    Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: The Oxford Handbook of the Ends of Empire offers the most comprehensive treatment of the causes, course, and consequences of the ends of empire in the twentieth century. The volume's contributors convey the global reach of decolonization, with chapters analysing the empires of Western Europe, Eastern Europe, China and Japan. The Handbook combines broad, regional treatments of decolonization with chapter contributions constructed around particular themes or social issues. It considers how the history of decolonization is being rethought as a result of the rise of the 'new' imperial history, and its emphasis on race, gender, and culture, as well as the more recent growth of interest in histories of globalization, transnational history, and histories of migration and diaspora, humanitarianism and development,0and human rights. The Handbook, in other words, seeks to identify the processes and commonalities of experience that make decolonization a unique historical phenomenon with a lasting resonance. In light of decades of historical and social scientific scholarship on modernization, dependency, neo-colonialism, 'failed state' architectures and post-colonial conflict, the obvious question that begs itself is 'when did empires actually end?'     Abstract: Taxing the Rich draws on unparalleled evidence from twenty countries over the last two centuries to provide the broadest and most in-depth history of progressive taxation available. Scheve and Stasavage explore the intellectual and political debates surrounding the taxation of the wealthy while also providing the most detailed examination to date of when taxes have been levied against the rich and when they haven't. Fairness in debates about taxing the rich has depended on different views of what it means to treat people as equals and whether taxing the rich advances or undermines this norm. Scheve and Stasavage argue that governments don't tax the rich just because inequality is high or rising--they do it when people believe that such taxes compensate for the state unfairly privileging the wealthy. Progressive taxation saw its heyday in the twentieth century, when compensatory arguments for taxing the rich focused on unequal sacrifice in mass warfare. Today, as technology gives rise to wars of more limited mobilization, such arguments are no longer persuasive. Taxing the Rich shows how the future of tax reform will depend on whether political and economic conditions allow for new compensatory arguments to be made. (Publisher's Web site)

    Abstract: This volume explores the relation between legal reasoning and logic from both a historical and a systematic perspective. The topics addressed include, among others, conditional legal acts, disjunctions in legal acts, presumptions and conjectures, conflicts of values, Jørgensen´s Dilemma, the Rhetor´s Dilemma, the theory of legal fictions, and the categorization of contracts. The unifying problematic of these contributions concerns the conditional structures and, more particularly, the relationship between legal theory and legal reasoning in the context of conditions. The contributions in this work constitute the first results of the ANR-DFG joint research project “JuriLog” (Jurisprudence and Logic), which aims at fostering the cooperation between legal scholars and philosophers. On the one hand, lawyers and legal scholars have an interest in emphasizing the logical character of legal reasoning. In this respect, the present enquiry examines the question of how logic, especially newer forms of dialogical logic, can be made fruitful as a significant area of philosophy for jurisprudence and legal practice. On the other hand, logicians find in legal reasoning a striving towards clear definitions and inference-procedures that is relevant to their discipline. In order to fully understand such reciprocal relationships, it is necessary to bridge the gap between law, logic and philosophy in contemporary academic research. The essays collected in this volume all work towards this common goal. The book is divided in three sections. In the first part, the strong relation between Roman Law and logic is explored with respect to the analysis of disjunctive statements in legal acts. The second part focuses on Leibniz´s legal theory. The third part, finally, is dedicated to current interactions between law and logic

The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: The 20th century saw an unprecedented number of major wars, conflicts, and massive human rights violations. From each emerged the desire to make sense of the recent past (and present) by imagining new ways of dealing with such events. In order to prevent new forms of violence, or to punish the persons responsible of past horrors, various solutions have been imagined, deployed, implemented, and discussed, at different levels. This book is a reflection on the social and historical construction, appropriation, and circulation of categories, norms, and savoir-faire related to the ways social groups and institutions-state, judiciary, professional organizations-confront traumatic events. Even if there is a robust literature on purges and other mechanisms intended to deal with an authoritarian or violent past, written by authors belonging to numerous disciplines and exploring different periods and topics with a variety of theoretical and methodological backgrounds, our goal was to propose a more sociologically oriented model of analysis. Far from being only an intellectual frenzy, this orientation appears to be less normative than most “post-transitional” approaches and potentially more general than strictly monographic approaches.     Abstract: This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly

