    Kurzfassung: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Kurzfassung: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective.     Kurzfassung: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence. The authors are eminent scholars and international experts with a profound knowledge of these topics. Particular attention is paid to the areas of digital democracy, digital media and regulation of the digital world. The approach employed is based on a comparative perspective from Germany, the Netherlands, Italy, Portugal and Brazil. One particular focus is on how various legal systems are coping with increasing difficulties in the exercise of democracy with regard to disinformation and hate speech.     Kurzfassung: The present work describes and analyses the causes and the course of the revival of Gaelic traditional music in Scotland in the 20th century, in particular using the musicological and cultural theoretical models by Tamara Livingston and Owe Ronström. The work focuses on the music of the groups Runrig and Capercaillie, both of which, embedded in the sociocultural and cultural-political changes of the “Gaelic Renaissance” in the 1970s and under the influence of Anglo-American popular musical styles, began to create their own hybrid musical forms of expression.〈eng〉

    Kurzfassung: This book explores the history of reggae in modern Britain from the time it emerged as a cultural force in the 1970s. As basslines from Jamaica reverberated across the Atlantic, so they were received and transmitted by the UK's Afro-Caribbean community. From roots to lovers' rock, from deejays harnessing the dancehall crowd to dub poets reporting back from the socio-economic front line, British reggae soundtracked the inner-city experience of black youth.     Kurzfassung: Over the last two decades, fighting modern slavery and human trafficking has become a cause célèbre. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Kurzfassung: What is classical music? This book answers the question in a manner never before attempted, by presenting the history of fifteen parallel traditions, of which Western classical music is just one. Eachmusic is analysed in terms of its modes, scales, and theory; its instruments, forms, and aesthetic goals; its historical development, golden age, and condition today; and the conventions governing its performance. The writers are leading ethnomusicologists, and their approach is based on the belief that music is best understood in the context of the culture which gave rise to it . By including Mande and Uzbek-Tajik music - plus North American jazz - in addition to the better-known styles of the Middle East, the Indian sub-continent, the Far East, and South-East Asia, this book offers challenging new perspectives on the word 'classical'.
    Kurzfassung: It shows the extent to which most classical traditions are underpinned by improvisation, and reveals the cognate origins of seemingly unrelated musics; it reflects the multifarious ways in which colonialism, migration, and new technology have affected musical development, and continue to do today. With specialist language kept to a minimum, it's designed to help both students and general readers to appreciate musical traditions which may be unfamiliar to them, and to encounter the reality which lies behind that lazy adjective 'exotic'. MICHAEL CHURCH has spent much of his career in newspapers as a literary and arts editor; since 2010 he has been the music and opera critic of The Independent. From 1992 to 2005 he reported on traditional musics all over the world for the BBC World Service; in 2004, Topic Records released a CD of his Kazakh field recordings and, in 2007, two further CDs of his recordings in Georgia and Chechnya.

    Kurzfassung: Dieser Open Access Band bietet sowohl deutsch- als auch italienischsprachige Beiträge zu wesentlichen Bereichen des gewerblichen Rechtsschutzes und des Urheberrechts aus der Sicht des deutschen, italienischen und österreichischen Rechts sowie zum TRIPS-Abkommen samt einem Blick auf das vorläufig in Kraft getretene Handelsabkommen zwischen Kanada und der Europäischen Union (CETA). Ein Schwerpunkt ist Schadenersatzansprüchen aus der Verletzung von Immaterialgüterrechten gewidmet, wobei die bei grenzüberschreitenden Sachverhalten auftretenden Fragen der internationalen Gerichtszuständigkeit und des Kollisionsrechts speziell behandelt werden. Darüber hinaus werden Bezüge zum italienischen Verfassungsrecht sowie zum europäischen Wettbewerbsrecht hergestellt und auch wirtschaftsstrafrechtliche Aspekte angesprochen. Schließlich wird ein Ausblick auf die zukünftige Entwicklung des internationalen Immaterialgüterrechts in der Europäischen Union gegeben. Ausgangspunkt für das Buch bildete der vom Internationalen Forum für Wirtschaftsrecht getragene 1.     Kurzfassung: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

At the same time, scholars have analyzed Christianity and Hip Hop without focusing on the self-identified community. This book brings these various conversations together and show, through these three themes, the complexities of the intersection of Christians and Hip Hop. Hip Hop is more than rap music, it is an African diasporic phenomenon. These three themes elucidate the many characteristics of the intersection between Christians and Hip Hop and our reasoning for going beyond "Christian Hip Hop."     Kurzfassung: This book demonstrates the rich and varied ways in which heavy metal music draws on the ancient Greek and Roman world. Contributors examine bands from across the globe, including: Blind Guardian (Germany), Therion (Sweden), Celtic Frost, Eluveitie (Switzerland), Ex Deo (Canada/Italy), Heimdall, Stormlord, Ade (Italy), Kawir (Greece), Theatre of Tragedy (Norway), Iron Maiden, Bal-Sagoth (UK), and Nile (US). These and other bands are shown to draw inspiration from Classical literature and mythology such as the Homeric Hymns, Vergil's Aeneid, and Caesar's Gallic Wars, historical figures from Rome and ancient Egypt, and even pagan and occult aspects of antiquity. These bands' engagements with Classical antiquity also speak to contemporary issues of nationalism, identity, sexuality, gender, and globalization. The contributors show how the genre of heavy metal brings its own perspectives to Classical reception, and demonstrate that this music-often dismissed as lowbrow-engages in sophisticated dialogue with ancient texts, myths, and historical figures. The authors reveal aspects of Classics' continued appeal while also arguing that the engagement with myth and history is a defining characteristic of heavy metal music, especially in countries that were once part of the Roman Empire

