    Kurzfassung: Ce rapport aborde une question qui se pose dans pratiquement tous les secteurs de services aux collectivités, à savoir la réglementation de l’accès à des installations essentielles. Les régulateurs des industries d’équipements collectifs publics se heurtent à un problème crucial : la réglementation des termes et conditions dans lesquels des entreprises en concurrence ont accès à des intrants clés fournis par des concurrents. Le développement de la concurrence et le succès de la libéralisation dépendent souvent des termes de l’accès et des conditions choisies, aussi les pouvoirs publics sont-ils soucieux de faire le bon choix. Préparé par le comité de la concurrence de l’OCDE, ce rapport traite du secteur des télécommunications et cherche à approfondir la compréhension de la réglementation de l’accès. Les problèmes d’accès ne sont pas des plus faciles pour les autorités de tutelle et les responsables de la politique de la concurrence : ils peuvent en effet être techniquement délicats et donner lieu à des polémiques retentissantes sur le plan pratique. En abordant la question sous ces deux angles, ce rapport cherche à aider les autorités de tutelle et les pouvoirs publics à tirer les leçons de l’expérience de l’OCDE pour obtenir des résultats efficients et compétitifs.

    Kurzfassung: En los países miembros de la OCDE resulta sorprendente el espectro, número y crecimiento de los programas de apoyo para la iniciativa empresarial y la microempresa. Buena parte del interés de política por fomentar la iniciativa empresarial se refleja en la convicción de que la creación de nuevas empresas contribuirá a facilitar el logro de importantes objetivos económicos y sociales. El aumento en el ritmo de creación de empresas es hoy una inquietud casi universal para las autoridades locales, al igual que para los gobiernos centrales que desean combatir la marginación económica local. Sin embargo, a pesar del amplio interés de política, pocos estudios han analizado sistemáticamente la relación entre la creación de nuevas empresas y el desarrollo económico local. Esta publicación analiza las principales rutas a través de las cuales la creación de empresas y su desarrollo puede tener un impacto sobre las economías locales. Así, se analiza la evidencia empírica acerca de la relación entre la iniciativa empresarial y las economías locales. Asimismo, se demuestra que aunque la creación de empresas puede resultar un componente crucial para el desarrollo económico local, el fomento de la iniciativa empresarial no constituye una panacea para el desarrollo. Por ello, se discuten a profundidad una serie de limitaciones potenciales de las estrategias orientadas hacia la iniciativa empresarial y cómo estas limitaciones pueden contrarrestarse. Este libro presenta detalladas recomendaciones de política tanto en el ámbito gubernamental local como nacional. Las recomendaciones se relacionan con tres ámbitos temáticos: estrategia, financiamiento y diseño de programas.     Kurzfassung: Regulatory reform efforts in a broad range of industries have resulted in increased importance of competitive forces as a means to allocate resources and improve economic efficiency. A number of indicators suggest that such forces have been stronger in the United States than in most other OECD countries for some time. This has contributed to sizeable productivity gains and good economic performance over the past decade or so. Nonetheless, despite the generally pro-competitive thrust of policies, a number of challenges remain. Although there are few sectors of the economy from which competition policy and law are completely excluded, given the high risk of sanctions and damages for violation, many anomalous exemptions and special regimes have found their way into US legislation. Contrary to other OECD countries, government related firms are exempted from competition enforcement. Intellectual property rights create special challenges for competition policy and some problems have followed their strengthening over the past two decades, such as the soaring cost of patent litigation. The generally favourable experience with deregulation created pressures for liberalisation in network industries, where the United States has rather been a laggard, at least in the electricity sector. Reforms in the 1990s have entailed some positive results but also some setbacks, reflecting both the difficulties in ensuring competition in such industries and policy mistakes.

