In the past thirty years, the country has gone through deep political, social and economic transition, along with a name change from ‘Macedonia’ to the ‘Republic of North Macedonia’ following the Prespa Agreement signed with Greece. The contributors consider Macedonia’s challenges, its multi-ethnic make-up and its ambition to enter the European mainstream through the auspices of the European Union and NATO. The volume includes chapters on international politics and North Macedonia’s place in the region’s security architecture as well as the difficulties of the privatisation of socially owned enterprises, political corruption, state capture and backsliding.     Kurzfassung: This book deals with the economic impact of technological changes and the rise of passenger shipping on social relations on board and ashore in European shipping industries between c.1850 and 2000. The changes in motive power, communication techniques and positioning technologies and the rise of passenger shipping went together with the creation of new tasks and functions and the marginalization or disappearance of traditional jobs and skills. This book presents case-studies on changes in different maritime professions between the middle of the nineteenth century and the end of the twentieth century, covering the shipping industries of a variety of seafaring countries in Europe. The subjects include changes in maritime labour at large, changes in specific groups of deck, catering or engine room personnel, such as captains, cooks, catering personnel, engineers, or radio-operators. A number of chapters employ a prosopographical or micro-historical approach, while others apply a spatial perspective, analyze business records, materials from professional associations or distil information from large sets of quantitative data. This book will be of interest to academics and students of economic history, maritime and labour history. Karel Davids is Professor Emeritus of Economic and Social History at the Vrije Universiteit Amsterdam, the Netherlands. He has published and taught on economic and social history, maritime history, the history of technology and global history. Joost Schokkenbroek has been Executive Director of the Vancouver Maritime Museum since July 2017.     Kurzfassung: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Kurzfassung: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’.     Kurzfassung: This book examines prisons and imprisonment. Historically, prisons and prisoners have been a source of interest to the general public. However, despite near universal acceptance of imprisonment as a feature of society, the reality of prison life, and the effects it has on individuals and communities, remain a mystery to many. Using academic scholarship, empirical research, government papers, policy reports, and accounts from lived experiences of the institution, this book analyses the complexities and contradictions of prison life, the place of the prison in twenty-first century society, and its prospects for the future. It introduces readers to key debates surrounding the use of imprisonment, and encourages readers to interrogate conventional perspectives on an institution that reflects the society in which it is situated. Cormac Behan is Lecturer in Criminology at the Technology University Dublin, Ireland. Abigail Stark is Lecturer in Criminology at the University of Central Lancashire, UK. .

    Kurzfassung: This open access handbook takes a comparative and global approach to analyse the practice of slavery throughout history. In order to understand slavery - why it developed, and how it functioned in various societies – is to understand an important and widespread practice in world civilisations. With research traditionally being dominated by the Atlantic world, this collection aims to illuminate slavery that existed in not only the Americas but also ancient, medieval, North and sub-Saharan African, Near Eastern, and Asian societies. Connecting civilisations through migration, warfare, trade routes and economic expansion, the practice of slavery integrated countries and regions through power-based relationships, whilst simultaneously dividing societies by class, race, ethnicity and cultural group. Uncovering slavery as a globalizing phenomenon, the authors highlight the slave-trading routes that crisscrossed Africa, helped integrate the Mediterranean world, connected Indian Ocean societies and fused the Atlantic world. Split into five parts, the handbook portrays the evolution of slavery from antiquity to the contemporary era and encourages readers to realise similarities and differences between various manifestations of slavery throughout history. Providing a truly global coverage of slavery, and including thematic injections within each chronological part, this handbook is a comprehensive and transnational resource for all researchers interested in slavery, the history of labour, and anthropology. Damian A. Pargas is Professor of North American History and Culture at Leiden University as well as Director of the Roosevelt Institute for American Studies in The Netherlands.     Kurzfassung: This book analyzes Russian and Chinese revisionism in the face of US and Western post-Cold War liberal international order building and asks why both powers have turned revisionist in the late 2000s. The study develops a neoclassical realist model of international order building and contestation and posits to view revisionism as a strategic choice. States go revisionist if the status quo international order threatens their vital security needs (broadly defined not only as territorial security, but also political, economic, normative and ontological) and if they have the means to challenge the undesirable status quo. Russia and China were both unhappy with the post-Cold War international order of American designs, but had to opt for accommodation in the 1990s and early 2000s (“strategic accommodation” in the Chinese case, “resentful accommodation” in the Russian case), before revisionism became even more of a necessity and a real policy option from the late 2000s onward (“constructive revisionism” in the Chinese case, “destructive revisionism” in the Russian case). The author calls for a policy of neo-containment to counter Moscow’s and Beijing’s efforts to game and erode the international order.     Kurzfassung: This edited book fills a void in the existing research concerning anti-communist movements in Central and Eastern Europe, outlining the linguistic implications of the cultural, social and political metamorphoses brought about by the (change of) regime. The authors included in this volume approach the topic from a variety of perspectives, but, ultimately, focus on language seen as a fundamental tool for simultaneously subjugating and liberating, concealing and revealing truth, discouraging dissidence and fostering revolt. Readers are invited to discover the linguistic implications of the many shapes and forms that the 1989 anti-communist revolutions took. Equally interesting are the investigations of the revolution aftermath, in the first years of transition to democracy. Perceived as a whole throughout the Cold War (1947-1991), the so-called "Eastern Bloc" managed to reveal its heterogeneity, the singularity of each of its comprising states and the multitude of its internal contrasts, most vividly perhaps, in the manifold manifestations of the 1989 anti-communist fight. This book will be of interest to academics and researchers from various fields, including history, (socio)linguistics, political studies, and conflict studies.     Kurzfassung: This book provides the student, researcher or practitioner with the tools to understand many of the most commonly used advanced statistical analysis tools in criminology and criminal justice, and also to apply them to research problems. The volume is structured around two main topics, giving the user flexibility to find what they need quickly. The first is “the general linear model” which is the main analytic approach used to understand what influences outcomes in crime and justice. It presents a series of approaches from OLS multivariate regression, through logistic regression and multi-nomial regression, hierarchical regression, to count regression. The volume also examines alternative methods for estimating unbiased outcomes that are becoming more common in criminology and criminal justice, including analyses of randomized experiments and propensity score matching. It also examines the problem of statistical power, and how it can be used to better design studies. Finally, it discusses meta analysis, which is used to summarize studies; and geographic statistical analysis, which allows us to take into account the ways in which geographies may influence our statistical conclusions.