This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU.     Kurzfassung: Music has long been an avenue for protest, seen as a way to promote freedom and equality, instill hope, and fight for change. Popular music, in particular, is considered to be an effective form of subversion and resistance under oppressive circumstances. But as Nomi Dave shows us in The Revolution's Echoes, the opposite is also true-music can often support, rather than challenge, the powers that be. Examining fifty years of history in Guinea, Dave introduces readers to the music supporting the authoritarian regime of former president Sékou Touré, and to the musicians who, even long after his death, have continued to praise dictators and avoid dissent. Dave shows that this isn't just the result of state manipulation-even in the absence of coercion, musicians and their audiences take real pleasure in musical praise of leaders. Time and again, whether in traditional music or in newer genres such as rap, Guinean musicians have celebrated state power and authority. With The Revolution's Echoes, Dave insists that we must grapple with the uncomfortable truth that some forms of music choose to support authoritarianism, generating new pleasures and new politics in the process

    Kurzfassung: In the early years of the Cold War, Western nations increasingly adopted strategies of public diplomacy involving popular music. While the diplomatic use of popular music was initially limited to such genres as jazz, the second half of the 20th century saw a growing presence of various popular genres in diplomatic contexts, including rock, punk, reggae, and hip-hop.This volume illuminates the interrelation of popular music and public diplomacy from a transnational and transdisciplinary angle. The contributions argue that, as popular music has been a crucial factor in international relations, its diplomatic use has substantially impacted the global musical landscape of the 20th and 21st centuries

Music is here approached as a practice not confined by audibility - rather, it is "seen" when the YouTube video is clicked, "felt" when the subwoofer vibrates, and "smelled" when the festival crowd dances: practices make music emerge in concrete situations constituted by people, objects, techniques, meanings, and emotions.     Kurzfassung: In the 20th and 21st century, the tradition of singer-poets gained popularity in Eastern Turkey and its neighboring countries. Many of these artists were bi- or multilingual and thus representative of the ethnically diverse region of Eastern Anatolia. The connection to oral traditions of the region is evident in the singer-poets’ songs, music and text. This anthology illustrates the variety of singer-poet traditions from an interdisciplinary perspective by discussing, among other topics, the artists’ employment as national symbol, the role of gender, and the different styles that are grown out of this kind of music

    Kurzfassung: This collection explores the idea of music in the salon during the long nineteenth century, both as a socio-cultural phenomenon, and as a source of artistic innovation and exchange. Drawing on a wide range of scholarly approaches, this book uses the idea of the salon as a springboard to examine issues such as gender, religion, biography and performance; to explore the ways in which the salon was represented in different media; and to showcase the heterogeneity of the salon through a selection of case studies. It offers fresh considerations of familiar salons in large cultural centres, as well as insights into lesser-known salons in both Europe and the United States.     Kurzfassung: Singing the Congregation examines how contemporary worship music shapes the way evangelical Christians understand worship and argues that participatory worship-music performances have brought into being new religious social constellations (“modes of congregating”). Through ethnographic investigation of five of these modes—concert, conference, church, public, and networked congregations—this book seeks to reinvigorate the analytic categories of “congregation” and “congregational music.” Drawing from theoretical models in ethnomusicology, congregational studies, and ecclesiology, Singing the Congregation reconceives the congregation as a fluid, contingent social constellation that is actively performed into being through communal practice—in this case, the musically structured participatory activity known as “worship.” By extension, “congregational music-making” is recast as a participatory religious musical practice capable of weaving together a religious community inside and outside local institutional churches. Congregational music-making is not only a means of expressing local concerns and constituting the local religious community; it is also a potent way to identify with far-flung individuals, institutions, and networks that this global religious community comprises. The unique congregations examined in each chapter include but extend far beyond local churches, revealing widespread conflicts over religious authority and far-ranging implications for how evangelicals position themselves relative to other groups in North America and beyond.

