    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: A major analysis of how China is attempting to become a media and information superpower around the world, seeking to shape the politics, local media, and information environments of both East Asia and the world. Since China's ascendancy toward major-power status began in the 1990s, many observers have focused on its economic growth and expanding military. China's ability was limited in projecting power over information and media and the infrastructure through which information flows. That has begun to change. Beijing's state-backed media, which once seemed incapable having a significant effect globally, has been overhauled and expanded. At a time when many democracies' media outlets are consolidating due to financial pressures, China's biggest state media outlets, like the newswire Xinhua, are modernizing, professionalizing, and expanding in attempt to reach an international audience.

Nicole Braida digs into the discursive and material structures and infrastructures of serious games, text-adventures, newsgames, interactive maps and data visualizations, in which refugees and migrants become the subject of humanitarian discourse. Although the goal is to arouse empathy towards migrants, these »interactive practices« distinguish who is vulnerable and who is not. It supports the idea of a »migratory crisis«, which, the author argues, is actually the symptom of a deeper crisis of the humanitarian system itself.

    Abstract: Im 21. Jahrhundert sehen die Verfassungen zahlreicher lateinamerikanischer Staaten indigene Rechte auf territoriale Autonomie vor. Während viele Studien im Forschungsfeld diese Rechte vorwiegend als Anerkennung bestehender indigener Organisationsformen interpretieren, weist Michael Fackler auf den Veränderungsdruck hin, den staatliche Autonomievorstellungen beinhalten. Zu diesem Zweck untersucht er die Umsetzung indigener Autonomierechte in Bolivien. Seine detaillierte Ethnographie fokussiert auf Spannungen und Konflikte in der Aneignung rechtlicher Normsetzungen durch die lokale indigene Bevölkerung und legt die Vielschichtigkeit der Konstruktion staatlich-sanktionierter Autonomie offen.

    Abstract: Postkoloniale Perspektiven im Kunstbetrieb und in der Kulturellen Bildung haben Hochkonjunktur, etwa in der Debatte um das Humboldt Forum Berlin. Doch handelt es sich hierbei meist um eine Rezitations- und weniger um eine Rezeptionspraxis. Dabei wären tiefergehende Debatten um und mit Theorien der Postkolonialität dringend notwendig, um etwa die Zumutungen der dominanten eurozentrischen Ausstellungs- und Vermittlungspraxen aufzudecken. Die Beiträge des Bandes evaluieren diesbezüglich die Verantwortung der Kunst aus einer explizit postkolonialen Perspektive, wobei der Fokus auf den »Double Binds« liegt, die das Feld durchziehen. Dabei werden sowohl diskriminierende Praxen im Feld entlarvt, als auch eine (auto-)kritische Theorieentwicklung vorangetrieben.

    Abstract: This book contains some of the richest written material in existence for precolonial West Africa with unique insights into daily life in an Afro-Atlantic coastal trade settlement. Presenting the complete translated and annotated text of the Inquisition trial of Crispina Peres, an African woman born in the Guinea-Bissau region, of a Portuguese father and an African mother, it documents the Portuguese Inquisition's religious persecution of Africans on African soil. Set in a slave port in 17th century West Africa, the trial focuses on the worldview of an African woman accused of engaging in African rites and witchcraft, who is imprisoned and brought before Inquisitioners in Lisbon. It highlights her resourcefulness, resilience and spirited defence of her innocence, providing precious details on her life, household, work, health and social and commercial networks in this understudied African region.