It is the first book to address the monetary history of the colonial period in a comprehensive way, covering several areas of the continent and different periods, with the ultimate aim of understanding the long-term impact of colonial monetary policies on African societies. While grounding an understanding of money in terms of its circulation, acceptance and impact, this book shows first and foremost how the monetary systems that resulted from the imposition of colonial rule on African societies were not a replacement of the old currency systems with entirely new ones, but were rather the result of the convergence of different orders of value and monetary practices. By putting histories of people using money at the heart of the story, and connecting them to larger imperial policies, the volume provides a new and fresh perspective on the history of the establishment of colonial rule in Africa. This book is the result of a collaborative and interdisciplinary research project that has received funding by the Gerda Henkel Foundation. The contributors are both junior and senior scholars, based at universities in Europe, Africa, Asia and the US, who are all specialists on the history of money in Africa. It will appeal to an international audience of scholars and educators interested in African Studies and History, Economic History, Imperial and Colonial History, Development Studies, Monetary Studies. Karin Pallaver is Associate Professor of African History in the Department of History and Cultures at the University of Bologna, Italy, where she teaches Modern African History and Indian Ocean History. Her research interests lie in the social and economic history of 19th-century and early colonial East Africa, and especially in the history of money and currency. On this topic, she has published several articles and book chapters and is collaborating with various international research groups and networks.

    Kurzfassung: Banking, Projecting, and Politicking uncovers a previously understudied and unacknowledged financial institution in late-seventeenth-century England known as Thompson and Company. Whilst the institution has been briefly mentioned in literary studies focusing on the poet and politician Andrew Marvell, it has never been the sole focus of an economic, financial, commercial, or political study in its own right. As such, nothing is known of how it operated, where it sits in the history of English finance, why it collapsed, or what it can tell us about wider Restoration society and its economic and political culture. Through a microhistorical study, the book reconstructs the institution of Thompson and Company, the social networks of its partners, the identity of its creditors, and the events and circumstances that led to its collapse. The book situates the reconstructed institution within its economic, commercial, financial, and political contexts, using the evidence accrued to question the traditional narrative of financial and commercial development, credit systems, the relationship between economics, finance, commerce and politics, and the place of risk and strategy in gendered relations, credit, and social status. The book will be of interest to academics and students in economic history, financial and business history. Mabel Winter has recently completed her PhD in socio-economic history at the University of Sheffield.