    Abstract: The study describes the process of gradual inclusion of the Jews into the ‚Heimatrecht‘ and citizenship in the Austrian monarchy since the Josephine reforms. The stony path of integration of the Jews into general citizenship which spans centuries and is marked by numerous setbacks allows to shed new light on the act of expatriation of the Austrian Jews during the Nazi regime.The stony path of integration of the Jews into general citizenship spans many centuries and is marked by numerous setbacks. It stretches from special royal protection of the Jews ('Judenregal') via Tolerance or 'Familienstelle' all the way to full citizenship. A description of this development allows to shed new light on the previously dimly lit act of expatriation of the Austrian Jews during the Nazi regime. This was a complex process running in several stages which, although similar to the rest of the German Reich, occurred at a somewhat later stage and already under the sign of flight and expulsion. However, the disenfranchisement and – literally and legally - depersonalization of the Austrian Jews was - so the argument - not just an act of targeted Nazi persecution, but the systematic reversal in rapid motion of the Jews' emancipation which had started at the end of the 18th century. What at first glance appears to have been an abstruse and cluttered convolution of Nazi regulatory activity turns out, on closer analysis, to have been a meticulous reversal of the historical process of 'Jewish emancipation'. Numerous case studies and three major biographical studies towards the end of the book show to what extent the 'Heimatrecht' and citizenship or, by contrast, the fate of statelessness determined the lives and identities of people - far beyond the time of the Austrian monarchy
    Abstract: Vor dem Hintergrund der Entrechtung und Ausbürgerung der österreichischen Juden während der NS-Zeit wird hier der umgekehrte Prozess der stufenweisen Inklusion von Juden in Heimatrecht und Staatsbürgerschaft der österreichischen Monarchie seit den josephinischen Toleranzedikten beschrieben. Dabei zeigt sich nicht nur die Bedeutung der Erlangung der vollen staatsbürgerlichen Rechte für den gesellschaftlichen, ökonomischen und kulturellen Aufstieg der Juden, sondern auch wie sehr Heimatrecht und Staatsbürgerschaft - oder umgekehrt: Staatenlosigkeit - Leben und Identität von Menschen prägten, noch weit über die Monarchie hinaus.Vor dem Hintergrund der Entrechtung und Ausbürgerung der österreichischen Juden und Jüdinnen während der NS-Zeit wird hier der umgekehrte Prozess der stufenweisen Inklusion von Juden in Heimatrecht und Staatsbürgerschaft der österreichischen Monarchie seit den josephinischen Toleranzedikten beschrieben.     Abstract: This volume presents two Leibnizian writings, the Specimen of Philosophical Questions Collected from the Law and the Dissertation on Perplexing Cases. These works, originally published in 1664 and 1666, constitute, respectively, Leibniz’s thesis for the title of Master of Philosophy and his doctoral dissertation in law. Besides providing evidence of the earliest development of Leibniz’s thought and amazing anticipations of his mature views, they present a genuine intellectual interest, for the freshness and originality of Leibniz’s reflections on a striking variety of logico-philosophical puzzles drawn from the law. The Specimen addresses puzzling issues resulting from apparent conflicts between law and philosophy (the latter broadly understood as comprising also mathematics, as well as empirical sciences). The Dissertation addresses cases whose solution is puzzling because of the convoluted logical form of legal dispositions and contractual clauses, or because of conflicting priorities between concurring parties. In each case, Leibniz dissects the problems with the greatest ingenuity, disentangling their different aspects, and proposing solutions always reasonable and sometimes surprising.     Abstract: This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, judicial decisions, official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart’s jurisprudence. Indeed, the book’s analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. The concluding chapter addresses potential objections not explicitly discussed in earlier chapters.

    Abstract: This Brief sheds light on the motivation of humanitarian intervention from a theoretical and empirical point of view. An in-depth analysis of the theoretical arguments surrounding the issue of a legitimate motivation for humanitarian intervention demonstrate to what extent either altruism or national/self-interests are considered a righteous stimulus. The question about what constitutes a just intervention has been at the core of debates in Just War Theory for centuries. In particular in regards to humanitarian intervention it is oftentimes difficult to define the criteria for a righteous intervention. More than in conventional military interventions, the motivation and intention behind humanitarian intervention is a crucial factor. Whether the humanitarian intervention cases of the post-Cold War era were driven by altruistic or by self-interested considerations is a question is covered within and enables a comprehensive and holistic evaluation of the question of what motivates Western democracies to intervene or to abstain from intervention in humanitarian crises.

