    Abstract: In dieser Dissertation untersuche ich verschiedene Aspekte des Integrationsprozesses von Migranten und Flüchtlingen, insbesondere wie sich ihre Präsenz auf die Protestaktivitäten und Einstellungen von Einheimischen auswirkt. Die vier Kapitel bauen auf der bestehenden Literatur auf und zielen darauf ab, diese in mehreren Aspekten zu ergänzen. Das erste und das zweite Kapitel verbessern unser Verständnis der kausalen Auswirkungen der Bedingungen im Heimatland auf die Rückkehrabsichten und die Arbeitsmarktintegration von Migranten im Zielland sowie das Verständnis der Auswirkungen traumatischer Erfahrungen während der Flucht auf die Arbeitsmarktintegration von Flüchtlingen. Das dritte Kapitel befasst sich mit der soziokulturellen Integration von Familienmigranten in einem Land, das nicht ihre erste Wahl darstellt. Das vierte Kapitel untersucht die Auswirkungen der Anwesenheit von Ausländern auf die Protestaktivität einer bestimmten Gruppe von Einheimischen und wie sich diese Proteste auf die Besorgnis über Fremdenfeindlichkeit und Intoleranz auf nationaler Ebene auswirken. Die Ergebnisse der Dissertation sollen die politischen Entscheidungsträger über die potenziellen Nebenwirkungen der Migrationspolitik informieren und empirische Erkenntnisse liefern, die zur Verbesserung bestehender und zur besseren Gestaltung künftiger politischer Maßnahmen beitragen.
    Abstract: In this PhD thesis, I look at different aspects of the integration process of migrants and refugees, and how their presence affects the protest activity and attitudes of natives. The four chapters build on and aim to extend the existing literature along several dimensions. The first and second chapters improve our understanding of the causal effect of home country conditions on migrants' return intentions and labour market outcomes at destination and of the effect of traumatizing experiences along the journey on refugees' labour market integration. The third chapter explores the socio-cultural integration of family migrants in a country that was not their primary choice, while the fourth chapter examines the effect of the presence of foreigners on the protest activity of a particular group of natives and how these protests affect worries about xenophobia and intolerance at the national level. The findings in the dissertation aim to inform policymakers on the potential side-effect of migration policies and to provide empirical evidence that help improve existing policies and better design future ones.eral dimensions.

    Abstract: In dem vorliegenden Buch werden die Interessenkonflikte der betrieblichen und behördlichen Datenschutzbeauftragten analysiert. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann.     Abstract: Terrorismus ist noch immer eines der bedrohlichsten Phänomene der heutigen Zeit. In diesem Buch werden mithilfe von Gerichtsakten vom Generalbundesanwalt beim Bundesgerichtshof in Karlsruhe die Radikalisierungsprozesse von 58 deutschen Jihadisten analysiert. Durch das umfassende Datenmaterial ist es möglich, die Wege dieser Personen von der Radikalisierung bis zum Anschluss an eine terroristische Organisation im Ausland (u.a. Islamischer Staat) sowie ausgeübte strafrechtlich relevante Handlungen zu rekonstruieren. Mithilfe einer Netzwerkanalyse wird das radikale Netzwerk untersucht, das aus Deutschland mit Jihadkämpfern im In- und Ausland verbunden gewesen ist. Dabei wird ein Augenmerk auf den Aufbau, die Funktionsweise und die Schlüsselpersonen des Netzwerks gelegt. Auch werden die unterschiedlichen Rollen und Unterstützungshandlungen der Netzwerkmitglieder in den Fokus genommen. Darüber hinaus trägt sie 2) zum Verständnis der technischen Leistungsfähigkeit optimal konzipierter Lebensmittelverarbeitungs- und -Lebensmittelzubereitungstechnologien bei. Diese Dissertation liefert zudem 3) Erkenntnisse über die Verbraucherakzeptanz, der mit diesen Technologien verarbeiteten und zubereiteten Lebensmittel. Weiterhin stellt sie 4) die Auswirkungen von neu eingeführten Lebensmittelverarbeitungstechnologie auf die Ernährungssicherheit dar. Schließlich wird 5) die Bedeutung des „Verbreitungsansatzes“ für den Erfolg der Einführung von „Clean Cooking“ Technologien diskutiert. Um all diesen Aspekten gerecht zu werden besteht diese Dissertation aus acht Kapiteln und die Ergebnisse werden in fünf einzelnen Unterkapitel vorgestellt. Die generellen Ergebnisse dieser Dissertation sind, dass erstens die in dieser Arbeit dargestellten Technologien nachhaltig und kosteneffizient genug sind um, zumindest temporär, die vorherrschenden traditionellen Methoden der Lebensmittelverarbeitung und Lebensmittelzubereitung zu ersetzen. Zweitens ist der Zugang zu Energie durch passive Solartrockner eine wichtige Komponente im Kampf gegen den Hunger und generelle Ernährungsunsicherheit. Drittens sollten Regierungen und relevante Akteure in den Kampf gegen Hunger und Energieunsicherheit die lokalen Kontexte in ihre Planungen einbeziehen und die entsprechenden und angemessenen Bildungs- oder Informationsansätze wählen.
    Abstract: This dissertation explores the effects of optimally designed processing energy usage on food quality and the respective impacts on FNS in rural Mozambique. It adds to the current literature, as it provides 1) a holistic understanding of the nature of FNS and its underlying drives. Furthermore, 2) it adds to the understanding of the technical performance of optimally designed food processing and preparation technologies. 3) The dissertation provides insights concerning users’ acceptability of the food processed and prepared through these technologies. 4) The effects of the newly introduced food processing technology on FNS are presented. Last – but not least – 5) it discusses the importance of the dissemination approach for the success of clean cooking adoption. This PhD dissertation is comprised of 8 chapters and the results are presented in five individual subchapters. The general conclusions of this thesis are that 1) the improved technologies presented in this study are sustainable and cost-effective means to substitute, at least temporarily, the prevailing traditional methods of food processing and food preparation; 2) energy provision through the use of passive solar drying is an essential component in the fight against food and nutrition insecurity and 3) governments and relevant stakeholders involved in energy and food security programs are advised to consider the local context to identify the most adequate training or information delivery technique.