    Kurzfassung: Reflecting emerging scholarship on the entanglement of colonial histories, this book examines British and South African perspectives on, and involvement in, the genocide of the Herero and Nama in German South West Africa from 1904 to 1908. Seeking to present a transnational and trans-colonial perspective on the war imposed by Germany, the book sheds light on Anglo-German relations during ‘native' rebellions and exposes shared experiences of colonial violence. This approach aligns with a new surge of historiography which emphasises the co-operation between colonial powers to maintain order in Africa. The author focuses on British involvement in counter-insurgency efforts, its awareness of the extent of the genocide, and how the Herero-Nama War impacted colonial rule in British territory. Not only exploring the war years, the book covers the entire period of German colonial rule in Africa (1884-1919), and highlights British and South African perspectives throughout this period.     Kurzfassung: Legisprudence considers a variety of perspectives and relies on contributions from numerous different disciplines. Rather than providing examples of the various possible approaches to legisprudential studies, this book – bringing together lawyers and legal theorists from seven different countries – highlights two aspects of the many disciplines involved. Firstly, it discusses theoretical abstraction, which borders on, or enters into the realm of full-fledged philosophical speculation. Secondly, it examines empirical observation of specific cases, precisely situated regarding their spatial or historical collocation, or referring to a particular species of legislative policy. Focusing on legislation both as a process and as a result, the aim of the book is twofold: on the one hand, it demonstrates that, far from being a purely theoretical and exclusively academic intellectual enterprise, legisprudence can offer criteria for both assessing and improving the quality of real-world legislation. On the other hand, it shows how lawmaking is at least as interesting and legitimate a field of inquiry as adjudication and interpretation of laws for legal theorists and philosophers of law, and that they are already equipped with extremely valuable intellectual tools for fruitful legisprudential inquiry. The book is organized in two parts. The first part comprises legal-theoretical accounts on general aspects of legislation as a process and as a result. The second part presents contributions focusing on specific experiences of evaluations of legislative quality and contributions to the legislature’s work on the part of the public, as well as on particular legislative policies, methodologies in lawmaking, and problems regarding legislation as an instrument.

    Kurzfassung: This book offers an introduction to the language of law from the perspective of logical semantics. As a logical tool, Boguslaw Wolniewicz’s formal ontology of situations is adapted. The central issue addressed is the meaning of normative statements, primarily legal norms. The main outcome of the book consists in explications of several legal notions (including legal events, legal acts and legal rules) in terms of the formal ontology of situations. In addition, the book concludes that legal norms are sentences in a logical sense, so some are true, while others are false, and that their logical value does not depend on whether or not they were adopted in the law-making process. Lastly, the book contends that there are semantic relations between orders that are similar to entailment, contradiction, opposition, and sub-opposition, despite the fact that orders are not sentences in a logical sense, i.e., they are neither true nor false. The book also presents some original Wittgenstein-style deontic logics built on the first order logic. The formal results are applied to selected problems in the theory of law, including the problem of the possibility of algorithmic application of legal norms.

    Kurzfassung: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Kurzfassung: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool.     Kurzfassung: Blockchains and cryptocurrencies, open banking, virtual assets, and artificial intelligence have become the buzzword of this decade. This book focuses on these ‘disruptive’ financial technologies that provide alternatives to the traditional financial services typically offered by regulated financial institutions. Financial technologies are characterized by the innovative ways in which they initiate, support or extend traditional financial services or offer alternative financial pathways and products. However, these financial technologies also pose money laundering and terrorist and proliferation financing as well as cyber security risks that require mitigation.     Kurzfassung: This book investigates approaches to community heritage within the Arab region and the underlying theories associated with these approaches. It aims, within the context of the region, to define ‘community’ and ‘heritage’, as well as examine the emergence and development of this field. The volume’s contributors deploy a wealth of case studies from the Middle East and North Africa to provide a unique forum for discussion, comparability, analysis and deeper understandings of current trends in community heritage.     Kurzfassung: This open access book addresses the discourse that creates, modifies, and reshapes the law, as well as discourse participants. The book focuses on the actors operating in legal regimes and their subtly, bluntly, or even outright aggressive impact on the formation of laws. As the book examines the intersection of domestic, European, international, and even transnational, legal regimes where new law emerges as a product of this discourse, it contributes to the understanding of the mobility of law and contemporary law’s interactive nature. This book provides enlightening examples of diverse legal fields influenced by international, non-domestic actors. It covers a wide range of relevant topics, from financial sanctions to the rights of indigenous peoples, and addresses actors ranging from the European Union and the European Court of Human Rights to disability organizations. By exploring actors, the book stresses their objectives and driving forces behind their efforts to influence law. The book reveals an array of diverging methods used by international actors to influence law. Additionally, the book resonates with Nordic legal tradition and highlights Nordic commitment to rule of law and equality. The authors are members of the Finnish branch of the International Law Association (ILA) and recognized experts in their particular fields and have been afforded freedom to adopt the approach they perceive as best suited to their topic.     Kurzfassung: This book presents a scientific view of fighting climate change in the economy of the future, the foundations of which are being set around the world. The authors substantiate the potential of Industry 4.0 in stimulating sustainable development in environmental protection and preservation of natural resources. This book considers the modern experience of fighting climate change based on possibilities of Industry 4.0 at the national scale in view of developed and developing countries with a special focus on Russia and at the corporate scale by the example of transnational corporations. It determines the future contribution of Industry 4.0 into development of responsible production and consumption, and compiles the “outlines” of “green” economy in Industry 4.0. It offers recommendations for control of climate change in Industry 4.0, and presents the authors’ vision of ecological responsibility in Industry 4.0 for implementing the sustainable development goals.     Kurzfassung: This book maps various national legal responses to gender mobility, including sex and name registration, access to gender modification interventions, and anti-discrimination protection (or lack thereof) and regulations. The importance of the underlying legislation and history is underlined in order to understand the law’s functions concerning discrimination, exclusion, and violence, as well as the problematic nature of introducing biology into the regulation of human relations, and using it to justify pain and suffering. The respective chapters also highlight how various governmental authorities, as well as civil society, have been integral in fostering or impeding the welfare of trans persons, from judges and legislators, to medical commissions and law students. A collective effort of scholars scattered around the globe, this book recognizes the international trend toward self-determination in sex classification and a generous guarantee of rights for individuals expressing diverse gender identities. The book advocates the dissemination of a model for the protection of rights that not only focuses on formal equality, but also addresses the administrative obstacles that trans persons face in their daily lives.     Kurzfassung: This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.