    Abstract: Hegel and Global Justicedetails the relevance of the thought of G.W.F. Hegel for the burgeoning academic discussions of the topic of global justice. Against the conventional view that Hegel has little constructive to offer to these discussions, this collection, drawing on the expertise of distinguished Hegel scholars and internationally recognized political and social theorists, explicates the contribution both of Hegel himself and his 'dialectical' method to the analysis and understanding ofa wide range of topics associated with the concept of global justice, construed very broadly. These topics include universal human rights, cosmopolitanism, and cosmopolitan justice, transnationalism, international law, global interculturality, a global poverty, cosmopolitan citizenship, global governance, a global public sphere, a global ethos, and a global notion of collective self-identity. Attention is also accorded the value of Hegel's account of mutual recognition for analysing themes in global justice, both as regardsthe politics of recognition at the global level and the conditions for a general account of relations of people and persons under conditions of globalization. In exploring these and related themes, the authors of this book regularly compare Hegel to others who have contributed to the discourse on global justice, including Kant, Marx, Rawls, Habermas, Singer, Pogge, Nussbaum, Appiah, and David Miller.

    Abstract: The key question for the history of universal human rights is why it took so long for them to become established as law. The main theme of this book is that the attainment of universal human rights required heroic struggle, first by individuals and then by ever-increasing numbers of people who supported those views against the major historical trends. Universal human rights are won from a hostile majority by outsiders. The chapters in the book describe the milestones in that struggle. The history presented in this book shows that, in most places at most times, even today, for concrete material reasons a great many people oppose the notion that all individuals have equal rights. The dominant history since the 1600s has been that of a mass struggle for the national-democratic state. This book argues that this struggle for national rights has been practically and logically contradictory with the struggle for universal rights. It would only be otherwise if there were free migration and access to citizenship on demand by anybody. This has never been the case. Rather than drawing only on European sources and being limited to major literary figures, this book is written from the Gramscian perspective that ideas mean little until they are taken up as mass ideologies. It draws on sources from Asia and America and on knowledge about mass attitudes, globally and throughout history.

    Abstract: Human rights offer a vision of international justice that today's idealistic millions hold dear. Yet the very concept on which the movement is based became familiar only a few decades ago when it profoundly reshaped our hopes for an improved humanity. Here, historian Samuel Moyn elevates that transformation to center stage and asks what it reveals about the ideal's troubled present and uncertain future. It was on the ruins of earlier political utopias, Moyn argues, that human rights achieved contemporary prominence. The morality of individual rights substituted for the soiled political dreams of revolutionary communism and nationalism as international law became an alternative to popular struggle and bloody violence. The essays make obvious the need to question our parochial common sense where ideals of moral order at other times and places differ from those of modern North Atlantic governance. State-centred law, for instance, is far from a 'central case'. Legalism may be 'aspirational', connecting people to wider visions of morality; duty may be as prominent a theme as rights; and rulers from thirteenth-century England to sixteenth-century Burma appropriate, as much they impose, a vision of justice as consistency. The use of explicit categories and rules does not reduce to simple questions of power. The cases explored range from ancient Asia Minor to classical India, and from medieval England and France to Saharan oases and southern Arabia.     Abstract: Der moderne Rechtsstaat beansprucht, seine Burger unterschiedslos als freie und gleiche Personen zu behandeln. Aufgrund dieses allgemeinen Anspruchs sind von der Legitimation staatlicher Normen partikulare ethische Konzeptionen ebenso ausgeschlossen wie Willkur und Privilegium. Eine besondere Frage entsteht aber im Verhaltnis zu den grossen Religionen, die einerseits selbst mit universalen Geltungsanspruchen auftreten, andererseits als Offenbarungsreligionen durch ihre Geschichtlichkeit aber auch partikular sind. Die aus dem Anspruch der Rechtsstaatlichkeit folgende Forderung nach weltanschaulich neutraler sakularer Normgebung fuhrt auf eine fur die neuzeitliche Philosophie, besonders fur die Rechtsphilosophie, zentrale Frage: Lassen sich grundlegende, allen gemeinsame Eigenschaften der Menschen (z.B. die Vernunft) ohne Rekurs auf besondere kulturelle Erfahrungen normativ wenden? Daran schliesst sich die Frage an, wie die so gewonnenen Normen sich zu den je partikular uberlieferten verhalten. Damit ist das Verhaltnis von Politik und Religion vor dem Hintergrund moderner Rechtsstaatlichkeit angesprochen, aus dem sich eine Reihe von philosophisch-historischen sowie von rechtssystematischen Problemen ergeben. Diese Probleme werden in diesem Buch von Philosophen und Rechtswissenschaftlern eingehend erortert und diskutiert. Dabei wird, ausgehend von der je eigenen Fachperspektive, eine interdisziplinare Diskussion eroffnet. Das Leitthema der Beitrage bildet dabei das Verhaltnis von naturrechtlichen, kulturellen und positivrechtlichen Elementen in der Legitimation staatlicher Normsetzung einerseits und in der Begrundung subjektiver Rechte, insbesondere der Menschenrecht.

