    Abstract: "The term human economics is sometimes used within economic theory with the hope of repositioning economic discipline as a human and social science, but with scarce success. Indeed, despite great economists have always carefully considered human nature, it has been largely neglected from modern economics. This book explores the potentials of a human economics arguing that the complexity and peculiarities of human nature should be central to the study of economics. Complex economic phenomena are subject to laws and limits that reveal their internal order in spite of the apparent randomness and unpredictability. The book embraces the contributions of thinkers and economists who have tried to fully consider human nature and society within their biological environment. From these solid foundations, the book introduces a different Weltanschauung, offers an analysis of socio-economic paradigms, and develops an alternative theoretical framework. On the basis of a transdisciplinary methodology, the book investigates human nature, interactions, and systems up to the macroeconomic cyclical development of the capitalist system. Future perspectives and issues facing modern economies are also discussed, from environmental sustainability to globalization and socio-political challenges.     Abstract: "Mobile Lifeworlds illustrates how the imaginaries and ideals of Western travellers, especially those of untouched nature and spiritual enlightenment, are consistent with media representations of the Himalayan region, romanticism and modernity at large. Blending tourism and pilgrimage, travel across Nepal, Tibet, Bhutan, and Northern India is often inspired and oriented by a search for authenticity, adventure and Otherness. Such valued ideals are shown, however, to be contested by the very forces and configurations that enable global mobility. The role ubiquitous media and mobile technologies now play in framing travel experiences are explored, revealing a situation in which actors are neither here nor there, but increasingly are 'inter-placed' across planetary landscapes. Beyond institutionalised religious contexts and the visiting of sacred sites, the author shows how a secular religiosity manifests in practical, bodily encounters with foreign environments. This book is unique in that it draws on a dynamic and innovative set of disciplinary and theoretical perspectives, especially phenomenology, the mobilities paradigm and philosophical anthropology.     Abstract: Drawing upon the literature of landscape geography, tourism studies, cultural studies, visual studies and philosophy, this book offers a multi-disciplinary approach to understanding the interaction between urban environments and tourists. This is a necessary prerequisite for cities as they make themselves into enticing destinations and compete for tourists' attention. It argues that tourists make sense of, and draw meaningful conclusions about, the places in which they tour based upon the interpretation of the signs or elements encountered within the built environment, elements such as graffiti and lamp posts. The writings of the American pragmatist Charles S. Peirce on interpretation provide the theoretical model for explaining the way in which mind and world, or thoughts and objects, result in tourists interacting with place. This theoretical framework elucidates three applied studies undertaken with foreign visitors to the Hungarian capital of Budapest. Based upon extensive ethnographic field work, these studies focus on tourists' interpretation of the urban landscape, with particular attention paid to the encounters with national culture, the role of architecture and the importance of the prosaic in urban tourism.

    Abstract: The hunt for beneficial owners is on. Like an elephant, the beneficial owner hides in the jungle of complex legal structures, waiting to be discovered by eager prosecutors. But what lies behind this metaphor? What is a Beneficial Owner? Is beneficial ownership a right? What does this right encompass? What is the value of this right compared to other rights? And if beneficial ownership is not a right, is it still a legally relevant relation? How do courts, namely the U.S. Supreme Court deal with the concept? When do Anglo-American judges and European scholars resort to the concept? This book approaches these questions from two perspectives: legal fundamentals and the field of U.S. federal Indian law. Both legal theories and case law are scrutinized with the aim to find a better understanding of the basic conception and characteristics of beneficial ownership. Federal Indian law has been chosen for the study of the concrete implications of the beneficial ownership concept in what Roscoe Pound referred to as “the law in action.” To some, this choice of legal field might seem somewhat unusual. What answers could federal Indian law possibly offer with regard to pressing questions from the financial industry? As always, there is a short and a long answer. The short answer is that the analysis of an equally sophisticated field of law can open new perspectives on a given field of law. What is the role of specific virtues in the development of a virtuous institution? What are management vices and what are the conditions in which they flourish? And, can we use MacIntyrean ideas to consider the management of all forms of institutions?     Abstract: This book examines the increasing role of the legal method of systematisation in European Union (EU) law. It argues that the legal method of systematisation that has been developed in a welfare-state context is increasingly used as a regulative tool to functionally integrate the market. The book uses the example of EU product regulation as a reference to illustrate the impact of systematisation on EU law. It draws conclusions from this phenomenon and redefines the current place and origin of systematisation in the EU legal system. It puts forward and demonstrates two main arguments. First, in certain sectors such as in EU product safety law, the quality of EU law changes from a sector-specific and reactive field of law to an increasingly coherent legal system at European level. Therefore, instead of punctual market intervention, it increasingly governs whole market areas. By doing so, it challenges and often fully replaces the respective welfare-based legal systems in the Member States for the benefit of the ideal of a market-driven EU legal system.     Abstract: This book is the first to present a detailed analysis of economic integration of immigrants in smaller areas of their host nations. It uses Atlantic Canada as a case in point and uses unpublished data based on several databases of Statistics Canada and Citizenship and Immigration, Canada. It identifies best policy practices that can also be used in other countries to address demographic challenges similar to those facing Canada, for example population ageing and youth out-migration from smaller regions to larger regions, through immigration. Economic integration of immigrants in Atlantic Canada is faster and better than it is nationally. An overarching result is that an analysis of regional data can lead to very different policy conclusions than the analysis of national data, which means that it can be risky to devise immigration policy based only on national data. A clear message is that economic benefits from immigration can be enhanced by facilitating a broader geographic distribution of immigrants, rather than maintaining their concentration in a few larger urban regions.     Abstract: The aim of the book is to argue for the restoration of theoretical and practical reason to economics. It presents Nancy Cartwright and Amartya Sen’s ideas as cases of this restoration and sees Aristotle as an influence on their thought. It looks at how we can use these ideas to develop a valuable understanding of practical reason for solving concrete problems in science and society. Cartwright’s capacities are real causes of events. Sen’s capabilities are the human person’s freedoms or possibilities. They relate these concepts to Aristotelian concepts. This suggests that these concepts can be combined. Sen’s capabilities are Cartwright’s capacities in the human realm; capabilities are real causes of events in economic life. Institutions allow us to deliberate on and guide our decisions about capabilities, through the use of practical reason.     Abstract: This book offers its readers an overview of recent developments in the theory of legal argumentation written by representatives from various disciplines, including argumentation theory, philosophy of law, logic and artificial intelligence. It presents an overview of contributions representative of different academic and legal cultures, and different continents and countries. The book contains contributions on strategic maneuvering, argumentum ad absurdum, argumentum ad hominem, consequentialist argumentation, weighing and balancing, the relation between legal argumentation and truth, the distinction between the context of discovery and context of justification, and the role of constitutive and regulative rules in legal argumentation.     Abstract: This book is a study of the scientific revolution as a movement of amateur science. It describes the ideology of the amateur scientific societies as the philosophy of the Enlightenment Movement and their social structure and the way they made modern science such a magnificent institution. It also shows what was missing in the scientific organization of science and why it gave way to professional science in stages. In particular the book studies the contributions of Sir Francis Bacon and of the Hon. Robert Boyle to the rise of modern science. The philosophy of induction is notoriously problematic, yet its great asset is that it expressed the view of the Enlightenment Movement about science. This explains the ambivalence that we still exhibit towards Sir Francis Bacon whose radicalism and vision of pure and applied science still a major aspect of the fabric of society. Finally, the book discusses Boyle’s philosophy, his agreement with and dissent from Bacon and the way he single-handedly trained a crowd of poorly educated English aristocrats and rendered them into an army of able amateur researchers.​