    Kurzfassung: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Kurzfassung: In der aktuellen Berichterstattung werden vor allem die Unterschiede zwischen dem christlichen Westen und dem islamischen Osten betont. Bei einem näheren Blick auf die Geschichte der beiden Kulturräume lässt sich jedoch eine ähnliche Entwicklung ausmachen: Als Renaissance wird sowohl eine Phase im Heiligen Römischen Reich unter den Habsburgern als auch im Herrschaftsgebiet der Timuriden bezeichnet.Diese vermeintliche Ähnlichkeit bildet den Ausgangspunkt für eine Untersuchung der beiden Kulturräume in der Zeit um 900/1500. Damals lenkten die Herrscher Maximilian I. und Babur die Geschicke der beiden Dynastien. Ihre Selbstzeugnisse bilden die Grundlage für eine vergleichende Analyse. Die Fragen, die im Rahmen der Arbeit behandelt werden, lauten: Welche signifikanten Ähnlichkeiten zwischen diesen Texten lassen sich ausmachen und woher rühren sie? Lassen sich Unterschiede feststellen, die Hinweise auf eine Auseinanderentwicklung der beiden Kulturräume geben?Die Analyse lässt zahlreiche Gemeinsamkeiten zutage treten. Es zeigt sich, dass der typologische Vergleich literarischer Texte dazu beitragen kann, aktuelle Entwicklungen, in denen die trennenden Elemente zwischen Westen und Osten stark betont werden, historisch präziser einzuordnen. Doch auch der herausgearbeitete Unterschied kann aufschlussreich sein: Er lässt sich als Vorzeichen auf die Auseinanderentwicklung beider Kulturräume im Bereich der Ambiguitätstoleranz deuten.
    Kurzfassung: The current media coverage emphasizes the differences between “Christian West” and “Islamic East”. However, a similarity in development can be found by having a closer look at the history of the Islamic world. For example, a period during the rule of the Timurid dynasty is also known as ‘Renaissance’. It took place at the same time as the ‘Renaissance’ under the rule of the Habsburgs in the Holy Roman Empire.This apparent similarity is used as a starting point for an analysis of the situation of the two cultural regions around 900/1500. The powerful dominions of the Habsburgs and the Timurids were ruled by the emperors Maximilian the First and Babur during that time. They both wrote self-testimonies which have been used for a comparative analysis. The thesis seeks to provide answers to the following questions: Which kind of important similarities can be found in the texts, and where do they originate? Can significant differences be identified which may reveal the starting point of the diverging development of the cultures?The results of the analysis indicate many similarities in the self-presentations. They show that a typological comparison of literary texts can lead to a more precise and historically correct interpretation than that of current trends, which rather promote differences between the cultures of West and East. Even the detected difference can be insightful: it is seen as an early sign of divergence of the two cultures in the area of intolerance of ambiguities.

    Kurzfassung: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

    Kurzfassung: With its dynamic choreographies and booming drumbeats, taiko has gained worldwide popularity since its emergence in 1950s Japan. Harnessed by Japanese Americans in the late 1960s, taiko's sonic largesse and buoyant energy challenged stereotypical images of Asians in America as either model minorities or sinister foreigners. While the majority of North American taiko players are Asian American, more than four hundred groups now exist across the United States and Canada, and these groups are comprised of people from a variety of racial and ethnic identities. Using ethnographic and historical approaches combined with performance description and analysis, this text explores the connections between taiko and Asian American cultural politics at the intersections of race, gender, and sexuality.

It follows in the footsteps of relentlessly travelling activists - both women and men - and brings to light the importance of music-making in the lived experience of politics. It shows how music encouraged, unified, divided, consoled and reminded; and it helps to understand better the affective register of the political and cultural life of those who composed, performed and consumed it. Throughout the long nineteenth century the sounds of liberty resonated across the Anglophone world: in the faint strains of 'rough music' played on the streets of Toronto and the 'middle-brow' performances within the walls of a secularist coven in Christchurch; in cacophonous election songs swirling around the hustings in Glasgow and Sunday afternoon chamber music concerts in the heart of radical Holborn; in defiant anthems blaring slightly out of tune on picket lines in Broken Hill and in hymns warbled by labour church choirs in Winnipeg. The first section examines songs; the second examines music's place in the public sphere where people - individually and collectively - made music when marching, electioneering, celebrating and commemorating, as well as striking, rioting and rebelling. The final section explores music-making within the walls of a range of associations and institutions including the difficult and often destructive part it played in European interaction with indigenous people" --Back cover

    Kurzfassung: Everyday articulations of music, place, urban politics, and inclusion/exclusion are powerfully present in Istanbul. This volume analyzes landscapes of music, community, and exclusion across a century and a half. An interdisciplinary group of scholars and artists presents four case studies: the rembetika, the music of the Asiks, the Zakir/Alevi tradition, and hip-hop, in Beyoglu, Üsküdar, the gentrifying Sulukule neighborhood, and across the metropolis. Alex Papadopoulos is Associate Professor of Geography at DePaul University, Chicago. He studies the contestation of urban space in European cities. Asli Duru is Marie Curie Fellow at The Open University, London, and studies everyday geographies of health and wellbeing.

    Kurzfassung: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively. This book is essential reading for policymakers and legislators across Europe and beyond
