    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

    Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically. The first part puts forward economics as the approach to better comprehend the couple's expectations of marriage. It focuses on explaining the economic rationale behind marriage, underlining its contractual nature, and demonstrating that common legal remedies as well as several mandatory and default rules in modern marriage law indeed have an economic foundation. The second part is devoted entirely to the conflict of laws dimension of marriage. The book will therefore be of interest to scholars and lawmakers attempting to launch reforms anywhere or looking for a practical and novel application of economics in the analysis of the law.

    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures.     Abstract: Schon vor 50 Jahren kämpfte Afrika um seine Kunst, die während der Kolonialzeit massenweise in europäische Museen gelangt war. Und es fand durchaus Unterstützung im Westen. Am Ende jedoch war der Kampf nicht nur vergebens, er wurde auch erfolgreich vergessen gemacht. Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute. Schließlich verlief alles im Sand. „Gebt koloniale Raubkunst zurück! Dafür engagiert sich Bénédicte Savoy. In ihrem Buch zeigt die Kunsthistorikerin nun, dass ihr Kampf ein alter ist. Schon in den 1960er-Jahren drängten die neu gegründeten Staaten Afrikas auf eine Rückführung – erfolglos.     Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--
