    Kurzfassung: ""This book provides an historically informed reconstruction of the social practices that have shaped the formation of the modern subject from the early modern period to the present. The formal legal protections accorded to subjects are, and always have been, latent in social practices, norms and language before they are articulated in formal legal orders. Vesting argues that, in Western societies, legal personhood is closely tied to three ideal types of social personhood - what he calls the gentleman, the manager, and Homo Digitalis. By examining these three ideal types and their emergence in society, we can see that Western formal law does not bring these ideal types into being but, on the contrary, arises from the social and cultural conditions that these ideal types generate and reflect. Correspondingly, Western legal personhood, or 'legal subjectivity', arises from the history and culture of Western nations, not the other way around. Therefore, signature features of Western formal law, particularly its valorization of the rights of persons (whether natural or non-natural), come from particular socio-historical cultural developments that had already generated the strong ideas of social personhood inherent in the ideal types of the gentleman, the manager, and Homo Digitalis. Subjectivity Transformed is a major contribution to legal and social theory and, with its original analysis of the formation of modern subjectivity, it will be of interest to students and scholars throughout the social sciences and humanities.""--

    Kurzfassung: "It is 1969 and Joni Mitchell is on television, standing empty-handed in the middle of a circular stage that is adorned with psychedelic colors. She is wearing a long, hunter-green dress, surrounded by an audience sitting cross-legged on the floor. She waits for television host Dick Cavett to introduce her next performance. The show is filming on the day after the 1969 Woodstock music festival, an event that Mitchell was initially scheduled to attend but from which she was held back by her management to ensure she could perform on The Dick Cavett Show the next day. The host introduces Mitchell and jokes with her about singing a capella, wondering aloud if someone stole her guitar. The singer laughs politely in response, denies any theft, and then proceeds to her performance, explaining to the audience that she will be singing a "song for America" that she wrote "as a Canadian living in this country." With her hands clasped behind her back, she performs "The Fiddle and the Drum" with no accompaniment, channeling the folk performance tradition on which the song is based. This song about military participation is a rare political statement from Mitchell who, unlike her peers Bob Dylan and Buffy Sainte-Marie, had only released this one "protest song" by 1969. But the song's message was not a particularly risky proclamation. Her anti-war narrative echoed the opinions of the young Cavett Show audience that night, aligning with an established trend of resistance against the war in Vietnam. Similar to the way that Mitchell's song "Woodstock" would eventually capture the spirit of an event she did not attend, "The Fiddle and the Drum" characterizes a popular anti-war sentiment in the public consciousness of the late 1960s"--

    Kurzfassung: "Focused on research within Africa and the African diaspora, contributors to this volume think through the painful iterations of trauma, systemic racism, and the vestiges of colonial oppression as well as the processes of healing and emancipation that emerge from wounded states. Their chapters explore an acoustemology of intimacy, woman-centered eroticism generated through musical performance, desire and longing in ethnographic knowledge production, and listening as intimacy. On the other end of the spectrum, authors engage with and question the fetishization of race in jazz; examine conceptions of vulgarity and profanity in movement and dance-ethnography; and address pain, trauma, and violation, whether physical, spiritual, intellectual, or political. Authors in this volume strive toward empathetic, ethical, and creative ethnographic engagements that summon vulnerability and healing. They propose pathways to aesthetic, discursive transformation by reorienting conceptions of knowledge as emergent, performative, and sonically enabled.     Kurzfassung: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. Both collaborative and competitive, musicians play with and against one another to create art and community. In Antagonistic Cooperation, Robert G. O'Meally shows how this idea runs throughout twentieth-century African American culture to provide a new history of Black creativity and aesthetics. From the collages of Romare Bearden and paintings of Jean-Michel Basquiat to the fiction of Ralph Ellison and Toni Morrison to the music of Louis Armstrong and Duke Ellington, O'Meally explores how the worlds of African American jazz, art, and literature have informed one another. He argues that these artists drew on the improvisatory nature of jazz and the techniques of collage not as a way to depict a fractured or broken sense of Blackness but rather to see the Black self as beautifully layered and complex.     Kurzfassung: This book presents both a new theoretical framework for the criminalisation of hate, referred to as “law as social justice liberalism”, and a comprehensive analysis of hate crime laws that have been enacted globally. The book begins by reflecting back on 30 years of theorisation on hate crime laws, arguing that there has been a failure to adequately capture the distinct harms of hate-based criminal conduct within legal frameworks. The book posits that liberal societies interested in advancing social equality ought to expand conventional paradigms of harm used in criminal law by comprehending hate-based conduct as a form of social injustice. Drawing on the work of Iris Young, the book sets out a comprehensive analysis of the harms of hate crime as a form of group-based oppression and uses this to set out criteria for the inclusion of protected characteristics under legislation. The second half of the book presents findings from a comparative study of hate crime laws enacted in 190 different legal jurisdictions. This includes a new taxonomy of types, models and legal tests used by legislatures to capture the myriad forms of hate-based criminal conduct that occur globally. Further evaluation of case law and empirical research on the application of these diverging legislative approaches is used to provide recommendations on how legislators ought to construct hate crime laws. The book completes its analysis of law as social justice liberalism by synthesising law, punishment and restorative justice as a means of ensuring that liberal systems of “justice” are more firmly anchored to the advancement of “social justice”. Mark Austin Walters is Professor of Criminal Law and Criminology at the University of Sussex, UK. Mark's research interests are focused primarily on hate crime studies and more broadly on criminal law theory and criminal justice reform, including restorative justice practice and theory.

