    Abstract: "By the start of the nineteenth century, the impact of the geological sciences and advancements in the field had radically expanded people's perception of the Earth's age. In How the Earth Feels, Dana Luciano maps the emergence of a "geological fantasy," in which increased knowledge of planetary life was used to racialize Native peoples as fossils and curiosities. Further, the geological fantasy served to cement the notion that the Earth had been preparing for the presence of humans, and that humans were in fact the ultimate expression of the Earth's teleological development in a both scientific and spiritual sense. Counterposing a range of texts-from early European and US geological texts to Indigenous accounts of earthquakes to African American men's anti-slavery writing featuring geological tropes-Luciano reveals the workings of the geological fantasy as it operated across the racial and biopolitical discourses of the nineteenth-century United States. Luciano offers a rich and historically nuanced account of how imagined relations with the non-human world have long served as a means of avoiding engagement with the dynamics of racial and colonial power"

    Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

    Abstract: "Uncovering the role of literature, late imperialism, and the rise of new models of internationalism as integral to the invention of Global English, this book focuses on three key figures from the "Vocabulary Control Movement" - C.K. Ogden, Harold Palmer, and Michael West - who competed for market share for their respective language teaching systems - Basic English, the Palmer Method, and the New Method - through battles over word lists and teaching methods in the 1920s and 30s. Drawing on archives from the Carnegie Corporation and considering language teaching in eight global sites, this book analyzes how a series of conferences in New York and London resolved their conflicts and produced a consolidated, international standard form of English. As a postcolonial approach to the development of the field of English Language Teaching, it reveals how these language debates were proxy battles over an idealized global subject: an urban, secular, consumer moving seamlessly between the tribal and global, speaking both mother tongues and an international lingua franca, Global English. Featuring analysis of the primary texts of each of the three key figures in this book as well as close readings of their readers, which featured adaptations of well-known literary texts from writers like Poe, Dickens, Wordsworth, Milton and Wells, it recovers a neglected history of English as it was redefined as an international language through anti-colonial resistance in the peripheries and transatlantic power struggles in the metropole during the interwar period."--

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: Argues that the slave narrative is a new world literary genre. In Runaway Genres, Yogita Goyal tracks the emergence of slavery as the defining template through which current forms of human rights abuses are understood. The post-black satire of Paul Beatty and Mat Johnson, modern slave narratives from Sudan to Sierra Leone, and the new Afropolitan diaspora of writers like Teju Cole and Chimamanda Ngozi Adichie all are woven into Goyal's argument for the slave narrative as a new world literary genre, exploring the full complexity of this new ethical globalism. From the humanitarian spectacles of Kony 2012 and #BringBackOurGirls through gothic literature, Runaway Genres unravels, for instance, how and why the African child soldier has now appeared as the afterlife of the Atlantic slave.Goyal argues that in order to fathom forms of freedom and bondage today-from unlawful detention to sex trafficking to the refugee crisis to genocide we must turn to contemporary literature, which reveals how the literary forms used to tell these stories derive from the antebellum genre of the slave narrative. Exploring the ethics and aesthetics of globalism, the book presents alternative conceptions of human rights, showing that the revival and proliferation of slave narratives offers not just an occasion to revisit the Atlantic past, but also for re-narrating the global present. In reassessing these legacies and their ongoing relation to race and the human, Runaway Genres creates a new map with which to navigate contemporary black diaspora literature.

    Abstract: Bodily contrasts - from the colour of hair, eyes and skin to the shape of faces and skeletons - allowed the English of the seventeenth and early eighteenth centuries to discriminate systematically among themselves and against non-Anglophone groups. Making use of an array of sources, this book examines how early modern English people understood bodily difference. It demonstrates that individuals' distinctive features were considered innate, even as discrete populations were believed to have characteristics in common, and challenges the idea that the humoral theory of bodily composition was incompatible with visceral inequality or racism. While 'race' had not assumed its modern valence, and 'racial' ideologies were still to come, such typecasting nonetheless had mundane, lasting consequences. Grounded in humoral physiology, and Christian universalism notwithstanding, bodily prejudices inflected social stratification, domestic politics, sectarian division and international relations

