    Abstract: Particle accelerators are used today for an increasing range of scientific and technological applications. They are very powerful tools for investigating the origin and structure of matter, and for improving understanding of the interaction of radiation with materials, including the transmutation of nuclides and the beneficial or harmful effects of radiation. Particle accelerators are used to identify properties of molecules that can be used in pharmacy, for medical diagnosis and therapy, and for biophysics studies. Particle accelerators must be operated in safe ways that protect the operators, the population and the environment. New technological and research applications give rise to new issues in radiation shielding. These workshop proceedings review the state of the art in radiation shielding of accelerator facilities and irradiated targets. They also evaluate advancements and discuss the additional developments required to meet radiation protection needs.

    Abstract: This report opens with an overview of bilateral agreements and other forms of labour recruitment of foreigners in several OECD countries (Czech Republic, France, Germany, Ireland, Italy, Poland, Switzerland, United Kingdom and United States) as well as in the Philippines and Romania.  It then has a series of chapters describing the management and implementation of these practices and analysing the impact of these agreements on labour markets, economic development and migration policies of both sending and receiving countries.  It also examines the prospects for this type of migration. The Annex lists the principal agreements signed by OECD countries, by type of recruitment scheme (e.g. seasonal, contract workers, trainees and guest workers).

    Abstract: Extended Producer Responsibility (EPR), a policy approach in which the responsibility of the waste from a consumer good is extended back up to the producer of the good, is developing and expanding in OECD countries. Governments find that these schemes can provide a new and flexible approach to reduce the upward trend of waste from consumer products. To address these issues, OECD organised a workshop in December 2002, which was hosted by the Japanese Ministry of Environment, in Tokyo. This book contains selected papers presented at this workshop.

The European Conference of Ministers of Transport (ECMT) and the International Association of Public Transport (UITP) have joined forces to examine how public authorities and transport operators can better work together to improve urban public transport vehicles, systems, and associate infrastructure. This report is the fruit of a joint ECMT-UITP task force. It explores how improved co-operation between transport operators and local authorities — along with a close sustained dialogue with members of the disabled community — can ensure better accessibility to public transport. With a focus on four cities: Gothenburg, Grenoble, Prague and Liverpool, the report identifies the critical elements of partnerships between public authorities at different levels of government and public transport operators.

    Abstract: The European Conference of Ministers of Transport (ECMT) has adopted a new approach to strengthening its work on road safety. It is now working to contribute more effectively to the debate on the improvement of road safety policies by conducting peer reviews of the measures and policies enacted by member countries. Lithuania is the first country to undertake this type of review in the safety field. This review, carried out by experts from Austria, the Netherlands, Sweden and the ECMT Secretariat, is an effective way for Lithuania to openly examine its policies and practices through detailed expert comment, discussion and insight on its activities. The peer review process is used extensively within the OECD and its affiliated organisations, always originating at the request of the country being reviewed. Apart from providing an open appraisal of national policies, the review process should help relevant Ministries obtain needed resources and implement effective policies and practice.

    Abstract: Does Geneva’s Montbrillant lower secondary school, which has now been in use for one year, meet the objectives targeted when it was designed? Does the new school respond to the needs and expectations of staff and students? Questions such as these serve to evaluate the quality of a school building once in use and tie in with work supported by PEB on post-occupancy evaluation. For the design of Montbrillant, the Geneva authorities promoted specific integrated concepts; to verify to what extent these were successfully incorporated into the building, the author contacted the school’s users, i.e. its management, administrative and technical staff, teachers, and students. Although their overall appreciation was positive, the users expressed dissatisfaction with many aspects of the facilities as described below.