    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: Hiring domestic workers is a routine part of the expat development lifestyle. Whether working for the United Nations, governmental aid agencies, or NGOs such as Oxfam, Save the Children, or World Vision, expatriate aid workers in the developing world employ maids, nannies, security guards, gardeners and chauffeurs. Though nearly every expat aid worker in the developing world has local people working within the intimate sphere of their homes, these relationships are seldom, if ever, discussed in analyses of the development paradigm and its praxis. Aid and the Help addresses this major lacuna through an ethnographic analysis of the intersection of development work and domestic work. Examining the reproductive labor cheaply purchased by aid workers posted overseas opens the opportunity to assess the multiple ways that the ostensibly "giving" industry of development can be an extractive industry as well

    Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: The case for an eco-emancipatory politics to release the Earth from human domination and free us all from lives that are both exploitative and exploitedHuman domination of nature shapes every aspect of our lives today, even as it remains virtually invisible to us. Because human beings are a part of nature, the human domination of nature circles back to confine and exploit people as well-and not only the poor and marginalized but also the privileged and affluent, even in the world's most prosperous societies. Although modern democracy establishes constraints intended to protect people from domination as the arbitrary exercise of power, it offers few such protections for nonhuman parts of nature. The result is that, wherever we fall in human hierarchies, we inevitably find ourselves both complicit in and entrapped by a system that makes sustainable living all but impossible. It confines and exploits not only nature but people too, albeit in different ways. In Eco-Emancipation, Sharon Krause argues that we can find our way to a better, freer life by constraining the use of human power in relation to nature and promoting nature's well-being alongside our own, thereby releasing the Earth from human domination and freeing us from a way of life that is both exploitative and exploited, complicit and entrapped. Eco-emancipation calls for new, more-than-human political communities that incorporate nonhuman parts of nature through institutions of representation and regimes of rights, combining these new institutional arrangements with political activism, a public ethos of respect for nature, and a culture of eco-responsibility

    Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

Es wird der Frage nachgegangen, ob und gegebenenfalls unter welchen institutionellen Bedingungen das doppische Haushalts- und Rechnungswesen bzw. die darin integrierten Instrumente im kommunalen und staatlichen Bereich den mit der Einführung verbundenen Erwartungen gerecht werden kann. Untersucht werden deshalb die Fragen nach effizienzfeindlichen Institutionen der Finanzsteuerung und deren konzeptioneller Berücksichtigung in der Doppik. Dabei werden die Grenzen der Reform, aber auch die organisationsbezogenen Effizienzpotenziale der Einführung von dezentraler Budgetierung, Zielvereinbarungen und einem auf Quasiwettbewerb beruhenden Controllings theoretisch fundiert nachgewiesen und Lösungsvorschläge abgeleitet. Der Autor Matthias Knödler hat das Projekt der Einführung des Neuen Kommunalen Haushalts- und Rechnungswesens in den Kommunen des Landes Sachsen-Anhalt als wissenschaftlicher Mitarbeiter begleitet und arbeitet derzeit im Bereich Haushaltswesen/Controlling in der Landesverwaltung Sachsen-Anhalt.

    Abstract: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform.     Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective.