    Abstract: This project draws together the diverse strands of the debate regarding disability in a way never before combined in a single volume. After providing a representative sampling of competing philosophical approaches to the conceptualization of disability as such, the volume goes on to address such themes as the complex interplay between disability and quality of life, questions of social justice as it relates to disability, and the personal dimensions of the disability experience. By explicitly locating the discussion of various applied ethical questions within the broader theoretical context of how disability is best conceptualized, the volume seeks to bridge the gap between abstract philosophical musings about the nature of disease, illness and disability found in much of the philosophy of medicine literature, on the one hand, and the comparatively concrete but less philosophical discourse frequently encountered in much of the disability studies literature.     Abstract: Constitutionalism is the permanent quest to control state power, of which the judicial review of legislation is a prime example. Although the judicial review of legislation is increasingly common in modern societies, it is not a finished project. This device still raises questions as to whether judicial review is justified, and how it may be structured. Yet, judicial review's justification and its scope are seldom addressed in the same study, thereby making for an inconvenient divorce of these two related avenues of study. To narrow the divide, the object of this work is quite straightforward. Namely, is the idea of judicial review defensible, and what influences its design and scope? This book addresses these matters by comparing the judicial review of legislation in the United Kingdom (the Human Rights Act of 1998), the Netherlands (the Halsema Proposal of 2002) and the Constitution of South Africa of 1996. These systems present valuable material to study the issues raised by judicial review. The Netherlands is of particular interest as its Constitution still prohibits the constitutional review of acts of parliament, while allowing treaty review of such acts. The Halsema Proposal wants to even out this difference by allowing the courts also to apply constitutional norms to legislation and not only to international norms. The Human Rights Act and the South African Constitution also present interesting questions that will make their study worthwhile. One can think of the issue of dialogue between the legislature and the judiciary. This topic enjoys increased attention in the United Kingdom but is somewhat under explored in South African thought on judicial review. These and similar issues are studied in each of the three systems, to not only gain a better understanding of the systems as such, but also of judicial review in general.