    Abstract: We all view the ubiquitous term ‘sustainability’ as a worthwhile goal. But how can we apply the principles of sustainability in the real world, at the sharp end of communities in developing nations where income insecurity is the troubled norm? This volume provides some practical answers, explaining the precepts of the ‘sustainable livelihood approach’ (SLA) through the case study of a microfinance scheme in Africa. The case study, centered around the work of the Catholic Church’s Diocesan Development Services organization, involved an SLA implemented over two years designed in part to help enhance its existing microfinance operation through closer links between local communities and international donors.     Abstract: The focus of this book is on the epistemological and hermeneutic implications of data science and artificial intelligence for democracy and the Rule of Law. How do the normative effects of automated decision systems or the interventions of robotic fellow ‘beings’ compare to the legal effect of written and unwritten law? To investigate these questions the book brings together two disciplinary perspectives rarely combined within the framework of one volume. One starts from the perspective of ‘code and law’ and the other develops from the domain of ‘law and literature’. Integrating original analyses of relevant novels or films, the authors discuss how computational technologies challenge traditional forms of legal thought and affect the regulation of human behavior. Thus, pertinent questions are raised about the theoretical assumptions underlying both scientific and legal practice.

    Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.

    Abstract: This Brief sheds light on the motivation of humanitarian intervention from a theoretical and empirical point of view. An in-depth analysis of the theoretical arguments surrounding the issue of a legitimate motivation for humanitarian intervention demonstrate to what extent either altruism or national/self-interests are considered a righteous stimulus. The question about what constitutes a just intervention has been at the core of debates in Just War Theory for centuries. In particular in regards to humanitarian intervention it is oftentimes difficult to define the criteria for a righteous intervention. More than in conventional military interventions, the motivation and intention behind humanitarian intervention is a crucial factor. Whether the humanitarian intervention cases of the post-Cold War era were driven by altruistic or by self-interested considerations is a question is covered within and enables a comprehensive and holistic evaluation of the question of what motivates Western democracies to intervene or to abstain from intervention in humanitarian crises.

    Abstract: The Children’s Court is one of society’s most important social institutions. At the same time, it is steeped in controversy. This is in large measure due to the persistence and complexity of the problems with which it deals, namely, juvenile crime and child abuse and neglect.Despite the importance of the Children’s Court as a means of holding young people accountable for their anti-social behaviour and parents for the care of their children, it has not been the subject of close study. Certainly it has not been previously studied nationally. This edited collection, is based on the findings of study that spanned the six States and two Territories of Australia. The study sought to examine the current challenges faced by the Children’s Court and to identify desirable and feasible directions for reform in each State and Territory. A further unique feature of this study is that it canvassed the views of judges and magistrates who preside over this court

    Abstract: This book brings together twelve of the most important legal philosophers in the Anglo-American and Civil Law traditions. The book is a collection of the papers these philosophers presented at the Conference on Neutrality and Theory of Law, held at the University of Girona, in May 2010. The central question that the conference and this collection seek to answer is: Can a theory of law be neutral? The book covers most of the main jurisprudential debates.