    Abstract: Argues that the slave narrative is a new world literary genre. In Runaway Genres, Yogita Goyal tracks the emergence of slavery as the defining template through which current forms of human rights abuses are understood. The post-black satire of Paul Beatty and Mat Johnson, modern slave narratives from Sudan to Sierra Leone, and the new Afropolitan diaspora of writers like Teju Cole and Chimamanda Ngozi Adichie all are woven into Goyal's argument for the slave narrative as a new world literary genre, exploring the full complexity of this new ethical globalism. From the humanitarian spectacles of Kony 2012 and #BringBackOurGirls through gothic literature, Runaway Genres unravels, for instance, how and why the African child soldier has now appeared as the afterlife of the Atlantic slave.Goyal argues that in order to fathom forms of freedom and bondage today-from unlawful detention to sex trafficking to the refugee crisis to genocide we must turn to contemporary literature, which reveals how the literary forms used to tell these stories derive from the antebellum genre of the slave narrative. Exploring the ethics and aesthetics of globalism, the book presents alternative conceptions of human rights, showing that the revival and proliferation of slave narratives offers not just an occasion to revisit the Atlantic past, but also for re-narrating the global present. In reassessing these legacies and their ongoing relation to race and the human, Runaway Genres creates a new map with which to navigate contemporary black diaspora literature.

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent.     Abstract: "Since 1970 the Law in Context series has been at the forefront of the movement to broaden the study of law. It has been a vehicle for the publication of innovative scholarly books that treat law and legal phenomena critically in their social, political and economic contexts from a variety of perspectives. The series particularly aims to publish scholarly legal writing that brings fresh perspectives to bear on new and existing areas of law taught in universities. A contextual approach involves treating legal subjects broadly, using materials from other social sciences, and from any other discipline that helps to explain the operation in practice of the subject under discussion. It is hoped that this orientation is at once more stimulating and more realistic than the bare exposition of legal rules. The series includes original books that have a different emphasis from traditional legal textbooks, while maintaining the same high standards of scholarship. They are written primarily for undergraduate and graduate students of law and of other disciplines, but will also appeal to a wider readership.     Abstract: The Oxford Handbook of the Ends of Empire offers the most comprehensive treatment of the causes, course, and consequences of the ends of empire in the twentieth century. The volume's contributors convey the global reach of decolonization, with chapters analysing the empires of Western Europe, Eastern Europe, China and Japan. The Handbook combines broad, regional treatments of decolonization with chapter contributions constructed around particular themes or social issues. It considers how the history of decolonization is being rethought as a result of the rise of the 'new' imperial history, and its emphasis on race, gender, and culture, as well as the more recent growth of interest in histories of globalization, transnational history, and histories of migration and diaspora, humanitarianism and development,0and human rights. The Handbook, in other words, seeks to identify the processes and commonalities of experience that make decolonization a unique historical phenomenon with a lasting resonance. In light of decades of historical and social scientific scholarship on modernization, dependency, neo-colonialism, 'failed state' architectures and post-colonial conflict, the obvious question that begs itself is 'when did empires actually end?' In seeking to unravel this most basic dilemma the Handbook explores the relationship between the study of decolonization and the study of globalization.     Abstract: Memory is as central to modern politics as politics is central to modern memory. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history. Placing commemorations in their historical settings, the contributors disclose the contested nature of these monuments by showing how groups and individuals struggle to shape the past to their own ends. The volume is introduced by John Gillis's broad overview of the development of public memory in relation to the history of the nation-state. The English past has featured many representations of declining community, expressed by those who lamented its loss in quite different periods and in diverse genres. This book analyses how community spirit and the passing of community have been described in the past...whether for good or ill...with an eye to modern issues, such as the so-called 'loneliness epidemic' or the social consequences of alternative structures of community. It does this through examination of authors such as Thomas Hardy, James Wentworth Day, Adrian Bell and H.E. Bates, by appraising detective fiction writers, analysing parish magazines, considering the letter writing of the parish poor in the 18th and 19th centuries, and through the depictions of realist landscape painters such as George Morland. K.D.M. Snell addresses modern social concerns, showing how many current preoccupations had earlier precedents. In presenting past representations of declining communities, and the way these affected individuals of very different political persuasions, the book draws out lessons and examples from the past about what community has meant hitherto, setting into context modern predicaments and judgements about 'spirits of community' today"...