    Kurzfassung: "Rock and roll's most iconic, not to mention wealthy, pioneers are overwhelmingly white, despite their great indebtedness to black musical innovators. Many of these pioneers were insensitive at best and exploitative at worst when it came to the black art that inspired them. Tear Down the Walls is about a different cadre of white rock musicians and activists, those who tried to tear down walls separating musical genres and racial identities during the late 1960s. Their attempts were often naïve, misguided, or arrogant, but they could also reflect genuine engagement with African American music and culture and sincere investment in anti-racist politics. Burke considers this question by recounting five dramatic incidents that took place between August 1968 and August 1969, including Jefferson Airplane's performance with Grace Slick in blackface on the Smothers Brothers Comedy Hour, Jean-Luc Godard's 1968 film, Sympathy for the Devil, featuring the Rolling Stones and Black Power rhetoric, and the White Panther Party at Woodstock. Each story sheds light on a significant but overlooked facet of 1960s rock-white musicians and audiences casting themselves as political revolutionaries by enacting a romanticized vision of African American identity. These radical white rock musicians believed that performing and adapting black music could contribute to what in the Black Lives Matter era is sometimes called "white allyship." This book explores their efforts and asks what lessons can be learned from them.     Kurzfassung: In 1933, John A. Lomax and his son Alan set out as emissaries for the Library of Congress to record the folksong of the "American Negro" in several southern African American prisons. Listening to the Lomax Archive: The Sonic Rhetorics of African American Folksong in the 1930s asks how the Lomaxes' field recordings--including their prison recordings and a long-form oral history of jazz musician Jelly Roll Morton--contributed to a new mythology of Americana for a nation in the midst of financial, social, and identity crises. Stone argues that folksongs communicate complex historical experiences in a seemingly simple package, and can thus be a key element--a sonic rhetoric--for interpreting the ebb and flow of cultural ideals within contemporary historical moments. He contends that the Lomaxes, aware of the power of folk music, used the folksongs they collected to increase national understanding of and agency for the subjects of their recordings even as they used the recordings to advance their own careers.     Kurzfassung: "In Crossing Bar Lines: The Politics and Practices of Black Musical Space James Gordon Williams reframes the nature and purpose of jazz improvisation to illuminate the cultural work being done by five creative musicians between 2005 and 2019. The political thought of five African American improvisers-trumpeters Terence Blanchard and Ambrose Akinmusire, drummers Billy Higgins and Terri Lyne Carrington, and pianist Andrew Hill-is documented through insightful, multilayered case studies that make explicit how these musicians articulate their positionality in broader society. Informed by Black feminist thought, these case studies unite around the theory of Black musical space that comes from the lived experiences of African Americans as they improvise through daily life. The central argument builds upon the idea of space-making and the geographic imagination in Black Geographies theory. Williams considers how these musicians interface with contemporary social movements like Black Lives Matter, build alternative institutional models that challenge gender imbalance in improvisation culture, and practice improvisation as joyful affirmation of Black value and mobility. Both Terence Blanchard and Ambrose Akinmusire innovate musical strategies to address systemic violence. Billy Higgins's performance is discussed through the framework of breath to understand his politics of inclusive space.     Kurzfassung: Explores how jazz helped propel the rise of African American Islam during the era of global Black liberationAmid the social change and liberation of the civil rights and Black Power movements, the tenor saxophonist Archie Shepp recorded a tribute to Malcolm X's emancipatory political consciousness. Shepp saw similarities between his revolutionary hero and John Coltrane, one of the most influential jazz musicians of the era. Later, the esteemed trumpeter Miles Davis echoed Shepp's sentiment, recognizing that Coltrane's music represented the very passion, rage, rebellion, and love that Malcolm X preached.Soundtrack to a Movement examines the link between the revolutionary Black Islam of the post-WWII generation and jazz music. It argues that from the late 1940s and '50s though the 1970s, Islam rose in prominence among African Americans in part because of the embrace of the religion among jazz musicians. The book demonstrates that the values that Islam and jazz shared-Black affirmation, freedom, and self-determination-were key to the growth of African American Islamic communities, and that it was jazz musicians who led the way in shaping encounters with Islam as they developed a Black Atlantic "cool" that shaped both Black religion and jazz styles. Soundtrack to a Movement demonstrates how by expressing their values through the rejection of systemic racism, the construction of Black notions of masculinity and femininity, and the development of an African American religious internationalism, both jazz musicians and Black Muslims engaged with a global Black consciousness and interconnected resistance movements in the African diaspora and Africa.

