    Abstract: In diesem Buch untersucht der Autor in einer vor allem rechtsvergleichenden Studie aus dem Wettbewerbsrecht den von marktbeherrschenden Unternehmen ausgeübten Behinderungsmissbrauch bei einer vertikalen Marktstruktur.     Abstract: Das Spannungsverhältnis zwischen Einheit und Vielfalt durchzieht und charakterisiert föderale Systeme. Holger P. Hestermeyer arbeitet dieses anhand des Gegensatzpaares Eigenständigkeit und Homogenität auf. Dabei werden die föderalen Systeme Deutschlands, der USA und der EU verglichen und der Vergleich um den historischen Kontext bereichert. Vier, die Eigenständigkeit der Gliedstaaten betonende Topoi und drei, die Verfassungsräume eines föderalen Systems homogenisierende Mechanismen werden untersucht, Verfassungsrhetorik von Verfassungsrealität getrennt und gezeigt, welches Gleichgewicht zwischen zentripetalen und zentrifugalen Kräften die Systeme gefunden haben. Dabei geht der Verfasser davon aus, dass keine »optimale« Balance zwischen den beiden Polen existiert, sondern vielmehr jede Generation für sich neu entscheiden muss, welches Maß an Homogenität und welches Maß an Eigenständigkeit der Gliedstaaten ihr angemessen erscheint.
    Abstract: The tension between autonomy and homogeneity that lies at the very heart of federal systems is the topic of this study. Holger P. Hestermeyer compares the German, US and EU federal systems, including their historical contexts, and reveals the balance that has been struck in each between the two opposing tendencies.

    Abstract: Internetquellen spielen in der Praxis der deutschen Zivilgerichte eine wichtige Rolle. Gleichzeitig sind die Grundlagen und Voraussetzungen ihrer Berücksichtigung weitgehend ungeklärt. Vielfach wird das Rechtsinstitut der Offenkundigkeit gemäß § 291 ZPO herangezogen, um gerichtliche Internetrecherchen zu legitimieren. Dem widerspricht Georg Haas anhand einer umfassenden Auslegung der Vorschrift und zeigt auf, dass die Berücksichtigung von Internetquellen grundsätzlich im Rahmen des Beweisverfahrens zu erfolgen hat. Auf dieser Grundlage kann sich eine Befugnis des Gerichts zu Internetrecherchen insbesondere aus den Regeln über die Beweisaufnahme von Amts wegen ergeben. Diese Befunde werden durch eine rechtsvergleichende Untersuchung des US-amerikanischen Zivilprozessrechts erhärtet. Zudem zeigen die Erkenntnisse aus dem Bereich der Kognitionspsychologie, dass unbeschränkte richterliche (Internet-)Recherchen erhebliche Risiken bergen. Marginalized citizens in search of protection and support may look to criminal leaders, gangs and mafias rather than to politicians and state agencies. Providing residents with forms of social welfare, security and dispute resolution, these criminal organizations have taken on the functions and symbols of the state.00Criminals' positions of power are not only rooted in their social provisioning role, or in fear and force. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: Dieses Buch befasst sich mit dem Konflikt, dem Unternehmen im amerikanischen Zivilprozess ausgesetzt sind, wenn sie während der Discovery dem BDSG unterfallende personenbezogene Daten vorlegen müssen. Die Autorin verdeutlicht, dass sich der seit den 1980er Jahren bestehende transatlantische Justizkonflikt dabei in verstärkter Form zeigt, da nicht nur die unterschiedlichen Vorstellungen Deutschlands und der USA bei der Sachverhaltsaufklärung im Zivilprozess, sondern auch im Datenschutz aufeinandertreffen. Personenbezogene Daten dürfen nur dann in die USA übermittelt werden, wenn die verantwortliche Stelle ausreichende Garantien für das Persönlichkeitsrecht der Betroffenen im Sinne von § 4c Abs. 2 Satz 1 BDSG herstellt. Dies ist lediglich durch die Vereinbarung von Vertragsklauseln zwischen der verantwortlichen Stelle, ihren Anwälten und den Anwälten der Gegenseite möglich.     Abstract: "Do the United States and France, both post-industrial democracies, differ in their views and laws concerning discrimination? Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars--including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others--Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at "colorblind" policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Young men and women whose parents and grandparents came from sub-Sahara and North Africa are stuck coping with a society that fails to take into account the barriers to employment and education they face. Discrimination at Work provides an incisive comparative analysis of how the nature of discrimination in both countries has changed, now often hidden, or steeped in deep unconscious bias. While it is rare for employers in both countries to openly discriminate, deep systemic discrimination exists, rooted in structural and environmental causes and the ways each state has dealt with difference in general.     Abstract: Law and economics are interdependent. Using a historical case analysis approach, this book demonstrates how the legal process relates to and is affected by economic circumstances. Glen Atkinson and Stephen P. Paschall examine this co-evolution in the context of the economic development that occurred in the nineteenth and early twentieth centuries as well as the impact of the law on that development. Specifically, the authors explore the development of a national market, the transformation of the corporation, and the conflict between state and federal control over businesses. Their focus on dynamic, integrated systems presents an alternative to mainstream law and economics. The authors apply John R. Commons's approach to three main law and economics issues: the changing relationship between corporations and the state, the application of the Commerce Clause and the Fourteenth Amendment of the US Constitution to state and federal regulation of business, and the relationship of antitrust law to industrialization. They provide a valuable linking of law with changing economic circumstances such as antitrust policy changes and the development of the corporate form.     Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: Das Werk beschäftigt sich mit der Frage, was genau unter indigenen Landrechten zu verstehen ist, wie sie im internationalen Vergleich realisiert werden, und ob der Schutz und die Durchsetzung indigener Landrechte in den einzelnen Ländern den völkerrechtlichen Mindestanforderungen entsprechen. Es bewegt sich hierbei auf der Schnittstelle zwischen öffentlichem Recht, Rechtsvergleichung und Völkerrecht. Im Ergebnis wird gezeigt, dass der Umgang der Staaten mit Landrechten indigener Völker den völkerrechtlichen Mindestanforderungen oftmals nicht entspricht. Ferner wird dargelegt, dass die Regierungen nicht auf die unterschiedlichen historischen Vorgehensweisen, durch die indigene Gebiete kolonisiert und indigene Völker in der Vergangenheit enteignet wurden, verweisen können, um eine Ungleichbehandlung indigener Völker in den unterschiedlichen Staaten oder in verschiedenen Regionen innerhalb ein und desselben Staates zu rechtfertigen. Stattdessen sind allein der politische Wille einer Regierung, die Einstellung der Mehrheitsgesellschaft gegenüber indigenen Völkern und das Auftreten und die Organisation der indigenen Völker ausschlaggebend dafür, ob und in welchem Umfang diese ihre Rechte an ihren traditionellen Gebieten durchsetzen können.