    Abstract: Denunciations were an essential component of everyday life under Nazism and affected almost every aspect of life. During the war, denunciations became a mass phenomenon. In Austria the subject was noticed relatively late. The attention proceeds from a general definition of terms, to a specific interpretation on the basis of archive sources (Wehrmacht legal records) and then to individual case reconstructions on the basis of oral history interviews, that is to say, from a macro to a micro perspective.The closed holding relates to charges on the offence of Wehrkraftzersetzung (subversion of the armed forces), most of which were reported by former residents in the Ostmark at the central court, Vienna, in 1943-1945. Central to this are above all questions of social history and the history of mentality, such as the significance of social milieu (denunciation as “release” from class or interest differences, as a group phenomenon, etc.), and of gender (gender-differentiated behaviour, denunciation as “release” from conflicts concerning gender hierarchy), of generation, of political/ideological orientation, and of the significance of the social environment, the sphere of life and the locality. Of interest, however, are not just the historical conditions under the Nazi regime, but also the room for manoeuvre of men and women - in the military milíeu in the endphase of the war - and the communicative mechanisms that led to political denunciation
    Abstract: Denunziationen waren wesentlicher Bestandteil des Alltags während des Nationalsozialismus und betrafen nahezu alle Aspekte des Lebens. Die exzessive Denunziationspraxis ist ein Charakteristikum des NS-Alltags. Im Unterschied zu anderen autoritären Regimen mussten Gestapo und Sicherheitsdienst kaum auf bezahlte Spitzel zurückgreifen, die Mehrheit ihrer Erfolge basierte auf der freiwilligen Mitarbeit der Bevölkerung. Während des Krieges wurden Denunziationen zu einem Massenphänomen. Das Phänomen der Denunziation fand in der österreichischen Geschichtsforschung zum Nationalsozialismus erst relativ spät Beachtung. Erstens wird der Kontext der Nationalsozialistischen Militär- und Strafjustiz umrissen. Jede auch nur annähernd kritische, humoristische oder einfach realistische Äußerung zur Erfahrungen in der Wehrmacht, an der Front, zur Kriegslage oder zu NS-Größen wurde unter dem Titel „Wehrkraftzersetzung“ strengstens bestraft. Im Kriegsverlauf waren die Verfahrensregeln und die Gesetzesbestimmungen zunehmend außer Kraft gesetzt, die Verfahren beschleunigt und verkürzt worden: Die Angeklagten hatten kein Recht auf den Instanzenweg, sie hatten kein Recht auf einen Verteidiger (außer bei drohendem Todesurteil) und kein Recht auf ein Verfahren für Gnadengesuche. Zweitens werden Ergebnisse aus der quantitativen und qualitativen Auswertung eines geschlossenen Bestandes von Prozessakten des Militärgerichts der Außenstelle Wien vorgestellt. Mittels ausgewählter signifikanter und spannender Fallgeschichten zu Denunziation als sozialem Phänomen werden – detailreich ausgearbeitete – qualitative Mikro-Analysen vorgelegt: Dabei werden biographische und soziale Hintergründe, Motive, Interessen, Konflikte, sowie differente Reaktionsweisen der DenunziantInnen und der wegen »Wehrkraftzersetzung« angezeigten Soldaten sichtbar gemacht. In allen untersuchten Fällen zeigten sich denunziatorische Handlungen in unterschiedlichsten Facetten als komplexe kommunikative Verhaltensweisen: Individuelle Motive, private Konflikte vermischten sich mit politischen Inhalten. Drittens werden Sichtweisen von Akteuren (eines Denunzianten und zweier Deserteure) als Interpretationsergebnisse von lebensgeschichtlich-narrativen Interviews als ausführliche biographische und historisch kontextualisierte tiefenhermeneutische Fallrekonstruktionen vorgestellt.     Abstract: The historical development of tonnage, ship registration, classification societies and national and international law for flag State responsibility is recounted, along with the large increase in numbers of non-traditional flag States and classification societies over the past fifty years. The Law of the Sea Convention provides for a State to grant its nationality to ships, for those ships to be surveyed before registration, and for a flag State to effectively exercise its jurisdiction and control in administrative, technical and social matters over ships flying its flag. A State has the sovereign right to determine conditions for grant of its nationality and this can lead to derogation of flag State responsibility with implications for safety of ships. These issues are analysed and remedies proposed for effective flag State implementation of mandatory instruments.

    Abstract: During the last decades, legal theory has focused almost completely on norms, rules and arguments as the constitutive elements of law. Concepts were mostly neglected. The contributions to this volume try to remedy this neglect by elucidating the role concepts play in law from different perspectives. A main aim of this volume is to initiate a debate about concepts in law. Åke Frändberg gives an overview of the many different uses of concepts in law and shows amongst others that concepts in the law should not be confused with the role of concepts in descriptions of the law. Dietmar von der Pfordten criticizes the restriction to norms as parts of the law in contemporary legal theory by questioning what concepts are and what their function is, both in general and in legal conceptual schemes. Giovanni Sartor assumes the inferential analysis of meaning proposed by Alf Ross in his ground breaking paper Tû-tû and addresses the question how possession of a concept, including the rules defining it, is possible without endorsing these rules. Jaap Hage argues that 1. legal status words such as 'owner' have a meaning because they denote things or relations in institutional reality, 2. the meaning of these words consists in this denotation relation, 3. knowledge of this meaning presupposes knowledge of the rules governing these words. Torben Spaak contributes to this volume with an exemplary analysis of one of the most central concepts of the law, namely that of a legal power. Lorenz Kähler discusses the role of concepts in determining the scope of application of legal rules and raises from this perspective the question to what extent legal concept formation can be arbitrary. Ralf Poscher argues that as soon as a concept is used in stating the law, the precise scope of application of this concept has become a legal matter.

