In Lion's Share Veit Erlmann traces the role of copyright law in this process and its impact on the South African music industry. Although the South African government tied the reform to its post-apartheid agenda of redistributive justice and a turn to a post-industrial knowledge economy, Erlmann shows how the persistence of structural racism and Euro-modernist conceptions of copyright threaten the viability of the reform project. In case studies ranging from anti-piracy police raids and the crafting of legislation to protect indigenous expressive practices to the landmark lawsuit against Disney for its appropriation of Solomon Linda's song "The Lion Sleeps Tonight" for The Lion King, Erlmann follows the intricacies of musical copyright through the criminal justice system, parliamentary committees, and the offices of a music licensing and royalty organization.     Abstract: Schon vor 50 Jahren kämpfte Afrika um seine Kunst, die während der Kolonialzeit massenweise in europäische Museen gelangt war. Und es fand durchaus Unterstützung im Westen. Am Ende jedoch war der Kampf nicht nur vergebens, er wurde auch erfolgreich vergessen gemacht. Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute. Schließlich verlief alles im Sand. „Gebt koloniale Raubkunst zurück! Dafür engagiert sich Bénédicte Savoy. In ihrem Buch zeigt die Kunsthistorikerin nun, dass ihr Kampf ein alter ist. Schon in den 1960er-Jahren drängten die neu gegründeten Staaten Afrikas auf eine Rückführung – erfolglos. In the case of Japan, these frictions have manifested themselves as historical issues. The history since World War II has also been a history of trying to overcome the hostility surrounding these issues. Since the end of the war there have been various attempts at reconciliation, and indeed, periods in which Japan has enjoyed good relations with China and also with South Korea. Despite that, historical issues have overheated in the twenty-first century, and their effects may extend beyond Japan's relations with China and South Korea to impact its relations with the United States, Southeast Asia, and Europe. --

    Abstract: "Rights Make Might examines why the three most salient minority groups in Japan all expanded their activism since the late 1970s and chronicles the galvanizing effects of global human rights ideas and institutions on local social movements. The prehistory of the three groups reveals that minority politics in Japan before the 1970s featured politically dormant Ainu - an indigenous people in northern Japan -, active but unsuccessful Koreans - a stateless colonial legacy group -, and active and established Burakumin - a former outcaste group that still faced social discrimination. Despite the unfavorable domestic political environment, the infusion of global human rights ideas and the opening of international human rights arenas as new venues for contestation transformed minority activists' movement actorhood, or subjective understanding about their position and entitled rights in Japan, as well as the views of the Japanese public and political establishment toward those groups, thus catalyzing substantial gains for all three groups. Having benefited from global human rights, all three groups also repaid their debt by contributing to the consolidation and expansion of global human rights principles and instruments. Drawing on interviews and archival data, Rights Make Might offers a detailed historical and comparative analysis of the co-constitutive relationship between international human rights activities and local politics that contributes to our understanding of international norms, multilateral institutions, social movements, human rights, and ethno-racial politics."

    Abstract: For more than 500 years, Indigenous laws have been disregarded. Many appeals for their recognition under international law have been made, but have thus far failed - mainly because international law was itself shaped by colonialism. How, this volume asks, might international law be reconstructed, so that it is liberated from its colonial origins?With contributions from critical legal theory, international law, politics, philosophy and Indigenous history, this volume pursues a cross-disciplinary analysis of the international legal exclusion of Indigenous Peoples, and of its relationship to global injustice. Beyond the issue of Indigenous Peoples` rights, however, this analysis is set within the broader context of sustainability; arguing that Indigenous laws, philosophy and knowledge are not only legally valid, but offer an essential approach to questions of ecological justice and the co-existence of all life on earth.

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

That volume discussed how the Five Principles of Peaceful Coexistence drowned in the first war between a communist and a non-aligned state. This new edition reproduces the original text, but supplements it considerably in light of subsequent developments and official records and reports only later released or leaked to the public. It places Sino-Indian relations in the wider, current context of the rise of China, the position of Tibet and the disorganised state of Asia. The border dispute did not prevent substantial economic relations developing between the two countries and visits taking place at the highest political level. But it still gives rise to almost daily incursions, and in the current climate, the risk of a clash is growing, as forces have been strengthened and most of the Line of Actual Control has not been demarcated.     Abstract: "The debate over what makes human beings unique has raged for hundreds of years, and many believe it is urgent to convince others to accept their particular definition of what it is to be human. Despite these dire warnings, nobody has empirically examined whether particular definitions of a human actually lead to maltreatment. In this book sociologist John H. Evans does and concludes that the definitions of a human promoted by biologists and philosophers actually are associated with less support for human rights. Members of the public who agree with these definitions say they are less willing to sacrifice to stop genocides, and are more supportive of buying organs from poor people, experimenting on prisoners against their will, torturing people to potentially save lives, and having terminally ill people commit suicide to save money. It might appear that the assumptions of critics are empirically correct. However, Evans finds that these critics are actually only partially right, and a detailed examination of the public's views reveals a much more subtle and complex situation. First, he shows that only a minority of the general public agrees with the definitions associated with less support for human rights. Then, he shows that the public has its own definitions of a human being that are unlikely to lead to human rights abuses. So while the critics are right about the definitions of a human promoted by academic biologists and philosophers, at present their concern about widespread maltreatment is overblown"--