    Kurzfassung: This book explores the border-transcending dimensions of public remembering by focussing on the triangular relationship between memory, monuments and migration. Framed by an introduction and conclusion, nine case studies located in diverse social and geo-political settings feature topical debates and contestation around monuments, statues and memorials erected by migrants or in memory of migrants, refugees and diasporas in host country societies. Written from different disciplinary perspectives including anthropology, art history, cultural studies and political science, the chapters consider displaced people as new, originally unintended audiences who bring transnational and transcultural perspectives to old monuments in host cities. In addition, migrants and diasporic communities are explored as ‘agents of memory’, who produce collective memory in tense environments of intra- and inter-group negotiation or outright hostility at the national and transnational level. The research is conceptually anchored in memory studies, notably transnational memory, multidirectional memory and other concepts emerging from memory studies’ recent ‘transcultural turn’.

    Kurzfassung: This open access book demonstrates the application of simulation modelling and network analysis techniques in the field of Roman studies. It summarizes and discusses the results of a 5-year research project carried out by the editors that aimed to apply spatial dynamical modelling to reconstruct and understand the socio-economic development of the Dutch part of the Roman frontier (limes) zone, in particular the agrarian economy and the related development of settlement patterns and transport networks in the area. The project papers are accompanied by invited chapters presenting case studies and reflections from other parts of the Roman Empire focusing on the themes of subsistence economy, demography, transport and mobility, and socio-economic networks in the Roman period. The book shows the added value of state-of-the-art computer modelling techniques and bridges computational and conventional approaches. Topics that will be of particular interest to archaeologists are the question of (forced) surplus production, the demographic and economic effects of the Roman occupation on the local population, and the structuring of transport networks and settlement patterns. For modellers, issues of sensitivity analysis and validation of modelling results are specifically addressed. This book will appeal to students and researchers working in the computational humanities and social sciences, in particular, archaeology and ancient history

    Kurzfassung: Pottery is the most ubiquitous find in most historical archaeological excavations and serves as the basis for much research in the discipline. But it is not only its frequency that makes it a prime dataset for such research, it is also that pottery embeds many dimensions of the human experience, ranging from the purely technical to the eminently symbolic. The aim of this book is to provide a cutting-edge theoretical and methodological framework, as well as a practical guide, for archaeologists, students and researchers to study ceramic assemblages. As opposed to the conventional typological approach, which focuses on vessel shape and assumed function with the main goal of establishing a chronological sequence, the proposed framework is based on the technological approach. Such an approach utilizes the concept of chaîne opératoire, which is geared to an anthropological interpretation of archaeological objects. The author offers a sound theoretical background accompanied by an original research strategy whose presentation is at the heart of this book. This research strategy is presented in successive chapters that are geared to explain not only how to study archaeological assemblages, but also why the proposed methods are essential for achieving ambitious interpretive goals. In the heated debate on the equation stating that “pots equal people”, which is a rather fuzzy reference to assumed relationships between (mostly) ethnic groups and pottery, technology enables us to propose with conviction the equation “pots equal potters”. In this way, a well-founded history of potters is able to achieve a much better cultural and anthropological understanding of ancient societies