    Abstract: The Globally Harmonised System for the Classification and Labelling of Chemicals defines skin corrosion as the production of irreversible tissue damage in the skin following the application of a test material. The test material (150 µL for liquids or solid with 150 µL of deionised water added on the top) is applied for up to 24 hours to the epidermal surfaces of skin discs (three skin discs are used for each test and control substance) in a two-compartment test system in which the skin discs function as the separation between the compartments. The skin discs are taken from humanely killed rats aged 28-30 days. Corrosive materials are identified by their ability to produce a loss of normal stratum corneum integrity and barrier function, which is measured as a reduction in the TER below a threshold level (5kΩ for rat). A dye-binding step incorporated into the test procedure permits to determine if the increase in ionic permeability is due to physical destruction of the stratum corneum.

    Abstract: Bilateral and regional investment agreements have proliferated in the last decade and new ones are still being negotiated. Most-Favoured-Nation (MFN) clauses link investment agreements by ensuring that the parties to one treaty provide treatment no less favourable than the treatment they provide under other treaties in areas covered by the clause. MFN clauses have thus become a significant instrument of economic liberalisation in the investment area. Moreover, by giving the investors of all the parties benefiting from a country’s MFN clause the right, in similar circumstances, to treatment no less favourable than a country’s closest or most influential partners can negotiate on the matters the clause covers, MFN avoids economic distortions that would occur through more selective country-by-country liberalisation.     Abstract: This paper presents results from an on-going joint European Commission / OECD project, aimed at monitoring the direct influence of tax and benefit instruments on household incomes. The project uses and extends OECD tax-benefit models to compute a range of work incentive indicators such as marginal effective tax rates on earned income. This paper provides a methodological background describing these extensions. It also discusses the usefulness of a range of indicators such as net replacement rates and marginal effective tax rates and to what extent they can be used to quantify possible work disincentives. The approaches are illustrated using detailed tax-benefit calculations for 2001 and comparing relevant indicators across 15 EU and 8 non-EU countries.     Abstract: Most Western countries have a long tradition of employment service provision by public bodies and non-profit organisations, but not by for-profit organisations. The creation of a quasi-market arrangement is not a simple choice for government. This paper underscores the difficulties and discusses design options. It calls for a complex balancing act between regulation and the creation of room for market competition, between old and new instruments and procedures, and between efficiency and equity. It identifies as two key issues the need to actively create sufficient room for market competition, and the need for "positive creaming" which encourages providers to concentrate their efforts on the most disadvantaged target groups.     Abstract: The in vivo percutaneous absorption study set out in this Test Guideline provides the linkage necessary to extrapolate from oral studies when making safety assessments following dermal exposure. The in vivo method, described in this guideline, allows the determination of the penetration of the test substance through the skin into the systemic compartment. The test substance, preferably radiolabelled, is applied, for a fixed period of time, to the clipped skin of animals at one or more appropriate dose levels in the form of a representative in-use preparation. The rat is the most commonly used species. At least four animals of one sex should be used for each test preparation and each scheduled termination time. A known amount of the test preparation is evenly applied to the site. This amount should normally mimic potential human exposure, typically 1-5 mg/cm² for a solid or up to 10 µl/cm² for liquids. A relevant exposure period (typically 6 or 24 hours) should be used, based on the expected human exposure duration. The animals should be observed for signs of toxicity/abnormal reactions at intervals for the entire duration of the study. This study includes: daily measurements (excreta), regular detailed observations, as well as sacrifice at the scheduled time and blood collected for analysis.

    Abstract: This Test Guideline describes a laboratory test method to assess abiotic hydrolytic transformations of chemicals in aquatic systems at pH values normally found in the environment (pH 4 – 9). This Guideline is designed as a tiered approach; each tier is triggered by the results of the previous tier.Sterile aqueous buffer solutions of different pH values (pH 4, 7 and 9) are treated with the non-labelled or labelled test substance (only one concentration, which should not exceed 0.01 M or half of the saturation concentration). They are incubated in the dark under controlled laboratory conditions (at constant temperatures). After appropriate time intervals, buffer solutions are analysed for the test substance and for hydrolysis products. The preliminary test should be carried out for 5 days at 50 ± 0.5°C and pH 4.0, 7.0 and 9.0. The second tier consists of the hydrolysis of unstable substances, and the third tier is the identification of hydrolysis products. The higher Tier tests should be conducted until 90 % hydrolysis of the test substance is observed or for 30 days whichever comes first.