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: "The Making of English Popular Culture provides an account of the making of popular culture in the nineteenth century. While a form of what we might describe as popular culture existed before this period, John Storey has assembled a collection that demonstrates how what we now think of as popular culture first emerged as a result of the enormous changes that accompanied the industrial revolution. Particularly significant are the technological changes that made the production of new forms of culture possible and the concentration of people in urban areas that created significant audiences for this new culture.     Abstract: Male Friendship and Testimonies of Love in Shakespeare’s England reveals the complex and unfamiliar forms of friendship that existed between men in the late sixteenth century. Using the unpublished letter archive of the Elizabethan spy Anthony Bacon (1558-1601), it shows how Bacon negotiated a path through life that relied on the support of his friends, rather than the advantages and status that came with marriage. Through a set of case-studies focusing on the Inns of Court, the prison, the aristocratic great house and the spiritual connection between young and ardent Protestants, this book argues that the ‘friendship spaces’ of early modern England permitted the expression of male same-sex intimacy to a greater extent than has previously been acknowledged. .

    Abstract: Taxing the Rich draws on unparalleled evidence from twenty countries over the last two centuries to provide the broadest and most in-depth history of progressive taxation available. Scheve and Stasavage explore the intellectual and political debates surrounding the taxation of the wealthy while also providing the most detailed examination to date of when taxes have been levied against the rich and when they haven't. Fairness in debates about taxing the rich has depended on different views of what it means to treat people as equals and whether taxing the rich advances or undermines this norm. Scheve and Stasavage argue that governments don't tax the rich just because inequality is high or rising--they do it when people believe that such taxes compensate for the state unfairly privileging the wealthy. Progressive taxation saw its heyday in the twentieth century, when compensatory arguments for taxing the rich focused on unequal sacrifice in mass warfare. Today, as technology gives rise to wars of more limited mobilization, such arguments are no longer persuasive. Taxing the Rich shows how the future of tax reform will depend on whether political and economic conditions allow for new compensatory arguments to be made. (Publisher's Web site)

    Abstract: This unique publication offers a complete history of Roman law, from its early beginnings through to its resurgence in Europe where it was widely applied until the eighteenth century. Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history. Roman law is both in point of time and range of influence the first catalyst in the evolution of the civil law tradition

    Abstract: In the past two decades, the study of transnational crime has developed from a subset of the study of organized crime to its own recognized field of study, covering distinct societal threats and requiring a particular approach. This volume provides examples of transnational crime, and places them in a broad historical context, which has so far been missing from this field of study. The contributions to this comprehensive volume explore the causes and historical precursors of six main types of transnational crime: piracy human smuggling arms trafficking drug trafficking art and antique trafficking corporate crime The historical contributions demonstrate that transnational crime is not a novel phenomenon of recent globalization and that, beyond organized crime groups, powerful individuals, governments and business corporations have been heavily involved.     Abstract: "Racism and imperialism are the twin forces that propelled the course of the United States in the world in the early twentieth century and in turn affected the way that diplomatic history and international relations were taught and understood in the American academy. Evolutionary theory, social Darwinism, and racial anthropology had been dominant doctrines in international relations from its beginnings; racist attitudes informed research priorities and were embedded in newly formed professional organizations. In White World Order, Black Power Politics, Robert Vitalis recovers the arguments, texts, and institution building of an extraordinary group of professors at Howard University, including Alain Locke, Ralph Bunche, Rayford Logan, Eric Williams, and Merze Tate, who was the first black female professor of political science in the country. Within the rigidly segregated profession, the "Howard School of International Relations" represented the most important center of opposition to racism and the focal point for theorizing feasible alternatives to dependency and domination for Africans and African Americans through the early 1960s. Vitalis pairs the contributions of white and black scholars to reconstitute forgotten historical dialogues and show the critical role played by race in the formation of international relations"--

    Abstract: "The sectional conflict over slavery in the United States was not only a clash between labor systems and political ideologies but also a viscerally felt part of the lives of antebellum Americans. This book contributes to the growing field of emotions history by exploring how specific emotions shaped Americans' perceptions of, and responses to, the sectional conflict in order to explain why it culminated in disunion and war. Emotions from indignation to jealousy were inextricably embedded in antebellum understandings of morality, citizenship, and political affiliation. Their arousal in the context of political debates encouraged Northerners and Southerners alike to identify with antagonistic sectional communities and to view the conflicts between them as worth fighting over. Michael E. Woods synthesizes two schools of thought on Civil War causation: the fundamentalist, which foregrounds deep-rooted economic, cultural, and political conflict, and the revisionist, which stresses contingency, individual agency, and collective passion"--