    Kurzfassung: This paper is concerned with how stylised differences in monetary policy transmission mechanisms and product and labour market rigidities between the US and euro-area economies affect their resilience to temporary shocks. To address this issue, a small general equilibrium model with long-run neoclassical and short-run neo-Keynesian features is calibrated to replicate the key properties of the US economy (as in the US Fed’s FRB-US model). To this model, features of the euro area’s financial and then product and labour markets are added sequentially with a view to replicating what is generally agreed are aspects of the functioning of the euro-area economy (as captured by the ECB’s Area-Wide Model). Most of the analysis is conducted assuming identical monetary policy reaction functions, although the sensitivity of the results to this assumption is tested.     Kurzfassung: Les États-Unis ont été le premier pays à mettre hors la loi les actes de corruption d’agents publics étrangers dans les transactions commerciales commis par leurs ressortissants et par les sociétés relevant de leur droit grâce à l’adoption du Foreign Corrupt Practices Act (FCPA) de 1977. Vingt ans plus tard, les États-Unis ont signé, en compagnie de trente-quatre autres pays, la Convention sur la lutte contre la corruption d’agents publics étrangers dans les transactions commerciales internationales (la Convention de l’OCDE sur la lutte contre la corruption). Le Congrès des États-Unis a réagi à la signature de la Convention en amendant le FCPA en octobre 1998. Par la suite, les États-Unis ont ratifié la Convention de l’OCDE et déposé leur instrument de ratification auprès de l’OCDE à la fin de 1998. Sont étudiées dans ce rapport les dispositions juridiques et les institutions en place aux États-Unis pour combattre la corruption d'agents publics étrangers et mesurer l'efficacité de ce dispositif. On y examine les mécanismes introduits tant au sein des administrations publiques que dans le secteur privé pour prévenir et détecter des faits de corruption d'agents publics étrangers. Ce rapport traite aussi de l'efficacité des mécanismes d’enquête et de poursuite de l’infraction de corruption étrangère et des infractions connexes notamment en matière de fraude et de blanchiment d'argent. Le rapport se termine avec des recommandations spécifiques, aussi bien en ce qui concerne la prévention et la détection que les poursuites et les sanctions appliquées en pratique. On y trouvera également les prescriptions juridiques essentielles destinées à dissuader, prévenir et combattre la corruption telles qu’elles ont été communiquées par les États-Unis lors du processus d’examen. L’examen de la mise en œuvre par les États-Unis des dispositions anti-corruption de l’OCDE entre dans le cadre d’un mandat plus large du Groupe de travail de l’OCDE sur la corruption dans le cadre de transactions commerciales internationales. Ce groupe est chargé d’une surveillance et d’un suivi systématiques et détaillés de l’ensemble des pays signataires de la Convention de l’OCDE sur la lutte contre la corruption étrangère. Jusqu’ici, le Groupe de travail a examiné l’application et la mise en œuvre de la Convention en Bulgarie, en Finlande, en Allemagne, en Islande et aux États-Unis. D’ici 2007, les examens des 30 autres pays seront réalisés.

    Kurzfassung: In this paper the OECD’s interlink model is used to explore several possible channels through which a narrowing of the US current account deficit could occur. The shocks considered include dollar depreciation, fiscal consolidation, and an improvement in the non-price competitiveness of US producers. A key conclusion is that shocks would have to be very large in order to materially reduce the US external deficit. In part, this is because second-round effects, including domestic policy responses, tend to offset the shocks’ initial impact. In addition, it is clear that each of the channels for narrowing the deficit involves risks to growth in the rest of the world, particularly in Japan where the authorities have limited room to use monetary or fiscal policy to offset any contractionary pressures. The exchange rate simulations highlight the fact that more exchange rate flexibility in Asia would spread the burden of adjustment more evenly across US trading partners. Attention is also ...

The regulation of the terms and conditions under which competing firms have access to essential inputs provided by rivals has become the single biggest issue facing regulators of public utility industries. Development of competition and the success of liberalisation often depend on the access terms and conditions chosen, and public policy interest in getting these terms and conditions right is important. Prepared by the OECD’s Competition Committee, this report focuses on the telecommunications industry and seeks to deepen the understanding of access regulation. Access issues are not easy issues for regulators and competition policy-makers - they can be both difficult technically and the source of noisy disputes in practice. By bringing together theory and practice, this report seeks to help regulators and policy-makers learn from OECD experience to achieve efficient and competitive outcomes.

