    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Abstract: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

    Abstract: This book undertakes a thorough study of Reindeer in the Upper Pleniglacial and Tardiglacial societies in France. It addresses two main topics - the economy of animal resources within the societies and the exploitation of Reindeer organized within the annual cycle, in terms of space and time, between 30,000 and 14,000 cal BP in France. The author proposes an analysis and hypothesis regarding the economy of animal resources and the nomadic cycle of the last Paleolithic hunter-gatherer societies, in order to identify a "Reindeer system." The author discusses the relationship between Reindeer and human mobility and offers some conclusions regarding the annual cycles of nomadism. The volume scrutinizes the distinct eco systems in three regions and its effects on the movements of both human and animal. This book is of interest to zooarchaeologists and prehistorians.

    Abstract: In dieser rechtsvergleichenden Studie entwickelt Antje G. I. Tölle einen Vorschlag de lege ferenda für den Vertragsschluss im elektronischen Geschäftsverkehr, der auf einer Abwägung zwischen den widerstreitenden Interessen nach Sicherheit und Flexibilität beruht. Dabei ordnet er etwa das Downloadshopping als verbindliches Angebot ein und ermöglicht seine Rücknahme. Weitere Themenkomplexe sind der Zugang und Widerruf eines Angebots, sein Erlöschen durch Zeitablauf, Ablehnung oder Verlust der Geschäftsfähigkeit oder den Tod. Für die Analyse werden insgesamt sechs europäische Rechtsordnungen, namentlich Deutschland, England, Frankreich, die Schweiz, die Niederlande und Ungarn herangezogen. Darüber hinaus berücksichtigt die Studie die europäischen Modellgesetze der PECL, des DCFR und des GEK zusammen mit dem UN-Kaufrecht neben diversen historischen Regelwerken wie etwa dem Allgemeinen Preußischen Landrecht oder dem Bürgerlichen Gesetzbuch Sachsens.     Abstract: Die Forschungsarbeit analysiert vergleichend die straf- und gefahrenabwehrrechtlichen Vorschriften sowie die Polizeipraktiken hinsichtlich des Umgangs mit „Gefährdern“ in den Bereichen Terrorismus, Fußballgewalt und Rückfall von haftentlassenen Sexualstraftätern. Die Verfasserin stellt fest, dass sich gemeinsame rechtspolitische Ansätze zur Schaffung von Sicherheit in diesen Systemen finden lassen. Anhand der rechtsvergleichenden Ergebnisse zeigt die Autorin neue Entwicklungen im Strafrecht auf und diskutiert die Existenz eines sog. Sicherheitsstrafrechts. Da Terrorismus, Hooliganismus und Sexualgewalt die nationalen Rechtssysteme vor neue Herausforderungen stellen, ist die Frage, wie die Rechtssysteme Deutschlands, Frankreichs und Englands mit dieser Gefahr von schwerer Gewalt umgehen, von entscheidender Bedeutung.     Abstract: Geomedia offers critical analysis of the new possibilities and power relations emerging in the public space of contemporary cities. As ubiquitous digital networks enable embedded and mobile devices to integrate place-specific data with real-time feedback circuits, everyday experience of public space has become subject to new demands. Looking beyond debates framed by the dominance of surveillance and spectacle, McQuire asks: how might the kind of collaborative practices that have flourished in art and online cultures be translated into urban space?In the urban crisis of the 1960s, Henri Lefebvre argued that the capacity for a city's inhabitants to actively appropriate the time and space of their surroundings was a critical dimension of modern democracy. What does it mean to speak of 'the right to the city' in the context of the networked city? Addressing this question through a series of case studies, this cutting-edge text highlights the tensions between citizen and consumer, communication and surveillance, participation and control, which define contemporary struggles over public space.     Abstract: Nachhaltige Stadtentwicklung ist ein Schlüsselfaktor für eine insgesamt nachhaltige Entwicklung. In vielen Kommunen stellt sich jedoch die Frage, mit welchen Maßnahmen und in welchen Bündnissen eine erfolgreiche Strategie nachhaltiger Stadtentwicklung bestmöglich initiiert werden kann. Dies gilt vor allem dann, wenn ein gesamtstädtischer und regionaler Ansatz über Einzelprojekte hinausgehen soll und die sozioökonomischen Rahmenbedingungen in den Mittelpunkt stellt. Antworten auf solche Fragen lassen sich aus einem Austausch von Kommunen auf nationaler und auf internationaler Ebene gewinnen. Denn auch wenn sich die spezifischen Ausgangslagen voneinander unterscheiden können, so ähneln sich doch die Herausforderungen, die zu bewältigen sind. Dies gilt auch für die Lage und die Städte in den beiden führenden europäischen Wirtschaftsnationen Frankreich und Deutschland. Das Deutsch-Französische Institut und die Wüstenrot Stiftung haben deshalb ihre Initiative für eine Intensivierung der Konsultationen zwischen deutschen und französischen Kommunen zu wichtigen Themen der Urbanistik um ein neues Projekt erweitert, das speziell den grenzüberschreitenden Wissens- und Erfahrungsaustausch zu Aufgaben und Strategien einer nachhaltigen Stadtentwicklung in den Fokus nimmt. Die Ergebnisse aus diesem Projekt sind in dieser Publikation gebündelt, um sie einer breiteren Öffentlichkeit zugänglich machen zu können.

