Abstract: "Twenty-five years after his prescient Democracy's Discontent, Michael Sandel updates his classic work for our more fractious age. He shows how, since the 1990s, Democrats and Republicans embraced a market faith that led to the toxic politics of our time. To rescue democracy, he argues, we must reimagine the economy and revitalize the civic project"--

Abstract: "One of the most far-reaching transformations in our era is the wave of digital technologies rolling over-and upending-nearly every aspect of life. Work and leisure, family and friendship, community and citizenship-all transformed by now-ubiquitous digital tools and platforms. Digital Technology and Democratic Theory explores a particularly unsettling and rapidly evolving facet of our new digital lives: transformations that affect our lives as citizens and participants in democratic governments. To understand these transformations, scholars from multiple disciplines (computer science, philosophy, political science, economics, history, and media and communications/journalism) wrestle with the question of how digital technologies shape, reshape, and affect fundamental questions about democracy and democratic theory. The contributors consider what democratic theory-broadly defined as normative theorizing about the values and institutional design of democracy-can bring to the practice of digital technologies. From the connectivity and transmission of information that has inspired positive change through movements such as the Arab Spring and #MeToo to the nefarious spread of distrust and outright disruption in democratic processes, this volume broaches the most pressing technological changes and issues facing not just individual states, but democracy as a philosophy and institution"--

Abstract: "Introduction Deepa das Acevedo This book, although it may appear to be a single book, is in fact two. On the one hand, this is a book about labor exchange in the gig economy masquerading as a book about the value of qualitative empirical data for law and policy development. On the other hand, this is also a book about the value of qualitative empirical data masquerading as a book about the buying, selling, and performance of labor via gig companies like Uber and Airbnb. Since a reader may find it difficult to tell which of these two she is reading at any given moment this introduction will sketch the contours and purpose of each book. Gig Work as a book about labor exchange in the gig economy this volume dives deeply into what is, in many ways, the hot-button work law issue of the day. The gig economy has generated immense popular interest in labor conditions - no mean feat in an era of decreasing unionization and growing corporate power - as much as it has commanded attention from policymakers and scholars. In many ways this appeal is unsurprising given the aura of innovation and entrepreneurship that surrounds the gig economy, the way it reflects broader trends toward micro- and on-demand transactions, and its incorporation of widely accessible technology."

Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation. Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

Abstract: Free speech is an essential component to the operation of a representative government committed to equal rights and the general welfare of the people. The constitutional right to engage in open expression is designed to secure personal dignity, civic engagement, and flow of information. No generation of interpreters can claim to capture its full relevance to social cohesion. The broad statement found in the Constitution has long been the subject of evolving, sometimes inconsistent, constitutional meaning. Since the early twentieth century, the Supreme Court has been at the forefront of efforts to articulate the range of words, symbols, arts, and other objects or activities that the First Amendment protects. Interpretation takes into account a variety of constitutional contexts, principles, and discursive considerations. As Justice Sotomayor pointed in her dissent to Manhattan Community Access Corporation v. Halleck, the context within which a statement is said should be considered along with the actual words allegedly in violation of a law

Abstract: "Citizenship is a like the air we breathe; it's all around us but often goes unnoticed. That is not a historically ordinary situation. Citizenship was once an exceptional status, a kind of aristocracy of the ancient world in which freedom and political voice were not taken for granted. Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies. More recently, it has been the individual marker of membership in all national communities. It is generic; almost everyone has it, hence the ubiquity that has made it sometimes unseen. Most people never change the citizenship that they are unthinkingly born into; they have no cause to consider it any more critically than their choice of parents. Insofar as citizenship during the twentieth century came to be aligned with national community on the ground and in the public imagination, there was even less reason to look at it searchingly"--

Abstract: "Rodricus Crawford was convicted and sentenced to die for the murder by suffocation of his beautiful baby boy. After years on death row, evidence confirmed what Crawford had claimed all along: he was innocent, and his son had died from an undiagnosed illness. Crawford is not alone. A full one-third of all known exonerations stem from no-crime wrongful convictions. The first book to explore this common but previously undocumented type of wrongful conviction, Smoke but No Fire tells the heartbreaking stories of innocent people convicted of crimes that simply never happened. A suicide is mislabeled a homicide. An accidental fire is mislabeled an arson. Corrupt police plant drugs on an innocent suspect. A false allegation of assault is invented to resolve a custody dispute. With this book, former New York City public defender Jessica S. Henry sheds essential light on a deeply flawed criminal justice system that allows--even encourages--these convictions to regularly occur. Smoke but No Fire promises to be eye-opening reading for legal professionals, students, and activists alike as it grapples with the chilling reality that far too many innocent people spend real years behind bars for fictional crimes"--

Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency. Despite the burgeoning recognition of the broader similarities between Roma and African Americans, including the systems that facilitate their marginalization and the barriers to their representation, no book-length work has sustained these comparisons"--

Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Abstract: "Of Love and Papers explores how immigration policies are fundamentally reshaping Latino families. Drawing on two waves of interviews with undocumented young adults, Enriquez investigates how immigration status creeps into the most personal aspects of everyday life, intersecting with gender to constrain family formation. The imprint of illegality remains, even upon obtaining DACA or permanent residency. Interweaving the perspectives of US citizen romantic partners and children, Enriquez illustrates the multigenerational punishment that limits the upward mobility of Latino families. Of Love and Papers sparks an intimate understanding of contemporary US immigration policies and their enduring consequences for immigrant families"--

Abstract: In contexts of insecurity and inequality across the world, criminal groups have developed into powerful, state-like organizations. Marginalized citizens in search of protection and support may look to criminal leaders, gangs and mafias rather than to politicians and state agencies. Providing residents with forms of social welfare, security and dispute resolution, these criminal organizations have taken on the functions and symbols of the state.00Criminals' positions of power are not only rooted in their social provisioning role, or in fear and force. 'Most Wanted' shows the role of popular culture in producing the socio-political authority of bosses, gangs and cartels. It illustrates this through discussions of Italian, Japanese and Russian mafias, and of criminal groups in Brazil, Ghana, Jamaica, and the United States. The essays collected here analyze different forms of visual, material and performative culture, including street art, film, video games, dance parties, popular music and various everyday objects. Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

Abstract: As Europe deals with a so-called 'refugee crisis', Australia's harsh border control policies have been suggested as a possible model for Europe to copy. Key measures of this system such as long-term mandatory detention, intercepting and turning boats around at sea, and the extraterritorial processing of asylum claims were actually used in the United States long before they were adopted in Australia. The book examines the process through which these policies spread between the United States and Australia and the way the courts in each jurisdiction have dealt with the measures. Daniel Ghezelbash's innovative interdisciplinary analysis shows how policies and practices that 'work' in one country might not work in another. This timely book is a must-read for those interested in preserving the institution of asylum in a volatile international and domestic political climate.

Abstract: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC). This Companion places present-day constitutional controversies in historical context, and offers insights from a range of disciplines, including history, political science, and law.

Abstract: "Interest in social science and empirical analyses of law, courts and specifically the politics of judges has never been higher or more salient. Consequently, there is a strong need for theoretical work on the research that focuses on courts, judges and the judicial process. The Routledge Handbook of Judicial Behavior provides the most up to date examination of scholarship across the entire spectrum of judicial politics and behavior, written by a combination of currently prominent scholars and the emergent next generation of researchers. Unlike almost all other volumes, this Handbook examines judicial behavior from both an American and Comparative perspective.?Part 1 provides a broad overview of the dominant Theoretical and Methodological Perspectives used to examine and understand judicial behavior,Part 2 offers an in-depth analysis of the various current scholarly areas examining the U.S. Supreme Court,Part 3 moves from the Supreme Court to examining other U.S. federal and state courts, andPart 4 presents a comprehensive overview of Comparative Judicial Politics and Transnational Courts. Each author in this volume provides perspectives on the most current methodological and substantive approaches in their respective areas, along with suggestions for future research. The chapters contained within will generate additional scholarly and public interest by focusing on topics most salient to the academic, legal and policy communities."--Provided by publisher

Einige Textabbildungen. Mit Literaturbericht und Personenregister. (2)