    Kurzfassung: The United States has a substantial impact on promoting economic growth and reducing poverty in developing countries due to the large size of its economy, its ability to influence world opinion and action and its weight within the international donor community. In 2001 the United States was the largest donor in the OECD’s Development Assistance Committee (DAC) in volume terms, reporting net official development assistance (ODA) of USD 10.9 billion, more than one-fifth of the DAC total. This represented 0.11% of its gross national income (GNI), the lowest ODA/GNI ratio in the DAC and below the DAC average country effort of 0.40%. President Bush recently announced a bold new proposal, the “Millennium Challenge Account” (MCA) for an additional USD 5 billion annually by 2006. If approved by Congress, the MCA will consolidate the American position as the largest donor, and slightly improve the country’s ODA/GNI performance. The American “checks and balances” system of government has some important ramifications for United States development co-operation. This approach implicates a wide range of stakeholders in budget decision-making, especially through the Congress. Flexible approaches to compromise are standard features of the American system, especially for issues of a short-term nature that respond to national or special interests. Addressing long-term issues related to development co-operation can prove more difficult because they lack urgency or a sufficiently strong and influential domestic constituency. Several of the issues raised in the 1998 DAC Peer Review are being addressed by the current Administration. However, some important development issues, including those relating to Congress, to the basic structure of American aid administration, or to the promotion of policy coherence for development, have proven more resistant to change and are noted again in this review...

    Kurzfassung: The budgetary process in the United States federal government is different from that in other OECD member countries. This is a consequence of the strict separation of powers that characterises the American constitutional system and of a long historical development in which new layers of institutional innovation were successively added to existing ones. The presidential budgetary process started to develop in the beginning of the previous century. Its first codification took place in the Budget and Accounting Act of 1921, which required that the President submit a budget for the government to Congress and created the Bureau of the Budget, now the Office of Management and Budget (OMB). In the 1970s, Congress changed its own budgetary process through the Congressional Budget and Impoundment Control Act of 1974, which created the Congressional Budget Resolution and established the Congressional Budget Office. The US health system is unique among OECD countries in its heavy reliance on the private sector for both financing and delivery of health care. The public sector plays a not-insignificant role, providing coverage for the elderly, disabled and poor, and spending as much on health as a share of GDP as is spent in total by many OECD countries.     Kurzfassung: Although new mothers are more likely than ever to be in the labour force, the time around childbirth is a dynamic one, with women quitting work altogether or changing jobs to accommodate the demands of their infants. The passage of Family and Medical Leave legislation during the 1980s and early 1990s may have altered incentives for employment among mothers of young children. This paper will examine whether the FMLA or prior state-legislated leave packages were associated with changes in the continuity of employment for mothers following childbirth, changes in return to their previous employer, and changes in their post-return versus pre-return earnings. Data come from the 1984-1997 waves of the Panel Study of Income Dynamics and its 1997 Child Development Supplement. Women who had a child post-FMLA return to work more quickly than those whose child was born prior to the FMLA, controlling for demographic factors and the state economic situation. Several successful high-technology companies in computers and communications, as well as in healthrelated sectors and services, were venture-backed. Young high-growth firms also benefit from a continuum of complementary finance from business angels, institutional investors and second-tier stock markets. The government played an active role in the early phases of the venture capital industry through the Small Business Investment Company (SBIC) program and various technology development schemes. A reduction in capital gains tax rates and liberalisation of rules for pension fund investments in risky assets in the late 1970s also unlocked new capital sources. Venture capital activity, however, has been quite cyclical. The framework consists of agency Strategic Plans, Annual Performance Plans and Annual Performance Reports. Additionally, the Director of the Office of Management and Budget (OMB) annually prepares a Government-wide Performance Plan. Approximately 100 Cabinet departments, independent agencies and government corporations prepare these plans and reports. These departments and agencies comprise nearly the entire Executive branch of government. (The Central Intelligence Agency is statutorily exempted, and OMB has exempted about 15 very small agencies from having to comply with GPRA requirements.)

