    Abstract: Über Religion wird seit jeher und offenbar unermüdlich gestritten. Auch in Deutschland geben aktuell religiöse Symbole im öffentlichen Raum, Missbrauchsskandale in den christlichen Kirchen und auch religiöser Fundamentalismus Anlass für leidenschaftlich geführte Debatten über den angemessenen Umgang mit Religion in liberalen Demokratien. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

Er führt in einer tour d'horizon sachlich und differenziert durch die aktuellen juristischen und politischen Diskussionen. Denn "die" Scharia gibt es ebenso wenig wie "den" Islam.

    Abstract: An enduring theme of Western philosophy is that we are all one another's equals. Yet the principle of basic equality is woefully under-explored in modern moral and political philosophy. In a major new work, Jeremy Waldron attempts to remedy that shortfall with a subtle and multifaceted account of the basis for the West's commitment to human equality. What does it mean to say we are all one another's equals? Is this supposed to distinguish humans from other animals? What is human equality based on? Is it a religious idea, or a matter of human rights? Is there some essential feature that all human beings have in common? Waldron argues that there is no single characteristic that serves as the basis of equality. He says the case for moral equality rests on four capacities that all humans have the potential to possess in some degree: reason, autonomy, moral agency, and ability to love. But how should we regard the differences that people display on these various dimensions? And what are we to say about those who suffer from profound disability--people whose claim to humanity seems to outstrip any particular capacities they have along these lines? Waldron, who has worked on the nature of equality for many years, confronts these questions and others fully and unflinchingly. Based on the Gifford Lectures he delivered at the University of Edinburgh in 2015, One Another's Equals takes Waldron's thinking further and deeper than ever before.--

    Abstract: "In some religious countries, churches have drafted constitutions, restricted abortion, and controlled education. In others, church influence on public policy is far weaker. Why? Nations under God argues that where religious and national identities have historically fused, churches gain enormous moral authority--and covert institutional access. These powerful churches then shape policy in backrooms and secret meetings instead of through open democratic channels such as political parties or the ballot box. Through an in-depth historical analysis of six Christian democracies that share similar religious profiles yet differ in their policy outcomes--Ireland and Italy, Poland and Croatia, and the United States and Canada--Anna Grzymała-Busse examines how churches influenced education, abortion, divorce, stem cell research, and same-sex marriage. She argues that churches gain the greatest political advantage when they appear to be above politics. Because institutional access is covert, they retain their moral authority and their reputation as defenders of the national interest and the common good. Nations under God shows how powerful church officials in Ireland, Canada, and Poland have directly written legislation, vetoed policies, and vetted high-ranking officials.     Abstract: "One of the most vexing problems in the theory and practice of politics is the issue of difference. How do we build a just and stable polity in the face of identity differences that have historically been the basis for inequality, injustice, and violence? Such differences can take a variety of forms, including religious difference, race and ethnicity, language difference, urban/rural tensions, and gender. In many countries, divisions such as these are the fault lines that threaten the stability of the social and legal order. This book addresses the role of constitutions and constitutionalism in dealing with the challenge of difference. In the spring of 2011, a conference held at Indiana University brought together a distinguished group of lawyers, political scientists, historians, religious studies scholars, and area studies experts to consider how constitutions and constitutionalism address issues of difference across a wide swath of the world we called "Pan-Asia." Pan-Asia runs from the Middle East, through Central Asia, South Asia, Southeast Asia, East Asia, and into Oceania. This is a meta-region across which ideas and influences have traveled for centuries. It is also an area of the world that includes every type of difference in abundant supply. Pan-Asia, therefore, provides a wonderful laboratory for examining the role of constitutions in addressing difference. The existing literatures, while rich in other ways, do not speak directly to this issue of constitutions as a mechanism for addressing difference.