    Abstract: Substate nationalism, especially in the past fifteen years, has noticeably affected the political and territorial stability of many countries, both democratic and democratizing. Norms exist to limit the behavior of collective agents in relation to individuals, the set of universally accepted human rights provides a basic framework. There is a lacuna in international law, however, in the regulation of the behavior of groups toward other groups, with the exception of relations among states. The book offers a normative approach to moderate minority nationalism that treats minorities and majorities in multinational states justly and argues for the differentiation of group rights based on how group agents are constituted. It argues that group agency requires a shared set of beliefs concerning membership and the social ontology it offers ensures that group rights can be aligned with individual rights. It formulates a set of principles that, if adopted, would aid conflict resolution in multinational states. The book pays special attention to national self-determination in transitional societies. The book is intended for everyone in political philosophy and political science interested in global justice and international law and legal practitioners interested in normative issues and group rights

    Abstract: "The Frame of Legal Customs" ("Der Rahmen der Rechtsgewohnheiten") attempts to interchange results from two scientific disciplines, legal theory and legal history for the middle ages.The first part describes the present and in the sphere of legal theory not unypical view of law as a system of norms as introduced by theorists like Hans Kelsen ore H.L.A. Hart. Main target of criticism is the concept of law as provided by legal positivism, pointing out the problems of the logic of norms and the speech-act-theoretical background of this concept.The second part shows the inadequacy of the modern concept of law – which faces law as system of norms – for the situation of the early middle ages, when law was practiced in judicial assemblies in a strict oral manner without the common use of written texts. Results of German legal history which assume a more differentiated structure of legal thinking (based on incompatible categories of law: "recht", "Gebot", "Willkür") instead of one comprehensive notion of law, are discussed.The third part is dedicated to the close examination of the concept of law of three of the most important legal historians in Germany (Karl Kroeschell, Gerhard Dilcher, Jürgen Weitzel).The fourth and last part offers an alternative approach to the problem, how legal thinking and legal practice can be understood in premodern societies. It starts at the fundamental criticism of legal positivism, which can be found in the work of Ronald Dworkin ("law as integrity") and earlier at Carl Schmitts concept of concrete order ("Konkretes Ordnungsdenken"). The correlation between the role of legal rules, decisions and orders is discussed within the proposed theoretical frame. Finally the notion of order-configurations ("Ordnungskonfigurationen"), which has been brought into discussion by Stefan Weinfurter, is compared to the concept of law as a form of concrete order as developed in the text. A text of Adalbero of Laon and the letters of pope Gregory VII are interpreted as an illustrating example (and implicit criticism on Weinfurter's specific use of sociological functionalism) using the proposed alternative categories
    Abstract: Der "Rahmen der Rechtsgewohnheiten" ist eine Auseinandersetzung mit der gegenwärtigen Entwicklung des Rechtsbegriffs der Rechtsgeschichte des Mittelalters. Konkret wird dabei versucht, rechtstheoretische Einsichten für diesen Begriff fruchtbar zu machen und zu einem, von rechtshistorischer Seite geforderten Brückenschlag zwischen den Diziplinen beizutragen.Der I. Abschnitt (aus rechtstheoretischer Perspektive für den Rechtshistoriker verfaßt) soll insoferne zeigen, mit welchen Konsequenzen zu rechnen ist, wenn Recht als Normensystem konzipiert wird. Gegenstad ist also der Rechtsbgriff des Positivismus, wie er typisch von Hans Kelsen oder H.L.A. Hart konzipiert wurde. Der Abschnitt vereint eine historische Herleitung mit einer systematischen Kritik der normenlogischen wie sprechakttheoretischen Grundlagen.Im II. Damit soll einerseits die Unzulänglichkeit des Normsystembegriffs für das Mittelalter plausibel gemacht und andererseits eine Strukturaufklärung des mittelalterlichen Rechts vorangetrieben werden, mit dem Ergebnis, daß auch aus rechttheoretischer Sicht an die Stelle eines einheitlichen, alle Phänomene umgreifenden Rechtsbegriffs eine begriffliche Vielfalt an Rechtsbegriffen treten muß, wie sie z.B. in der Lehre Ebels mit ihrer Differenzierung in "recht", "Gebot" und "Willkür" vorgeschlagen wurde.Der III. Abschnitt ist der eingehenden Analyse der Rechtsbegriffe von drei der bedeutendsten deutschsprachigen Rechtshistoriker gewidmet (Kroeschell, Dilcher, Weitzel); Leitfaden ist der Begriff der "Rechtsgewohnheiten". Der Begriff wird einerseits als wichtiger Ansatz zur Überwindung des Normystem-Paradigmas gewürdigt, zugleich aber dahingehend kritisiert, daß seine Formulierung und theoretische Konkretisierung immer noch in wesentlichen Momenten dem unangemessenen Normsystemdenken verhaftet bleibt.Im IV. und letzten Abschnitt wird anknüpfend an die rechtsphilosophische Fundamentalkritik am Rechtspositivismus von Ronald Dworkin (prozedurale Rechtstheorie) und von Carl Schmitt (Konkretes Ordnungsdenken) der Versuch unternommen, einen alternativen den oralen bzw. semioralen Verhältnissen des Mittelalters angemesseneren Rechtsbegriff zu entwicklen oder zumindest eine Rahmentheorie zu bieten, innerhalb w ...