First instar chironomid larvae are exposed to at least five concentrations of the test chemical in sediment-water systems. The test starts by placing first instar larvae into the test beakers containing the sediment-water system and subsequently spiking the test substance into the water. Chironomid emergence and development rate is measured at the end of the test. The maximum exposure duration is 28 days for C. riparius, C. yoshimatsui, and 65 days for C. tentans. Larval survival and weight may also be measured after 10 days if required (using additional replicates as appropriate). The study report should include the development time and the total number of fully emerged midges (sex and number are recorded daily), the observation of any abnormal behaviour, the number of visible pupae that have failed to emerge and any egg masses deposition. The data are analysed either by using a regression model in order to estimate the concentration that would cause x % reduction in emergence, larvae survival or growth, or by using statistical hypothesis testing to determine a NOEC/LOEC.

The limit test corresponds to one dose level of 1000 mg/kg. This study includes the observation of unusual behaviour and morphology, the counting and weighing of the adult worms after the four primary weeks, the number of juveniles hatched at the end of the second 4-week period. The reproductive output of the worms exposed to the test substance is compared to that of the control(s) in order to determine the no observed effect concentration (NOEC) and/or ECx by using a regression model to estimate the concentration that would cause a x % reduction in reproductive output. The test concentrations should bracket the ECx so that the ECx then comes from interpolation rather than extrapolation.

Part 1 considers how domestic regulations and regulatory reform affect market openness. It shows how with the help of advanced regulatory reform tools and approaches governments can create regulations and regulatory procedures that efficiently meet their policy objectives while at the same time supporting market access. Part 2 demonstrates that international market opening can contribute to facilitating domestic regulatory reform. Trade agreements signed on the multilateral, regional and bilateral levels can promote general principles or specific elements of good regulation and help guide or drive countries' individual regulatory reform efforts. Finally, part 3 analyzes the mutual benefits of regulatory reform and an open multilateral system for trade and investment. It is argued that by increasing domestic economic efficiency, raising the international competitiveness of domestic enterprises and reducing barriers to trade and investment, traderelated regulatory reform enables countries to take better advantage of trade liberalization and of open global markets.

    Abstract: The purpose of this test is to measure the time course of biodegradation of a test substance at low concentration in aerobic natural water and to quantify the observations in the form of kinetic rate expressions. The test is performed in batch by “pelagic test” or “suspended sediment test” to simulate a water body with suspended solids or re-suspended sediment. The test flasks are incubated in darkness at an environmental temperature under aerobic conditions and agitation during 60 days normally. At least two different concentrations of test substance (non-volatile or slightly volatile organic) should be used. The maximum test concentration should be less than 100µg/L (biodegradation following first order kinetics) and the lowest test concentration preferably in the range of ‹1-10µg/L. Two subsamples should be withdrawn from each test flask at each sampling time. Degradation is followed at appropriate time intervals, by measuring either the residual 14C or the residual concentration of test substance. The total mineralisation and the primary biodegradation are determined by a different 14C labeling part of the molecule. Periodic measurements of pH and oxygen concentration in the test system must be conducted.

    Abstract: This study, that investigates two specific types of quantitative restrictions, namely import prohibitions and quotas, is part of a broad reflection aimed at learning more about the nature and scope of non-tariff measures. The analysis reviews information on these measures contained in the WTO Trade Policy Reviews, WTO notifications and in various other trade reports. The objective of the report is to contribute to discussions, particularly on market access for non-agricultural goods, at the WTO, or elsewhere. The research revealed that the use of quotas and prohibitions for economic reasons has declined, but most countries use prohibitions as part of their regulatory frameworks for protecting human safety and health or the environment, and this tendency appears to be increasing. Traders would benefit from greater transparency of these measures. Also, there are import bans hampering the international trade in used goods, whose circumstances and appropriateness in terms of regulatory efficiency merit scrutiny.