The 2001 National Energy Policy is an important development. The US is taking unilateral action as an alternative to the Kyoto Protocol. This report urges consideration of legislation on carbon dioxide and adoption of policies allowing international trading in emissions. Strengthening fuel economy standards is an encouraging approach to energy use in transport. Different standards for cars and light trucks should be addressed as a priority. Policies to promote new sources of energy supply should be balanced by continuing effort to enhance efficient use of energy. Regional Transmission Operators are a sensible means of ensuring access to transmission and the functioning of a competitive wholesale market. The power crisis in California has slowed progress on market reform; confidence should be restored to reactivate reform and to create certainty for new investment. Harmonised electricity industry standards and regulations could help promote competition and encourage investment. Barriers to exploration for oil and gas need to be addressed. Drilling in new onshore and offshore areas, meeting acceptable environmental standards, is necessary or imports must rise. Refineries are operating at full capacity; pressure could be eased by reducing the range of products they are required to produce to meet regional standards. Coal use will remain important and could be environmentally sustainable with advanced clean coal technology. Re-licensing of existing nuclear plants, consistent with safety standards, could ensure nuclear power plays a continuing role, even if new plants remain uneconomic. The decision on the Yucca Mountain repository will be important for the future of nuclear power worldwide.

    Kurzfassung: This paper sheds light on the importance of aggregation bias in the analysis of wage shares developments over time and across countries. We focus on five European countries and the United States and show that the trend decline in the aggregate wage share observed in these countries over much of the 1980s and 1990s partly reflects changes in the sectoral composition of the economy. The application of a fixed-weight aggregation method changes the profile of the observed wage share in a significant way: in particular there is no longer sign of an overshooting of the wage share levels of the early-1970s. Error-correction wage equations based on the adjusted wage shares generally have a better regression fit and show long-run elasticities of real wages to unemployment that vary less across countries and are substantially lower than those obtained with observed shares. This document presents a synthesis of the analytical studies on the quantification of the size of government procurement markets and proposes a series of estimates of procurement markets for over 130 individual countries. The world total government procurement is estimated to amount to $5550 billion in 1998, which is equivalent to 82.3% of the world merchandise and commercial services exports in 1998. The world value of government procurement that is potentially opened up to international trade is estimated at $2083 billion, which is equivalent to 7.1% of the world Gross Domestic Product (GDP) or 30.1% of the world merchandise and commercial services exports. Detailed estimates of government procurement markets are proposed for OECD countries, including estimates of procurement broken down by government levels, types of expenditure (consumption versus investment) and contestable shares. Informed knowledge about the size of government procurement markets and in particular the shares of national markets that are potentially opened up to intenational competition is relevant for the business community, government and trade negotiators.

This year’s edition also includes data on the activity of affiliates of national firms abroad (outward investment). Volume I provides data for the manufacturing sector covering 18 variables including production, employment, investment, research and trade. Part I presents the main findings and highlights trends for each of the variables displayed by foreign multinationals and domestic firms in total manufacturing industry, leading sectors as well as a detailed geographical breakdown. Part II provides basic data and shows the share of each sector controlled by foreign multinationals for the available industrial variables. Data sources and definitions are also provided. Published for the first time, Volume II presents data for services. Five variables are covered: employment, turnover, value added, exports and imports. These data provide a measure of the impact of foreign direct investment on the economies of the OECD countries. From this standpoint, they provide a vital backup for data on direct investment flows.

    Kurzfassung: Tradeable or transferable permits (TPs) are increasingly perceived as a cost-effective and flexible policy instrument for pollution control and natural resources management. Initially they were considered a policy tool whose applications were limited to only certain sectors, such as air pollution management and fisheries. However, over the last few years, there have been significant developments in the use of domestic TPs, across a broader range of environmental issues. TPs now face a double challenge: could they become a key instrument for curbing greenhouse gas emissions in light of the Kyoto Protocol? And could they be used in other areas of environmental management? This book presents the proceedings of an OECD workshop on domestic TPs held in September 2001 in Paris. It provides an analysis on recent developments in the use of domestic TP in new areas including climate change, renewable energy, transport, solid waste management, and water resources management. It highlights issues regarding the use of TPs in policy mixes, reviews key elements of ex post evaluations of earlier TP schemes, identifies key challenges in the design and use of TP systems, and attempts to link the past lessons to further research needs.