    Abstract: This book explores California’s prison system in the context of vocational education reform. For prisons in the early twenty-first century, ideologies of evidence-based management meant that reform efforts to change the purpose of prisons from punishment to rehabilitation through vocational education required “evidence” to justify policy prescriptions. Yet who determines what constitutes evidence? In political environments, solutions are typically pre-conceived, which means that the nature of the evidence collected is also preconceived. As a result, key assumptions about outcomes are often wished away to show improvement and be accountable. Through a detailed analysis interspersed with stories from the authors’ experiences “behind the wall” among California’s prison population, the authors challenge the nature of evidence-based research as used in the prison environment.     Abstract: This volume takes a look at the status quo of whistleblowing in several jurisdictions from around the world. Covering a topic that draws the attention of a broad public and is gaining importance amongst legislators, practitioners and scholars all over the globe, the book examines the various aspects of whistleblowing. It looks at what kind of legal protection of whistleblowers is in force, who is protected, what kind of behaviour is protected, and what kind of behaviour whistleblowers are protected against. This is achieved by a combination of a general comparative report with country-specific reports that give information on whistleblowing in various jurisdictions. These countries include, amongst others, Canada, Germany, France, Italy, the Netherlands and the USA. A synopsis comprises information on whistleblowing in 23 countries in one tabula. The chapters of this book were originally prepared for the XIXth International Congress of Comparative Law (20th and 21〈st〈 sup=""〉 July 2014) of International Academy of Comparative Law in Vienna.〈/st.

Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars--including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others--Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at "colorblind" policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Young men and women whose parents and grandparents came from sub-Sahara and North Africa are stuck coping with a society that fails to take into account the barriers to employment and education they face.     Abstract: This book tackles the regulatory issues of Unmanned Aerial Systems (UAS) or Remotely-Piloted Aerial Systems (RPAS), which have profound consequences for privacy, security and other fundamental liberties. Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. It will also provide a criminological background for related legal issues, such as privacy law, aviation law, international criminal law, and comparative law.