    Abstract: Earthquake-prone communities need earthquake-resistant schools. In 2002, a primary school in San Giuliano, Italy, collapsed killing 29 children and one teacher. In May 2003, a medium-sized earthquake in the city of Bingöl, Turkey, caused the collapse of three new schools and a dormitory, killing many children as they slept. All too frequently, earthquakes cause the collapse of school buildings and the injury and death of staff and students. Further, when schools are closed because of earthquake damage, education is hampered, community life disrupted, and potential emergency shelters unavailable. Where school attendance is compulsory, communities have an obligation to provide a safe study and work environment. Why do schools collapse even during moderate earthquakes? Experts agree that many collapse due to avoidable errors in design and construction. Often, the needed technology is not applied and laws and regulations are not sufficiently enforced. Application of existing knowledge can significantly lower the seismic risk of schools and help prevent further injury and death of school occupants during earthquakes. Moreover, this can be accomplished at reasonable cost and within a reasonable period. Keeping Schools Safe in Earthquakes presents expert knowledge, opinions and experiences, and provides valuable insight into the scope of problems involved in protecting schools and their occupants. Its recommendations are a call to action to all governments in OECD and partner countries to help facilitate their implementation.

    Abstract: This paper focuses primarily on the issue of how to achieve high quality in the audit process. In addition to describing the types of procedures needed to achieve quality, however, it discusses basic principles and those matters of institutional management that create an environment that encourages high quality in an SAI’s work. Audit quality is obtained by a process of identifying and administering the activities needed to achieve the quality objectives of an SAI. All types of SAIs need to understand the benefits that can be realised once audit quality is made a top priority. Improving audit quality requires a systematic SAI-wide approach. Piecemeal efforts by individuals and individual audit teams are not enough and will not work. There are no quick fixes to be obtained where audit quality is concerned. SAIs need to proceed methodically in an organised way to fix each quality issue and problem in turn. As new problems will always emerge, this should be a continuous process for the SAI. It is also evident that most audit quality-related problems are mainly the result of poor management of the audit process or of the SAI itself. Ensuring high levels of quality in an audit organisation involves a succession of detailed steps that must be taken over a period of time. In fact, it is a never-ending process of continual improvement. The first requirement is to define the standards of quality and then to put quality control procedures in place that will ensure that these standards are met. These procedures need not – and should not – suppress the initiative and good judgement of the auditor in adapting to particular circumstances. However, if the auditor judges that it is necessary to depart from the usual audit techniques, it is incumbent upon the auditor to demonstrate the necessity of doing so, and to show that the approach he or she has chosen is capable of satisfying the audit objectives.

    Abstract: This paper applies the most advanced methodologies for measuring services barriers to calculate the restrictiveness and the impact of services barriers in selected transition economies, i.e. the Baltic States, and eight South Eastern European (SEE) countries (for telecommunications and banking) and Russia (for telecommunications). Among the selected countries, the Baltic countries record the highest liberalisation scores for both telecommunications and banking services making their situation comparable to that of most developed countries. By contrast, the SEE countries have more room to improve their performance and the price level of their telecommunication services, both in fixed and cellular services by eliminating general restrictions on competition and removing barriers to foreign equity participation. With respect to banking services, the results suggest that the SEE markets are fairly contestable; policy priorities would thus appear to be broad issues of macroeconomic stability and structural reform.     Abstract: Regulatory Reform in Japan was among the first in a series of in-depth country reviews on regulatory reform. Since 1999, when the review was published, the Japanese government has introduced a number of measures to enhance regulatory quality and to promote regulatory reform, competition policy and market openness. This publication assesses the progress made, identifies some of the lessons that can be learned about the implementation process and indicates what more can be done in light of current challenges. The monitoring exercise covers the core issues of capacity for regulatory quality, competition and market openness. This study updates information about competition policy in Japan, and such trade-related matters as internationally harmonised measures and conformity assessment processes. It calls attention to the linkages between regulatory policies and tools, and the application of competition and market-openness principles. Innovative efforts, such as the Special Zones initiative, also receive attention. The overall concern is how further progress on regulatory reform can enhance Japan’s growth potential. The report brings out many of the lessons of implementation, which take account of the specificities of the Japanese context, but can be of wider value in other countries as well. What began in the 1990s as an effort to remove regulatory barriers is gaining momentum. Regulatory reform is a dynamic process aimed at improving regulatory tools and institutions, reassessing existing regulations in light of current economic and social developments, and assessing the impact of new regulations while they are in preparation. These tasks call for a whole-of-government approach, which is one of the main challenges for Japan’s next three-year Programme for Regulatory Reform.