    Abstract: The study describes the process of gradual inclusion of the Jews into the ‚Heimatrecht‘ and citizenship in the Austrian monarchy since the Josephine reforms. The stony path of integration of the Jews into general citizenship which spans centuries and is marked by numerous setbacks allows to shed new light on the act of expatriation of the Austrian Jews during the Nazi regime.The stony path of integration of the Jews into general citizenship spans many centuries and is marked by numerous setbacks. It stretches from special royal protection of the Jews ('Judenregal') via Tolerance or 'Familienstelle' all the way to full citizenship. A description of this development allows to shed new light on the previously dimly lit act of expatriation of the Austrian Jews during the Nazi regime. This was a complex process running in several stages which, although similar to the rest of the German Reich, occurred at a somewhat later stage and already under the sign of flight and expulsion. However, the disenfranchisement and – literally and legally - depersonalization of the Austrian Jews was - so the argument - not just an act of targeted Nazi persecution, but the systematic reversal in rapid motion of the Jews' emancipation which had started at the end of the 18th century. What at first glance appears to have been an abstruse and cluttered convolution of Nazi regulatory activity turns out, on closer analysis, to have been a meticulous reversal of the historical process of 'Jewish emancipation'. Numerous case studies and three major biographical studies towards the end of the book show to what extent the 'Heimatrecht' and citizenship or, by contrast, the fate of statelessness determined the lives and identities of people - far beyond the time of the Austrian monarchy
    Abstract: Vor dem Hintergrund der Entrechtung und Ausbürgerung der österreichischen Juden während der NS-Zeit wird hier der umgekehrte Prozess der stufenweisen Inklusion von Juden in Heimatrecht und Staatsbürgerschaft der österreichischen Monarchie seit den josephinischen Toleranzedikten beschrieben. Dabei zeigt sich nicht nur die Bedeutung der Erlangung der vollen staatsbürgerlichen Rechte für den gesellschaftlichen, ökonomischen und kulturellen Aufstieg der Juden, sondern auch wie sehr Heimatrecht und Staatsbürgerschaft - oder umgekehrt: Staatenlosigkeit - Leben und Identität von Menschen prägten, noch weit über die Monarchie hinaus.Vor dem Hintergrund der Entrechtung und Ausbürgerung der österreichischen Juden und Jüdinnen während der NS-Zeit wird hier der umgekehrte Prozess der stufenweisen Inklusion von Juden in Heimatrecht und Staatsbürgerschaft der österreichischen Monarchie seit den josephinischen Toleranzedikten beschrieben. Die Studie belegt nicht nur die Bedeutung der Erlangung der vollen staatsbürgerlichen Rechte für den gesellschaftlichen, ökonomischen und kulturellen Aufstieg der Juden, sondern ermöglicht zugleich auch einen neuen Blick auf die nationalsozialistische Judengesetzgebung, die hier als systematische, fast spiegelbildliche Rückführung der historischen „Judenemanzipation“ erscheint.     Abstract: This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly

    Abstract: The 20th century saw an unprecedented number of major wars, conflicts, and massive human rights violations. From each emerged the desire to make sense of the recent past (and present) by imagining new ways of dealing with such events. In order to prevent new forms of violence, or to punish the persons responsible of past horrors, various solutions have been imagined, deployed, implemented, and discussed, at different levels. This book is a reflection on the social and historical construction, appropriation, and circulation of categories, norms, and savoir-faire related to the ways social groups and institutions-state, judiciary, professional organizations-confront traumatic events. Even if there is a robust literature on purges and other mechanisms intended to deal with an authoritarian or violent past, written by authors belonging to numerous disciplines and exploring different periods and topics with a variety of theoretical and methodological backgrounds, our goal was to propose a more sociologically oriented model of analysis. Far from being only an intellectual frenzy, this orientation appears to be less normative than most “post-transitional” approaches and potentially more general than strictly monographic approaches. In doing so, our objective is not only to provide a critical approach, but also to sustain a more realistic view of this highly political and moral domain