Ces données montrent comment les petites et moyennes entreprises perçoivent le coût de l’administration et de la réglementation nationales. La réglementation et les formalités administratives, ce qu'on appelle la "paperasserie", sont d’importants outils dont se servent les autorités publiques pour conduire leur action dans de nombreux domaines, notamment la sécurité, la santé et la protection de l’environnement. Toutefois, si elles sont mal conçues ou mal appliquées, inefficaces ou dépassées, elles peuvent entraver l’innovation, l’accès au marché, l’investissement, et créer des obstacles inutiles aux échanges et à l’efficacité économique. Une réglementation et des formalités administratives de piètre qualité ont un coût pour les économies nationales : la capacité de croissance de ces dernières, leur compétitivité, leur capacité d’adaptation et leur aptitude à créer des emplois peuvent en pâtir. Ce rapport s'appuie sur les résultats d’une enquête menée auprès de 8 000 entreprises, il fait le point sur la qualité, la mise en œuvre et le poids de la réglementation et des formalités administratives dans les domaines de l’emploi, de l’environnement et de la fiscalité. Les résultats sont inquiétants. Un exemple : la « paperasserie » absorbe 4 % du chiffre d’affaires annuel des entreprises (ce sont les plus petites qui sont le plus durement frappées) et ce coût augmente dans la plupart des pays.

    Kurzfassung: Entre 1980 et 1997, le volume de résidus urbains par habitant a augmenté de 22 % tandis qu’il devenait de plus en plus difficile de trouver des sites pour implanter des installations d’élimination des déchets. Si, au cours des dernières décennies, d’importants progrès ont été accomplis en matière de réduction du volume de pollution de l’eau et de l’air produit par habitant, la production de déchets continue d’augmenter. Face à cet accroissement, de nombreux gouvernements ont passé en revue les différents moyens d’action dont ils disposent. Ils en ont conclu qu’imputer au producteur la responsabilité de contribuer ou de pourvoir à l’élimination de ses déchets pouvait permettre d'atténuer certaines des contraintes que ces derniers exercent sur l’environnement (après consommation du produit qu’ils accompagnent). La « responsabilité élargie des producteurs » (REP) est une stratégie en vertu de laquelle les producteurs acceptent d’assumer une responsabilité importante - d’ordre financier et/ou matériel - en ce qui concerne le traitement des déchets d’emballage. La prise en charge de cette responsabilité pourrait inciter à prévenir la production de déchets à la source, promouvoir la conception de produits dans le souci du respect de l’environnement, et contribuer à atteindre les objectifs publics de recyclage et de gestion des matériaux. Au sein de l’OCDE, la tendance est à l’élargissement de la REP à de nouveaux produits, groupes de produits et flux de déchets tels que les appareillages électriques et électroniques. Ce manuel d’orientation constitue un moyen d’informer les gouvernements des avantages et des coûts potentiels liés à la REP.

Cette édition de poche des Principes de l'OCDE applicables en matière de prix de transfert contient la version intégrale des principes en matière de prix de transfert adoptée par les pays membres à l’usage des entreprises multinationales qui transfèrent des biens ou des services d’un pays à l’autre ou au sein d’un seul et même groupe d’entreprises. Ils réaffirment qu’un traitement de pleine concurrence doit être appliqué aux entreprises faisant partie d’un groupe multinational et que pour ce faire, les méthodes transactionnelles traditionnelles doivent être privilégiées. Ces questions controversées n’intéressent pas uniquement les spécialistes de la fiscalité. De fait, les administrations fiscales, les contribuables et les chefs d’entreprises ont tous un rôle à jouer pour éviter la coexistence de règles fiscales contradictoires qui risqueraient d’entraver sérieusement le développement des échanges mondiaux. Les Principes ont été également publiés en classeurs.

    Kurzfassung: GEOTRAP is the OECD/NEA Project on Radionuclide Migration in Geologic, Heterogeneous Media carried out in the context of site evaluation and safety assessment of deep repository systems for long-lived radioactive waste.Performance assessment of proposed waste disposal sites requires models of radionuclide transport through the geosphere. To be used in repository planning and development, these models must have the confidence of both national waste management programmes and the wider scientific community. The fourth GEOTRAP workshop, "Confidence in Models of Radionuclide Transport for Site-specific Performance Assessment" held in June 1999, addressed the issue of technical confidence building and provided an overview of current developments in this field. Proposed approaches to confidence building and approaches that have already proven successful were presented and discussed. In addition to the material presented during the workshop, this publication includes a technical synthesis reflecting the discussions that took place as well as the conclusions and recommendations made, notably during the working group sessions.