We're told that human activity is currently producing a sixth mass extinction. Indeed, there is a very real concern that the human species may itself be poised to go the way of the dinosaurs, victims of the most recent mass extinction some 65 million years ago.     Abstract: Wenn Übersetzungszwänge zwischen sozialen Sinnhorizonten den Kardinaleffekt sozialer Differenzierung bilden, kann eine entsprechende Soziologie multipler Differenzierung ihren eigenen Realitätsbezug, wie den jedes anderen Sinnzusammenhanges, nur als eine Art »indirekter Referenz« ausweisen.Joachim Renns Analyse geht einen medientheoretischen Umweg: Sie konzentriert sich zunächst auf die Bedeutung verschiedener Kommunikationsmedien für die eigenlogische Formatierung möglicher Gegenstände der Bezugnahme und erst dann auf die Referenzansprüche der Soziologie selbst. Es zeigt sich: Diese pragmatistische Rekonstruktion einer medialen »Welt-Erschließung« wird - anders als der weit verbreitete Konstruktivismus - der realistischen Intuition einer Soziologie als empirischer Wissenschaft gerecht
    Abstract: When translation constraints between horizons of social meaning create the cardinal effect of social distinction, a pertinent sociology of multiple distinction can disclose its own reference to reality, such as that of any other context, only as a kind of »indirect reference«. Joachim Renn's analysis takes a media-theory detour: Initially it focuses on the meaning of different communication media for the formation of potential objects of reference that is logical in itself, and then it focuses on the reference claims of sociology itself.     Abstract: Die Anhörung im Asylverfahren ist seit über 60 Jahren die bedeutendste Etappe für Asylbewerber*innen in Deutschland. Nur in dieser einmaligen mündlichen Anhörung können die Antragsteller*innen Gründe für ihr Asylgesuch vortragen und ihre Fluchtgeschichte rekonstruieren - doch dieser Prozess wurde bisher kaum untersucht. Anhand von Fallanalysen zeigt Samah Abdelkader auf, dass die Rekonstruktionsverfahren während der Befragung nicht planlos entstehen, sondern methodisch systematischen Techniken folgen und sich an drei Kategorien orientieren: der internen sowie der externen Kohärenzprüfung der Fluchtgeschichte und der Prüfung von außertextuellen Indikatoren.

    Abstract: In the past twenty years, international criminal law has become one of the main areas of international legal scholarship and practice. Most textbooks in the field describe the evolution of international criminal tribunals, the elements of the core international crimes, the applicable modes of liability and defences, and the role of states in prosecuting international crimes. The Oxford Handbook of International Criminal Law, however, takes a theoretically informed and refreshingly critical look at the most controversial issues in international criminal law, challenging prevailing practices, orthodoxies, and received wisdoms. Some of the contributions to the Handbook come from scholars within the field, but many come from outside of international criminal law, or indeed from outside law itself.     Abstract: Being a home to more than 80 ethnic groups, Ethiopia has to balance normative diversity with efforts to implement state law across its territory.This volume explores the co-existence of state, customary, and religious legal forums from the perspective of legal practitioners and local justice seekers. It shows how the various stakeholders' use of negotiation, and their strategic application of law can lead to unwanted confusion, but also to sustainable conflict resolution, innovative new procedures and hybrid norms. A defender of common sense, the press is irked at intellect yet often dependent on its critical autonomy. The social control of intellect by journalism is accompanied by social control of journalism in newsrooms and in classrooms where norms are cultivated. Anti-intellectualism consequently operates like dark matter in media, a presence inferred by its effects rather than directly observed or acknowledged. When journalists anticipate a punitive public, the reified resentment is no more real than the fiction of omnipotent citizens in democratic theory, yet the audience imagined compels how intellect is rendered in the news as nuisance, deviance, or object of ridicule. Interviews with 25 "dangerous professors" demonstrate how alliances in the academic-media nexus can seed intellect in newswork.

In other words, games work in the medium of agency. This book explores what games have to teach us about our own rationality and agency. We have the capacity for a peculiar sort of motivational inversion. For some of us, winning is not the point. We take on an interest in winning temporarily, so that we can play the game. Thus, we are capable of taking on temporary and disposable ends. At the center of this book is a view about games as communicative artifacts.     Abstract: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights.     Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0