    Abstract: African Asylum at a Crossroads: Activism, Expert Testimony, and Refugee Rights examines the emerging trend of requests for expert opinions in asylum hearings or refugee status determinations. This is the first book to explore the role of court-based expertise in relation to African asylum cases and the first to establish a rigorous analytical framework for interpreting the effects of this new reliance on expert testimony. Over the past two decades, courts in Western countries and beyond have begun demanding expert reports tailored to the experience of the individual claimant.     Abstract: This book explores the issue of development-induced resettlement, with a particular emphasis on the humanitarian, legal, and social aspects of this problem. Today, so-called development-induced displacement and resettlement` (DIDR) is one of the dominant causes of internal spatial mobility worldwide. Each year over 15 million people are forced to abandon their homes to make space for economic development infrastructure. The construction of dams and irrigation projects, the expansion of communication networks, urbanization and re-urbanization, the extraction and transportation of mineral resources, forced evictions in urban areas, and population redistribution schemes count among the many possible causes.Terminski aims to present the issue of development-caused displacement as a highly diverse, global social problem occurring in all regions of the world. As a human rights issue it poses a challenge to public international law and to institutions providing humanitarian assistance. A significant part of this book is devoted to the current dynamics of development-caused resettlement in Europe, which has been neglected in the academic literature so far.

    Abstract: In Pragmatism in Islamic Law , Ibrahim presents a detailed history of Sunni legal pluralism and the ways in which it was employed to accommodate the changing needs of society. Since the formative period of Islamic law, jurists have debated whether it is acceptable for a law to be selected based on its utility, rather than weighing conflicting articulations of the law to determine the most likely expression of the divine will. Virtually unanimous opposition to the utilitarian approach, referred to as "pragmatic eclecticism," emerged among early Islamic jurists. However, due to a host of changing institutional and socioeconomic transformations, a trend toward the legitimization of pragmatic eclecticism arose in the thirteenth century. Subsequently, the Mamluk authorities institutionalized this pragmatism when Sultan Baybars appointed four chief judges representing the four Sunni schools in Cairo in 1265 CE. After a brief attempt to reverse Mamluk pluralism by imposing the Hanafi school in the sixteenth century, Egypt's new rulers, the Ottomans, embraced this pluralistic pragmatism. In examining over a thousand cases from three seventeenth- and eighteenth-century Egyptian courts, Ibrahim traces the internal logic of pragmatic eclecticism under the Ottomans. An array of archival sources documents the manner in which Egyptian society's subaltern classes navigated Sunni legal pluralism as a tool to avoid more austere legal doctrines. The ensuing portrait challenges the assumption made by many modern historians that the utilitarian approaches adopted by nineteenth- and twentieth-century Muslim reformers constituted a clear rupture with early Islamic legal history. In contrast, many of the legal strategies exercised in Egypt's partial codification of family law in the twentieth century were rooted in premodern Islamic jurisprudence.

    Abstract: Das islamische Recht ist im Westen durch spektakuläre Todes-urteile und drakonische Körperstrafen in Verruf geraten, ansonsten aber weitgehend unbekannt. Was ist die Scharia? Was ist eine Fatwa? Kann es im Islam eine Gleichberechtigung der Geschlechter geben? Diese und andere Fragen behandelt Mathias Rohe in der ersten umfassenden Darstellung des islamischen Rechts seit Jahrzehnten. Er beschreibt die Entstehung, Entwicklung und gegenwärtige Ausformung des islamischen Rechts, erläutert islamische Rechtsfindungsmethoden und schildert die Grundzüge des Familien-, Völker-, Straf- und Wirtschaftsrechts. Dabei kommen auch grundlegende Unterschiede zwischen Sunniten, Schiiten und anderen Richtungen zur Sprache. Sein besonderes Augenmerk gilt den Regelungen für Muslime in einer nichtislamischen Umgebung, vor allem in Deutschland. Ein Ausblick auf Perspektiven des islamischen Rechts in einer globalisierten Welt beschließt dieses anschaulich geschriebene Standardwerk.