The scale of road freight transport for own account, the impact of regulatory changes and the future of the sector are the themes addressed in the introductory reports and the experts’ discussions outlined in this publication.

    Kurzfassung: Businesses’ Views on Red Tape provides the first opportunity to systematically compare data across 11 OECD countries. The data show how small and medium-sized enterprises perceive national administrative and regulatory costs. Regulations and government formalities, so-called "red tape", are important tools used by governments to carry out public policies in many policy areas, including safety, health, and environmental protection. However, if they are poorly designed or applied, inefficient, or outdated, they can impede innovation, entry, investment, and create unnecessary barriers to trade, investment, and economic efficiency. The result of poor regulation and formalities is that national economies become less able to grow, compete, adjust, and create jobs. Based on a survey of almost 8 000 businesses, this report assesses the quality, application and burdens of employment, environment and tax regulations and formalities. The results are dramatic: for example, red tape accounts for 4% of the annual turnover of companies, while the hardest hit are the smallest companies, and these costs are growing in most countries.

    Kurzfassung: Municipal waste has increased 22 % per capita from 1980 to 1997. At the same time, the difficulty of siting new waste disposal facilities has increased. While major progress has been made to lessen the per capita generation of air and water pollution over the past decades, waste generation is still on the rise. Faced with the increase of waste, many governments have reviewed available policy options and concluded that placing the responsibility for the post-consumer phase of certain goods on producers could provide a means to relieve certain environmental pressures, arising from post-consumer waste. Extended Producer Responsibility (EPR) is a policy approach under which producers accept significant responsibility - financial and/or physical - for the treatment or disposal of post-consumer products. Assigning such responsibility could provide incentives to prevent wastes at the source, promote product design for the environment and support the achievement of public recycling and materials management goals. Within the OECD the trend is towards the extension of EPR to new products, product groups and waste streams such as electrical appliances and electronics. This guidance manual represents one means to inform national governments about the potential benefits and costs associated with EPR.

They maintain the arm's length principle of treating related entreprises within a multinational group and affirm traditional transaction methods as the prefered way of implementing the principle. These controversial issues are not just of interest to tax experts. National tax administrations, taxpayers, and businessmen alike all have a share in avoiding conflicting tax rules which might seriously hamper the development of world trade. These guidelines have also been published in a loose leaf version.

    Kurzfassung: The term multifunctionality is increasingly used, but is prone to different interpretations concerning its definition, its utility and its implications for policy at domestic and international level. The OECD undertook this analysis to clarify the concept of multifunctionality and to try to establish a common analytical framework and terminology. Examining production, externality and public good aspects of multifunctionality, the analysis contained in this report leads to a series of questions, the answers to which determine if and when policy intervention is warranted and what the nature of that intervention should be. The framework encompasses both negative and positive externalities of agriculture. The first question relates to the degree of jointness in production between the multiple outputs. The second question identifies the circumstances in which market failure arises. A third question leads to an investigation of the public good characteristics of the outputs in question and helps to define the optimal type of intervention. These may range from market creation, to the imposition of user fees, the formation of clubs or public provision financed at local, regional or national level. The most efficient policy option is defined by the nature of jointness on the supply side and by the characteristics of the output on the demand side, all costs and benefits being taken into account.

    Kurzfassung: Most OECD countries, and many countries outside the OECD, are now deeply engaged in a reform of their electricity markets to stimulate competition and improve efficiency. This book considers the key elements of effective reform based on a review of experiences to date. A converging trend emerges, that emphasises competition in the generation, supply and trade of electricity, aimed at maximising consumer choice. It also highlights the development of new approaches to regulation of the transmission system, which remains monopolistic. This book is an invaluable guide and reference for energy policy makers. It examines the many issues and functions that define a modern, liberalised electricity supply industry, and the challenges posed by regulatory reform. It updates the 1999 IEA publication “Electricity Market Reform - an IEA Handbook”, and is the latest in a series of IEA publications on energy market reforms.