    Abstract: Über Kopftuch und Burka werden in Deutschland wie in Frankreich seit Jahren heftige Debatten geführt. Auslöser waren hierfür in Deutschland Entscheidungen des Bundesverfassungsgerichts aus den Jahren 2003 und 2015. In Frankreich erregen zwei Gesetze die Gemüter: das Kopftuchverbot für Schülerinnen 2004; ein generelles Verbot, mit einem Gesichtsschleier in der Öffentlichkeit aufzutreten, 2010. Nachdem der Europäische Gerichtshof für Menschenrechte dieses Verbot nicht beanstandet hatte, wurde auch in Deutschland ein Burka-Verbot gefordert. Die Kontroverse um Kopftuch und Burka stellt aber nur ein Symptom dahinter liegender Probleme dar: Wieviel Homogenität ist für ein friedliches Zusammenleben in einer multireligiösen Gesellschaft erforderlich? Auf wieviel Toleranz ist sie angewiesen? Aber auch, wo sind deren Grenzen? Die Antworten werden auch bestimmt durch das Verständnis des Verhältnisses von Staat und Religion, das Ausmaß an Laizität. Deren Konzepte in Frankreich und Deutschland nähern sich gerade angesichts der Verbreitung des Islam in beiden Ländern ungeachtet unterschiedlicher historischer Ausgangspunkte an.     Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.

    Abstract: This book analyzes in detail differing interpretations of the rule of law in Western legal systems and in the People's Republic of China. As the rule of law is seen by many as a prerequisite for China's future development, politicians, activists and entrepreneurs from China and from the West alike have long been calling for adherence to this principle, which is constitutive of Western democracies. All these groups use the same words, but do they truly share the same idea? In order to address this question, the book compares the "Rule of Law with Chinese characteristics," as propagated by Chinese leaders and in official Chinese publications, to different applications of the rule of law as it is understood in Western civilization.     Abstract: "Most incidents of urban unrest in recent decades - including the riots in France, Britain and other Western countries - have followed lethal interactions between the youth and the police. Usually these take place in disadvantaged neighborhoods composed of working-class families of immigrant origin or belonging to ethnic minorities. These tragic events have received a great deal of media coverage, but we know very little about the everyday activities of urban policing that lie behind them. Over the course of 15 months, at the time of the 2005 riots, Didier Fassin carried out an ethnographic study in one of the largest precincts in the Paris region, sharing the life of a police station and cruising with the patrols, in particular the dreaded anti-crime squads. Far from the imaginary worlds created by television series and action movies, he uncovers the ordinary aspects of law enforcement, characterized by inactivity and boredom, by eventless days and nights where minor infractions give rise to spectacular displays of force and where officers express doubts about the significance and value of their own jobs. Describing the invisible manifestations of violence and unrecognized forms of discrimination against minority youngsters, undocumented immigrants and Roma people, he analyses the conditions that make them possible and tolerable, including entrenched policies of segregation and stigmatization, economic marginalization and racial discrimination. Richly documented and compellingly told, this unique account of contemporary urban policing shows that, instead of enforcing the law, the police are engaged in the task of enforcing an unequal social order in the name of public security."--Publisher's description