    Kurzfassung: This book explores the EU law notion of ‘individual rights’. It examines which sorts of rules grant EU legal rights to individuals, how it is decided if a right is conferred, and which individuals may claim the judicial protection of a right. It further discusses the legal implications and consequences of holding an EU legal right with respect to the interpretation and application of EU law in general and to specific remedies such as declaratory remedies, injunctions, restitution and damages. On a more overarching level, the book explores the question of how the idea of EU law rights relates to other fundamental EU law concepts such as the principles of effectiveness and direct effect, and discusses the legal stringency of the EU courts’ ‘rights language’ in light of the overall aim of European integration. It thus contributes to the body of literature that aims to shed new light on the borders of the sui generis legal order that is EU law.

    Kurzfassung: Archaeologies of Early Modern Spanish Colonialism illustrates how archaeology contributes to the knowledge of early modern Spanish colonialism and the "first globalization" of the 16th and 17th centuries. Through a range of specific case studies, this book offers a global comparative perspective on colonial processes and colonial situations, and the ways in which they were experienced by the different peoples.The volume stresses the importance of peripheral “unsuccessful” colonial episodes. Thus, some of the papers deal with very brief colonial events, even “marginal” in some cases, considered “failures” by the Spanish crown or even undertook without their consent. These short events are usually overlooked by traditional historiography, which is why archaeological research is particularly important in these cases, since archaeological remains may be the main type of evidence that stands as proof of these colonial events. At the same time, the book critically examines the construction of categories and discourses of colonialism, and questions the ideological underpinnings of the source material required to address such a vast issue. Accordingly, the book strikes a balance between theoretical, methodological and empirical issues, integrated to a lesser or greater extent in most of the chapters. .

    Kurzfassung: This volume highlights important aspects of the complex relationship between common language and legal practice. It hosts an interdisciplinary discussion between cognitive science, philosophy of language and philosophy of law, in which an international group of authors aim to promote, enrich and refine this new debate. Philosophers of law have always shown a keen interest in cognitive science and philosophy of language in order to find tools to solve their problems: recently this interest was reciprocated and scholars from cognitive science and philosophy of language now look to the law as a testing ground for their theses. Using the most sophisticated tools available to pragmatics, sociolinguistics, cognitive sciences and legal theory, an interdisciplinary, international group of authors address questions like: Does legal interpretation differ from ordinary understanding? Is the common pragmatic apparatus appropriate to legal practice? What can pragmatics teach about the concept of law and pervasive legal phenomena such as legal indeterminacy or legal disagreements?

    Kurzfassung: This work focuses on a specific aspect of the enforcement of maritime claims, namely judicial sales of ships, a procedure creditors typically resort to in the event of an irreversible default situation. A substantial part of the book approaches the topic from a comparative perspective, the goal being to assess the similarities and differences of the judicial sale procedure between three specific jurisdictions: Belgium, the Netherlands, and England & Wales. In this study, the comparison is used to further analyse the impacts of these differences on the effectiveness and reliability of the judicial sale procedure in each jurisdiction and also forms the basis for assessing the feasibility of harmonising judicial sale procedures and fostering their acceptance. Considering the international character typical of judicial sales of ships, conflict-of-law questions are very likely to arise during these procedures. Accordingly, the comparative study, where appropriate, is viewed against a private international law background.

    Kurzfassung: This anthology provides an in-depth analysis and discusses the issues surrounding nudging and its use in legislation, regulation, and policy making more generally. The 17 essays in this anthology provide startling insights into the multifaceted debate surrounding the use of nudges in European Law and Economics. Nudging is a tool aimed at altering people’s behaviour in a predictable way without forbidding any option or significantly changing economic incentives. It can be used to help people make better decisions to influence human behaviour without forcing them because they can opt out. Its use has sparked lively debates in academia as well as in the public sphere. This book explores who decides which behaviour is desired. It looks at whether or not the state has sufficient information for debiasing, and if there are clear-cut boundaries between paternalism, manipulation and indoctrination. The first part of this anthology discusses the foundations of nudging theory and the problems associated, as well as outlining possible solutions to the problems raised. The second part is devoted to the wide scope of applications of nudges from contract law, tax law and health claim regulations, among others. This volume is a result of the flourishing annual Law and Economics Conference held at the law faculty of the University of Lucerne. The conferences have been instrumental in establishing a strong and ever-growing Law and Economics movement in Europe, providing unique insights in the challenges faced by Law and Economics when applied in European legal traditions.
