    Abstract: In contexts of insecurity and inequality across the world, criminal groups have developed into powerful, state-like organizations. Marginalized citizens in search of protection and support may look to criminal leaders, gangs and mafias rather than to politicians and state agencies. Providing residents with forms of social welfare, security and dispute resolution, these criminal organizations have taken on the functions and symbols of the state.00Criminals' positions of power are not only rooted in their social provisioning role, or in fear and force. 'Most Wanted' shows the role of popular culture in producing the socio-political authority of bosses, gangs and cartels. It illustrates this through discussions of Italian, Japanese and Russian mafias, and of criminal groups in Brazil, Ghana, Jamaica, and the United States. The essays collected here analyze different forms of visual, material and performative culture, including street art, film, video games, dance parties, popular music and various everyday objects.     Abstract: Based in part on his own naval experience, including duty in Antarctica, and informed by extensive archival and secondary research, David Stam's book examines the printed needs of several polar expeditions, including those of Adolphus Greely in the International Polar Year 1881-83 in northernmost Canada. Stam's study also includes analysis of shipboard- and expedition-based periodicals throughout the so-called Heroic Age of exploration (ca. 1880-1921); a definitive essay on the enduring books of Ernest Shackleton's legendary journey aboard the Endurance; a parallel study of the primarily religious literature distributed as Loan Libraries of the American Seamen's Friend Society; and, finally, an account of the three libraries assembled by Richard Evelyn Byrd for the successive bases at Little America (1929-41). The volume is bookended by chapters that provide an autobiographical account of how Adventures in Polar Reading came to be written and extensive suggestions pointing the way to topics of research that Stam's methodology might enable for other scholars

    Abstract: Internetquellen spielen in der Praxis der deutschen Zivilgerichte eine wichtige Rolle. Gleichzeitig sind die Grundlagen und Voraussetzungen ihrer Berücksichtigung weitgehend ungeklärt. Vielfach wird das Rechtsinstitut der Offenkundigkeit gemäß § 291 ZPO herangezogen, um gerichtliche Internetrecherchen zu legitimieren. Dem widerspricht Georg Haas anhand einer umfassenden Auslegung der Vorschrift und zeigt auf, dass die Berücksichtigung von Internetquellen grundsätzlich im Rahmen des Beweisverfahrens zu erfolgen hat. Auf dieser Grundlage kann sich eine Befugnis des Gerichts zu Internetrecherchen insbesondere aus den Regeln über die Beweisaufnahme von Amts wegen ergeben. Diese Befunde werden durch eine rechtsvergleichende Untersuchung des US-amerikanischen Zivilprozessrechts erhärtet. Zudem zeigen die Erkenntnisse aus dem Bereich der Kognitionspsychologie, dass unbeschränkte richterliche (Internet-)Recherchen erhebliche Risiken bergen.     Abstract: In diesem Buch untersucht der Autor in einer vor allem rechtsvergleichenden Studie aus dem Wettbewerbsrecht den von marktbeherrschenden Unternehmen ausgeübten Behinderungsmissbrauch bei einer vertikalen Marktstruktur. Der unmittelbare Anlass sind die unterschiedlichen Urteile von U.S. Supreme Court und Europäischem Gerichtshof (EuGH) zur Kosten-Preis-Schere (KPS), welche eine Preisstrategie von vertikal integrierten Unternehmen ist. Mithilfe einer Analyse verschiedener Fälle werden sowohl die US-amerikanischen, die europäischen und die koreanischen Regulierungsgrundlagen eines bei einer bestimmten Marktstruktur ausgeübten Behinderungsmissbrauchs miteinander verglichen. Der Autor gelangt zur Einsicht, dass der wettbewerbsrechtliche Trend zur Effizienzverbesserung auf Kosten des Wettbewerbs stattfindet.     Abstract: Das Spannungsverhältnis zwischen Einheit und Vielfalt durchzieht und charakterisiert föderale Systeme. Holger P. Hestermeyer arbeitet dieses anhand des Gegensatzpaares Eigenständigkeit und Homogenität auf. Dabei werden die föderalen Systeme Deutschlands, der USA und der EU verglichen und der Vergleich um den historischen Kontext bereichert. Vier, die Eigenständigkeit der Gliedstaaten betonende Topoi und drei, die Verfassungsräume eines föderalen Systems homogenisierende Mechanismen werden untersucht, Verfassungsrhetorik von Verfassungsrealität getrennt und gezeigt, welches Gleichgewicht zwischen zentripetalen und zentrifugalen Kräften die Systeme gefunden haben. Dabei geht der Verfasser davon aus, dass keine »optimale« Balance zwischen den beiden Polen existiert, sondern vielmehr jede Generation für sich neu entscheiden muss, welches Maß an Homogenität und welches Maß an Eigenständigkeit der Gliedstaaten ihr angemessen erscheint.
    Abstract: The tension between autonomy and homogeneity that lies at the very heart of federal systems is the topic of this study. Holger P. Hestermeyer compares the German, US and EU federal systems, including their historical contexts, and reveals the balance that has been struck in each between the two opposing tendencies.

    Abstract: This book documents the findings and recommendations of research into the question of how IT laws should develop on the understanding that today's information and communication technology is shaped by cloud computing, which lies at the foundations of contemporary and future IT as its most widespread enabler.     Abstract: Borders sit at the center of global politics. Yet they are too often understood as thin lines, as they appear on maps, rather than as political institutions in their own right. This book takes a detailed look at the evolution of border security in the United States after 9/11. Far from the walls and fences that dominate the news, it reveals borders to be thick, multi-faceted and binational institutions that have evolved greatly in recent decades.     Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Abstract: For immigrants to America, from Europeans in the early 20th century through later Latinos, Asian, and Caribbeans, gaining social and political ground has generally been considered an exercise in ethnic and racial solidarity. The experience of South Asian Americans, one of the fastest-growing immigrant - one in which distinctions within a group play a significant role. Focusing on Indian, Pakistani, and Bangladeshi American communities, Sangay K. Mishra analyzes features such as class, religion, nation of origin, language, caste, gender, and sexuality in mobilization. He shows how these internal characteristics lead to multiple paths of political inclusion, defying a unified group experience. How, for instance, has religion shaped the fractured political response to intensified discrimination against South Asians - Hindus, Muslims, and Sikhs - in the post-9/11 period?