Abstract: How do we bring the law into line with people's psychological experience? How can psychoanalysis help us understand irrational actions and bad choices? Our legal system relies on the idea that people act reasonably and of their own free will, yet some still commit crimes with a high likelihood of being caught, sign obviously one-sided contracts, or violate their own moral codes-behavior many would call fundamentally irrational. Anne Dailey shows that a psychoanalytic perspective grounded in solid clinical work can bring the law into line with the reality of psychological experience. Approaching contemporary legal debates with fresh insights, this original and powerful critique sheds new light on issues of overriding social importance, including false confessions, sexual consent, threats of violence, and criminal responsibility. By challenging basic legal assumptions with a nuanced and humane perspective, Dailey shows how psychoanalysis can further our legal system's highest ideals of individual fairness and systemic justice

Abstract: "How did Americans in the generations following the Declaration of Independence translate its lofty ideals into practice? In this broadly synthetic work, distinguished historian Richard Brown shows that despite its founding statement that "all men are created equal," the early Republic struggled with every form of social inequality. While people paid homage to the ideal of equal rights, this ideal came up against entrenched social and political practices and beliefs. Brown illustrates how the ideal was tested in struggles over race and ethnicity, religious freedom, gender and social class, voting rights and citizenship. He shows how high principles fared in criminal trials and divorce cases when minorities, women, and people from different social classes faced judgment. This book offers a much-needed exploration of the ways revolutionary political ideas penetrated popular thinking and everyday practice"--

Abstract: "On an average day in America, seven young people aged nineteen or under will be shot dead. In Another Day in the Death of America, award-winning Guardian journalist Gary Younge tells the stories of the lives lost during the course of a single day in the United States. It could have been any day, but Younge has chosen November 23, 2013. From Jaiden Dixon (9), shot point-blank by his mother's ex-boyfriend on his doorstep in Ohio, to Pedro Dado Cortez (16), shot by an enemy gang on a street corner in California, the narrative crisscrosses the country over a period of twenty-four hours to reveal the powerful human stories behind the statistics. Far from a dry account of gun policy in the United States or a polemic about the dangers of gun violence, the book is a gripping chronicle of an ordinary but deadly day in American life, and a series of character portraits of young people taken from us far too soon and those they left behind.
Abstract: Whether it's a father's unspeakable grief over his son who was at the wrong place at the wrong time, a mentor who tries to channel his rage by organizing, or a friend and neighbor who finds strength in faith, the lives lost on that day and the lives left behind become, in Younge's hands, impossible to ignore, or to forget. What emerges in these pages is a searing portrait of youth, family, and the way that lives can be shattered in an instant on any day in America. At a time when it has become indisputable that Americans need to rethink their position on guns, this moving narrative work puts a human face...a child's face...on the "collateral damage" of gun deaths across the country. In his journalism, Younge is committed to challenging conventional wisdom and looking twice where others might look away. There are some things, he argues, that we have come to see as normal, even when they are unacceptable. And gun violence is one of them.
Abstract: A clear-eyed and iconoclastic approach to this contentious issue, this book helps answer the questions so many of us are grappling with, and makes it even harder to just look away"...

Abstract: "Article V of the Constitution allows two-thirds majorities of both houses of Congress to propose amendments to the document and a three-fourths majority of the states to ratify them. Scholars and frustrated advocates of constitutional change have often criticized this process for being too difficult. Despite this, state legislatures have yet to use the other primary method that Article V outlines for proposing amendments: it permits two-thirds of the state legislatures to petition Congress to call a convention to propose amendments that, like those proposed by Congress, must be ratified by three-fourths of the states. In this book, John R. Vile surveys more than two centuries of scholarship on Article V and concludes that the weight of the evidence (including a much-overlooked Federalist essay) indicates that states and Congress have the legal right to limit the scope of such conventions to a single subject and that political considerations would make a runaway convention unlikely. Charting a prudent course between those who fail to differentiate revolutionary change from constitutional change, those who fear ever using the Article V convention mechanism that the Framers clearly envisioned, and those who would vest total control of the convention in Congress, the states, or the convention itself, Vile's work will enhance modern debates on the subject." -- Back cover

Abstract: "When the Civil Rights Act of 1964 was passed, its primary target was the outright exclusion of women from particular jobs. Over time, the Act's scope of protection has expanded to prevent not only discrimination based on sex but also discrimination based on expression of gender identity. Kimberly Yuracko uses specific court decisions to identify the varied principles that underlie this expansion. Filling a significant gap in law literature, this timely book clarifies an issue of increasing concern to scholars interested in gender issues and the law."--Publisher's website