    Kurzfassung: "The Jazz Tradition and Black Vernacular Dance explores the complex intersections between jazz music and popular dance over the last hundred-plus years. It aims to show how popular entertainment and cultures of social dancing were crucial to jazz music's formation and development, but it also investigates the processes through which jazz music came to earn a reputation as a "legitimate" art form better suited for still, seated listening. Through the concept of "choreographies of listening," the book explores amateur and professional jazz dancers' relationships with jazz music and musicians as jazz's soundscapes and choreoscapes were forged through close contact and mutual creative exchange. The book's later chapters also critically unpack the aesthetic and political negotiations through which jazz music supposedly distanced itself from dancing bodies. As musicians and critics sought to secure institutional space for jazz within America's body-averse academic and high-art cultures, an intentional severance from the dancing body proved crucial to jazz's re-positioning as a form of autonomous, elite art. Fusing little-discussed material from diverse historical and contemporary sources with the author's own years of experience as a social jazz dancer, this book seeks to advance participatory dance and embodied practice as central topics of analysis in jazz studies. As it tells the rich, untold story of jazz as popular dance music, this book also exposes how American anxieties about bodies and a broad cultural privileging of the cerebral over the corporeal have shaped efforts to "elevate" expressive forms such as jazz to elite status"--

    Kurzfassung: This volume examines the concept of rhapsody through a broad lens. Beginning with a discussion of the meaning(s) of the term itself, it then traces the history and reception of the genre and its significance in European culture. It argues for a close relationship between the idea of rhapsody and the concept of Gypsiness by demonstrating that 'rhapsody' and 'Gypsiness' can be seen as manifestations of the same types of influence and preferences for certain aesthetic categories. The book pays special attention to the seminal role of Franz Liszt in its discussion of the instrumental rhapsody. Ultimately, it reveals the consequences of historiographical representations of the rhapsody (e.g. the ossification of the image of the European Gypsy musician as a bard/rhapsode, the fossilization of presumptions concerning the nature of so-called ?Gypsies?) as well as unexpected similarities and differences between the rhapsody and the ballad as romantic genres with national implications.

    Kurzfassung: In 1933, John A. Lomax and his son Alan set out as emissaries for the Library of Congress to record the folksong of the "American Negro" in several southern African-American prisons. Listening to the Lomax Archive: The Sonic Rhetorics of African American Folksong in the 1930s asks how the Lomaxes' field recordings-including their prison recordings and a long-form oral history of jazz musician Jelly Roll Morton-contributed to a new mythology of Americana for a nation in the midst of financial, social, and identity crises. Jonathan W. Stone argues that folksongs communicate complex historical experiences in a seemingly simple package, and can thus be a key element-a sonic rhetoric-for interpreting the ebb and flow of cultural ideals within contemporary historical moments. He contends that the Lomaxes, aware of the power folk music, used the folksongs they collected to increase national understanding of and agency for the subjects of their recordings (including the reconstitution of prevailing stereotypes about African American identity) even as they used the recordings to advance their own careers.     Kurzfassung: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Kurzfassung: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Kurzfassung: ""In the mid-20th century, African musicians took up Cuban music as their own. They claimed it as a marker of black Atlantic connections and of cosmopolitanism untethered from European colonial relations. Today, Cuban/African bands popular in Africa in the 1960s and '70s have moved into the world music scene in Europe and North America, and world music producers and musicians have created new West African-Latin American collaborations expressly for this market niche. This book follows two of these bands, Orchestra Baobab and AfroCubism, and the industry and audiences that surround them-from musicians' homes in West Africa, to performances in Europe and North America, to record label offices in London. This book examines the intensely transnational experiences of musicians, industry personnel, and audiences as they collaboratively produce, circulate, and consume music in a specific post-colonial era of globalization. Musicians, industry personnel, and audiences work with and push against one another as they engage in personal collaborations imbued with histories of global travel and trade. They move between and combine Cuban and Malian melodies, Norwegian and Senegalese markets, and histories of slavery and independence as they work together to create international commodities. Understanding the unstable and dynamic ways these peoples, musics, markets, and histories intersect elucidates how world music actors assert their places within, and produce knowledge about, global markets, colonial histories, and the black Atlantic.     Kurzfassung: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.