    Abstract: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue.In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law.     Abstract: Deutschland, Frankreich, Großbritannien: Drei Länder, drei unterschiedliche Grundeinstellungen zum Jugendmedienschutz bei Gewalt darstellenden Videospielen. Nach einem Überblick zum aktuellen Stand der Medienwirkungsforschung in diesem Bereich analysiert diese Studie die nationalen Systeme und bewertet sie hinsichtlich 21 ausgewählter Gütekriterien. Nach einer Darstellung der europarechtlichen Bezüge schließt ein Ausblick auf die aktuellen Entwicklungsperspektiven dieser komplexen Materie die Betrachtung ab. Ein besonderer Fokus der Untersuchung liegt auf den Möglichkeiten einer fortschreitenden Vereinheitlichung der Systeme auf europäischer Ebene sowie auf dem Optimierungspotenzial des deutschen Jugendmedienschutzes. Berücksichtigt werden dabei sowohl das Scheitern der Reform des Jugendmedienschutz-Staatsvertrages im Dezember 2010 als auch die seit Februar 2011 geltenden, überarbeiteten Verfahrensgrundsätze der USK. Die wissenschaftliche Grundlage der Studie bilden neben der Auswertung von Literatur und Rechtsprechung die vom Verfasser geführten Experteninterviews mit 20 Akteuren des europäischen Jugendmedienschutzes für Videospiele, darunter Vertreter der Europäischen Kommission sowie Mitwirkende in den Verfahren sämtlicher Klassifikationssysteme (USK, BPjM, PEGI, BBFC). Veranschaulicht werden die Ergebnisse zudem durch zahlreiche farbig gestaltete Abbildungen und Tabellen sowie durch bebilderte Beispiele zu kontrovers diskutierten Videospielen (u.a. Dead Space, Manhunt, Left 4 Dead, Call of Duty: Modern Warfare 2).

    Abstract: Die Menschheit erlebt aktuell die größte Völkerwanderung ihrer Geschichte. Ein Drittel der Weltbevölkerung zieht über Provinzen, Länder, Kontinente hinweg vom Land in die Städte. In unserer Zeit leben zum ersten Mal mehr Menschen in der Stadt als auf dem Land. Die These, dass diese radikale, unumkehrbare Entwicklung eine positive ist sowohl für die Migranten als auch für die Städte, in denen sie ankommen , setzt Saunders Buch von gern beschworenen Untergangsszenarien ab. Ob Migration funktioniert oder nicht, hat wenig mit kulturellen Klüften oder religiösen Gegensätzen zu tun. Die Ziele der Neuankömmlinge sind egal aus welchem Land sie stammen oder in welche Stadt sie gehen die gleichen. Doch ob sie Arbeit finden, soziale Netzwerke aufbauen, ihren Kindern Schulbildung und eine Zukunft ermöglichen können, hängt stark davon ab, ob die Stadt auf sie vorbereitet ist. Drei Jahre lang hat Saunders in Berlin-Kreuzberg, im Londoner East End und den Banlieues von Paris, in den Favelas von Rio de Janeiro und den Barrios in Los Angeles mit Menschen über ihre Lebenspläne und -wirklichkeiten gesprochen. Über zwanzig solcher Viertel, Rand- und Außenbezirke, diese Orte der Ankunft Arrival Citys, porträtiert Saunders in seinem Buch. Sein Fazit: Scheitert die Arrival City, wird sie zum sozialen Brennpunkt, zur Brutstätte von Kriminalität und hybridem Extremismus, zum Elendsviertel.     Abstract: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy
