appui des tribunaux européens, a mis en place le cadre de la politique de la concurrence en Europe. Ce cadre a été édifié depuis le traité de Rome de 1957 avec le souci fondamental de promouvoir l’ouverture du marché tout en renforçant les institutions communautaires. Les réformes destinées à la « modernisation » du processus d’application sont entrées en vigueur en mai 2004, ainsi que les modifications intervenues en matière de contrôle des fusions. La Commission envisage en outre de revoir son dispositif dans d’autres domaines, comme l’abus de position dominante et les aides publiques. À mesure que les États membres adaptent leurs règles substantielles aux principes communautaires, le rôle de la Commission européenne, des autorités nationales de la concurrence et des tribunaux évolue aussi. La coordination du processus d’application entre les nombreux organes de la Communauté européenne, notamment en ce qui concerne les demandes de clémence déposées dans le cadre d’enquêtes relatives aux ententes, est de plus en plus importante. La Commission a pris des mesures pour renforcer ses capacités d’analyse économique et pour corriger les faiblesses de son processus de décision qui étaient apparues à l’occasion d’importantes décisions de justice. Tout le problème pour ce dispositif, qui est adapté aux méthodes administratives d’application, est de produire des résultats convaincants pour les tribunaux, tout en préservant la cohérence de l’action des pouvoirs publics dans un contexte d’application décentralisée. Ce rapport a servi de base à l’examen par les pairs réalisé en 2005 dans le cadre du Comité de la concurrence.

Les services hospitaliers comportent un ensemble complexe de produits et de services destinés aux patients, qui ne sont pas tous soumis de la même manière à la concurrence. Certains services comme les services d’urgence sont peu, voire pas du tout, soumis à la concurrence. D’autres comme la chirurgie qui peut être programmée, peuvent être soumis à la concurrence d’autres services offrant un service comparable. D’autres encore, comme les services de diagnostic, les consultations de spécialistes et les services de consultations externes peuvent être en concurrence avec les centres de diagnostic, les cabinets de médecins et les centres de chirurgie ambulatoire.

    Abstract: This paper provides the key elements to develop an integrated approach for measuring and monitoring city performance globally. The paper reviews the role of cities and why indicators are important. Then it discusses past approaches to city indicators and the systems developed to date, including the World Bank's initiatives. After identifying the strengths and weaknesses of past experiences, it discusses the characteristics of optimal indicators. The paper concludes with a proposed plan to develop standardized indicators that emphasize the importance of indicators that are measurable, replicable, potentially predictive, and most important, consistent and comparable over time and across cities.     Abstract: This paper suggests a new factor that makes civil war more likely: the inability of political actors to make credible promises to broad segments of society. Lacking this ability, both elected and unelected governments pursue public policies that leave citizens less well-off and more prone to revolt. At the same time, these actors have a reduced ability to build an anti-insurgency capacity in the first place, since they are less able to prevent anti-insurgents from themselves mounting coups. But while reducing the risk of conflict overall, increasing credibility can, over some range, worsen the effects of natural resources and ethnic fragmentation on civil war. Empirical tests using various measures of political credibility support these conclusions

    Abstract: This paper revisits the early empirical literature on economic growth in transition economies, with particular focus on fiscal policy variables-fiscal balance and the size of government. The baseline model uses a parsimonious specification, drawn from Fischer and Sahay (2000), of economic growth as a function of initial conditions, stabilization, liberalization, and structural reform. The paper expands the data used in previous analyses by up to 10 years and finds unambiguous evidence that fiscal balance matters for growth, while confirming other previous findings on the correlates of economic growth in transition economies. In addition, the paper extends the baseline model and explores potential sources of nonlinearities in the relationship between growth and public finance. A key finding is that determinants of growth may vary in relative importance, depending on the underlying institutional quality. The evidence indicates that there could be higher growth payoffs from macroeconomic stability and public expenditure in countries characterized by relatively better public sector governance as measured by relevant indicators. In addition, the size of government matters for growth in a nonlinear manner: Beyond indicative thresholds of expenditure levels, public spending has a negative impact, while at levels below the threshold, there is no measurable impact on economic growth

    Abstract: This paper examines different models of governing structure found in metropolitan areas around the world. It evaluates how well these models achieve the coordination of service delivery over the entire metropolitan area as well as the extent to which they result in the equitable sharing of costs of services. Based on theory and case studies from numerous cities in developed and less developed countries, the paper concludes that there is no "one size fits all" model of metropolitan governance. Other observations from the case studies highlight the importance of the process of implementing a metropolitan structure, the need to match fiscal resources with expenditure responsibilities, the need to have a governance structure that covers the entire economic region, and the critical importance of having a strong regional structure that ensures that services are delivered in a coordinated fashion across municipal boundaries

    Abstract: Scholars, policymakers, aid donors, and aid recipients acknowledge the importance of good governance for development. This understanding has spurred an intense interest in more refined, nuanced, and policy-relevant indicators of governance. In this paper we review progress to date in the area of measuring governance, using a simple framework of analysis focusing on two key questions: (i) what do we measure? and, (ii) whose views do we rely on? For the former question, we distinguish between indicators measuring formal laws or rules 'on the books', and indicators that measure the practical application or outcomes of these rules 'on the ground', calling attention to the strengths and weaknesses of both types of indicators as well as the complementarities between them. For the latter question, we distinguish between experts and survey respondents on whose views governance assessments are based, again highlighting their advantages, disadvantages, and complementarities. We also review the merits of aggregate as opposed to individual governance indicators. We conclude with some simple principles to guide the refinement of existing governance indicators and the development of future indicators. We emphasize the need to: transparently disclose and account for the margins of error in all indicators; draw from a diversity of indicators and exploit complementarities among them; submit all indicators to rigorous public and academic scrutiny; and, in light of the lessons of over a decade of existing indicators, to be realistic in the expectations of future indicators

    Abstract: The aim of this paper is to empirically explore the relationship between the quality of political institutions and the performance of regulation, an issue that has recently occupied much of the policy debate on the effectiveness of infrastructure industry reforms. Taking the view that political accountability is a key factor that links political structures and regulatory processes, the authors investigate, for the case of telecommunications, its impact on the performance of regulation in two time-series-cross-sectional data sets on 29 developing countries and 23 industrial countries covering the period 1985-99. In addition to confirming some well documented results on the positive role of regulatory governance in infrastructure industries, the authors provide empirical evidence on the impact of the quality of political institutions and their modes of functioning on regulatory performance. The analysis of the data sets shows that the (positive) effect of political accountability on the performance of regulation is stronger in developing countries. An important policy implication of this finding is that future reforms in these countries should give due attention to the development of politically accountable systems

    Abstract: This review of human resource management (HRM) in Belgian government is the first country review of its kind to be carried out by the OECD. It provides a detailed diagnosis and solutions for improving the management of government employees in the Brussels-Capital Region, Federal Government, Flemish Government, French Community and Walloon Region. The report compares the policies and practices of Belgium with those in other OECD countries, as well as those across different governments in Belgium. Recommendations suggest that governments should reform the intergovernmental framework on employment to remove rigidities and enhance co-operation, pay special attention to staff productivity and efficiency, and enhance the good governance of their HRM systems.

    Abstract: El Banco Interamericano de Desarrollo (BID) y la Organización para la Cooperación y el Desarrollo Económico (OCDE) cooperan en el derecho de la competencia y la política para promover el aumento del crecimiento económico, empleo y eficiencia económica, y un nivel de vida medio más elevado en el mediano y largo plazo. Hay un creciente consenso que las leyes de competencia y política sólidas son esenciales para alcanzar estos objetivos. La cooperación del BID y la OCDE en el derecho de la competencia y la política se centra en reuniones anuales del Foro Latinoamericano de Competencia (FLC). Las reuniones del FLC incluyen substancialmente discusiones en mesas redondas y revisiones por pares de las leyes nacionales y las instituciones. La OCDE y el BID están satisfechos de participar en este trabajo como parte de sus esfuerzos para promover un mejor ambiente de negocios para la inversión en los países de América Latina y del Caribe.

