Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

    Abstract: Angesichts moderner Medizintechnik verfassen immer mehr Menschen in Deutschland eine Patientenverfügung, damit sie im Zweifelsfall sterben dürfen. Allerdings ist die Patientenverfügung weit weniger Ausdruck eines autonomen Patientenwillens, als sie scheint. Dieser Band zeichnet basierend auf zahlreichen Gesprächen aus kulturanthropologischer Perspektive die Entstehungsgeschichten einzelner Patientenverfügungen nach. Dabei werden hintergründige Wirkmechanismen offengelegt, vor denen sich Individuen in einem komplexen Gefüge aus Interaktionen, Wissenshierarchien und gesellschaftlichen Verhaltensnormen als präventiv handelnde Akteure konstituieren.     Abstract: Religiöses Recht ist immer wieder in Diskussion: Jüdisches Recht bei der Beschneidung, islamisches Recht beim Schächten und katholisches Kirchenrecht bei der Bistums-Finanzverwaltung. Die Säkularisierung trennte Staat und Religion in der Weise, dass für das Recht der Staat zuständig ist. Können, sollen Religionsgemeinschaften trotzdem ihr eigenes internes Recht haben? Die Autorinnen und Autoren gehen dieser Frage aus unterschiedlichen geographischen und religiösen Richtungen nach und verbinden die theologischen und religiös-rechtlichen Binnenperspektiven mit religionshistorischen, philosophischen, sozialanthropologischen und weltlich-rechtlichen Außenperspektiven. Religionsfreiheit erweist sich dabei als Verbindungsglied, aber auch als Filterinstanz zwischen beiden Bereichen. So zeigt sich, dass die Begründung religiösen Rechts womöglich gerade in einem sich fortentwickelnden Verständnis von Säkularisierung liegt.

    Abstract: Die britische Mathematikenthusiastin ("Mathematik der Liebe"), Professorin in London, schreibt über das Wirken von Algorithmen in den Daseinsdimensionen "Macht, Daten, Justiz, Medizin, Autos, Kriminalität, Kunst." Die Algorithmen entscheiden für uns oder bereiten Entscheidungen vor, doch sie sind indiskret, fehlerbehaftet (wie menschliches Handeln), ungerecht und gaukeln eine Sicherheit vor, die sie nur bedingt geben können. Die Autorin referiert die z.T. bekannten Beispiele. Vieles grenze, vor allem in der sogenannten KI, die sie lieber eine erweiterte Computerstatistik nennen wolle, an "Zauberei", vor allem dann, wenn nicht mehr erklärt werden könne, wie die Ergebnisse zustande kämen. Die Kernfrage bleibe also, wie sehr wir den Algorithmen trauen und sie als Autorität in unserem/über unser Leben anerkennen. Man muss nicht zum Cyborg werden, aber ein vernünftiges und rationales Miteinander von menschlichen und algorithmisierten Verfahren sei ein anstrebenswertes Ziel. Sehr gut zu lesen, gut neben z.B. K. Mainzer, C. O'Neil, M. Tegmark

The English past has featured many representations of declining community, expressed by those who lamented its loss in quite different periods and in diverse genres. This book analyses how community spirit and the passing of community have been described in the past...whether for good or ill...with an eye to modern issues, such as the so-called 'loneliness epidemic' or the social consequences of alternative structures of community. It does this through examination of authors such as Thomas Hardy, James Wentworth Day, Adrian Bell and H.E.     Abstract: This is a study of what ethical principles and practices people around the world hold in common and what institutions best allow virtue to flourish. It is based on a Carnegie Council project on comparative ethics that Michael Ignatieff has run for the past three years. Most works of comparative ethics look at formal systems of belief. What, for example, do Christian and Confucian texts say about the role of the family? What do the Koran or John Rawls say about treatment of the poor? This is, by contrast, a work of "lived ethics." Ignatieff took a team of researchers around the world to examine what values and ethical beliefs guide diverse people in practice. They went to places where people are living under unusual stresses or where contemporary social challenges are particularly clear. They went to Brazil, for example, to discuss life where corruption is a serious problem, to Sarajevo to talk about reconciliation, to Queens in New York to talk about diversity, and to Fukushima, Japan, to talk about disaster and recovery. Overall, they found more commonality than they were expecting, that whatever formal systems of belief prevail, people tend to orient themselves in similar ways around the values of trust, tolerance, forgiveness, reconciliation, and resilience. But where people are suffering they often doubt that others share their ethical beliefs and begin to circle the wagons to defend their own group. We shouldn't expect citizens to be heroes. So what institutions and political arrangements encourage or inhibit virtue? Overall, Ignatieff says, liberal constitutionalism seems most effective, but only as long as poverty and inequality are not allowed to get out of hand.--

