    Abstract: This open access book presents an interdisciplinary, multi-authored, edited collection of chapters on Artificial Intelligence (‘AI’) and the Law. AI technology has come to play a central role in the modern data economy. Through a combination of increased computing power, the growing availability of data and the advancement of algorithms, AI has now become an umbrella term for some of the most transformational technological breakthroughs of this age. The importance of AI stems from both the opportunities that it offers and the challenges that it entails. While AI applications hold the promise of economic growth and efficiency gains, they also create significant risks and uncertainty. The potential and perils of AI have thus come to dominate modern discussions of technology and ethics – and although AI was initially allowed to largely develop without guidelines or rules, few would deny that the law is set to play a fundamental role in shaping the future of AI. As the debate over AI is far from over, the need for rigorous analysis has never been greater. This book thus brings together contributors from different fields and backgrounds to explore how the law might provide answers to some of the most pressing questions raised by AI.     Abstract: This open access volume of LIDC contributions focuses on how competition and intellectual property laws incorporate sustainability objectives. Businesses are increasingly embracing sustainability objectives, driven by the international community. Although competition and intellectual property law are certainly not the only tools for addressing sustainability issues, they can play a role in moving toward a more sustainable society. Sustainability has gained prominence in competition law in all jurisdictions covered in this volume. The contributions focus on classic questions such as whether sustainability agreements restrict competition and, if so, to what extent businesses can be exempted on efficiency grounds. The papers also raise a number of questions, in particular concerning the treatment of non-market efficiencies. The soft law and case law produced by competition authorities are examined, and the leadership role of some competition authorities in the field – from advocacy to policy papers and sustainability guidelines – is highlighted. The authors call for more individual guidance to provide enhanced transparency and clarity to industry, advisors and society at large on sustainability issues, with guidelines or sustainability-related block exemptions providing even greater legal certainty. With regard to intellectual property, the contributions examine various important issues, such as the need for intellectual property rights to remain technology-neutral, ways to promote the use of sustainable technologies and incentives for licensing, and ways to promote the dissemination of sustainable technologies, including compulsory licensing, cross-licensing, open source or FRAND licensing, and replacing the destruction of counterfeit goods with recycling. The papers also discuss greenwashing and how it can be addressed through revisions to trademarks and related rights.

    Abstract: This textbook presents a range of classical philosophical approaches in order to show that they are unsuitable as a foundation for human rights. Only the conception of human dignity –based on the Kantian distinction between price and dignity – can provide a sufficient basis. The derivation of human rights from the principle of human dignity allows us to identify the most crucial characteristic of human rights, namely the protection of personhood. This in turn makes it possible (1) to distinguish between real moral human rights and spurious ones, (2) to assess the scope of protection for many codified human rights according to the criteria of “core” and “yard,” and (3) offers a point of departure for creating new, unwritten human rights. This philosophical basis supports a substantial reassessment of the case law on human rights, which will ultimately allow us to improve it with regard to legal certainty, clarity and cogency. In the second edition, errors have been corrected in numerous places, the text has been made clearer and easier to understand. In addition, more recent human rights issues have been newly included, especially those related to the Corona epidemic and climate change. The textbook is primarily intended for advanced law students who are interested in a deeper understanding of human rights. It is also suitable for humanities students, and for anyone in the political or social arena whose work involves human rights and their enforcement.     Abstract: The book presents observations concerning automated decision-making from a general point of view at the same time as it analyses the manner in which praxis in some jurisdictions has evolved as concerns automated decision-making and how the requirements that are placed by the legal orders on it are formulated. The principle of the rule of law should apply in the context of automated decision-making of public authorities just as much as when the decision-makers are physical persons. In sync with increasing automatization of decision-making in public authorities, problematizing questions about the appropriate legal basis for algorithmic decision-making have started emerge. How should the principle of the rule of law apply within the area of automated decision-making, how should automated decision-making be regulated so that it satisfies the requirements created by the principle of the rule of law, and how should the principle of the rule of law be made concrete in decision-making that is based on algorithms? The proposal for an AI Act launched by the European Commission in April 2021, including an identification of high-risk uses of algorithmic techniques, raises further questions concerning practices and interpretations related to automated decision-making. The state based on the rule of law proceeds from the maxim that public powers are exercised within a legal frame that makes the exercise of public powers foreseeable in light of legal norms. Also, a state based on the rule of law requires that the contents of the exercise of public powers is regulated by legal norms, which means that the citizens must be able to know everything that is relevant about how the powers will be exercised, not only who it is that will exercise the powers. Because of rules and principles of this kind, including non-discrimination and proportionality, the exercise of powers will not become arbitrary.