    Abstract: The harmful effects of corruption on social welfare, political stability and economic development are well known. Combating corruption has gained high priority throughout the world. In Asia and the Pacific, 23 countries have in the framework of the ADB/OECD Anti-Corruption Initiative for Asia and the Pacific endorsed an Anti-Corruption Action Plan that guides reform efforts in their respective countries. While significant progress has been achieved under this regional instrument, the battle against corruption is far from being won. To address this challenge and build capacity in a number of particularly crucial areas, the ADB/OECD Initiative's fourth regional anti-corruption conference has brought together more than 150 senior representatives of governments, the private sector, non-governmental organizations and the international development partner community in Kuala Lumpur, Malaysia, in December 2003. The present publication offers an insight into the most recent national anti-corruption strategies of Asian and Pacific countries, as well as an overview of preventive and enforcement policies and practices developed in the region, with special focus on the management of conflict of interest, measures aimed at curbing corruption in public procurement, corporate ethics, whistleblower protection, forensic accounting and mutual legal assistance.

    Abstract: Korea was among the first countries reviewed in the OECD Reviews of Regulatory Reform Series. Since the first review in 2000, Korea has made bold efforts to enhance conditions for long term growth: promoting regulatory reform, cutting red tape, strengthening competition policy and market openness. The Korean government has also modernised its regulatory framework for information technologies, an area where Korea plays a leading role among OECD countries. This publication assesses progress since 2000 and analyses many of the lessons of implementation of regulatory reform. It highlights possible responses to current challenges. These include the pressures of an ageing society, future welfare needs and human capital development. The study includes a new special chapter on tertiary education, where improvements in the regulatory framework can yield significant benefits for future innovation and productivity.

    Abstract: The Randstad is a poly-centric urban area in western Netherlands, comprising Amsterdam, Rotterdam, The Hague, Utrecht and several smaller cities. It is one of the most densely populated areas in the OECD, and has developed into an advanced urban economy with many leading sectors, such as logistics, horticulture and financial services. The Randstad has one of the lowest unemployment rates in all OECD countries, and it is one of the most attractive metropolitan areas for FDIs. However, even though the Randstad had high growth rates over the 1990s, it performed less well in the 2000s. In particular, the Randstad has witnessed relatively low labour productivity growth over the last decade - much lower than cities such as Munich or Stockholm for instance. This Review aims to provide a detailed diagnosis and solutions for improving the competitiveness of the Randstad. The Randstad does not seem to exploit well the proximity of its four large cities, and therefore it does not represent an integrated functional urban system. Key recommendations are: improve internal accessibility within the area; facilitate knowledge transfers to the private sector; increase flexibility in housing and labour market; and strengthen the coordination of the economic specialities of its cities, such as higher education and tourism. Changing the governance framework is a key condition of success: individual city-regions within the Randstad should be granted more responsibilities, and a Randstad agenda should be created, prioritising improvement of regional public transport. This Territorial Review of the Randstad is integrated into a series of thematic reviews of metropolitan regions undertaken by the OECD Territorial Development Policy Committee. The overall aim of these case studies is to draw and disseminate horizontal policy recommendations for national governments.

    Abstract: E-Government in Hungary has been driven by the overarching national goal to integrate Hungary in the European Union. Strong political leadership has lead to results in a short space of time, including the online availability of 20 core e-government services benchmarked by the EU, as well as other transactional services. The review draws several important lessons from the Hungarian experience: Hungary has moved forward by adopting international good practices, rather than re-inventing the wheel. In order to continue progress, however, Hungary needs to focus on the bigger picture which means using e-government to improve the efficiency and effectiveness of the public sector, i.e. better government, not more government. This review also identifies the challenges that Hungary will face in order to meet these new objectives.