    Abstract: An enduring theme of Western philosophy is that we are all one another's equals. Yet the principle of basic equality is woefully under-explored in modern moral and political philosophy. In a major new work, Jeremy Waldron attempts to remedy that shortfall with a subtle and multifaceted account of the basis for the West's commitment to human equality. What does it mean to say we are all one another's equals? Is this supposed to distinguish humans from other animals? What is human equality based on? Is it a religious idea, or a matter of human rights? Is there some essential feature that all human beings have in common? Waldron argues that there is no single characteristic that serves as the basis of equality. He says the case for moral equality rests on four capacities that all humans have the potential to possess in some degree: reason, autonomy, moral agency, and ability to love. But how should we regard the differences that people display on these various dimensions? And what are we to say about those who suffer from profound disability--people whose claim to humanity seems to outstrip any particular capacities they have along these lines? Waldron, who has worked on the nature of equality for many years, confronts these questions and others fully and unflinchingly. Based on the Gifford Lectures he delivered at the University of Edinburgh in 2015, One Another's Equals takes Waldron's thinking further and deeper than ever before.--

    Abstract: An account of all the new and surprising evidence now available for the beginnings of the earliest civilizations that contradict the standard narrative. Why did humans abandon hunting and gathering for sedentary communities dependent on livestock and cereal grains, and governed by precursors of today's states? Most people believe that plant and animal domestication allowed humans, finally, to settle down and form agricultural villages, towns, and states, which made possible civilization, law, public order, and a presumably secure way of living. But archaeological and historical evidence challenges this narrative. The first agrarian states, says James C. Scott, were born of accumulations of domestications: first fire, then plants, livestock, subjects of the state, captives, and finally women in the patriarchal family-all of which can be viewed as a way of gaining control over reproduction. Scott explores why we avoided sedentism and plow agriculture, the advantages of mobile subsistence, the unforeseeable disease epidemics arising from crowding plants, animals, and grain, and why all early states are based on millets and cereal grains and unfree labor. He also discusses the "barbarians" who long evaded state control, as a way of understanding continuing tension between states and nonsubject peoples

    Abstract: "Japan's Household Registration System (koseki seido) is an extremely powerful state instrument, and is socially entrenched with a long history of population governance, social control and the maintenance of social order. It provides identity whilst at the same time imposing identity upon everyone registered, and in turn, the state receives validity and legitimacy from the registration of its inhabitants. The study of the procedures and mechanisms for identifying and documenting people provides an important window into understanding statecraft, and by examining the koseki system, this book provides a keen insight into social and political change in Japan.By looking through the lens of the koseki system, the book takes both an historical as well as a contemporary approach to understanding Japanese society. In doing so, it develops our understanding of contemporary Japan within the historical context of population management and social control; reveals the social effects and influence of the koseki system throughout its history; and presents new insights into citizenship, nationality and identity. Furthermore, this book develops our knowledge of state functions and indeed the nation state itself, through engaging critically with important issues relating to the koseki while at the same time providing a platform for further investigation. The contributors to this volume utilise a variety of disciplinary areas including history, gender studies, sociology, law and anthropology, and each chapter provides insights that bring us closer to a comprehensive grasp of the role, effects and historical background of what is a crucial and influential instrument of the Japanese state.This book will be of great interest to students and scholars of Japanese history, Japanese culture and society, Japanese studies, Asian social policy and demography more generally.