However, the current state of research in this field is unsatisfactory. Although existing scholarship tends to agree that the common feature of these regimes is the incumbents' tendency to interfere in political competition, little is known about how incumbents select between different forms of electoral manipulation and how such different forms go on to affect electoral results.     Abstract: Echoing the famous "The Limits to Growth" report from 1972, this edited volume analyses the changes that the World System has undergone to the present, on the fiftieth anniversary of the original report. During the past fifty years, both the concept and understanding of these limits have significantly changed. This book highlights that the evolution of the World System has approached a new critical milestone, moving into a fundamentally new phase of historical development, when the old economic and social technologies no longer work as efficiently as before or even begin to function counterproductively, which leads the World System into a systemic crisis. The book discusses the transition of human society to a new phase state, the shape of which has not yet been determined. New approaches are needed for both, for the analysis of the global situation, and for forecasts. The book is based on an integrated approach including the world-systems, historical and evolutionary perspectives, as well as a systematic view of society, in which changes in one subsystem cause transformations in others.     Abstract: This book offers a comprehensive review of crowdfunding at Higher Education Institutions, both in theory and practice. In addition, it sheds new light on the emerging concept of crowdfunding at Higher Education Institutions and presents an overview of current academic discussions and best practices regarding crowdfunding in education. Approaching crowdfunding from an integrated perspective, the book explores the relationship between crowdfunding and higher education institutions from both theoretical and practical perspectives. The theory part outlines why higher institutions should interact with crowdfunding platforms beyond the goal of simply raising funds. It continues to define science crowdfunding and education crowdfunding and provides a literature review of education crowdfunding. It follows with an outline of teaching alternative finance theory. The practice part consists of an attempt to develop a core curriculum for teaching crowdfunding, with cases stemming from university education as well as professional education. Two contributions deal with the implementation of crowdfunding platforms at universities. Furthermore, crowdfunding is then connected to non-fungible tokens used to alleviate student debt. Lastly, crowdfunding is put into the context of crowdsourcing practices. It includes contributions from international academics, scholars and professionals in the field and provides a global, multidimensional perspective on crowdfunding. Lastly, the book is unique in that it points the way forward, both for policymakers and for the research community, in terms of thinking about crowdfunding at Higher Education Institutions and the complex issues surrounding its development.

In addition, the book explores issues concerning changes in regulations for various financial crimes around the world, statistics, and ways to combat digital crimes including punitive, preventive and other measures.     Abstract: This book critically analyzes the criminalization of incitement to terrorism under the fundamental principles of legality, necessity, and proportionality with the aim of striking a fair balance between security and liberty on this complicated issue. The criminalization of incitement to terrorism has gained momentum, but no exact or generally accepted definition of this offense exists at the international level. What’s more, given that the criminalization of incitement to terrorism results in restrictions on the exercise of citizens’ freedom of expression, there should be certain limitations on those criminal measures to avoid unnecessary or disproportionate infringement of this fundamental human right. Nevertheless, there has not been a precise standard by which to determine how to draw the line between anti-terrorism and the protection of freedom of expression. Hence, it could be concluded that the criminalization of incitement to terrorism concerns how to balance security and liberty, and the safeguarding principles of legality, necessity, and proportionality should be fully observed in considering this issue. This book studies definitions of “incitement”, “terrorism”, and “incitement to terrorism” under the relevant international and national legislation, and points out the existing absence, ambiguousness, or substantive divergence in defining actus reus and mens rea regarding incitement to terrorism. It carefully considers the current need for and essential limitations on criminal measures against incitement to terrorism in accordance with the principles of necessity and proportionality, and particularly focuses on how to balance the protection of freedom of expression with the criminalization of incitement to terrorism.     Abstract: This book offers an in-depth analysis of a fundamental human freedom and a cornerstone of democracy: the Freedom of Religions or Beliefs (FoRB). The book focuses on the legal protection and promotion of FoRB in Europe because, in this context, exercising this right goes beyond a mere internal positioning in terms of legislation; rather, it is influenced by international and supranational case law, as well as the promotional activities of selected non-state subjects of international law. The content is divided into three sections: Part I on the European Convention of Human Rights, Part II on the EU, and Part III on other international actors. The first two Parts examine FoRB in its systematic aspects and “day-to-day” aspects. In contrast, the third Part highlights the promotional activities carried out by the Holy See, the ILO, the Council of Europe (“beyond the Strasbourg Court”), and the OSCE to promote, recommend or otherwise support it. Overall, the volume highlights how the exercise of FoRB can be ensured via international and supranational legal protection (both normative and judicial) and via promotional activities aimed at encouraging and helping states guarantee tolerance and pluralism in their national legislation. The 16 main chapters offer a broad overview of the topic under investigation. Each contribution can be seen as a stand-alone study and, simultaneously, as a link in a chain of legal analysis that connects multiple FoRB-focused questions.     Abstract: This book provides a survey of the economic, health, and somatic progress of Baltic countries during the period 1918-2018, framed by the outline of the historical-sociological theory of modern social restorations, as originally conceived by the Austrian-American comparative historian Robert A. Kann. The author reworks Kann's theory to analyse post-communist transformations in the Baltic region. The book argues that the purpose of modern social restorations is to make restoration societies safe against a recurrence of revolution. There were two waves of modern social restorations: post-Napoleonic and post-communist. Most post-Napoleonic restorations were brief, because they failed to economically and socially outperform the pre-revolutionary and post-revolutionary systems. It considers Baltic restorations as laboratory cases of second-wave modern social restorations, because they encompass a triple restoration of the nation-state, capitalism, and democracy. The book assesses the performance success of Baltic restorations by comparing economic and social progress of Baltic countries during the periods of original independence (1918-1940), foreign-imposed state socialism (1940-1990), and restored independence (since 1990). It then elaborates the criteria to assess the ultimate performance success of these restorations by 2040, when restored Baltic states may endure longer than their ancestors in 1918-1940 and the complete foreign occupations era (1940-1990). The author, an expert in historical sociology, uses extensive historical-statistical data in cross-time comparisons to develop his analysis and create future projections. This book is of wide interest to sociologists, social demographers, political scientists, and economists studying the Baltic region.