    Abstract: Kaum ein Zeitabschnitt war von solch grundlegenden technischen, politischen und philosophischen Umbrüchen geprägt wie die 100 Jahre bis zur Jahrtausendwende - vom Kaiserreich zur globalen Weltgesellschaft, vom Idealismus zum Werterelativismus. Die juristische Grundlagenforschung - auch die Rechtsphilosophie - ist gegenwärtig in keiner guten Verfassung: Ihr fehlt die gesellschaftliche Resonanz, und damit einhergehend der qualifizierte wissenschaftliche Nachwuchs.     Abstract: There is a veritable gold rush mentality in the life science world as scientists, entrepreneurs and multinationals are staking claims to the ‘code of life’ embodied in the world’s current stock of plants, animals, microbes and human populations. In response, the communities that see themselves as the custodians of both that traditional knowledge and specific genetic resources have demanded greater recognition of their role in creating and conserving this resource, access to any resulting improvements and a share of the benefits arising from their patrimony. This has precipitated a widespread effort-in local communities, in the marketplace, in many developing and developed countries and at the talks in the Doha Round of the WTO-to reconcile the interests and concerns of the two opposing groups. This edited volume explores the legal, economic and political context for the debate about intellectual property rights for traditional knowledge and genetic resources and critically analyses the theory and practice of access and benefits sharing efforts around the world.     Abstract: Costa and Zolo share the conviction that a proper understanding of the rule of law today requires referring to a global problematic horizon. It seems unavoidable to investigate into the relationship between Europe and the United States, on the one hand, and the rest of the world, on the other. Over the last centuries this relationship developed in terms of conquest and colonisation, on the widespread view that Western civilisation should be opposed as a whole to barbaric others. Today, however, the notion of rule of law is still rousing a debate that cannot be said to have come to an end. The reason is quite simple: if the origins of the rule of law are in Western societies and cultures, and if until recently the West took the lion s share in the debate on our subject matter, it remains true that today other societies and other cultures take an active and creative part into a sustained philosophical-political debate. This is by no means a merely intellectual or academic question: the Arab-Islamic world, India, China, are not far away planets whose orbits never crossed the European and American West. On the contrary, in fairly recent times the encounters have been close and traumatic. In sum, the book intends to offer some relevant guides for orienting the reader through a political and legal debate where the rule of law (and the doctrine of human rights ) is a concept both controversial and significant at the national and international levels.