    Abstract: The General Framework Agreement for Peace in Bosnia and Herzegovina (GFAP), popularly known as the Dayton Peace Agreement (DPA) since it was negotiated and initialed at a U.S. Air Force base in Dayton, Ohio, defined Bosnia and Herzegovina as a state consisting of two entities, the Federation of Bosnia and Herzegovina (FBiH) and the Republika Srpska (RS). In accordance with international law, Bosnia and Herzegovina continued the legal existence of the Republic of Bosnia and Herzegovina, with its internal structure modified, but within the existing, internationally recognised, borders. The Federation covers 51 per cent of the state territory, that is, 26 110 sq km. Geographically, the Federation occupies central and western parts of Bosnia and Herzegovina, although the two entities are intertwined, which makes it difficult to attach to them geographical designations. Moreover, according to the DPA, the entities do not have jurisdiction over border control. The last official census took place in 1991, but the Federation Bureau of Statistics published on 30 June 2003 an official estimate of population figures. According to the Bureau, in summer 2003 the Federation of Bosnia and Herzegovina had 2 839 215 inhabitants, of which 2 321 058 actually resided in the Federation. The remaining 518 157 persons were categorized as refugees.

    Abstract: This paper provides estimates of the implicit fiscal assets as well as of the evolution over time of fiscal costs and revenues related to tax-favoured retirement saving regimes in 17 OECD countries, taking into account current and future contributions, asset accumulation and withdrawals, all of which will be strongly influenced by future demographic developments. The main results show that in the case where tax incentives are assumed to lead essentially to saving diversion rather than creation, the net budgetary cost of tax-favoured schemes would remain large, despite the sharp rise in revenues collected from withdrawals as population ages.     Abstract: This study forms part of on-going OECD work on trade in services, in co-operation with UNCTAD, aimed at assisting WTO Members in managing request-offer negotiations under the GATS. The key objective is to help officials of WTO Members in both gaining a greater insight into the particular issues of importance in the legal services sector and how they might be approached in the negotiations. While only modest liberalisation of legal services trade was achieved during the Uruguay Round, the current negotiations offer the opportunity to achieve greater levels of liberalisation, which may lead to significant economic benefits to all countries. In addition, the peculiar characteristic of legal services is that the potential downsides stemming from liberalisation — both in terms of market failures to achieve social objectives and of the displacement of local suppliers — are likely to be less significant in these services.

    Abstract: As modern nuclear power programmes mature and large, commercial nuclear power plants and fuel cycle facilities approach the end of their useful life by reason of age, economics or change of policy on the use of nuclear power, new challenges associated with decommissioning and dismantling come to the fore. Politicians and the public may expect there to be a “right answer” to the choice of strategy for a particular type of facility, or even all facilities. Both this seminar and wider experience show that this is not the case. Local factors and national political positions have a significant input and often result in widely differing strategy approaches to broadly similar decommissioning projects. All facility owners represented at the seminar were able to demonstrate a rational process for strategy selection and compelling arguments for the choices made.
